Abstract

Kegiatan pengabdian kepada masyarakat ini bertujuan untuk meningkatkan pengetahuan manajemen risiko keuangan dan sistem pengendalian internal pada Koperasi Merah Putih di Desa Pasar Pedati, Kecamatan Pondok Kelapa, Kabupaten Bengkulu Tengah. Permasalahan utama yang dihadapi koperasi berupa lemahnya sistem administrasi serta tingginya tingkat kredit macet. Melalui pendekatan partisipatif, kegiatan ini dilaksanakan dalam bentuk pelatihan interaktif, pendampingan penyusunan Standard Operating Procedure (SOP) keuangan, serta sosialisasi prinsip hukum koperasi dan tata kelola keuangan yang akuntabel. Dalam tahapan evaluasi proses, tim pengabdi tidak hanya menyampaikan materi, tetapi juga  mengamati respons dan partisipasi pengurus serta anggota koperasi. Peserta terlihat aktif berdiskusi, antusias, dan mampu memahami materi dengan baik. Pada tahapan evaluasi hasil, kegiatan ini terbukti meningkatkan pemahaman peserta terhadap pentingnya pencatatan keuangan yang tertib, prinsip kehati-hatian, serta urgensi pengendalian internal dalam mencegah kesalahan pengelolaan dana. Meskipun tanpa praktik langsung, peserta merasakan adanya wawasan baru dan mengajukan kebutuhan pelatihan lanjutan untuk implementasi SOP keuangan, pencatatan transaksi, dan mekanisme double check. Pada tahapan evaluasi dampak menunjukkan meningkatnya kesadaran kolektif pengurus akan perlunya pembenahan tata kelola koperasi. Pengurus juga menunjukkan komitmen melaksanakan kembali Rapat Anggota Tahunan (RAT) serta merevitalisasi fungsi koperasi sebagai lembaga ekonomi rakyat yang sehat dan transparan. Program ini tidak hanya memperkuat kelembagaan, tetapi juga membangun budaya akuntabilitas dan kesadaran hukum dalam pengelolaan koperasi. Dengan demikian, kegiatan ini berpotensi menjadi model pemberdayaan hukum koperasi yang dapat direplikasi di wilayah lain sebagai strategi penguatan ekonomi masyarakat berbasis prinsip keadilan sosial.

Abstract

This study aims to analyze the position and limits of the attribution authority of the Environment and Forestry Service (DLHK) of Bengkulu Province in protecting Rafflesia arnoldii as an endemic flora, and to assess the effectiveness of the implementation of legal protection instruments in addressing the threat of habitat destruction and illegal exploitation. The research method used is normative juridical with a legislative and conceptual approach, supported by limited empirical data through literature study. The results show that DLHK has strong and independent attribution authority based on the Law on Conservation of Biological Natural Resources and the Law on Regional Government, with the scope of regulatory, supervisory, law enforcement, and coordination functions. However, the implementation of legal protection for Rafflesia arnoldii has not been optimal. This is due to the high level of habitat destruction due to human activities, the persistence of illegal exploitation, limited institutional resources, and weak supervision and law enforcement. In addition, low public awareness also exacerbates this condition. Therefore, more comprehensive efforts are needed through strengthening institutional capacity, improving law enforcement, sustainable habitat protection, and community involvement in conservation activities. Thus, it is hoped that protection of Rafflesia arnoldii can be more effective and sustainable.

Abstract

This study examines the juridical analysis of the influence of the Kyoto Protocol on efforts to tackle global warming. Global warming is defined as an increase in the average temperature of the earth’s surface due to rising greenhouse gas emissions caused by human activities such as fossil fuel combustion, deforestation, and agricultural activities. The Kyoto Protocol, as an international legal instrument under the United Nations Framework Convention on Climate Change (UNFCCC), aims to stabilize greenhouse gas concentrations through structured and measurable regulatory mechanisms. It establishes quantitative emission reduction targets, particularly for developed countries, and introduces flexible mechanisms such as Emission Trading, Joint Implementation, and Clean Development Mechanism. However, its effectiveness remains limited due to unequal obligations between developed and developing countries, lack of binding enforcement mechanisms, and the absence of major emitting countries in its implementation. Therefore, although the Kyoto Protocol represents an important milestone in international environmental law, its impact on reducing global warming is still considered less effective.

Abstract

This study explores the dynamics in the international maritime law system related to the handling of security cases in the Malacca Strait. Guides the reader through a journey from a general view to a focus on the core issues and opportunities in the international maritime law system related to the handling of security cases in the Malacca Strait. The pyramid begins with a broad context of what the problems are in the Malacca Strait, highlighting the importance of an effective response from the maritime law system of each country around the strait. This understanding opens a window into the complexity of the challenges faced by the authorities. The pyramid then tapers to how the role of countries around the strait to maintain the security of the Malacca Strait. An in-depth analysis of existing laws highlights the imprecise definition, a major limitation in dealing with the increasingly complex problems of the Malacca Strait. This study serves as a guide to understanding, identifying, and responding to issues and opportunities in the international maritime law system related to the security of the Malacca Strait. By detailing the obstacles and providing concrete solutions, this study is expected to be the basis for more adaptive and effective legal reform in an era that continues to evolve.

