Abstract

This research aims to analyze the criminal liability of perpetrators of arson and destruction of public facilities during demonstrations in Indonesia, as well as to examine the enforcement of criminal law against these crimes based on applicable positive law. However, in practice, demonstrations are often accompanied by anarchic actions in the form of arson and destruction of public facilities that harm the public interest and disrupt public order. The urgency of this research lies in the need to ensure that criminal liability and criminal law enforcement for acts of arson and destruction of public facilities are carried out individually and proportionally in accordance with the provisions of the old Criminal Code and the National Criminal Code, in order to prevent the general application of criminal law to participants in demonstrations. The results of the first study indicate that criminal liability for perpetrators of arson and destruction of public facilities during demonstrations has basically been regulated in the old Criminal Code and then updated in the National Criminal Code, especially regarding the crimes of arson and destruction of property. While the second enforcement of criminal law against these acts requires proportional and individual application, even though it is carried out in the context of collective mass action.

Abstract

The juridical issues concern the limits of military criminal jurisdiction, patterns of sentencing for soldiers, command responsibility, and their implications for the principles of civilian supremacy and equality before the law. This study aims to analyze the implications and provide a comparative assessment of the expansion of the Indonesian National Armed Forces’ (TNI) authority following Law Number 3 of 2025 concerning the Amendment to Law Number 34 of 2004, particularly in relation to the addition of civilian positions that may be occupied by active-duty soldiers and the expansion of Military Operations Other Than War (OMSP). This research employs a normative juridical method with statutory, conceptual, and comparative approaches, using data sources in the form of legislation as well as national and international legal literature, which are analyzed qualitatively with deductive reasoning in drawing conclusions. The results of the study indicate that, first, the criminal law implications of the post-expansion of the TNI’s authority and roles give rise to the potential emergence of official offenses (delicta propria), particularly in the implementation of OMSP and the assignment of active-duty soldiers to civilian positions, which may generate ambiguity in judicial forums and criminal accountability; and second, a comparison with the military sentencing systems in the Netherlands and the United States demonstrates the importance of clear classification of offenses, a clearer separation between military jurisdiction and civilian courts, and the strengthening of due process of law, as well as effective civilian oversight to ensure the professionalism and legal certainty of the TNI.

Abstract

Drug abuse constitutes a form of criminal offense with distinct and complex characteristics, as in many cases the perpetrators are not merely offenders but also individuals suffering from dependence on addictive substances. This condition places drug abusers in a dilemmatic position, since on the one hand they violate criminal law provisions, while on the other hand they require special treatment in the form of recovery and care. Therefore, the application of conventional punitive approaches that emphasize imprisonment is often considered insufficient to comprehensively address drug-related problems. Such approaches may even generate further issues, including prison overcrowding, the failure to achieve rehabilitation objectives, and the low effectiveness of behavioral reform among offenders. In this context, an alternative approach that prioritizes humanitarian values, recovery, and social benefit is required, one of which is the application of the restorative justice concept. This approach emphasizes the restoration of the offender’s condition without disregarding the interests of society and the state. This research aims to examine and analyze the concept of restorative justice in the handling of drug-related criminal offenses, to review its legal regulation within the Indonesian positive legal system, and to assess its relevance in light of fundamental principles of criminal law, particularly justice, utility, legal certainty, and criminal liability. The research employs a normative legal research method using statutory and conceptual approaches, conducted through library research on primary, secondary, and tertiary legal materials related to drug offenses and restorative justice. The findings indicate that the application of restorative justice in drug-related crimes may be implemented in a limited and selective manner, particularly for offenders classified as drug abusers or addicts who are not involved in illicit drug trafficking networks. This approach prioritizes medical and social rehabilitation as forms of recovery, thereby offering a more balanced, just, and effective alternative to conventional punishment.

