Abstract

This study aims to find out how the legal political configuration of the Formation of Provincial Regulation No. 7 2019 concerning Amendments to Regional Regulation No. 4 2016 concerning the Formation and Composition of Regional Apparatus of Riau Province. The formulation of the problem posed is what is the political configuration and legal character in the Provincial Regulation No. 7 2019 concerning the Formation and Composition of the Regional Apparatus of Riau Province from the aspect of legal politics. This research belongs to the typology of empirical juridical legal research. Research data was collected by means of document / library study and interviews with the Head of the Legal Bureau and Members of the Special Committee for Regional Regulation No. 7 2019 concerning the Formation and Composition of Regional Apparatus of Riau Province. The analysis was conducted using a statutory approach combined with related party interviews. The results of this study show the configuration of political parties that occurred in the discussion of Provincial Regulation No. 7 2019 concerning the Formation and Composition of Regional Apparatus of Riau Province, namely that there are slight differences in general views between political party factions. The organizational arrangement of regional apparatus is a common thing in an organizational cycle, including in regional government organizations. The process of its birth until the discussion of Regional Regulation No. 7 2019 concerning the Formation and Composition of Regional Apparatus of Riau Province by the DPRD Riau Province is one example of a legal product that is reflects the fulfillment of the demands of individuals and social groups in society so that it is better able to reflect a sense of justice in society. The suggestion put forward by the author is that there is a need for good coordination between the Regional Secretariat Organization Division with all OPD and DPRD as well as all state civil servants who are in the scope of Riau Province. In the process of implementing this regional apparatus regulation, additional facilities and infrastructure should be made as well as provisioning needed by the state civil apparatus in realizing regional apparatus institutions in accordance with the applicable Regional Regulations.

Abstract

In the social life of modern times not to lose traditional medicine devotees, especially the thought of people who think traditional medicine does not lose quality with medical treatment. This kind of research can be classified into types sosiologis. Riset juridical reseach was conducted in a large hall Pekanbaru food and drug supervision, while the sample population is a whole party with regard to the issues examined in this study. Data sources used, the primary data, secondary data, and the data tertiary data collection techniques in this study with the inteview, and literature study. The authors obtained reseach results can be concluded. Fist, perfom an examination of the report evidence gathering, arrest and detention of offenders while being assisted by the police, conduct an examination of the suspect by investigators BBPOM, manufacture of interrogation, the suspect along with the submission of a letter of introduction from civil servants investigator large hall food and drug oversight to police investigator, submit the results of the investigation to the public prosecutor by police investigators based on book of the law number. 36 of 2009 and coordinate with agencies other law enforcement agencies in solving crime is not rampant circulation of tradisional medicines that contain hazardous chemical materials. Abstract

The presence of large-dimensional vehicles and large capacity is a factor causing road damage and high fasalitas for road users in Pekanbaru City. The obligation to comply with the provisions of goods shall be regulated in Article 169 paragraph (1) of Law Number 22 Year 2009 regarding LLAJ which reads "The Driver and / or Public Transport Company must comply with the provisions on loading procedures, transportation capacity, vehicle dimension and road class, large tonnage in violation of the hauling procedure is very disturbing to the public.The rise of violation of cargo goods that occurred in Pekanbaru City is not free from the law enforcement process that has not been optimal, therefore the law enforcement of motor vehicle goods that are not in accordance with the provisions must be optimized to realize legal certainty and public comfort.The purpose of writing this thesis, namely: First, To know the law enforcement of vehicle freight knowing the procedure of loading and transporting vehicle dimensions based on Law no. 22 Year 2009 About LLAJ in Pekanbaru City. Second, To know the obstacles in law enforcement of motor vehicle freight in general. Third, To know the efforts made in the law enforcement of motor vehicle freight in general.This type of research can be categorized in the type of sociological research. The research location is Pekanbaru City. Sources of data used are primary data and secondary data. Data collection techniques are interviews and literature study using deductive methods that draw conclusions from things that are general to things that are special.From the research results can be concluded. First, the enforcement of motor vehicle law in Pekanbaru City has not been proven optimally with high freight cost. Secondly, lack of optimization of law enforcement caused by obstacles such as limited authority of PPNS Dinas Perhubungan, lack of regulations on limitation of freight rates, corruption, lack of coordination of authorized institutions, minimal facilities and facilities, absence of storage warehouse, lack of awareness of drivers and cultural factors. Abstract

