Abstract

AbstractThe people's need of legal certainty is the responsibility of all parties to make it happen. Various cases raised in society require the law enforcement agencies to follow up and protect the witnesses and victims. Gorontalo city is inseparable with some legal cases taken place in urban communities that require contributions from law enforcement agencies, including universities. This study focuses on the implementation of law on the protection of witnesses and victims for the law existence to people in Gorontalo city that employed normative juridical method in which it is a law study aimed at finding out the norms and œdas Sollen. The result reveals that the implementation of law on the protection of witnesses and victims to people in Gorontalo city has not been effectively applied as resulted from the empirical factual review. Further, there are five important aspects that determine the existence of witness and victim protection agency, including 1) laws, 2) the witnesses™ and victims™ mental attitude, 3) professional law enforcement officers, 4) community control, 5) electronic media. Keywords: Protection, Witnesses, Victims

Abstract

This research aims to find out what the settlement efforts are if a debtor defaults in a credit agreement with fiduciary collateral at BRI KCP UNIT Paguyaman and what causes bad credit in terms of creditor behavior in credit agreements with fiduciary collateral at BRI KCP UNIT Paguyaman bank. This research uses empirical legal research methods and data collection techniques in this research are taken from the results of observations and interviews. The results of this research show that the creditor's out-of-court or non-litigation settlement efforts will invite the debtor to discuss the problem in order to find the best way for both the creditor and the debtor. Settlements that can be carried out include negotiation or mediation, with mutual openness from the parties, peaceful efforts will be found in resolving the credit agreement so that a civil lawsuit will not be filed in the District Court first through the normal procedural legal process until a decision is issued by the court. Factors – Factors that cause default in paying debts are health factors, economy problem, misuse of goals, and lack of good faith.

Abstract

Undang-undang RI Nomor 6 tahun 2014 tentang desa telah membawa dampak pada otonomi desa dalam pembangunan masyarakat. Kondisi tersebut dipandang sebagai peluang dan tantangan dalam pemanfaatan potensi wilayah. Desa Iluta merupakan salah satu desa mitra binaan LPPM Universitas Negeri Gorontalo yang ditetapkan berdasarkan Surat Keputusan Rektor Nomor. 45/PM/LPM/2012 tentang penetapan Desa Binaan Lembaga Penelitian dan Pengabdian Masyarakat. Desa Iluta merupakan desa pesisir danau Limboto yang selama ini selalu berhadapan dengan masalah pertumbuhan eceng gondok. Implementasi PPDM tahun pertama telah difokuskan pada : 1) pemanfaatan eceng gondok sebagai ragam produk kerajinan tangan, 2) penguatan sumber daya manusia dalam penanggulangan gulma eceng gondok, 3) penguatan fungsi dan unsur manajemen serta penerapannya dalam usaha kelompok. Berdasarkan realisasi program tahun pertama maka untuk tahun kedua program yang akan diimplementasikan adalah : 1) lanjutan pemanfaatan eceng gondok sebagai ragam produk unggulan, 2) penguatan fungsi dan unsur manajemen keuangan serta penerapannnya dalam kegiatan usaha kelompok, 3) standarisasi ragam produk unggulan kerajinan tangan berbahan dasar eceng gondok. Pada tahun kedua ini target yang dicapai adalah 1) berkurangnya jumlah eceng gondok di pesisir danau limboto, 2) meningkatkan kapasitas pengelolaan keuangan, 3) adanya standarisasi ragam produk unggulan eceng gondok.

