Abstract

The purpose of the study was to analyze the legal status of narcotics abusers after the hand-holding operation. This type of research is normative legal research with a legislative approach, a case approach and a conceptual approach. The analysis used in this study is qualitative data analysis through the management of legal materials in a deductive way. Based on the research, the results of the research were obtained that in Law Number 35 of 2009 concerning Narcotics, it is stated that after the arrest operation or after the seizure, within a minimum of 3 x 24 hours an evidence test must be carried out to ensure the narcotic content found, then this can have implications for the legal status of a person arrested in the arrest operation. A person caught in a narcotics case can have several possible legal statuses, including; as an arrested witness, if he is only at the scene of the incident without direct evidence of his involvement; as a suspect, if there is preliminary evidence that he possesses or uses narcotics; as a person without legal status who is temporarily detained, if his status is still waiting for the results of laboratory tests of evidence. Therefore, it is necessary to update regulations through the revision of the Narcotics Law which must contain clear time limits on how a person who is caught must be treated before the results of the evidence test come out..

Abstract

Catcalling or verbal sexual harassment is a social phenomenon that is rampant in Indonesia. It involves unwanted sexualized remarks that dehumanize the victim and can have a psychological impact. Although Law Number 12 of 2022 on Criminal Acts of Sexual Violence (UU TPKS) has regulated non-physical sexual harassment in Article 5, its application in the field still faces various obstacles. This study aims to determine the legal formulation of the application of sanctions against perpetrators of verbal sexual harassment (catcalling). This research uses an empirical normative approach. The results show that the legal formulation of the application of sanctions against perpetrators of verbal sexual harassment has progressed with explicit regulation in Article 5 of Law Number 12 of 2022 concerning Criminal Acts of Sexual Violence (TPKS Law). To realize substantive and effective justice, it is necessary to improve the formulation of sanctions, integrate non-criminal sanctions, increase the capacity of law enforcers, and strengthen public education.

Abstract

Pertambangan rakyat merupakan bentuk pemanfaatan sumber daya alam yang banyak dilakukan di wilayah pedesaan, seperti di Desa Karyabaru, Kecamatan Dengilo, Kabupaten Pohuwato. Aktivitas ini kerap dijalankan tanpa pengawasan hukum dan lingkungan yang memadai, sehingga menimbulkan dampak sosial dan ekologis. Penelitian ini bertujuan untuk mengkaji implementasi perlindungan hukum terhadap hak-hak masyarakat yang terdampak pertambangan rakyat serta mengidentifikasi kendala yang dihadapi pemerintah dalam menjalankan fungsi perlindungan tersebut. Metode penelitian yang digunakan adalah hukum empiris dengan pendekatan kualitatif, melalui teknik wawancara, dokumentasi, dan studi pustaka. Hasil menunjukkan bahwa pelaksanaan perlindungan hukum masih belum optimal akibat lemahnya pengawasan, rendahnya partisipasi masyarakat, serta tingginya ketergantungan ekonomi terhadap pertambangan. Di samping itu, minimnya kesadaran lingkungan juga memperburuk situasi. Oleh karena itu, dibutuhkan penguatan regulasi, pemberdayaan masyarakat, dan kebijakan partisipatif agar pengelolaan sumber daya alam dapat berjalan secara adil, legal, dan berkelanjutan

Abstract

This research discusses the application of criminal sanctions against vagrants and beggars inGorontalo City based on the provisions of Articles 504 and 505 of the Criminal Code and otherrelated regulations. The phenomenon of the increasing number of vagrants and beggars in the cityposes challenges in law enforcement, especially in terms of the effectiveness of the implementationof criminal sanctions and the socio-economic obstacles behind it. This study aims to analyze theimplementation of criminal provisions against homeless people and beggars and identify factorsthat hinder their enforcement. This research uses a qualitative method with an empirical legalapproach, which is obtained through a literature study and interviews with relevant agencies. Theresults show that the application of criminal sanctions has not been running optimally due to weakinter-agency coordination, the absence of specific regional regulations, and cultural factors of thecommunity that still tolerate the practice of begging. Therefore, an integrated legal approach isneeded to create a more just and sustainable repressive, preventive, and rehabilitative solution.

Abstract

This type of research is normative legal research with a legislative approach, case approach and conceptual approach. The analysis used in this study is qualitative data analysis through the processing of legal materials in a deductive manner. Based on the research, the results of the study show that in Law Number 35 of 2009 concerning Narcotics, it is stated that after a sting operation or after a confiscation, within a minimum of 3 x 24 hours, evidence must be tested to ensure the narcotics content found, so this can have implications for the legal status of someone arrested in a sting operation. A person caught red-handed in a narcotics case can have several possible legal statuses, including; as a witness who is arrested, if he is only at the scene without direct evidence of his involvement; as a suspect, if initial evidence is found that he has or uses narcotics; as a person without legal status who is temporarily detained, if his status is still awaiting the results of laboratory tests of evidence. Therefore, it is necessary to update the regulations through a revision of the Narcotics Law which must include a clear time limit on how someone caught red-handed must be treated before the results of the evidence test are out.

