Abstract

Law enforcement against narcotics crime has been carried out by law enforcement officers and has received a judge's decision in a court hearing. In the Supreme Court Circular Letter Number 3 of 2011 concerning the Placement of Narcotics Abuse in the Institute of Medical Rehabilitation and Social Rehabilitation, every narcotics addict and victim of narcotics abuse must undergo medical rehabilitation and social rehabilitation.The purpose of this thesis is: First, to find out the implementation of the Supreme Court Circular Letter Number 3 of 2011 concerning the placement of narcotics abuse in medical rehabilitation and social rehabilitation institutions in the Pekanbaru District Court. Second, to find out the inhibiting factors for the implementation of the Supreme Court Circular Letter Number 3 of 2011 concerning the placement of narcotics abuse in medical rehabilitation and social rehabilitation institutions in the Pekanbaru District Court.This type of research can be classified as a type of sociological legal research, because in this study the authors directly conduct research at the location or places that are examined to provide a complete and clear picture of the problem under study. This research was conducted at the Pekanbaru District Court, while the population and sample were all sections related to this research, the data sources used included primary data, secondary data and tertiary data, data collection techniques, namely interviews and literature studies.From the results of the research and discussion it can be concluded that, First, the Implementation of the Supreme Court Circular Letter Number 3 of 2011 in the Pekanbaru District Court has not been going well and maximally. Second, Obstacles in the Implementation of the Supreme Court Circular Letter Number 3 of 2011 in the Pekanbaru District Court, namely that doctors have not been checked or delayed for narcotics abusers before trial in court, the second is budgetary problems, and thirdly the lack of cooperation with other Pekanbaru agencies in providing a place that is feasible in carrying out rehabilitation because so far in Pekanbaru City the place to do rehabilitation is done at the Tampan Mental Hospital.Keywords: Narcotics – Abuser – Implementation – Rehabilitation.

Abstract

One of the state institutions supporting bodies in the Indonesian constitutional structure system is the Corruption Eradication Commission, hereinafter abbreviated as the KPK, the presence of the Corruption Eradication Commission (KPK) To carry out the eradication of corruption, the corruption eradication commission requires the support of professional, high integrity, moral and human resources. responsible and consistent in carrying out their duties, powers and obligations in accordance with the provisions of laws and regulations. However, on July 24, 2020, Government Regulation Number 41 of 2020 concerning the Transfer of Corruption Eradication Commission Employees to State Civil Servants was enacted. This regulation came out following the issuance of Law No. 19 of 2019 concerning the Corruption Eradication Commission, but this change in the status of KPK employees has reaped pros and cons in the public because many think that this status change will interfere with the independence and performance of the KPK, because the change in the status of KPK employees to State Civil Apparatus (ASN)This research uses a typology of normative legal research or what is also called doctrinal legal research, which deals more specifically with legal principles. In this study the authors use descriptive research characteristics, because the authors describe the Regulatory Structuring of Independent State Institutions in the Structure of the Indonesian State Administration System.The results of the research conducted by the author is that this status will interfere with the independence and performance of the KPK, because the transfer of the status of KPK employees to the State Civil Apparatus (ASN) certainly makes the KPK also subject to the regulations of the State Civil Apparatus. The change of status to ASN also affects the recruitment of employees, including competency enhancement which cannot be done alone and specifically the provisions of Article 9 paragraph (1) and paragraph (2) of the PP are related to salary and benefits. Abstract

The development of Computer Technology, telecommunication, andinformation has been running in such a way that at this time has been very muchdifferent from previous years. The increasing growth of business activities in thetelecommunication sector makes the government need to do structuring andcontrolling for the realization of postal and telecommunication services thatquality, efficient and positive impact for the community. Based on Article 1 point44 of Pekanbaru City Regulation No. 6 of 2015 on the Management andArrangement of the Telecommunication Tower Operation. Based on theobservations, the authors found several cafes that do not have permission. Basedon the above background, the authors are interested to examine this issue with thetitle "Investigation Against Criminal Violation of Regional Regulation PekanbaruCity No. 6 of 2015 About Structuring and Management of TelecommunicationTower Operation in terms of cafe who do not have permission."The problem of this research are: First, how is the implementation ofcriminal investigation on internet cafe business which is not licensed based on theRegional Regulation of Pekanbaru Number 6 Year 2015 on Setup andManagement of Telecommunication Tower Operation in Pekanbaru City? Second,how is the criminal liability for internet cafe that does not have permission basedon Pekanbaru Regulation No. 6 of 2015 on Setup and Management ofTelecommunication Tower Operation? Abstract

