Abstract

The implementation of the Ministerial Regulation plays a crucial role in enhancing the effectiveness of the Karang Taruna organization, in accordance with the Regulation of the Minister of Social Affairs Number 25 of 2019. This study aims to analyze the role of youth organization or Karang Taruna in Cempaka Barat Village, particularly in relation to Article 6 of Permensos 25/2019, from the perspective of Fiqh Siyasah Tanfidziyyah. The research employs a field study approach using a case study of the local Karang Taruna organization. The findings indicate that while Karang Taruna has made efforts to optimize its role, it continues to face challenges, including limited funding and the absence of many members due to work or study commitments outside the region. The principles of Fiqh Siyasah Tanfidziyyah have been found to be highly relevant in improving organizational effectiveness. This study underscores the importance of adaptive policies to support the role of Karang Taruna in promoting social development within village communities.

Abstract

The divorce gives rise to rights and obligations, especially women's economic rights after divorce, namely iddah, mut'ah and madhiyah livelihood. Judges in determining the amount of alimony still vary and there are no standard rules and methods so that judges can guide them in determining the value of alimony for wives as a result of divorce which reflects propriety and justice. The author will put forward the idea of ​​the jurimetric method as a mathematical analysis method related to determining the amount of iddah, mut'ah and madhiyah maintenance for wives after divorce. The aim of the research is to analyze the application of the jurimetric approach in resolving disputes over women's rights in divorce decisions for talak at the Gedong Tataan Religious Court and the Sukadana Religious Court and to analyze the perspective of maslahah al mursalah and the theory of justice towards the implementation of the jurimetric approach as a method for determining the amount of women's rights in decisions divorce. This research is normative legal or normative juridical research which is descriptive analytical in nature. The application of jurimetry in determining the amount of women's rights in divorce and divorce decisions regarding 'iddah, mut'ah and madhiyah income, is carried out by collecting empirical data which is then expressed in variables. Jurimetry is a tool to interpret norms for the sake of realizing justice. By applying a jurimetric approach in determining the amount of 'iddah, mut'ah and madhiyah income, it has fulfilled procedural justice and distributive justice and fulfilled maslahah al-mursalah.

Abstract

Descente or site visit are usually carried out on material cases, such as inheritance cases, joint property, sharia economics and so on, with the aim of avoiding difficulties in carrying out the execution of decisions at a later date. However, in several decisions, site visit were also found in cases other than material things, including in disputes over child custody or hadhanah by examining Decision Number 1063/Pdt.G/2022/PA.Tgm, Decision Number 627/Pdt.G/2023/ PA.Prw and Decision Number 585/Pdt.G/2020/PA.Ppg. This research is normative legal research or library research with a conceptual approach which examines primary data from several judicial decisions in Indonesia such as the Tanggamus Religious Court, the Pringsewu Religious Court and the Pasir Pangaraian Religious Court. The results of the research show that the implementation of site visit of children is the same as site visit of material cases and there are two reasons why the panel of judges conducts site visit of site visit of these cases, namely: directly ensuring the objective condition of the child and the child's growth and development and also ensuring environmental conditions. around the child in order to realize the best interests of the child. Site visit of children, apart from fulfilling the best interests of the child, also fulfills the objectives of Islamic law in maqāṣid asy-syarīah, namely hifz al-nafs or soul.

Abstract

BUMDes as a source of Village Original Income is a business entity managed by a group of people who are entrusted by the Village Council to improve the village economy and explore its potential systematically for mutual benefit. Village-Owned Business Entities aim to optimize the economy of village residents by building villages and business entities. The purpose of this research is to identify how Article 87 of the BUMDes Law can be utilized to optimize the village economy. The formulation of the problem in this research is the position of the Sadar Sriwijaya Village Government in implementing Article 87 of the BUMDes Law to optimize the village economy, and the use of Fiqh Siyasah analysis in this regard. This research uses a qualitative descriptive method in the field, with information collection through observation, interviews, and recording. Based on the results of the study, the economy of Sadar Sriwijaya Village has been running well, but has not been running optimally due to limited business capital and less than optimal dependence on PAD. In other words, there has been no business development cooperation between BUMDes and villagers.

