Abstract

Policy regulations are needed in the administration of government. As the rule of law country, Indonesia has a consequence of acting based on law. But the summary of the regulation of the formation of policy regulations raises various multi-interpretations in its implementation. This raises problems, including the substance of the material that exists in the policy regulations is contrary to the laws and regulations. This study aims to find the concept of convergence of the formation of policy regulations in local laws. This is doctrinal legal research examining various laws and regulations. The research shows that there is a discourse on the convergence of the formation of policy regulations as part of regional legal provisions in an effort to protect preventive law hence officials of local government in the formation of policy regulations follow rules and guidelines that have been worded in legislations. The convergence of the formation of policy regulations at the regional level is carried out by changing the Regulation of the Minister of Home Affairs Number 80 of 2015 in connection to the Regulation of the Minister of Home Affairs Number 120 of 2018 concerning the Establishment of Regional Laws hence the laws in the form of regulations consist of regulations, Regional Representative Houses’ regulations, and regional policy regulations.

Abstract

Land is one of the important natural resources for humanbeing sustainability. Relation both of them is not only a place for life, but also it is providing resources for life. Thus, the government policy on land for development must be managed wisely today and for future. The policy includes also life provision for development. One of the government actions, the provision of it must be fair. It based on the principle that it must be protected by law, right to property or right of having it guaranteed by the constitution. Abstract

This study aims to analyze and find the ideal legal design of the relationship of authority between the central and regional governments in order to strengthen synergy in public services. In essence, the granting of autonomy to the regions is directed at accelerating the realization of public welfare, through the implementation of government affairs. Concurrent government affairs as stipulated in Law no. 23/2014, is a governmental affair that is divided between the central government, provincial government and district/city governments. In practice, when problems occur in the implementation of concurrent affairs which fall under the central authority, the regional government is in a powerless position. This research uses normative legal research methods with statutory, case, and conceptual approaches. The results of this study indicate that: the absence of a legal instrument that accommodates and bridges central and regional authorities causes problems that occur in the community to continue and do not immediately find solutions. It is necessary to have legal instruments in the form of government regula-tions in bridging the authority of the central and regional governments to build synergy in public services, especially to resolve conflicts that occur in society so that government administration can run effectively.

Abstract

The standard of environmental quality is one of the instruments in preventing environmental pollution beside KLHS, special plan, environemtal analysis, UKL-UPL, permission, etc. the standard comprises of the standards of water, water waste, sea water, air ambien, emission, and nuisance. Politics of law in determination of the standards as a preventive  instrument of the pollution is based on Article 28H verse (1) of the Indonesian Constitution 1945 states that healthy and good environment is a human rights that should be guaranteed, Article 33 of the Act also provides that national economy must be based on economic democracy by environmentally principle. The determination is one of the legal responsive forms raised from democracy politics configuration to answer the need of people for the healthy and good environment. Abstract

ABSTRAK. Pengelolaan irigasi di Kabupaten Tanggamus belum dilandaskan pada peraturan daerah dan belum dilakukan dengan baik, hal ini terlihat dari coverage jaringan irigasi yang hanya dapat mengaliri 5.000 Ha sawah sehingga setiap tahunnya mengakibatkan trend penurunan produksi pertanian. Penelitian yang bertujuan untuk memetakan legal framework kebutuhan pengelolaan irigasi di Kabupaten Tanggamus Provinsi Lampung ini dilakukan dalam koridor doctrinal research serta menggunakan statute dan conceptual approach. Adapun temuan penelitian ini adalah: Legal framework kebutuhan Perda Pengelolaan Irigasi di Kabupaten Tanggamus Provinsi Lampung diatur dalam 12 peraturan perundang-undangan terkait pengelolaan irigasi yang isinya memaparkan aspek kewenangan dan aspek substantif pengelolaan irigasi yang dapat dijadikan dasar dalam pembentukan Perda tentang Pengelolaan Irigasi di Kabupaten Tanggamus. Legal framework tersebut, selain dalam bentuk rezim hukum yang sifatnya sektoral, berkaitan juga dengan rezim hukum pemerintahan daerah. Legal Framework of Local Regulation Irrigation Management Needs in The District Tanggamus Lampung Province  ABSTRACT. Irrigation management in Tanggamus not be based on local regulations and have not done well, it can be seen from the irrigation network coverage that can only flow through 5,000 hectares of rice fields so that each year resulting in a decline trend in agricultural production. The study aimed to mapping the legal framework needs of irrigation management in Tanggamus District, Lampung Province is done in the corridors of doctrinal research as well as the use of the statute and conceptual approach. The findings of this study are: Legal framework needs of regulation Irrigation Management in Tanggamus Lampung province arranged in 12 (twelve) legislation related to irrigation management that it exposes aspects of authority and substantive aspects of irrigation management which can be used as a basis for the establishment of Regulation on Management irrigation in Tanggamus. The legal framework, other than in the form of legal regime sectoral nature, is also related to the legal regime of the regional autonomy.

