Abstract

Penelitian ini bertujuan untuk menganalisis hubungan antara otonomi daerah dan strategi intervensi harga komoditas pertanian dalam rangka meningkatkan kesejahteraan petani dan ketahanan pangan nasional di Indonesia. Menggunakan pendekatan Systematic Literature Review (SLR) yang dikombinasikan dengan analisis bibliometrik melalui perangkat lunak VOSviewer, studi ini mengevaluasi 107 artikel dari database Scopus. Hasil penelitian menunjukkan bahwa otonomi daerah memberikan ruang bagi pemerintah lokal untuk merancang kebijakan harga yang lebih adaptif terhadap kondisi pasar dan sosial-ekonomi setempat. Strategi intervensi harga yang terdesentralisasi terbukti efektif dalam meningkatkan pendapatan petani, mengurangi dampak fluktuasi pasar, serta memperkuat stabilitas pangan daerah. Visualisasi jaringan kata kunci juga menyoroti bahwa tema governance, decision-making, dan community menjadi fokus utama dalam literatur yang dianalisis. Studi ini menekankan perlunya penguatan koordinasi antar pemerintah dan partisipasi masyarakat dalam perumusan kebijakan harga di sektor pertanian

Abstract

Kenaikan harga barang kebutuhan pokok merupakan isu publik yang terus berulang dan berdampak langsung pada penurunan daya beli masyarakat, khususnya menjelang hari-hari besar keagamaan dan nasional. Dalam konteks ini, kebijakan pemerintah daerah menjadi instrumen strategis untuk menstabilkan harga dan menjamin ketersediaan barang pokok secara adil dan merata. Penelitian ini bertujuan untuk menganalisis faktor-faktor utama penyebab kenaikan harga bahan pokok serta mengevaluasi kebijakan stabilisasi harga yang diterapkan pemerintah daerah. Metode yang digunakan adalah yuridis normatif dengan pendekatan kualitatif, melalui studi kepustakaan terhadap peraturan perundang-undangan, dokumen kebijakan, jurnal ilmiah, dan literatur relevan. Hasil penelitian menunjukkan bahwa kenaikan harga dipicu oleh meningkatnya permintaan, gangguan distribusi, praktik penimbunan, dan lemahnya pengawasan pasar. Untuk mengatasi hal tersebut, pemerintah daerah menjalankan berbagai kebijakan seperti operasi pasar murah, pengawasan harga secara rutin, dan kerja sama dengan distributor lokal. Penelitian ini menekankan pentingnya peran aktif pemerintah daerah dalam menciptakan sistem pasar yang lebih tertib, adil, dan berpihak pada kesejahteraan masyarakat

Abstract

This paper aims to see the influence of political aspects in legal reform. By using a conceptual approach, it was found that:In the context of legal reform, political aspects have a significant influence, this can be seen in the formation of the Constitutional Court. The formation of the Constitutional Court was realized because of the political desire to form a state institution that could control the legislative products of the DPR, synchronize it with the 1945 Constitution so that there would be no violations of the constitutional rights of citizens and to maintain the principle of checks and balances between state institutions. The establishment of the Constitutional Court is a form of legal reform in a formal institutional sense. Apart from the context of forming legislation for legal reform, political aspects can also actually influence law enforcement. This can be seen in the handling of protracted corruption cases, as well as the use of a reverse evidence system in corruption cases, making it easier for law enforcers to work. This reverse evidence system is a form of legal reform.