E-Commerce activities are not an unusual thing in people's lives, but have become routine along with the development of information technology. The presence of social media makes it very easy for the public in all activities, both information exchange and business transactions. Business transactions that have become an existence for writers, namely Paid Promote and Endorse, are promoted by public figures in social media applications, namely Instagram.However, in online transactions there are still many victims of fraud as a result of E-Commerce which is promoted by promoted and endorsed actors. So far the authors have reviewed according to Article 45A paragraph 1 of Law Number 19 of 2016 on amendments to Law Number 11 of 2008 concerning Electronic Information and Transactions, which have not clearly and clearly regulated the types of crimes of Cyber Illegal Content with the modus operandi of services paid to promote in the media social. As a result, the perpetrators cannot be held responsible for the crime.This type of research is normative legal research, namely using library research in data search and examining the subject matter according to the scope and identification of problems through a statutory approach carried out by examining statutory regulations and regulations related to the legal issues under study.The result of this research is that the promoted and endorsed offenders can be convicted if they fulfill the elements of a criminal act with a fraud mode that is misleading consumers as regulated in Article 45A paragraph 1 of the ITE Law and if they are proven to be deceiving and misleading others, they can be held responsible for the crime who feel aggrieved and troubled by the crime of participation as regulated in Article 55 of the Criminal Code concerning Inclusion of Crimes.Keywords: Criminal Accountability Crime- Cyber Illegal Contents in Paid Promote on Social Media.

Abstract

Given the importance of implementing regional autonomy, the government makes the market a priority program to increase income and also economic welfare for the community. Therefore, the Kuantan Singingi Government makes the market one of the potential sources of regional income. Kuantan Singingi has 12 traditional markets located throughout the Kuantan Singingi Regency which are managed by the local government and 34 village markets managed by the village government. This thesis discusses the supervisory function of the Regional Representative Council of Kuantan Singingi Regency against Regional Regulation Number 7 of 2012 concerning Market Service Retribution in Kuantan Singingi Regency.This type of research can be classified in the type of sociological legal research, or called field research, namely examining the applicable legal provisions and what is happening in reality in society. The research location is at the Regional Revenue Agency Office of Kuantan Singingi Regency and is carried out at the Market in Kuantan Singingi Regency. Sources of data used, namely: primary data and secondary data in the form of primary legal materials, secondary legal materials and tertiary legal materials. Data collection techniques in this study were interviews and literature study. Data analysis was carried out qualitatively, namely the data obtained not using statistics or mathematics or the like.The conclusion of this study is that the supervisory function of the Regional House of Representatives of Kuantan Singingi Regency against Regional Regulation Number 7 of 2012 concerning Market Service Retribution in Kuantan Singingi Regency has not implemented a systematic monitoring mechanism. Obstacles to supervision activities against Regional Regulation Number 7 of 2012 concerning Market Service Fees in Kuantan Singingi Regency are the laws that have been formed and agreed upon are not implemented properly, the ineffective communication and coordination between the executive and the legislature at the Kuantan Singingi Regency Regional Level and cultural factors The law is the supervision by the Kuantan Singingi Regency DPRD as the essence of the control function of the legislative body. Efforts to supervise the Regional People's Representative Council of Kuantan Singingi Regency are to effectively implement the law that has been formed and agreed upon, the executive and the legislature at the Regional Level of Kuantan Singingi Regency communicate and coordinate, so that effective law enforcement is realized and the third legal culture effort is the legislature. and executives should work together in administering the local government of Kuantan Singingi Regency. The writer's suggestion is that the DPRD is expected to be able to play its role optimally in carrying out the control function on the management of the Kuantan Singingi Regency Market Retribution.Keywords: Supervision Function - Regional Representative Council of Kuantan Singingi Regency - Market Service Retribution.

