Abstract

This research aims to analyze the differences in the definition of a child's age in the Child Protection Law and the Human Rights Law and how this affects the handling of juvenile cases, as well as the implications of the contradiction in the definition of a child's age between the Child Protection Law and the Human Rights Law in juvenile justice processes. This type of research is normative research. The research results indicate that (1) The difference in the definition of a child in the Child Protection Law (Law No. 35 of 2014) and the Human Rights Law (Law No. 39 of 1999) creates inconsistency in legal protection for children. A fair legal system should provide more protection to vulnerable groups, such as children, without distinguishing their marital status. The principle of justice as fairness requires that every individual, especially vulnerable groups, should receive equal opportunities and maximum protection under the law. However, the definition in the Human Rights Law, which excludes married children, creates injustice and contradicts the principle of non-discrimination outlined in the Convention on the Rights of the Child (CRC). (2) The implication of the contradiction in the definition of a child's age between the Child Protection Law and the Human Rights Law in juvenile justice processes is the legal impact, leading to inconsistency in law enforcement by law enforcement officials. Legal theory highlights that the success of law enforcement is influenced by the alignment between the law, law enforcement officials, and society. In this case, the misalignment of legal definitions complicates the decision-making process for law enforcers in determining the status of a married child, which impacts the protection of their rights. Additionally, the theory of distributive justice emphasizes that the distribution of legal treatment should be proportional to the individual's needs. A married child still requires legal protection as a vulnerable age group, so the legal treatment should reflect this need

Abstract

Proses pembentukan peraturan desa yang selama ini dilakukan secara konvensional, diperhadapkan pada situasi seperti pandemik covid-19, sehingga diperlukan sebuah formula untuk tetap melaksanakan kewenangan pembentukan peraturan desa yang baik meskipun dalam kondisi new normal yang penuh dengan keterbatasan.  Tujuan penelitian ini adalah untuk menjelaskan bagaimana proses pembentukan peraturan desa di masa new normal khususnya di Kabupaten Boalemo Provinsi Gorontalo. penelitian ini menggunakan pendekatan perundang-undangan, pendekatan kasus, dan pendekatan konseptual. Temuan penelitian menunjukkan bahwa pandemik covid-19 yang menimbulkan berbagai pembatasan aktifitas dan mobilitas masyarakat dan pemerintah serta refokusing anggaran menjadi hambatan utama dalam pembentukan peraturan desa. Produktifitas pembentukan peraturan desa se Kabupaten Boalemo lebih terfokus pada peraturan desa yang memayungi urusan rutin pemerintah desa, seperti Perdes APBDes, RKPDes, RPJMDes. Ketiadaan inventarisasi pembentukan peraturan desa di tingkat kabupaten juga membuat kontrol terhadap pembentukan peraturan desa (klarifikasi dan evaluasi) tidak berjalan efektif. Diperlukan formula pembentukan peraturan desa yang sangat kompatibel dengan kondisi new normal seperti saat ini dengan memanfaatkan kemajuan teknologi informasi yang tidak saja sebagai media penyebarluasan proses pembentukan serta peraturan desa yang telah diundangkan, melainkan juga menjadi bank data elektronik berbagai peraturan desa yang telah dibentuk di Kabupaten Boalemo, serta menjadi media penyelenggaraan tahap klarifikasi dan evaluasi yang lebih efektif dan efisien.

Abstract

Lahirnya undang-undang tentang pengelolaan sampah sejatinya memperkuat konstitusionalitas aspek lingkungan hidup di Indonesia. Perintah undang-undang untuk membentuk peraturan daerah (provinsi) tentang pengelolaan sampah regional tidak dipenuhi oleh seluruh daerah provinsi di Indonesia, kondisi ini menujukkan terjadinya legislative omision. Artikel ini menguraikan aspek konstitusionalitas lingkungan hidup yang di dalamnya termasuk pula aspek pengelolaan sampah, serta perbandingannya dengan beberapa negara lain, dan memotret kondisi legislative omision dalam pengaturan pengelolaan sampah di provinsi se Indonesia. pendekatan yang digunakan adalah pendekatan perundang-undangan, pendekatan kasus, pendekatan konseptual, dimana bahan hukum yang diperoleh disajikan secara preskriptif. Penelitian ini menemukan 16 provinsi yang telah membentuk peraturan daerah tentang pengelolaan sampah sebagaimana perintah dari Undang-Undang tentang Pengelolaan Sampah, sementara 18 provinsi lainnya hingga saat ini belum membentuk peraturan daerah dimaksud. Obesitas peraturan perundang-undangan, pengaturan pengelolaan sampah yang diwujudkan dalam bentuk peraturan gubernur, masifnya pembentukan peraturan daerah kabupaten/kota tentang pengelolaan sampah, menjadi sebagian faktor yang memengaruhi  mayoritas provinsi yang tidak membentuk peraturan daerah provinsi tentang pengelolaan sampah.