Abstract

This research aims to analyze the forms of legal protection for consumers in the case of illegal cosmetic circulation in the Traditional Market of Moluo Village, Kwandang District, North Gorontalo Regency, and to examine the roles of the Health Department and the Gorontalo Food and Drug Supervisory Agency (BBPOM) in supervising and guiding business actors. The research method used is empirical legal research with a non-doctrinal qualitative approach, thru interviews with sellers, consumers, and supervisory authorities, as well as field observations and document studies. The research results show that the majority of vendors in the market already understand the importance of a distribution permit from BPOM and choose to sell legal products, although in practice illegal cosmetics are still found due to high consumer demand for instant results. The main obstacle lies in consumers who are often aware of the dangers of illegal cosmetics but still purchase them. BPOM Gorontalo implements legal protection thru two channels: preventive measures such as socialization, education, and routine inspections, and repressive measures such as legal action in accordance with Article 435 of Law Number 17 of 2023 concerning Health. The implications of this research confirm the need for more comprehensive legal protection strategies with cross-agency collaboration, increased public legal literacy, and consumer empowerment to make them more critical in product selection.

Abstract

Penelitian ini membahas problematika hukum penguasaan kawasan konservasi di Indonesia dengan fokus pada pemanfaatan Cagar Alam Tangale untuk kegiatan ekonomi masyarakat, khususnya perkebunan. Melalui pendekatan yuridis normatif dengan analisis terhadap peraturan perundang-undangan yang relevan, penelitian ini menemukan bahwa kegiatan penguasaan dan pembukaan lahan di kawasan konservasi tanpa izin merupakan pelanggaran hukum sebagaimana diatur dalam Undang-Undang Nomor 5 Tahun 1990 tentang Konservasi Sumber Daya Alam Hayati dan Ekosistemnya serta Undang-Undang Nomor 41 Tahun 1999 tentang Kehutanan. Secara yuridis, tindakan tersebut mengandung implikasi pidana, perdata, dan administratif yang mengharuskan pelaku untuk memulihkan fungsi ekologis kawasan. Namun, penelitian ini juga menyoroti faktor ekonomi dan sosial masyarakat sebagai penyebab utama perambahan, yang menuntut pendekatan hukum berbasis keadilan sosial dan keberlanjutan. Diperlukan kebijakan kolaboratif melalui kemitraan konservasi antara pemerintah dan masyarakat untuk menyeimbangkan perlindungan lingkungan dengan kesejahteraan sosial. Penegakan hukum yang humanis dan edukatif diharapkan mampu menciptakan tata kelola kawasan konservasi yang efektif, berkeadilan, dan berkelanjutan

Abstract

The e-sports industry in Indonesia is fostering professional relationships between athletes and team management through work agreements. However, the lack of specific legal frameworks has led to concerning contractual clauses, notably the freeze contract clause, which allows team management to indefinitely suspend an athlete's contract while preventing them from pursuing professional opportunities. This study examines the implications of such clauses on athletes' rights and welfare, utilizing normative legal research with legislative and conceptual methodologies. The findings indicate that while the freeze contract is rooted in the freedom of contract principle, it often lacks good faith and balance, resulting in potential bargaining inequalities, loss of wages, and career sustainability issues for athletes. Consequently, there is a pressing need for more precise regulations and contractual guidelines from e-sports institutions to enhance legal protection and equitable welfare for athletes.

Abstract

This study examines the validity and legal implications of electronic signatures in notarial agreements within the Indonesian jurisdiction. Although the Electronic Information and Transactions Law recognizes electronic signatures as valid legal evidence, their direct application to authentic deeds still faces severe normative constraints under the Notary Public Act. Specifically, the Act firmly mandates the physical presence of all parties, the verbal reading of the deed, and the physical signing before an authorized notary. Utilizing normative legal research and statutory approaches, this analysis demonstrates that employing electronic signatures without careful regulatory harmonization degrades the evidentiary power of authentic deeds, effectively reducing them to mere underhand deeds. This systemic conflict generates profound legal uncertainty while significantly increasing the professional liability risks for notaries nationwide. Therefore, comprehensive statutory synchronization alongside the establishment of definitive implementing regulations remains absolutely essential to support a secure, legally sound, and highly prudent digital transformation of notarization practices.