Abstract

As contained in Article 1 number 21 of Law Number 6 Year 2011 on Immigration, Tingga Permit is a permit granted to foreigners by an immigration official or an official of a foreign office to reside in the territory of Indonesia. It permits the stay by foreigners is a provision which is prohibited by law no mor 6 of 2011 on immigration governed by Article 122 which reads, shall be punished with imprisonment for a period of 5 (five) years and a maximum fine of Rp500. 000.000,00 (five hundred million rupiah): a. Any foreigner who deliberately misuses or performs activities that are inconsistent with the intent and purpose of granting a residence permit granted to him; b. Any person who orders or gives opportunity to a foreigner misuses or undertakes activities that are inconsistent with the intent or purpose of granting the residence permit granted to him or her.The type of research or approach done by the author is juridical sosilogical legal research. This research was conducted at the Office of Immigration Class I Pekanbaru. This location was chosen because the criminal case of immigration permit misuse was done by foreigners in Pekanbaru area. In this study the authors menggunakas data sources that can be grouped as beriku: Primary data, ie data obtained directly in the location of research. Secondary data, that is data obtained indirectly through a library (library research).From the research problems that dihad fire by the Immigration Office Class I Pekanbaru, namely: First, the law enforcement carried out by the criminal act of abuse of immigration to the residence permit by foreigners. Abstract

Sengketa laut China Selatan telah dimulai sejak tahun 1947, pada tahun tersebut Negara China membuat garis putus-putus untuk mengklaim semua kepulauan yang ada di Laut China Selatan. Permasalahan ini dilatarbelakangi oleh dua factor penting, yaitu : pertama, letak yang strategis yakni laut China Selatan merupakan jalur Pelayaran perdagangan dan jalur komunikasi internasional yang menghubungkan samudra Hindia dan samudra Fasifik, beruntung dari segi Geografi karena dikelilingi oleh sepuluh Negara pantai. Kedua, sumber daya alam yakni kekayaan alam yang terkandung di wilayah Kepulauan Spartly memiliki kandungan minyak dan gas alam yang besar. Sumber daya alam ini merupakan salah satu produk yang sangat penting bagi pembangunan ekonomi Negara. Yang menjadi objek focus utama sengketa antara Negara-negara sekawasan (China, Taiwan, Singapura, Philipina, Vietnam, Malaysia, Brunei Darrusalam) yaitu dua pulau utama yang terdapat di wilayah laut tersebut, terkhususnya Kepulauan Spartly. Tujuan penulisan skripsi ini yakni ; Pertama, Penyelesaian Sengketa Kepemilikan Kepulauan Spartly Berdasarkan UNCLOS III Tahun 1982, Kedua, Upaya-upaya yang di Lakukan Oleh Negara-negara Sengketa Dalam Menyelesaikan Sengketa Kepemilikan Kepulauan Spartly di Laut China SelatanJenis Penelitian ini dapat digolongkan dalam penellitian hukum normative, yaitu penelitian yang dilakukan dengan cara meneliti bahan sekunder atau penelitian yang berdasarkan aturan-aturan baku yang telah dibukukan atau dapat juga disebut dengan penelitian kepustakaan.Dari hasil penelitian masalah ada dua hal pokok yang dapat disimpulkan. Pertama, penyelesaian sengketa kepemilikan Kepulauan Spratly berdasarkan UNCLOS III Tahun 1982 yakni pada Pasal 279 menyebutkan penyelesaian sengketa secara damai. Pasal ini memberikan penjelasan bahwasanya penyelesaian sengketa dengan jalan damai merupakan penyelesaian sengketa yang harus lebih dahulu ditempuh dan yang sangat dianjurkan dalam Konvensi Hukum Laut Internasional dalam penyelesaian suatu konflik Hukum Laut Internasional. Kedua, Upaya penyelesaian konflik ini sudah dilakukan sejak tahun 1970an baik melalui upaya-upaya bilateral maupun multilateral. Dalam upaya-upaya tersebut telah disepakati beberapa hal seperti kerjasama pengelolaan wilayah Kepulauan Spratly, maupun pembagian sumber daya alam. Akan tetapi konflik ini belum selesai karena belum ada kesepakantan mengenai hak kepemilikan wilayah Kepulauan tersebut. ASEAN sebagai organisasi regional Asia Tenggara ikut berperan aktif dalam upaya penyelesaian konflik di wilayah tersebut.Kata Kunci : Penyelesaian Sengketa – Secara Damai – UNCLOS