Abstract

International agreements are one of the sources of international law that have an important role in regulating relations between countries in the international community. International treaties not only serve as a binding legal basis for the countries to which they are parties, but also serve as an instrument to create legal certainty, stability, and international cooperation. This study aims to analyze the position of international agreements as a source of international law, the process of their formation, their binding force, and their implementation in the practice of relations between countries. The research method used is a qualitative approach with library research, reviewing literature in the form of books, scientific journals, international legal documents, and the 1969 Vienna Convention on the Law of Treaties. The results of the study show that international treaties have a strategic position in the international legal system as stipulated in Article 38 of the Statute of the International Court. The establishment of international agreements is carried out through the stages of negotiation, signing, ratification, and enactment, which ensure the legitimacy and approval of the parties to the agreement. The binding power of international treaties is based on the principle of pacta sunt servanda, which affirms that every agreement must be implemented in good faith by the parties. The implementation of international agreements in the practice of relations between countries is influenced by national legal systems, political commitments, institutional capacity, and economic and social dynamics. This research confirms that international agreements play a key role as a key instrument in maintaining state compliance, preventing conflicts, and facilitating sustainable global cooperation. Abstract

The limited number of studies on the synchronization of policies for protecting traditional fishers within the framework of the blue economy indicates the need for studies that examine the interrelationship among regulations, ecosystem degradation, economic inequality, and the sustainability of traditional fishers’ livelihoods. This study aimed to analyze the effectiveness of fisher protection regulations and explore sustainability-based economic empowerment strategies in the coastal areas of Bengkulu. This study used a descriptive qualitative approach, with the research location in the coastal areas of Bengkulu selected using purposive sampling. Data were collected through in-depth observation of conflicts over fishing area claims between trawl fishers and traditional fishers in Seluma Regency, Bengkulu Province, and were then analyzed using thematic analysis. The results showed that the dominant factors influencing the conflict were weak enforcement of sanctions against the use of trawl fishing gear and the absence of participatory supervision by the competent authorities, which prompted traditional fishers to take self-help actions to protect their fishing areas. This finding reinforces the theory of legal pluralism, which highlights the gap between formal state law and the practice of living law carried out by communities in the field. Thus, integrated supervision of coastal areas between the government and fishing communities is the key to reducing conflict and creating legal certainty for traditional fishers. The implications of this study include enriching the literature on maritime legal sociology in Bengkulu and providing practical recommendations for the Regional Government of Seluma Regency to strengthen fishing area zoning through regional regulations that accommodate the rights of traditional fishers.

Abstract

Illegal fishing in the North Natuna Sea after 2020 remains a serious threat to Indonesia’s maritime sovereignty and the sustainability of national marine resources. This area has a strategic position, is rich in fishery resources, and directly borders several countries, making it vulnerable to illegal fishing activities by foreign vessels. This study aims to analyze the effectiveness of law enforcement against illegal fishing in the North Natuna Sea after 2020, identify the obstacles encountered, and formulate strategies for strengthening maritime law enforcement policies. This study used a normative juridical method with statutory and case approaches. Data were obtained through a literature review of relevant regulations, official reports, and scientific literature. The results showed that the Indonesian government has strengthened law enforcement efforts through integrated maritime patrols, interagency cooperation, the implementation of stricter sanctions, and the reinforcement of the roles of authorities such as the Indonesian Navy (TNI AL) and the Ministry of Marine Affairs and Fisheries. However, the effectiveness of law enforcement still faces obstacles in the form of limited facilities and infrastructure, the vastness of the surveillance area, and international political pressure. These findings confirm that a diplomatic approach remains necessary to maintain maritime sovereignty without triggering open conflict. Thus, law enforcement against illegal fishing in the North Natuna Sea requires a comprehensive and sustainable strategy through regulatory strengthening, capacity building for law enforcement officials, and the optimization of regional and international cooperation. This study contributes to the development of more effective maritime policies for addressing illegal fishing in Indonesian waters.

Abstract

Marine pollution caused by human activities has led to extensive damage to maritime ecosystems, thus requiring comprehensive state responsibility to protect them. This research is urgent to identify the gap between marine protection legal regulations and their practical implementation. The method used is normative juridical research with a descriptive-analytical approach to related legislation. The results show that state responsibility is manifested through preventive measures, law enforcement, and environmental restoration. However, this implementation is hindered by weak supervision, overlapping authorities between central and regional governments, and minimal public participation. Therefore, a transformation of the state responsibility model is required through inter-agency policy integration, strengthening technology-based supervision, implementing strict liability principles, and involving coastal communities to achieve sustainable marine conservation.