Abstract

The rampant circulation of illegal cosmetics through social media, which is difficult to monitor, poses a serious challenge to consumer protection and the effectiveness of law enforcement in Indonesia. This study aims to analyze the positive legal regulations regarding the sale and purchase of illegal cosmetics via social media and identify factors that hinder law enforcement in Gorontalo City. The phenomenon of the rampant circulation of illegal cosmetics via social media poses a serious challenge, primarily due to the dynamic and difficult-to-monitor nature of digital media. The research method used is an empirical legal approach, with data collection through observation and interviews with Gorontalo BPOM officers and a review of relevant laws and regulations such as the Health Law, the Consumer Protection Law, the ITE Law, and BPOM Regulation No. 18 of 2015. The results of the study indicate that although regulations are available, implementation in the field still faces various obstacles such as a weak deterrent effect, limited human resources and technology, and low public awareness. The conclusion of this study emphasizes the importance of regulatory reform, strengthening the digital capacity of regulatory agencies, and cross-sector collaboration to create more effective legal protection for consumers in the era of digital commerce.

Abstract

The phenomenon of violence against pets is increasingly prevalent in Indonesia, including malpractice committed by pet shops that provide medical services without proper authorization. This study aims to analyze the criminal legal liability for pet malpractice by pet shops and to identify the inhibiting factors in law enforcement in Gorontalo City. The research adopts a normative-empirical approach through a two-month field study using purposive sampling techniques involving cat lover communities, victims, and the police. Primary data were obtained through interviews and observations, while secondary data were collected through literature studies. The discussion highlights the case of Liga Pet Shop, which performed tail docking and administered restricted drugs without authorization—acts that fulfilled the elements of actus reus and mens rea, violating Article 302 of the Indonesian Criminal Code (KUHP) and Law No. 41 of 2014 on Animal Husbandry and Animal Health. However, criminal liability was not strictly enforced and concluded only with an apology. Inhibiting factors include weak specific regulations, limited competence of animal forensic officers, lack of investigative facilities, low public legal awareness, and a permissive culture in dispute resolution. The proposed recommendations include strengthening regulations by establishing standard operating procedures (SOPs) for pet shops, enhancing officer competence through animal forensic training, providing adequate investigative infrastructure, and launching public legal awareness campaigns. The study concludes that reforming the animal legal protection system is necessary through an integrative approach combining repressive, educational, and preventive measures to achieve fair and effective law enforcement

Abstract

Penelitian ini bertujuan untuk menganalisis upaya kepolisian resor Bone Bolango dalam menangani tindak pidana pertambangan emas tanpa izin. Penelitian ini dilakukan dengan menggunakan metode penelitian hukum empiris dan mengumpulkan data melalui wawancara, observasi, dan dokumentasi. Responden dalam penelitian ini adalah pihak kepolisian serta masyarakat (penambang). Hasil penelitian ini dapat diketahui upaya penanganan oleh pihak Kepolisian resor Bone Bolango terhadap pelaku tindak pidana pertambangan emas tanpa izin terdapat beberapa tindakan yaitu tindakan pre-emtif seperti memberikan pemahaman hukum kepada masyarakat tentang ancaman pidana pertambangann emas tanpa izin, dan melakukan tindakan preventif serta tindakan represif yaitu melakukan patroli, razia. Hambatan Kepolisian resor Bone Bolango dalam menangani tindak pidana pertambangan emas tanpa izin meliputi faktor sarana dan prasarana, faktor masyarakat, faktor kebudayaan, faktor ekonomi, serta faktor pendidikan.

Abstract

Indonesian criminal law adheres to various principles that form the basis for solving problems, especially in problems related to two or more countries. One of the principles recognized and in line with the research, in this case, is the territorial principle, which is a useful principle in determining the limits of validity of criminal law provisions based on place or location. This study aims to analyze the application of the territorial principle to perpetrators of pedophilia crimes committed by foreign nationals. The method used in this study is a normative type of research that uses the law approach and case studies. The results of this study indicate that should be based on the principle of criminal law, namely the territorial principle, Indonesian law will be applied to anyone who commits a crime in Indonesia, including in this case foreign citizens who commit pedophilia crimes, especially a sovereign state has exclusive jurisdiction in the environment. the territory itself is called territorial sovereignty so that the state has full jurisdiction to punish people who commit crimes against the law in the territory of the country. In reality, this territorial principle cannot be applied to this case because the suspect is still in the process of waiting for the results of approval or rejection of extradition by the Ministry of Law and Human Rights of the Republic of Indonesia, considering that the suspect is a foreign citizen and is also a fugitive in his home country, namely the United States of America. so that the country of origin sends a letter of request for extradition and this extradition request is still in the process of being followed up.

Abstract

This article aims to determine and analyze the application of the law to drug abusers and addicts based on Law Number 5 of 2009 on Narcotics and Law Number 1 of 2023 on the Criminal Code. Furthermore, to know, analyze, and construct drug crime arrangements that ensure legal protection for drug abusers and addicts. This article is normative research with a statutory approach, a case approach, a historical approach, and a conceptual approach. The results show that first, the application of the law against drug abusers and addicts has many problems, especially in the implementation of the law on narcotics. This problem has implications for regulatory bias in some articles, such as in Articles 4 and 54, which cause differences in subjects who are obliged to undergo medical rehabilitation and social rehabilitation. Furthermore, there is a tendency to use Article 111 or Article 112 charged with Article 127 (if an alternative charge) or without Article 127 (if a single charge) against drug abusers and drug users. This trend illustrates that the approach used is criminal, even if it is towards drug users, not drug dealers. Furthermore, the regulation of drug crimes in the New Criminal Code basically does not eliminate these problems because the provisions maintained through the New Criminal Code are only copies of repealed articles and no longer apply to the law on narcotics. Second, criminal regulation that ensures legal protection for drug abusers and addicts can be realized by revising the law on narcotics, which focuses on subject consistency in Article 54, Article 55, and Article 103, changing the elements of Article 127 paragraph (3) and abolishing the Explanation to Article 54.
