Abstract

The prosecution service, as dominus litis, plays a pivotal role in ensuring the balance between the principle of legality and the pursuit of substantive justice within the criminal justice system. The enactment of the 2023 National Criminal Code, which formally recognizes the concept of living law, represents a significant paradigm shift by requiring criminal law enforcement to respond to social values and local community norms rather than relying solely on a rigid textual framework. This study addresses two central research questions: first, how the Criminal Procedure Code structurally constrains prosecutorial authority at the investigation and pre-prosecution stages; and second, how the formal recognition of living law generates implementation challenges, including normative conflict, discriminatory application, and legal uncertainty. Using a normative juridical research method with statutory, conceptual, and comparative approaches, this study finds a fundamental paradox within the prosecutorial function. Although prosecutors possess formal legitimacy as controllers of criminal cases, they lack adequate legal instruments to exercise this authority substantively. The absence of clear operational standards for applying living law risks undermining legal certainty and weakening the principle of equality before the law. Comparative analysis of prosecutorial practices in Canada, the Netherlands, and Germany demonstrates alternative models that integrate restorative justice, legal pluralism, and prosecutorial supervision more effectively. This study concludes that strengthening the prosecutorial role requires not merely procedural reform of the Criminal Procedure Code, but also ethical reinforcement, professional capacity building, and judicial verification mechanisms to ensure alignment with constitution, and universal human rights principles.

Abstract

This research aims to analyze the criminal liability of perpetrators of arson and destruction of public facilities during demonstrations in Indonesia, as well as to examine the enforcement of criminal law against these crimes based on applicable positive law. However, in practice, demonstrations are often accompanied by anarchic actions in the form of arson and destruction of public facilities that harm the public interest and disrupt public order. The urgency of this research lies in the need to ensure that criminal liability and criminal law enforcement for acts of arson and destruction of public facilities are carried out individually and proportionally in accordance with the provisions of the old Criminal Code and the National Criminal Code, in order to prevent the general application of criminal law to participants in demonstrations. The results of the first study indicate that criminal liability for perpetrators of arson and destruction of public facilities during demonstrations has basically been regulated in the old Criminal Code and then updated in the National Criminal Code, especially regarding the crimes of arson and destruction of property. While the second enforcement of criminal law against these acts requires proportional and individual application, even though it is carried out in the context of collective mass action.

Abstract

The juridical issues concern the limits of military criminal jurisdiction, patterns of sentencing for soldiers, command responsibility, and their implications for the principles of civilian supremacy and equality before the law. This study aims to analyze the implications and provide a comparative assessment of the expansion of the Indonesian National Armed Forces’ (TNI) authority following Law Number 3 of 2025 concerning the Amendment to Law Number 34 of 2004, particularly in relation to the addition of civilian positions that may be occupied by active-duty soldiers and the expansion of Military Operations Other Than War (OMSP). This research employs a normative juridical method with statutory, conceptual, and comparative approaches, using data sources in the form of legislation as well as national and international legal literature, which are analyzed qualitatively with deductive reasoning in drawing conclusions. The results of the study indicate that, first, the criminal law implications of the post-expansion of the TNI’s authority and roles give rise to the potential emergence of official offenses (delicta propria), particularly in the implementation of OMSP and the assignment of active-duty soldiers to civilian positions, which may generate ambiguity in judicial forums and criminal accountability; and second, a comparison with the military sentencing systems in the Netherlands and the United States demonstrates the importance of clear classification of offenses, a clearer separation between military jurisdiction and civilian courts, and the strengthening of due process of law, as well as effective civilian oversight to ensure the professionalism and legal certainty of the TNI.

Abstract

Drug abuse constitutes a form of criminal offense with distinct and complex characteristics, as in many cases the perpetrators are not merely offenders but also individuals suffering from dependence on addictive substances. This condition places drug abusers in a dilemmatic position, since on the one hand they violate criminal law provisions, while on the other hand they require special treatment in the form of recovery and care. Therefore, the application of conventional punitive approaches that emphasize imprisonment is often considered insufficient to comprehensively address drug-related problems. Such approaches may even generate further issues, including prison overcrowding, the failure to achieve rehabilitation objectives, and the low effectiveness of behavioral reform among offenders. In this context, an alternative approach that prioritizes humanitarian values, recovery, and social benefit is required, one of which is the application of the restorative justice concept. This approach emphasizes the restoration of the offender’s condition without disregarding the interests of society and the state. This research aims to examine and analyze the concept of restorative justice in the handling of drug-related criminal offenses, to review its legal regulation within the Indonesian positive legal system, and to assess its relevance in light of fundamental principles of criminal law, particularly justice, utility, legal certainty, and criminal liability. The research employs a normative legal research method using statutory and conceptual approaches, conducted through library research on primary, secondary, and tertiary legal materials related to drug offenses and restorative justice. The findings indicate that the application of restorative justice in drug-related crimes may be implemented in a limited and selective manner, particularly for offenders classified as drug abusers or addicts who are not involved in illicit drug trafficking networks. This approach prioritizes medical and social rehabilitation as forms of recovery, thereby offering a more balanced, just, and effective alternative to conventional punishment.
