Abstract

AbstractThis research is intended to study the process and implementation of mediation in the Malang City Religious Court. The subject of the debate from this research is what problems are faced by the judge in seeking peace towards the parties and what efforts are made by the judges in the Malang City Religious Court starting from the problems raised by research seeking research under several sub-examples namely : 1) What is the process of conducting mediation in the Malang City Religious Court? (2) What are the problems of the judge in conducting the mediation of divorce cases in the Malang City Religious Court without success? (3) Doing mediator judge efforts in conducting mediation in Malang City Religious Court?In accordance with the above title, this study is included in the category of field research (field research). While the nature of this research is descriptive-analytic, namely describing the discussion material coming from various sources for later analysis carefully in order to obtain results as a result of the study. The license used is juridical based on the applicable laws in Indonesia (positive law). In analyzing the data obtained using qualitative data analysis, after the data collected were analyzed using the deduction method, namely by using the process obtained from general truth.Based on observations during the Malang City Religious Court, in reconciling the parties to be reconciled until now it has been running omtimal because there are other problems such as, problems that need to be by the mediator Judge as for the number of mediators in the Malang Religious Court as many as 23 people and the number of cases approved by the panel of judges per day totaling 50 or more cases a day if one month reaches 1,500 cases then it is certainly difficult for the mediating judge to maximize fully mediated cases, and issues related to the negotiating parties first and are reconciled by their respective parents so the mediator is rather difficult to reconcile the two sides.Key Words: Mediation, Mediator, Role of Judges

Abstract

Compilation of Islamic Law, is discuss aspects of Islamic law in Indonesia. This discussion complex matter even though occupies an important position in life of the nation today. Formulation of the problem is how to regulate Islamic Law in the Compilation of Islamic Law in Indonesia and how the position of the Compilation of Islamic Law in Positive Law in Indonesia. The position of the research is to determine the arrangement of Islamic Law in the Compilation of Islamic Law and to determine the position of the Compilation of Islamic Law in Positive Law in Indonesia. This type of research is normative, using descriptive analysis of library reasearch, primary legal materials, secondary legal materials and tertiary legal materials. The legal analysis method is normative juridical. The result was success in compiling the book Compilation of Islamic Law as a guide for the Muslim community in Indonesia and a reference for judges in the Religious Courts. Islamic law is regulated in three books Compilation of Islamic Law which contains Marriage Law, Inheritance Law and Endowment Law. The position of the Compilation of Islamic Law is recognized as one of the Positive Laws applicable in Indonesia based on Presidential Instruction No. 1 of 1991.

Abstract

AbstrackAs human beings, human beings cannot be separated from social life, one of which is in zakat activities. Zakat in Islam is the right of the poor who are found in some rich people's wealth. Along with the times, the modern economy is also growing. The emergence of these bond transaction instincts many fiqh scholars still debate about zakat which must be issued for bond transactions. The purpose of this study is to describe the view of Islamic law regarding the zakat of bonds and to describe the thoughts of Yusuf Qardhawi about zakat on bonds. As for getting maximum results, the type of research used is library research, while the method used is descriptive and comparative. In this study, Yusuf Qardhawi assumed that stocks and bonds are analogous to commercial assets, which are potential to develop, so from that the provisions of zakat law are equated with commercial assets without differentiating between stocks and bonds in the enforcement. The provisions of the Nisab are 84 grams of gold or 588 grams of silver from the capital and the proceeds, or added with other assets and the amount of zakat that must be issued as much as 2.5%.  Kata Kunci: Zakat Obligasi, Obligasi Menurut Hukum Islam.

Abstract

AbstractBackground :marriage law number 16 year 2019 is the end result of the long dialogue of the Indonesia people regarding marriage law, wich has been carried out from 1950 to 2019 the purpose of the ratification of law number 16 of 2019 on marriages is to make social changes and foster marital behavior in the community,wich at that time tended to harm women and children, because of the number of underage marriages, ratification of law number 16 year 2019 concerning marriage can not be separated from law number 1 of 1974 concerning marriage in which the law is considered by a group of citizens as a law that discriminates against women because in article 300 the civil code states that children namely those aged 21 years, in the law childrens welfare law also states that children are those who are 18 years old, for this reason a group of citizens submitted a request for revision to the constitusional court (MK) so that the constitusional court gave an order to the House Of Representatives (DPR) to immediately revise the old marriage law to create a healthy marriage physically and spriritually.Keywords: Background, yuridicial marriage, marriage law,discrimination