Abstract

The study aims to analyze the judgment of judges in granting early marriage dispensation at the Gorontalo Religious Court. This research belongs to the type of normative legal research with a statutory approach and a case approach. The data analysis technique used in this research is using qualitative data analysis. The results of this study show that the considerations of judges are classified into two, namely legal considerations and considerations of community justice. The negative impact arising from marriage under the age of marriage dispensation is: Husband and wife who marry under the age of age are prone to divorce; In terms of reproductive health prone to death in children and mothers; There will be a to poor; There is child exploitation. Positive Impact on the establishment of early marriage dispensation is: Useful to continue the chain of offspring; Can maintain and maintain the genitals; It can make Muslims more responsible; The achievement of peace and tranquility between husband and wife; Marriage plays a role in helping to maintain people's lifestyle.

Abstract

The purpose of this study was to analyze the inheritance distribution system of the Tondano Javanese people in the village of Tondano Reksonegoro and the settlement of inheritance disputes that occurred through the Alternative Dispute Resolution (ADR) for the Tondano Javanese community in Reksonegoro village, Tibawa district, Gorontalo regency. The nature of this research is descriptive qualitative with a socio-legal approach method—data obtained through direct interviews with subjects or informants. The data analysis technique consists of 4 steps: data collection, data reduction, data entry, and conclusion drawing or verification. The division of inheritance with a will is practiced by theTondano Javanese people in Reksonegoro Village, Tibawa District because there is a high possibility of disputes between the heirs. The division of inheritance with a will is also based on the suitability of the following three things, namely personal experience, seeing the surroundings/surroundings, and messages from parents. Results analysis of property dispute resolution through Alternative Dispute Resolution (ADR) in the Tondano community in Reksonegoro village, namely consultation, negotiation, and mediation. The three forms are widely used sequentially according to stages. The reasons for resolving property disputes through the Alternative Dispute Resolution (ADR) route are (1) upholding the principles of Ampit Watu Esa Pelayas, (2) Cultivating the cultural value of deliberation for consensus, (3) Upholding the value of gotong royong, (4) Reluctance towards settlement through court institutions, (5) Maintaining the pam or the good name and honor of the family, and (6) Preventing disputes from getting bigger and too long.

Abstract

The purpose of this article is to find corrective material for regulating the procurement of goods and services in an emergency / pandemic. The research method used in this research is the normative research method by taking a statute approach and a case approach. The results of this study indicate that there are serious challenges in complying with laws and regulations related to handling the Covid-19 Pandemic in 2020. Where the BPK finding number is the tip of the iceberg phenomenon of irregularities that may be committed by local governments. Where most of the local governments are not equipped with adequate evidence of price reasonableness. Therefore, the price of goods must be based on adequate price reasonableness documents, but most of the appointed goods and services providers do not have/will not submit evidence of adequate price reasonableness. This raises suspicions about whether the high price disparity is really a real economic phenomenon or just a fabrication by individuals trying to take advantage of the situation. In addition, there is an obligation from the Internal Auditor to conduct an audit of price reasonableness, but it was not carried out. In addition, BPK as an external auditor was also unable to conduct a maximum inspection due to constraints with the Health protocol and online audit system. This makes the opportunity or potential irregularities in financial management large and even undetectable.