Handling the Poor is the responsibility of the state in guaranteeing human rights in an effort to improve social welfare in Indonesia. This study aims to examine the problem of handling the poor who are made by the state in this case the government based on Law No. 13 of 2011 concerning Management of the Poor.The research method used in this thesis is normative legal research or also known as library research, namely research conducted with a normative juridical approach through the study of literature as secondary data. This study uses qualitative data analysis and produces descriptive data.The results of the study, first concluded that the regulation of state responsibility for the handling of the Poor in Law number 13 of 2011 does not guarantee human rights, because there has not been a fair and equitable social welfare condition. Second, the ideal form of regulation regarding the handling of the poor in Indonesia with the problem of poor people is dynamic and complex. Requires policies and strategies that are flexible, sustainable and based on human rights, so that the achievement of Social Welfare for the Poor.The author's suggestion, is the first need to be made changes to the Law 13 of 2011 concerning the Management of the Poor on the basis of social welfare development, social change, and rights-based. And it is hoped that going forward in the strategy of handling the Poor, it is not only focused on help, but must be accompanied by empowerment. The availability of an integrated database to be the basis for Handling the Poor so that it is right on target. Second, Requires a gradual and planned handling and evaluation and overall oversight because it is not easy to complete in a short time. Abstract

Grant fund corruption can occur because of the abuse of power by the authorities. The number of cases of corruption in the absorption of the grant spending APBD that occurred in Bengkalis Regency is quite high. If you look at the criminal cases of corruption, especially in the irregularities in the absorption of the APBD, grant spending committed by unscrupulous members of the DPRD actually involves many parties. The money received was intended for the defendant to fight for an additional budgetary amount included in the grant funds in the Bengkalis Regency APBD. However, in the process of asking for accountability of perpetrators of criminal acts of corruption, especially in irregularities in the absorption of the APBD, grant expenditures are not carried out thoroughly.This type of research can be classified in the type of sociological legal research (empirical), because in this study the author directly conducted research at the location or place being studied in order to provide a complete and clear picture of the problem under study. This research was conducted in the legal area of Bengkalis Regency. The data sources used are primary data and secondary data. Data collection techniques in this study were interviews and literature review.The conclusions that can be obtained from the results of the research are First, the criminal responsibility of the perpetrators of Corruption in the Absorption of APBD Budget on the Bengkalis Regency grant expenditure (Study of Decision No.4 / Pid.Sus.TPK / 2017 / PN.PBR) involves many parties. The party held accountable is only one perpetrator. However, in the process of asking for accountability of perpetrators of criminal acts of corruption, especially in irregularities in the absorption of the APBD, grant expenditures are not carried out thoroughly. Second, Constraints in holding criminal accountability for the perpetrators of Corruption in the Absorption of APBD Budget in Bengkalis Regency grant expenditures related to the results of assets from criminal acts committed are very difficult for its flow to be traced. Abstract

Trafficking of human organs is one of the most rapidly evolving crimes in Indonesia. This crime is for the purpose of organ transplant effort. Transplantation is a noble undertaking where a donor gives a part of his body or his organs to help patients who have malfunction of certain organs. In Indonesia the criminal act of trafficking human organs by regulation. While the criminal acts of trafficking of human organs are extraordinary crimes that should be regulated more specifically in legislation such as laws on the trade of human organs. Based on this understanding, the writer of this thesis formulates two formulation of the problem, namely: First, How to regulate the criminal trafficking of human organs according to Indonesian criminal law? Second, What is the criminal liability for the crime of trafficking of human organs in Indonesian criminal law? The regulation of the crime of trafficking of human organs based on positive law in Indonesia. Sanctions against criminals shall be subject to special sanctions that may be deterrent such as imprisonment or fines. Abstract

The condition of prisons in Indonesia are less clean and inadequate to accommodate the number of inmates is very possible the transmission of HIV / AIDS. Which exceeds the capacity of the holding cell can unwittingly transmit HIV / AIDS to the prisoners therein which occurs when blood or sexual contact. Is not new news that in detention cells often occur sex sexual intercourse (sodomy) so in order inmates with HIV / AIDS do not feel discriminated against then those with HIV / AIDS should get proper treatment. Based on Government Regulation No. 32 of 1999 on the terms and procedures for the implementation of the rights of inmates Correctional particular Article 16 (3) mentioned when the results of medical examination of prisoners found infectious diseases or dangerous, then the patient is treated specifically.As for the purpose of writing this essay, namely: First, how special handling of prisoners suffering from HIV / AIDS in Penitentiary Class II A Pekanbaru. Second, obstacles in the process of special handling of prisoners living with HIV / AIDS in Penitentiary Class II A Pekanbaru. Third, the efforts of correctional officers in giving special treatment to inmates suffering from HIV / AIDS in Penitentiary Class II A Pekanbaru.The conclusion that can be derived from this research is the First, implementation of the guidance and treatment for those with HIV / AIDS in Penitentiary Class II A Pekanbaru already well underway, although there are still some obstacles that hinder the implementation of coaching and penanganan.Kedua, Barriers in coaching and handling of prisoners with HIV / AIDS in Lemabaga Penitentiary Class II A Pekanbaru a capacity Penitentiary Class II A Pekanbaru very less in accommodating inmates, Cost to perform medical treatment are minimal, medical personnel is still lacking, especially to handle the problem of HIV / AIDS, medical facilities and infrastructure that is still far from standard. Abstract