Abstract

Tujuan dari penelitian ini adalah untuk mengamati bagaimana kebijakan pemerintah Kabupaten Pesisir Barat terkait keterbelakangan pekon dalam hal infrastruktur jalan yang menghubungkan Pekon Way Haru dengan pusat-pusat perdagangan, pemerintahan, dan kesehatan sangat memprihatinkan. Penelitian ini mengaplikasikan metode hukum yuridis normatif atau yang dikenal sebagai penelitian dogmatik hukum. Metode ini bertujuan untuk menganalisis norma-norma hukum yang ada serta mengevaluasi pelaksanaan ketentuan hukum tersebut dalam praktik yang sebenarnya. Poin utama dalam penelitian ini adalah kebijakan-kebijakan yang relevan dan konsep-konsep yang mendasari fenomena yang diteliti, terkait dengan politik hukum pembangunan di wilayah tertinggal. Berdasarkan hasil temuan penulis, hingga saat ini belum ada tindakan dari pemerintah kabupaten terkait infrastruktur jalan di pekon tersebut, yang menyebabkan masyarakat setempat tertinggal dalam berbagai aspek kehidupan.Kata Kunci : Politik Hukum, Pembangunan, Daerah 3T

Abstract

Stunting is a condition of growth failure caused by chronic malnutrition and recurrent infections during the first 1,000 days of life, which has a serious impact on the quality of Indonesia's human resources. Stunting is not only a health issue, but also a violation of children's rights guaranteed by the constitution and national legal instruments. In this context, the state has a legal responsibility to ensure every child's right to nutrition and health in a comprehensive manner. An analysis of Presidential Regulation No. 72 of 2021 shows that national regulations have established strategies to accelerate the reduction of stunting, but they lack mechanisms for sanctions, oversight, and clear delineation of authority. Weak cross-sectoral coordination, low legal literacy among the public, and minimal public participation undermine the effectiveness of policies. To enrich the analysis, this study highlights best practices from Malaysia, Myanmar, and Thailand. These countries have successfully reduced stunting rates through a multisectoral, community-based, and rights-oriented approach. Their strategies include nutrition education, food security, women's empowerment, and interventions based on educational and social institutions. Without a strong and implementable legal framework, and without learning from successful global practices, Indonesia will struggle to achieve significant reductions in stunting. Therefore, strengthening legal policies and adopting international best practices are crucial to realizing the vision of Indonesia's Golden Generation 2045

Abstract

The National Health Insurance Program (JKN) by BPJS Kesehatan provides broad access to health services to the public, but also presents its own challenges for doctors in carrying out their professional duties. The high workload, limited facilities, and patient expectations can pose a risk of criminalization for medical actions, even though they are in accordance with professional standards. This study aims to examine the forms and limits of criminal liability of doctors in BPJS services based on positive law in Indonesia, as well as examine how the principles of medical ethics become the basis of legal protection for doctors. The method used is a normative juridical approach with a literature study of relevant laws and regulations, such as Law Number 17 of 2023 concerning Health, Criminal Code, Presidential Regulation Number 59 of 2024 as an amendment to Presidential Regulation Number 82 of 2018 concerning Health Insurance, and other professional regulations. The results showed that doctors in the JKN system by BPJS have limited criminal liability, as long as medical actions are carried out according to professional standards and operational procedures. Medical ethical principles such as beneficence, non-maleficence, autonomy, and justice provide an important basis for legal protection, especially when doctors face a dilemma between professional obligations and system restrictions. Integration between law, ethics, and policy is needed to ensure fair legal protection for doctors in the practice of national health services

Abstract

Perkembangan teknologi medis memungkinkan pasangan dengan indikasi medis infertilitas untuk memiliki anak melalui penyewaan rahim wanita lain (surrogate mother). Akan tetapi, prosedur tersebut menimbulkan berbagai problematika seperti eksploitasi wanita dan anak, ketidakpastian hukum, pertentangan norma, hingga pengabaian hak-hak anak. Penelitian ini bertujuan untuk memaparkan perbedaan regulasi terkait surrogate mother di Indonesia dan India juga untuk mengatahui bagaimana kedudukan hukum dan hak waris anak yang dilahirkan melalui proses surogasi. Penelitian ini termasuk dalam penelitian hukum normatif yang  menggunakan pendekatan perundang-undangan, konseptual dan komparatif. Dari penelitian ini dapat disimpulkan bahwa berdasarkan hukum Indonesia, anak hasil surogasi memiliki hubungan hukum sebagai anak kandung surrogate mother,dan memiliki hak waris terhadapnya. Sebaliknya, menurut hukum India anak tersebut menjadi anak kandung dari intending couple, serta hak keperdataan lainnya seperti waris, nafkah, serta kewarganegaraan. Tidak adanya regulasi khusus terkait surrogate mother di Indonesia menyebabkan ketidakpastian hukum terhadap status anak dan merugikan hak keperdataan mereka. Oleh sebab itu, pemerintah diharapkan untuk menyusun regulasi terkait perlindungan hukum anak dari surrogate mother,serta edukasi bagi masyarakat terkait implikasi hukum anak dari surogasi.