Abstract

This article discusses the responsibility of social media platform providers, such as Facebook, in managing and protecting usernames created by users, which are a crucial component of digital identity. With the increasing use of social media globally, misuse of usernames, such as identity theft or account impersonation, poses significant risks to users' reputation and privacy. This research highlights the importance of username protection as part of broader personal data protection, emphasizing the need for platforms to implement effective policies to prevent abuse. Regulations such as Indonesia's Personal Data Protection Law (UU PDP) and the General Data Protection Regulation (GDPR) in the European Union are examined to understand how platforms are required to protect user data, including usernames. The study uses a qualitative approach with literature review and policy analysis methods to analyze existing regulations, as well as interviews with data security experts to explore the challenges faced by platform providers in protecting user identities. The findings indicate that while existing policies and technologies are reasonably adequate, there are still many gaps that can be exploited for identity abuse. Therefore, the research proposes several strategies for social media platform providers to strengthen username protection, including enhancing verification systems, introducing advanced security technologies, and improving abuse reporting systems. These findings are expected to contribute to the ongoing conversation about data privacy and security in the digital age, as well as provide recommendations to protect users' digital identities on social media platforms.

Abstract

This study aims to examine the Implementation of E-Court during the COVID-19 Pandemic as a Support for the Contante Justitie Principle in the Religious Courts. This type of research is empirical legal research, which uses a qualitative approach method, with Primary Data sources obtained directly. The results showed that the implementation of the Electronic Justice System (E-Court) during the Covid-19 Pandemic at the Gorontalo Class 1A Religious Court was comprehensively in accordance with the principles of Contantia Justitia or simple, fast and low cost justice, because it had been implemented from the time of receipt and registration of cases to the reading of case decisions carried out electronically using online applications that had been officially developed by the Supreme Court such as e-Filling (case registration), e-Payment (case fee), e-Summons (Summons of Parties), e-Litigation (trial), e-Copy (Copy of Decision), and e-Sign (Signature), and supported by online communication channel applications such as zoom cloud meeting, google meet, email, and even telephone lines.

Abstract

This research seeks to examine the law enforcement approach addressing breaches of stay permits by foreign nationals (WNA) under the jurisdiction of the Class I TPI Gorontalo Immigration Office, as well as to identify the practical challenges encountered. This research primarily examines the coordination challenges across agencies in overseeing and prosecuting foreign nationals who breach visit visas, along with the obstacles faced by immigration agents in managing instances of stay permit abuse. This research employs an empirical legal methodology using a qualitative approach, supplemented by normative data. Data collection was conducted by observation, comprehensive interviews with immigration officers, and the recording of institutional data. The research was conducted in the Class I TPI Gorontalo Immigration Office due to the prevalence of visa abuse cases involving foreign nationals, particularly from Sri Lanka, Vietnam, and China. The study's findings reveal that breaches of stay permits by foreign nationals in Gorontalo predominantly arise from inadequate administrative oversight and a deficiency in both the quantity and expertise of personnel, particularly immigration investigators proficient in foreign languages and capable of executing their duties with professionalism. Furthermore, the cooperation across authorities like the National Police, the Indonesian National Armed Forces, the Ministry of Foreign Affairs, and local governments remains suboptimal, resulting in delayed discovery and management of infractions. Law enforcement via administrative means, including deportation and deterrent, has been implemented; nevertheless, it has proven insufficient without complementary preventative strategies, such as enhancing public legal knowledge and using information technology for oversight. Therefore, a reconfiguration of law enforcement strategies is essential, encompassing the enhancement of institutional capacity, the elevation of human resource quality, and intersectoral collaboration, enabling Indonesia to uphold immigration sovereignty equitably and responsibly in the context of globalization and transnational mobility.

Abstract

This study examines the application of the retroactive principle in the issuance of State Administrative Decisions (KTUN) by regional administrative officials amid digitalization in public services. The research aims to examine the legal basis of retroactive application within administrative law and to identify appropriate mechanisms to ensure its benefit for public administration and society. Using a normative juridical method with statutory and conceptual approaches, the research is supported by literature studies on legal documents and regulations. The findings indicate that, under Indonesian administrative law, the retroactive application of KTUN is legally permissible if it meets specific conditions outlined in the Law on Government Administration—primarily to prevent greater harm and/or to protect citizens’ rights. Retroactive KTUN may address discrepancies between the timing of decision issuance and actual administrative activities, especially in a digital governance environment. The study concludes that to ensure legal certainty and accountability, such application must be based on formal mechanisms, including the development of standard operating procedures (SOPs) and the issuance of regional head regulations as normative foundations. These measures are essential to institutionalize retroactive KTUN and ensure its use aligns with principles of legal certainty, public benefit, and good governance in regional government administration.