Abstract

The determination used by the customary community of the Binongko sub-district of Umbeda-Umbeda language, Wakatobi district, Southeast Sulawesi province in determining the temonea (dowry), and the Islamic law perspective regarding the determination of the temonea (dowry) in the marriage of the indigenous people of the Umbeda-Umbeda language Binongko sub-district, Wakatobi district, Southeast Sulawesi province, the background of this problem is the difference in determining the amount of dowry in the marriage of the people of the Binongko sub-district of Umbeda-Umbeda language. The approach used in this research is descriptive qualitative research and uses anthropological and sociological approaches, in collecting data the researcher uses interview and observation techniques, and to check the validity of the data the researcher uses data triangulation and source triangulation from the results of the study the researchers found that The practice of dowry in the traditional marriage of the Binongko people of Umbea-umbeda language is by looking at the status of a prospective bride

Abstract

This study aims to determine the influence of the organization of youth mosque activities in improving Islamic character for students. This research was conducted at the Islamic mosque organization Ainul Yaqin starting from April to June 2019. The research was aimed at students who took part in the activities of the youth mosque organization with a total population of 60 students and then th e entire sample was taken from the population. The data obtained from questionnaire data, prerequisite analysis techniques using two prerequisites with normality tests and linearity tests. While the hypothesis testing technique uses simple regression. The results of the study show that there is no relationship between the activities of the mosque's youth organizations in improving Islamic character for students. With the calculation of the significance value of 0.711> 0.5 and Tcount of 0.372 <T table 2.00172.

Abstract

Abstract

This research describes an effort to improve the quality of teachers in the process of improving the memorization of the Qur'an. This research will also answer two questions raised by researchers, as follows: (1) How to improve the ability of teachers to improve the memorization of Al-Qur'an class X students. (2) What obstacles are often find in an effort to improve the memorization of Al-Qur'an grade X students. This research uses descriptive qualitative. The data search in this study used three methods, observation, unstructured interviews, and documentation. The results of this research indicate that: (1) the teacher adopts the habit of each class time, the teacher applies the talaqqi, takrir, and muraja'ah methods, the teacher implements a memorization quality improvement system with the One Sitting Juz method. The teacher also gives appreciation to students who do not reach the target, and the teacher always provides motivation that is almost acceptable with learning tahfidz. (2) Obstacles to learning drowsiness, some student readings are still not in accordance with the makharijul letters and the rules of recitation, physic healts by one student because of stress on memorization targets, and a residential environment that is less representative or helps students memorize the Koran.

Abstract

At the beginning of 2020, there was an uproar with the emergence of the COVID-19pandemic which spread to almost all corners of the world. This outbreak originated inWuhan, China. Due to the Covid-19 outbreak, Indonesia cannot carry out normallearning or learning as usual, it is required to maintain social distance and followhealth protocols. With the Covid-19 outbreak, learning cannot be maximized, with theholding of combined learning (Blended Learning), the learning process can be better.Blended learning is a combination of online learning and face-to-face learning. In thisblended learning, researchers conducted research in SMA Negeri 5 Malang by usingdescriptive qualitative research method with the type of case study research. Theresults showed that the implementation of blended learning in Islamic religiouseducation subjects during the covid-19 pandemic at SMA Negeri 5 Malang, whichincluded 3 aspects, namely planning which included designing learning programtargets, planning learning support offices and foundation, getting ready learningtimetables, and mingling. Then the execution of mixed learning incorporates onlinelearning and face-to-face learning and finally evaluation of blended learning, as wellas inhibiting and supporting factors in the implementation of blended learning.

Abstract

The development of science and technology today leaves several issues that need attention. It is undeniable that modern society has succeeded in developing science and technology to become an alternative to solving problems of daily life, but in other conditions, advanced science and technology is less able to cultivate noble morality. In overcoming this problem, Smp Islam Al-ma'arif 01 singosari carries out the process of internalizing spiritual values the formation of a student's personality through religious activities. This study uses a qualitative phenomenology-based approach in case study type studies. The results of this study show that the internalization process carried out through religious activities makes good changes to develop mental values students. This is supported by the school's support factors, such as quality familiarity. while the obstacles in the process of internalizing spiritual values are the diverse backgrounds of students. Kata Kunci: Internalisation, Spiritual Values, Character Building
