Abstract

Perkawinan di bawah umur di Indonesia masih menjadi permasalahan hukum yang serius, ditandai dengan lonjakan 64.211 perkara dispensasi kawin pada tahun 2020 pasca berlakunya Undang-Undang Nomor 16 Tahun 2019. Kondisi ini mengindikasikan adanya disfungsi sistemik dalam perlindungan hukum terhadap hak anak yang bersumber dari ketidakselarasan regulasi dan lemahnya implementasi. Penelitian ini bertujuan menganalisis bentuk-bentuk disfungsi perlindungan hukum terhadap hak anak akibat perkawinan di bawah umur serta merumuskan model perlindungan hukum yang integratif bagi anak korban perkawinan dini di Indonesia. Metode yang digunakan adalah penelitian hukum normatif dengan pendekatan perundang-undangan (statute approach) dan pendekatan konseptual (conceptual approach) melalui analisis bahan hukum secara kualitatif-deduktif. Hasil penelitian mengidentifikasi disfungsi tiga lapis: disfungsi normatif vertikal antara Undang-Undang Nomor 16 Tahun 2019 dengan Pasal 28B ayat (2) Undang-Undang Dasar 1945; disfungsi normatif horizontal antara Undang-Undang Perkawinan dan Undang-Undang Nomor 35 Tahun 2014 yang menciptakan legal grey zone bagi anak usia 18–19 tahun; serta disfungsi implementatif berupa inkonsistensi penerapan Peraturan Mahkamah Agung Nomor 5 Tahun 2019 dan lemahnya koordinasi antarlembaga. Penelitian ini merumuskan Model Triple-P (Pencegahan–Penegakan–Pemulihan) sebagai kerangka perlindungan integratif yang menempatkan pilar pemulihan berbasis restorative justice sebagai komponen mandiri untuk mengisi kekosongan mekanisme pemulihan hak anak pascaperkawinan dalam sistem hukum Indonesia.

Abstract

This study examines the legal certainty of including the status of "unregistered marriage" in the Family Card from a normative juridical perspective with a statutory, conceptual, and casuistic approach, revealing fundamental inconsistencies between the substantive formalism of Law Number 1 of 1974 concerning Marriage which requires registration as an absolute requirement for the legal force of marriage (Article 2 paragraph 2) with the administrative descriptive approach of Law Number 24 of 2013 concerning Population Administration which accommodates the social reality of unregistered marriage through a Statement of Absolute Responsibility based on the Regulation of the Minister of Home Affairs Number 109 of 2019. The results of the analysis show that this normative dualism gives rise to the ambiguity of the hierarchy of norms as stipulated in Article 7 of Law Number 12 of 2011 concerning the Establishment of Legislation, moral hazard in marriage registration practices, and permissive Dukcapil field practices with tens of thousands of families with this status every year. The legal implications for the protection of wives' civil rights include the vulnerability of the right to maintenance (Article 34 of the Marriage Law), joint property, and limited inheritance (KHI Article 171), while for children it creates weak legal filiation resulting in the status of "one mother's child", hampered education rights, and the risk of statelessness which is contrary to the Convention on the Elimination of All Forms of Discrimination Against Women, the Convention on the Rights of the Child 1989, and Articles 27-28 of the 1945 Constitution. Critical discussions through grammatical, systematic, teleological, and comparative interpretations confirm that the status of "unregistered marriage" violates the principle of rechtszekerheid, creates structural gender injustice, and institutionalizes administrative exploitation. As a novelty, the research proposes the concept of "integrated administrative itsbat" through a national digital platform that integrates the Population and Civil Registration Office-Religious Affairs Office-Religious Court with artificial intelligence-based validation of Absolute Responsibility Statements and a mandatory 90-day timeline, revolutionizing the protection of marginalized families through inclusive technology

Abstract

The e-sports industry in Indonesia is fostering professional relationships between athletes and team management through work agreements. However, the lack of specific legal frameworks has led to concerning contractual clauses, notably the freeze contract clause, which allows team management to indefinitely suspend an athlete's contract while preventing them from pursuing professional opportunities. This study examines the implications of such clauses on athletes' rights and welfare, utilizing normative legal research with legislative and conceptual methodologies. The findings indicate that while the freeze contract is rooted in the freedom of contract principle, it often lacks good faith and balance, resulting in potential bargaining inequalities, loss of wages, and career sustainability issues for athletes. Consequently, there is a pressing need for more precise regulations and contractual guidelines from e-sports institutions to enhance legal protection and equitable welfare for athletes.