Abstract

ABSTRAK. Pengelolaan pertambangan mineral bukan logam dan batuan merupakan salah satu urusan pemerintahan yang dibagi secara konkuren antara pemerintah pusat, pemerintah provinsi dan pemerintah kabupaten/kota. Studi ini bertujuan untuk memetakan harmonisasi pengaturan kewenangan pengelolaan pertambangan mineral bukan logam dan batuan melalui pemberian izin pertambangan rakyat. Penelitian hukum yang menggunakan optik doktrinal ini menunjukkan bahwa terjadi disharmonisasi horizontal antar undang-undang yang mengatur kewenangan pemberian izin pertambangan rakyat. UU No. 23 Tahun 2014 memberikan kewenangan pemberian izin pada pemerintah provinsi, sedangkan UU No. 4 Tahun 2009 memberikan kewenangan pemberian izin pada pemerintah kabupaten/kota. Kondisi disharmonisasi tersebut menimbulkan ketidakpastian hukum bagi pengusaha pertambangan sehingga akan mempengaruhi iklim usaha pertambangan rakyat di daerah, sehingga disarankan agar pemerintah pusat dan dewan perwakilan rakyat (DPR), perlu meninjau kembali kewenangan pemberian izin pertambangan rakyat, dengan mengembalikan kewenangan tersebut dari perspektif rezim hukum pemerintahan daerah kepada pemerintah kabupaten/kota, karena rentang kendalinya dengan pelaku dan wilayah pertambangan lebih singkat sehingga cenderung lebih berdayaguna dan berhasilguna. Harmonization of Regulation Local Government Authority in The Management of Non-Metal Mineral and Rock Mining ABSTRACT. Mineral non-metal and rocks mining management is one of the government affairs are shared concurrently between the central government, provincial government and district/city governments. This study aims to mapping the harmonization of authority regulation in the management of non-metallic mineral and rock mining through the granting of people permits mining. This legal research that used the doctrinal optical shows that there is horizontal disharmony between the governing legislation in the licensing mining authority. Law No. 23 of 2014 granting the authorizes of licenses to the provincial government, while Law No. 4 of 2009 provides the authority to grant permission to the district/city government. The disharmony conditions create legal uncertainty for mining entrepreneurs that will affect people's mining business climate in the area, so it is suggested that the central government and the parliament (DPR), need to review the authority regulation in the management of non-metallic mineral and rock mining, to restore the authority of licensing in the perspective of local government legal regime area to the district/city, because of its control range with actors and mining areas tend to be shorter so effective and efficient.