Abstract

The distribution of illicit cosmetic products in North Gorontalo traditional markets poses highly substantial health risks, highlighting a critical gap between statutory consumer protection norms and empirical practices. This study evaluates the efficacy of legal safeguards in ensuring consumer security. Employing an empirical juridical methodology with statutory and conceptual frameworks, this research utilizes field interviews with the Gorontalo BBPOM enforcement team, market traders, and consumers, alongside comprehensive literature reviews. Findings indicate that legal protection operates through preventive mechanisms, including public socialization and routine surveillance, alongside repressive measures like product confiscation and strict law enforcement. However, systemic effectiveness remains fundamentally constrained by consumers' inadequate legal awareness and the complex dynamics of online distribution networks. Ultimately, this current study concludes that fortifying public legal literacy and substantially augmenting institutional supervisory capacities constitute indispensable strategic imperatives for actualizing optimal, sustainable consumer protection against hazardous, unregulated commodities within the contemporary Indonesian domestic retail marketplace.

Abstract

A grant is the gift of an item to someone where the giver is still alive. Materially, the existence of a grant has something to do with inheritance. In contrast to a will, a grant is a lifetime expenditure of assets based on affection for the benefit of a person or for the benefit of a social, religious, scientific body, also to someone who has the right to be his heir. The purpose of this study is to find out the law on the withdrawal of donated assets according to the Civil Code, to find out the legal consequences of withdrawing donated assets according to the Civil Code, and to find out the settlement of the withdrawal of donated assets according to the Civil Code. The research conducted is legal research which is descriptive analysis in nature and uses normative juridical research. Through descriptive research, researchers try to describe events and events that are the center of attention without giving special treatment to these events. This study uses secondary data by processing data from primary legal materials, secondary legal materials and tertiary legal materials. Based on the results of the research it is understood that the withdrawal of gift items according to the Civil Code is regulated in article 1688 which reads that a grant cannot be revoked and therefore cannot be revoked, except in 3 cases, namely if the grantee's conditions are not met, if the person who was given the gift is guilty of committing or participating in an attempt to kill or some other crime against the donor himself, and if the grantor falls into poverty while the one who was given the gift refuses to provide for him. If the recipient of the grant refuses to provide a living or allowance to the grantor, after that the grantor falls into poverty. With the withdrawal or elimination of this gift, all kinds of items that have been donated must be returned to the grantor in a clean condition of the burdens attached to the item. The legal consequence of the decision to cancel a grant that has permanent legal force is that the object of the dispute, namely land, will return to the grantor and their rights. If the object of the dispute has been certified on behalf of the recipient of the grant, then with this decision the certificate becomes null and void.

Abstract

Penelitian ini menganalisis implikasi hukum pembatalan akta kelahiran terhadap anak yang lahir di luar perkawinan dengan studi kasus Putusan Pengadilan Agama Gorontalo Nomor 449/Pdt.G/2022/PA.Gtlo. Menggunakan metode penelitian hukum normatif dengan pendekatan perundang-undangan, konseptual, dan kasus, penelitian ini mengkaji hubungan antara pencatatan kelahiran, status keperdataan anak, serta rezim perlindungan anak dalam hukum Indonesia. Hasil penelitian menunjukkan bahwa pembatalan akta kelahiran menyebabkan anak kembali ditempatkan hanya dalam hubungan perdata dengan ibu dan keluarga ibunya sebagaimana Pasal 43 ayat (1) Undang-Undang Perkawinan, sehingga berimplikasi pada pengakuan identitas, hak waris, serta akses terhadap perlindungan hukum dan layanan sosial. Meskipun pembatalan tersebut dalam kasus ini dilandasi oleh kepentingan administratif dan perlindungan anak, kebijakan tersebut tetap berpotensi menimbulkan kerentanan hukum baru apabila tidak disertai dengan mekanisme perlindungan yang memadai. Oleh karena itu, setiap tindakan pembatalan akta kelahiran harus ditempatkan dalam kerangka prinsip the best interests of the child dan perlindungan hak anak sebagai subjek hukum.