Abstract

Children have an important role in determining the quality of a nation's civilization. It is no wonder that preparing the next generation of the nation is an important dimension for state administrators. The guarantee for the protection of children's rights is not only regulated in the Indonesian constitution, but also emphasized in UU No.23 Tahun 2002 jo. UU No.17 Tahun 2016 on Child Protection. Various parties are obliged and responsible for ensuring the fulfillment of children's rights, starting from the smallest institutions, namely the family, community, village/kelurahan government, sub-district, district / city government, provincial government and government. Child rights protection is one of the important foundations that must be understood by all parties, including the village government as the government unit closest to the community. This is also part of realizing sustainable development through the fulfillment of children's rights. A rampant case and a problem for the Indonesian nation is the high rate of marriage at the age of a child. This community service activity aims to educate the community, especially the village government, about child rights protection as an effort to mitigate the risk of marriage at a child's age. This is important because the protection of children's human rights has been regulated in various laws and regulations in Indonesia, including the government's efforts to prevent child marriage. This is important for the community to understand so that they can avoid child marriage as a legally protected child right. This activity is a preventive solution to reduce the number of marriages at the age of children. So that the target audience in this activity is the community from various elements, BPD, and the Village Government. The location of the activity was Fajar Baru Village, South Lampung Regency. The methods used in this activity are through lectures, and discussions.

Abstract

One of the materials for the amendment of the 1945 Constitution is the guarantee of human rights and constitutional rights of citizens. This change can be seen as a manifestation of awareness about the importance of protecting the human rights and constitutional rights of citizens, which grows and becomes the spirit of reform. Local governments have an important role in presenting the spirit of reform by presenting Regional Regulations for the Fulfillment of Human Rights. The material model for the content of the Local regulation Fulfillment of Human Rights based on progressive law relies on three things, namely: laws and regulations that regulate human rights both vertically and horizontally, the contextual reality of the recognition and protection of human rights found in local communities and thirdly for humans and humanity. Systematically, the division of chapters containing the content in it consists of: general provisions; principles and objectives; type of human rights; human rights recognition; protection of human rights; fulfillment of human rights; community participation; guidance and supervision; funding and closing provisions. By using the socio-legal approach, this paper describes the material model for the content of regional regulations regarding the fulfillment of human rights based on progressive law.

Abstract

This study aims to identify and explain the problems surrounding the implementation of Regional Regulations initiated by the Lampung Provincial House of Representatives (DPRD), particularly in terms of their effectiveness in supporting community welfare. Using a normative legal research method with a statute and theoretical approach, this study analyzed 12 Regional Regulations issued between 2015 and 2023 through content analysis of legal texts and supporting documents. The findings indicate two major issues. First, the absence of follow-up regulations in the form of Governor Regulations creates a legal vacuum, which hinders Regional Apparatus Organizations from operationalizing the Local regulation. Second, there is a fundamental disconnect between the legislative focus of the DPRD which emphasizes accommodating community aspirations and the executive priorities of the Regional Government, which are more programmatic and budget-oriented. As a result, DPRD-initiated Local regulation are often not integrated into regional development planning and remain unimplemented. This study recommends strengthening coordination mechanisms between the DPRD and the Regional Government during the legislative planning stage, as well as mandating a time-bound issuance of implementing regulations to ensure effective enforcement of regional laws.