Abstract

: Pengawasan Badan Usaha Milik Desa (BUMDes) yang diamanatkan Pasal 31 PP No. 11 Tahun 2021 merupakan instrumen krusial untuk mewujudkan akuntabilitas. Namun, praktik di lapangan menunjukkan kesenjangan signifikan antara regulasi dengan implementasi, di mana mekanisme audit investigatif, sistem dokumentasi, pelaporan Musyawarah Desa, dan check and balance seringkali tidak berjalan optimal. Penelitian ini bertujuan: (1) menganalisis implementasi mekanisme pengawasan BUMDes Mahameru berdasarkan Pasal 31 PP No. 11/2021; dan (2) mengevaluasi praktik pengawasan dari perspektif Fiqh Siyasah. Penelitian menggunakan pendekatan kualitatif dengan desain studi kasus di Desa Gumawang, Kabupaten Ogan Komering Ulu Timur. Data dikumpulkan melalui wawancara dengan 15 informan (pengurus BUMDes, pengawas, kepala desa, dan 10 nasabah), observasi, dan studi dokumentasi LPJ 2021-2024. Analisis data menggunakan model interaktif dengan interpretasi prinsip Fiqh Siyasah (al-Riqabah, al-Hisbah, al-Amanah, as-Syura, al-’Adalah, Maslahah Mursalah). Hasil menunjukkan keempat aspek pengawasan mengalami disfungsi total: audit investigatif tidak pernah dilakukan, dokumentasi sangat lemah, Musdes seremonial tanpa pelibatan masyarakat, dan check and balance tidak berfungsi. Dari perspektif Fiqh Siyasah, kegagalan ini merupakan pengabaian prinsip fundamental tata kelola yang menghalangi tercapainya Maslahah Mursalah. Keterbatasan penelitian meliputi studi kasus tunggal dan durasi singkat. Penelitian merekomendasikan transformasi tata kelola melalui pembinaan intensif pengawas, transparansi berbasis teknologi, dan penguatan independensi organ pengawas berbasis nilai masyarakat.

Abstract

The transformation of gender roles in Muslim countries shows diverse dynamics due to the influence of religious interpretations, political systems, and social structures in each country. This study examines the transformation of gender roles in Muslim families in Indonesia, Egypt, and Iran through a descriptive-comparative approach. Data were collected from policy documents and relevant literature. The results show that the transformation of gender roles in Muslim families cannot be separated from the interaction between religion, state, and society. In Indonesia, cultural pluralism and an open legal system support women's involvement in the public sphere. In Egypt, change is hampered by conservative norms despite a strong feminist heritage. Meanwhile, in Iran, women face institutionalized restrictions but show resistance through social movements and education. This research emphasizes the importance of cross-border dialogue among Muslim countries in promoting contextual, equitable gender transformation that is in line with local values. [Transformasi peran berdasarkan gender di negara muslim menunjukkan dinamika yang beragam berbeda karena dipengaruhi oleh interpretasi agama, sistem politik, dan struktur sosial masing-masing negara. Penelitian ini mengkaji transformasi peran gender dalam keluarga Muslim di Indonesia, Mesir, dan Iran melalui pendekatan deskriptif-komparatif. Data dikumpulkan dari dokumen kebijakan dan literatur yang relevan. Hasil penelitian menunjukkan bahwa transformasi peran gender dalam keluarga Muslim tidak dapat dilepaskan dari interaksi antara agama, negara, dan masyarakat. Di Indonesia, pluralisme budaya dan sistem hukum yang terbuka mendukung keterlibatan perempuan di ranah publik. Di Mesir, perubahan terhambat oleh kekuatan norma konservatif meskipun ada warisan feminisme kuat. Sementara itu, di Iran, perempuan menghadapi pembatasan yang dilembagakan meski menunjukkan resistensi melalui gerakan sosial dan pendidikan. Penelitian ini menegaskan pentingnya dialog lintas negara Muslim dalam mendorong transformasi gender yang kontekstual, adil, dan sejalan dengan nilai-nilai lokal].

Abstract

Community participation is a process where the interests, needs, and values of the community are incorporated into government decision-making. This involves two-way communication and dialogue, with the primary goal of achieving better decision-making and community support. To understand community participation in the formation of village regulations, this research is important as it aims to address two main issues: First, how community participation in the formation of village regulations in Bumi Aji Village, Central Lampung, is implemented based on Article 6 of the Ministry of Home Affairs Regulation Number 111 of 2014; and second, how the SiyasahTanfiżiyyah perspective reviews the role of community participation in the formation of village regulations in Bumi Aji Village. The role of the community in Bumi Aji Village, Central Lampung, is examined using the SiyāsahTanfiżiyyah perspective approach, alongside the method used, which is field research with a descriptive qualitative approach, and the nature of the research is descriptive analytical. The research results show that community participation in Bumi Aji Village runs in accordance with the guidelines of the Ministry of Home Affairs Regulation Number 111 of 2014, which aligns with the principles of Siyāsah Tanfiżiyyah because obeying the applicable law is a form of state obedience.

Abstract

The obligation of a husband to provide maintenance within the family is often understood narrowly as merely fulfilling material needs, thereby neglecting moral, emotional, and child-rearing dimensions. This limited understanding raises academic concern, as it may lead to the phenomenon of fatherlessness even when the father is physically present in the family. This study aims to analyze the husband’s maintenance obligations from the Islamic perspective, the provisions of Article 80 of the Compilation of Islamic Law, and Law Number 1 of 1974, as well as their relevance to the emergence of fatherless conditions. The research employs a normative juridical method using legislative and conceptual approaches. The findings indicate that maintenance in Islam encompasses not only economic support but also obligations of protection, religious guidance, and fulfillment of the psychological needs of both wife and children. The husband is positioned as the primary party responsible for family welfare in both material and non-material aspects. Neglect of these responsibilities contributes to fatherlessness, which is caused not only by biological absence but also by weak paternal caregiving and leadership roles. This condition negatively affects children’s emotional development and family stability, highlighting the importance of a comprehensive understanding of maintenance obligations to strengthen family resilience.