Abstract

The regional growth is a process of solving the region, from a region of the province, district or city to more than one region, then in Act No. 23 of 2014 made clear that the regional growth not only be interpreted as the formation of new regions but may include merging some districts / cities different. Abstract

Justice Collaborator understanding in the general public often be confused with Whistle Blower, though equally to cooperate with law enforcement agencies to provide important information related to a legal case. But both have a different legal status, so that the two can not beequated. Granting the status of Justice Collaborator usually given for criminal acts which besifat organized and pose a serious threat to public safety issues and undermine democratic values. For example, corruption, terrorism, drugs, money laundering, or the Human Trafficking. The term Whistle Blower and Justice Collaborator now often appear in corruption cases handled by the Corruption Eradication Commission (KPK), the term both quoted from the Appellate Court (SEMA) No. 4 of 2011 on the treatment for the reporting crime (Whistle Blower) and witness the perpetrator collaboration (Justice Collaborator) in certain criminal acts. The purpose of the author discusses Justice Collaborator problem is due to the frequent occurrence of misperceptions in the community and also for its own law enforcement officials the authority of labeling a person can become a Justice Collaborator. Because after the author inventarisir that provisionJustice Collaborator is the authority of the judge and the judge examine certain criminal cases by the facts that occurred in the trial on the grounds that alleviate the burdensome and in accordance with Article 197 letter (f) of the Criminal Procedure Code and SEMA No: 04 Year 2011. Since that determines a person as the main perpetrator or who participate commit a specific criminal act is after the judges checked out and try the case in court, so if there are other institutions that determine a person as Justice Collaborator is an arbitrary act, it is author to convey because our country is a country of law is not a mere power in the sense that all that is done by law enforcementauthoritiesisbasedontheAct.Criminal Justice System which apply to the Justice Collaborator on the crime of corruption and certain other criminal offenses, are not regulated in detail it means not getting adequate arrangements to be a legal basis for law enforcement officers. Until now the setting of Justice Collaborator only explicitly stipulated in the Supreme Court Circular No. 4 of 2011 and regulations together on treatment for the reporting crime (Whistleblower) and a witness who cooperated (Justice Collaborator) in certain criminal cases, thus SEMA and the joint regulation has no binding legal force as well as the Act is internal in the sense that only the Supreme Court. Abstract

Regional autonomy in Indonesia have set up a republic constitution in 1945 after the amandements stipulated in article 18 republic constitution 1945. Autonomy regulate the principle of decentralization, deconcentration and assistance. One such principle is decentralization. In development since Indonesia’s independence to reform implementation. The principle of decentalization in legislation to increase local autonomy towards regional autonomy in accordance with the constitutional mandate, but from the juridical aspect, namely the law number 23 of 2014. Has not been able to pt the principle of decentralization as a cornerstone in the implementation of regional autonomy, the actualization of law number 23 of 2014 leading to a centralized regional autonomy. Causing imbalance affairs division of authority between the center and regions. Based on this understanding the writing of this formulated two formulation of the problem. First, how is the actualization of the principle of local autonomy in the law number 23 of 2014, the second whether laar behind changes in the law number 23 of 2014.The kind of research is legal normative and descriptive analysis.