Abstract

This study examines the validity and legal implications of electronic signatures in notarial agreements within the Indonesian jurisdiction. Although the Electronic Information and Transactions Law recognizes electronic signatures as valid legal evidence, their direct application to authentic deeds still faces severe normative constraints under the Notary Public Act. Specifically, the Act firmly mandates the physical presence of all parties, the verbal reading of the deed, and the physical signing before an authorized notary. Utilizing normative legal research and statutory approaches, this analysis demonstrates that employing electronic signatures without careful regulatory harmonization degrades the evidentiary power of authentic deeds, effectively reducing them to mere underhand deeds. This systemic conflict generates profound legal uncertainty while significantly increasing the professional liability risks for notaries nationwide. Therefore, comprehensive statutory synchronization alongside the establishment of definitive implementing regulations remains absolutely essential to support a secure, legally sound, and highly prudent digital transformation of notarization practices.

Abstract

The distribution of illicit cosmetic products in North Gorontalo traditional markets poses highly substantial health risks, highlighting a critical gap between statutory consumer protection norms and empirical practices. This study evaluates the efficacy of legal safeguards in ensuring consumer security. Employing an empirical juridical methodology with statutory and conceptual frameworks, this research utilizes field interviews with the Gorontalo BBPOM enforcement team, market traders, and consumers, alongside comprehensive literature reviews. Findings indicate that legal protection operates through preventive mechanisms, including public socialization and routine surveillance, alongside repressive measures like product confiscation and strict law enforcement. However, systemic effectiveness remains fundamentally constrained by consumers' inadequate legal awareness and the complex dynamics of online distribution networks. Ultimately, this current study concludes that fortifying public legal literacy and substantially augmenting institutional supervisory capacities constitute indispensable strategic imperatives for actualizing optimal, sustainable consumer protection against hazardous, unregulated commodities within the contemporary Indonesian domestic retail marketplace.

Abstract

This study examines the legal challenges of remote working in Indonesia, aiming to inform comprehensive, justice-based employment policies. Employing a normative juridical method with statutory, conceptual, and case-based approaches, including analysis of Indonesian court decisions, the research reveals that remote work faces structural injustice due to regulatory gaps. The Ma power Law (Law No. 13/2003) and Job Creation Law (Law No. 11/2020 jo. Law No. 6/2023) lack specific remote work provisions, while foundational Civil Code (Burgerlijk Wetboek/BW) principles governing employment contracts remain underutilized. This regulatory vacuum generates legal uncertainty that disproportionately affects vulnerable workers. Persistent gaps concern working hours, overtime, occupational health and safety, data protection, monitoring, employment agreements, social security, and cross-border taxation, leaving weak and unilateral corporate policies as the de facto framework. Comparative analysis of Russia, Spain, Turkey, and the Netherlands confirms that comprehensive legislation is both feasible and necessary. Grounded in justice theory, this study argues that regulating of remote work goes beyond administrative technicalities and forms part of the protection of fundamental constitutional rights. Consequently, Indonesia must enact dedicated legislation establishing minimum standards to ensure equitable protection, dignity, equality, and legal certainty for all workers in the digital era..

Abstract

Divorce cases, particularly cerai talak (husband-initiated divorce), have increased significantly at the Gorontalo Religious Court over the past three years, raising serious concerns regarding the fulfillment of the economic rights of women and children following marital dissolution. This article analyzes the judicial efforts undertaken to protect and fulfill the economic rights of women and children in cerai talak cases at the Gorontalo Religious Court. The purpose of this article is to examine both preventive and repressive measures employed by judges in ensuring that rights such as mutah, iddah maintenance, child support, and division of marital assets are adequately addressed within court rulings. A normative-juridical method was employed through a case approach and statute approach. The findings prove that while judges have made considerable efforts through active fact-finding, mediation, and ex officio authority, the effectiveness of these rulings remains substantially hindered by low legal literacy among women, weak post-judgment execution mechanisms, and limited access to legal aid. It is therefore recommended that institutional strengthening, inter-agency synergy, and the consistent optimization of judges' ex officio authority are essential to ensuring that legal protection for women and children extends beyond formal court decisions into substantive justice