Abstract

Artikel ini menganalisis penegakan hukum terhadap tindak pidana penganiayaan yang menyebabkan kematian anggota pencak silat di wilayah hukum Polres Madiun serta menilai efektivitasnya dalam menurunkan tindak pidana serupa. Kajian ini menggunakan pendekatan hukum empiris dengan orientasi sosio-legal. Data diperoleh melalui studi kepustakaan, dokumentasi perkara, observasi, dan wawancara dengan aparat kepolisian, pengurus perguruan pencak silat, bidang advokasi, serta tokoh masyarakat. Hasil penelitian menunjukkan bahwa penegakan hukum telah berjalan melalui penerimaan laporan, penyelidikan, penyidikan, pengumpulan alat bukti, penetapan tersangka, dan pelimpahan perkara sesuai kerangka hukum acara pidana. Akan tetapi, efektivitasnya belum optimal karena masih terdapat kendala pembuktian, kesulitan menentukan pelaku utama dalam kekerasan kolektif, tekanan solidaritas kelompok, fanatisme, provokasi media sosial, dan budaya hukum masyarakat yang belum sepenuhnya menolak kekerasan. Data perkara 2010-2025 memperlihatkan pola fluktuatif dengan kecenderungan meningkat, termasuk munculnya perkara fatal pada beberapa tahun tertentu. Temuan ini menegaskan bahwa keberhasilan penegakan hukum tidak cukup ditentukan oleh norma pidana, tetapi juga oleh keterpaduan substansi hukum, struktur penegakan hukum, dan budaya hukum masyarakat. Pendekatan represif perlu diperkuat dengan pencegahan yang konsisten melalui sinergi kepolisian, perguruan pencak silat, pemerintah daerah, dan masyarakat.

Abstract

The rapid development of information technology has transformed conventional gambling into online gambling, which is characterized by its borderless nature, anonymity, and complex digital infrastructure. This phenomenon presents significant challenges for criminal law enforcement, particularly within the framework of cybercrime. This research aims to analyze and compare the regulation of online gambling offenses in Indonesia and Brunei Darussalam, and to identify constructive legal reforms that may be adopted in Indonesia. The study employs a normative juridical method using statutory, comparative, and conceptual approaches. The findings indicate that Indonesia adopts a total prohibition model, regulating online gambling through the new Penal Code and the Electronic Information and Transactions Law. Despite fulfilling the principle of legality, enforcement faces obstacles related to digital evidence, cross-border servers, encryption systems, and uneven targeting of offenders. Brunei Darussalam also applies a total prohibition approach but within a dual legal system integrating the Common Gaming Houses Act and the Syariah Penal Code Order 2013. The comparative analysis demonstrates that regulatory effectiveness depends not only on the severity of sanctions but also on normative consistency, institutional integration, and preventive strategies. This study concludes that Indonesia requires harmonization of legal provisions, proportional sentencing differentiation, and stronger institutional coordination to effectively combat online gambling as a form of cybercrime.

Abstract

The researcher looks at the presence of state funds under the supervision of State-Owned Enterprises, which clearly still generates different interpretations of the matter of state financial situation. The researcher became interested in doing a legal study to assist in attesting elements of state financial losses in criminal activities of corruption inside State-Owned Enterprises. This paper aims to investigate and comprehend the presence of state finances in State-Owned Enterprises to support the attestation of aspects of state financial losses in State-Owned Enterprises in addressing criminal actions of corruption. Analyzing the legislative and case approaches helps one to adopt a normative juridical writing style. Since State-Owned Enterprises officials with strategic duties and authority and a significant part in the running of the national economy commit corruption offenses, they constitute a type of corruption as an unusual crime. Under the application of the unique nature of Lex Specialis of the Corruption Eradication Law, which follows the flow of state finances wherever the money is located, efforts aiming at strengthening attestation of state financial losses under the management of State-Owned Enterprises declare losses resulting from unlawful acts or fraud as state losses.

Abstract

Perkembangan globalisasi saat ini mempengaruhi perkembangan ilmu pengetahuan dan teknologi, oleh karena itu sarana komunikasi dengan masyarakat juga mengalami perkembangan. Jaminan ketertiban dan keteraturan dalampenggunaan media sosial, pemerintah merespon dengan mengeluarkan Undang-Undang Nomor 19 Tahun 2016 Tentang Perubahan Atas Undang- Undang Nomor 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik. Bahwa upaya perumusan peraturan di masa yang akan datang terkait tindak pidana pencemaran nama baik harus dilakukan. Pentingnya pengaturan penegasan batasan, kualifikasi yuridis serta mengenai apa yang dimaksud tindak pidana pencemaran baik dan perbuatan apa saja yang menjadi alasan pembenar suatu tindak pidana pencemaran nama baik,maka diperlukan batas-batas yang jelas terhadap konsep demi kepentingan umum. Ide formulasi pembaharuan tindak pidana pencemaran baik di masa yang akan datang, baik di RUU KUHP maupun Undang-Undang Khusus di luar KUHP diharapkan tidak lagi mencederai hak-hak masyarakat