Law enforcement can be interpreted as an effort to implement the law as it should, supervisethe implementation of the law so that there is no violation if there is a violation so there are otherefforts to restore the violated law to be re-enforced. Law enforcement against debt collectors whocommit criminal acts in the withdrawal of fiduciary objects can be done through a legal mechanism,where the debtor feels disadvantaged to be able to report a criminal act committed by a debt collectorto hold accountable.As for the formulation of the problem in this study is how law enforcement against debtcollectors who commit criminal acts in the withdrawal of goods or objects fiduciary collateral andconstraints in the debt collector law enforcement who commit a crime in the withdrawal of goods orfiduciary collateral.The research method used in this case is sociological juridical by direct field survey to obtainprimary data, where this study looks at the continuity between law and society, while the nature of thisresearch is descriptive, namely describing the problems to be studied.Based on the results of the study, it can be seen that law enforcement against debt collectorswho commit criminal acts in the withdrawal of goods or fiduciary collateral objects in the TampbaruPekan Polsek is that the community as a debtor can report any form of crime committed by the debtcollector on the police if the debt collector acts debt collection raises losses to the debtor, whilecriminal acts that can occur include article 369, article 378, article 335 of criminal law, acts of thedebtor who are not cooperative in dealing with debt collectors in general are the cause of theseproblems so that reports on actions a criminal offense that is detrimental to the debtor who mustsurrender the motorized vehicle unit that is used as collateral for the fiduciary and the debtor isunable to avoid the obligation.Constraints in law enforcement against debt collectors who commit criminal acts in thewithdrawal of goods or fiduciary collateral objects can be legal factors where the existence of debtcollectors are not specifically regulated in legislation, making debt collector actions difficult toprocess legally, law enforcement factors or police officers who are weak in responding to criminalacts reported by disadvantaged debtors and community factors which are the most dominant factors ininhibiting law enforcement against debt collectors because debtors are negligent in fulfilling theirachievements in general the community does not know how to do default and avoid collecting debt bydebt collectors.Keywords: Law Enforcement-Debt Collector - Fiduciary Guarantee

Abstract

Local elections democratically elected as mandated by the Constitution of the Republic of Indonesia, to prioritize the people's democratic sovereignty so dilaksanakanlah local elections directly elected by the people. The elections based on Law No. 8 of 2015 held simultaneously. Implementation of simultaneous elections in 2015 led to the implications for the Constitutional Court and also has implications for the judgments of the Constitutional Court.The conclusions in this study, First, some things that have implications on Law No. 8 of 2015 in the Constitutional Court that the buildup of cases in the Court, when the settlement is only 45 days in the Constitutional Court, filing an application for a maximum of 3 x 24 hours, and terms petition filing that is the difference in vote totals at most 2 percent. Second, There are three (3) things that have implications on the judgments of the Constitutional Court on the settlement of election disputes, namely, implications on the Constitutional Court itself, have significant implications for candidates who dispute and also the electoral commission local area, and impilcations for local area influential for the wheels of local government in the dispute. Abstract

Waiver of criminal cases for the sake of public interest or can be referred to as “deponering” is the embodiment of the opportunistic principle that has been legitimized by the state through Article 35 letter c of Law No. 16 of 2004 concerning the Republic of Indonesia Attorney General's Office and Article 14 letter h of the Law Code. Criminal Procedure. In fact, what should be an important note for the government and law enforcement officials is that from the perspective of the general public who do not understand the law comprehensively.This type of research is normative juridical research. In this research, the researcher discusses the principles of law, namely the principle of equality before the law, namely equality before the law. Then also using the legality principle which is the principle that determines that no action is prohibited and punishable if it is determined in advance in legislation, known in Latin as Nullum Delictum Nulla Poena Sine Praevia Lege Poenali (no offense, no punishment without advance regulation).The conclusions that can be obtained from the research results are: First, there is no derivative regulation in interpreting the meaning of the "public interest" so that it becomes a multi-interpretation area and contradicts the legality principle where the legality principle requires rules first, because the regulation does not can be applied if legality is not written about the derivative rules. This means that there are misinterpretations and legal findings that occur in interpreting waivers in the public interest so that it is not relevant to our ideals as a rule of law. Second, the criteria for the Attorney General to link legal interests and public interests in granting deponering basically do not have standard rules and contradict the principle of legality which requires prior rules in order to achieve legal certainty.