Abstract

ABSTRAK: Desa atau yang dikenal dengan istilah lain merupakan satuan pemerintahan terkecil yang memiliki kewenangan otonom untuk mengatur dan mengurus pemerintahannya sendiri. Sebagai satuan pemerintahan terkecil yang berada di daerah, banyak persoalan pemerintahan terkait penataan desa yang dihadapi seperti: efektifitas penyelenggaraan pemerintahan, peningkatan kualitas pelayanan publik dan kesejahteraan masyarakat, yang tentu saja membutuhkan peranan aktif pemerintah daerah melalui regulasi yang mendukung pembangunan desa. Tulisan ini bertujuan memberikan algoritma/formula Peraturan Daerah Penataan Desa yang mampu mewujudkan desa yang maju dan berdaya saing. Dengan menggunakan pendekatan socio legal dan teori perundang-undangan serta konsep hukum pengayoman dan hukum progresif, dihasilkan algoritma peraturan daerah sebagai berikut: Peraturan Daerah Penataan Desa harus beranjak dari persoalan riil yang secara umum terjadi di suatu daerah dengan melandaskan pembentukannya pada aspek filosofi, sosiologis dan yuridis; peranan pemerintah daerah harus ditegaskan sampai pada aspek pendanaan hingga pengawasan dan evaluasi; memberikan ruang akses yang seluas-luasnya bagi desa untuk mengembangkan potensinya terkait pemekaran maupun perubahan status. Dengan demikian, diharapkan desa yang maju dan berdaya saing dapat terwujud melalui Peraturan Daerah Penataan Desa. Local Regulation Algorithm of Village Arrangement Toward A Visible and Competitive Village ABSTRACT: The village or other known term is the smallest unit of government with autonomous authority to regulate and administer its own government. As the smallest government unit in the region, many governance issues related to village arrangement are faced such as the effectiveness of government administration, improvement of public service quality and community welfare, which of course require active role of local government through local regulation that supporting village development. This paper aims to provide an algorithm/formulation of Local Regulation Village Arrangement that is able to realize a visible and competitive village. By using socio legal approach and the theory of legislation as well as the concept of hukum pengayoman and hukum progresif, the result of local regulation algorithm as follows: Local Regulation of Village Arrangement must be moved from real problem which generally occur in a region by based its formation on philosophy, sociology and juridical aspect; The role of local government should be emphasized to funding aspects up to monitoring and evaluation; Provide the widest possible access space for villages to develop their potential for division and status change. Thus, it is expected that visible and competitive villages can be realized through the Local Regulation of Village Arrangement.

Abstract

ABSTRAK: Berlakunya Undang-Undang Nomor 23 Tahun 2014 tentang Pemerintahan Daerah membawa konsekuensi baru terkait pelaksanaan urusan pemerintahan konkuren antar tingkat pemerintahan di daerah. Kajian ini bertujuan untuk mendekonstruksi urusan pemerintahan konkuren pemerintah daerah sehingga akan terlihat titik berat otonominya. Penelitian yang dilakukan dengan koridor doctrinal research dan menggunakan statute dan conceptual approach ini menghasilkan temuan sebagai berikut: Perubahan kewenangan konkuren pemerintah daerah yang diatur dalam UU No. 23 Tahun 2014 membawa konsekuensi terjadinya polemik antar pemerintah provinsi dan pemerintah kabupaten/kota serta infleksibilitas, inefektifitas dan inefisiensi dalam pelaksanaan urusan pemerintahan tertentu, seperti pelaksanaan kewenangan di bidang perizinan pertambangan yang akan lebih baik jika dilaksanakan oleh pemerintah kabupaten/kota karena sesuai dengan aspek perpajakan daerahnya. Hal ini menjadikan pembagian urusan pemerintahan konkuren daerah dalam UU No. 23 Tahun 2014 bernuansa the thinnest version rule of law.   Deconstruction of Concurrent Government Affairs Based on Law Number 23 of 2014 on Local Governance ABSTRACT: The enactment of Law No. 23 of 2014 on Local Governance brings new consequences related to the implementation of concurrent government affairs between levels of local government. This study aims to deconstructing the administration of local government concurrent affairs so that it looks the emphasis autonomy. Research conducted by doctrinal research corridors and using the statute and conceptual approach, resulted in the following findings: The changes of local government concurrent authority as stipulated in Law No. 23 of 2014 brought consequences of a polemic between the provincial government and district/city governments as well as inflexibility, ineffectiveness and inefficiency in the implementation of government affairs, such as the exercise of authority in the field of licensing mining would be better if implemented by the district/city governments because in accordance with aspects of taxation area. This makes the distribution of concurrent local government affairs in Law No. 23 of 2014 shades of the thinnest version rule of law.