Abstract

A grant is the gift of an item to someone where the giver is still alive. Materially, the existence of a grant has something to do with inheritance. In contrast to a will, a grant is a lifetime expenditure of assets based on affection for the benefit of a person or for the benefit of a social, religious, scientific body, also to someone who has the right to be his heir. The purpose of this study is to find out the law on the withdrawal of donated assets according to the Civil Code, to find out the legal consequences of withdrawing donated assets according to the Civil Code, and to find out the settlement of the withdrawal of donated assets according to the Civil Code. The research conducted is legal research which is descriptive analysis in nature and uses normative juridical research. Through descriptive research, researchers try to describe events and events that are the center of attention without giving special treatment to these events. This study uses secondary data by processing data from primary legal materials, secondary legal materials and tertiary legal materials. Based on the results of the research it is understood that the withdrawal of gift items according to the Civil Code is regulated in article 1688 which reads that a grant cannot be revoked and therefore cannot be revoked, except in 3 cases, namely if the grantee's conditions are not met, if the person who was given the gift is guilty of committing or participating in an attempt to kill or some other crime against the donor himself, and if the grantor falls into poverty while the one who was given the gift refuses to provide for him. If the recipient of the grant refuses to provide a living or allowance to the grantor, after that the grantor falls into poverty. With the withdrawal or elimination of this gift, all kinds of items that have been donated must be returned to the grantor in a clean condition of the burdens attached to the item. The legal consequence of the decision to cancel a grant that has permanent legal force is that the object of the dispute, namely land, will return to the grantor and their rights. If the object of the dispute has been certified on behalf of the recipient of the grant, then with this decision the certificate becomes null and void.

Abstract

Penelitian ini menganalisis implikasi hukum pembatalan akta kelahiran terhadap anak yang lahir di luar perkawinan dengan studi kasus Putusan Pengadilan Agama Gorontalo Nomor 449/Pdt.G/2022/PA.Gtlo. Menggunakan metode penelitian hukum normatif dengan pendekatan perundang-undangan, konseptual, dan kasus, penelitian ini mengkaji hubungan antara pencatatan kelahiran, status keperdataan anak, serta rezim perlindungan anak dalam hukum Indonesia. Hasil penelitian menunjukkan bahwa pembatalan akta kelahiran menyebabkan anak kembali ditempatkan hanya dalam hubungan perdata dengan ibu dan keluarga ibunya sebagaimana Pasal 43 ayat (1) Undang-Undang Perkawinan, sehingga berimplikasi pada pengakuan identitas, hak waris, serta akses terhadap perlindungan hukum dan layanan sosial. Meskipun pembatalan tersebut dalam kasus ini dilandasi oleh kepentingan administratif dan perlindungan anak, kebijakan tersebut tetap berpotensi menimbulkan kerentanan hukum baru apabila tidak disertai dengan mekanisme perlindungan yang memadai. Oleh karena itu, setiap tindakan pembatalan akta kelahiran harus ditempatkan dalam kerangka prinsip the best interests of the child dan perlindungan hak anak sebagai subjek hukum.

Abstract

This study analyzes the barriers to fulfilling the right to obtain employment for persons with disabilities in Gorontalo City, focusing on the discrepancy between legal norms and policy implementation as well as structural barriers in socio-cultural and accessibility aspects. Employing a juridical-empirical method with a socio-legal research approach, this study combines normative analysis of legislation with empirical studies through in-depth interviews and documentation studies. The research findings reveal two main problems. First, there is a sharp discrepancy between the mandate of Law Number 8 of 2016 and Gorontalo City Regional Regulation Number 3 of 2023, which mandate a 2% employment quota for persons with disabilities, and the reality that no persons with disabilities work within the Gorontalo City Government environment out of a total of 613 registered persons with disabilities. This implementation failure is caused by weak law enforcement, the non-integration of disability issues in regional planning and budgeting, and the absence of an integrated database. Second, structural barriers in the form of stigma and perspective discrimination, lack of understanding of reasonable accommodation, inaccessible infrastructure, and low levels of education and job training create a systematic vicious cycle of exclusion. This study recommends comprehensive policy interventions encompassing public perspective transformation, accessible infrastructure development, and sustainable capacity-building programs.
