Abstract

Island rentals in Indonesia to foreign parties violate the principles of an island nation that emphasizes the integration between land, sea and air dimensions in carrying out national development. It can also eliminate the integration of the sea dimension or waters in national development. in the National Long-Term Development Plan (RPJPN), one of the points of the long-term development mission is to realize Indonesia as an archipelago / maritime country, while the nation's predecessors have fought steadily so that the principles of the island nation are recognized byinternational world as stated in UNCLOS 1982.This type of research used in writing this law is normative legal research that focuses on principles by formulating legal principles, both from social data and from positive written legal data. Whereas when viewed from the nature of this research is descriptive. this study uses secondary data, namely data that has been prepared.The results of this study are island leasing in the territory of the Republic of Indonesia sovereignty against foreign parties based on the 1982 United Nations Convention on Law of the Sea (UNCLOS) in the form of usufructuary rights and leases based on legislation that applies in the Republican sovereignty Indonesia. Indonesian foreign parties are given authority over island rentals as limited as managers. However, some foreign parties have exceeded the authority given to the detriment of the local people who are the people of Indonesia. Island leasing in the territory of the Republic of Indonesia sovereignty against foreign parties based on positive law in Indonesia has not been able to accommodate the interests of the Indonesian people in accordance with the 1945 ConstitutionIsland leasing to foreign parties is more oriented towards seeking profits to increase state income and naturally eliminate the rights of local communities over natural resources of Indonesian waters.Keywords: Island Rental, Foreign Parties, UNCLOS 1982

Abstract

Batam as an industrial area which development is carried out by the BatamIsland Industrial Area Development Authority agency, has also been expanded into anautonomous region which later give birth to the Batam City Government. The existence ofthese two government agencies then creates problems in the management of Batam Cityin the form of overlapping / dualism of authority. To overcome this problem, thegovernment then issued a new breakthrough by setting the Head of the Batam ConcessionAgency to be held ex-officio by the Mayor of Batam in the hope that the implementation ofhis duties and authority would be more effective. Therefore, the aim of this thesisresearch is first, the ex-officio determination of the Mayor of Batam from the point ofview of state administrative law. Second, the ex-officio implications by the Mayor ofBatam in public services. Third, the ideal arrangement for the relationship between theBatam City Government and the Batam Concession Agency.This type of research can be classified into the juridical sociological researchtype, because it wants to see the correlation between the law and what happens in thefield so as to reveal the effectiveness of the law's application. With the research locationlocated at the Batam Concession Agency and the Batam City Government, while thepopulation and sample are all parties related to the problem under study. This researchuses data sources in the form of primary data and secondary data, and data collectiontechniques are carried out by means of interviews, questionnaires and literature review.From the research, there are three main points that can be concluded. First,in fact, the ex-officio implementation by the Mayor of Batam is something that is justifiedin state administrative law. Second, the ex-officio implementation carried out by theMayor of Batam has no implication in resolving the problem of overlapping / dualism ofauthority that occurs in Batam City. Third, the ideal arrangement for the relationshipbetween the Batam City Government and the Batam Concession Agency is needednecessary to integrate the Batam, Bintan, and Karimun Free Trade Zone and Free PortExploitation Agency (BP BBK) by first issuing a Government Regulation as a form offurther regulation regarding the work relationship between the Batam City Governmentand the Batam Concession Agency. There is suggestion from author; first, the centralgovernment requires assertiveness in resolving issues of overlapping / dualism ofauthority that occur immediately issued a legal product in the form of a governmentregulation regarding the working relationship between the city government and theBatam concession agency. Abstract

The use of checks as a means of payment in Indonesia, especially Riau Province still often cause problems, especially about the blank checks that cause harm to the recipient. Issuance of a blank check is qualified as a criminal act of banknote fraud in the form of a blank check, as provided for in Article 378 of the Criminal Code. Marakya bank crime crime in the form of blank checks that occurred in Riau Province is inseparable from the investigation process that has not been optimal. Investigations that have not been optimal in law enforcement of bank criminal acts in the form of blank checks in the Riau Regional Police cause not materialized legal certainty. Therefore, the investigation of banknotes crime in the form of blank checks by the Riau Police Investigators should be optimized in order to realize legal certainty. The purpose of writing this thesis, namely: First, To find out the investigation of criminal acts fraudulent bank in the form of blank checks in the Riau Regional Police. Secondly, to find out whether the proof of criminal act of bank warning fraud in the form of blank checks in Riau Regional Police requires expert information. This type of research can be categorized in the type of sociological research. The research location is Riau Regional Police. Sources of data used are primary data and secondary data. Data collection techniques are interviews and literature studies using deductive methods that draw conclusions from things that are general to things that are special. From the result of the research, there are two main points that can be concluded. Firstly, the investigation of criminal act of bank warning fraud in the form of blank checks at Riau Regional Police has not been optimally proven by the high number of fraud checks and the delay or unfinished professional and proportional investigation process, The lack of optimal investigation due to obstacles, including limited investigation personnel, lack of operational budgets, lack of expert investigators in handling cases of fraud checks, geographical circumstances with the potential for occurrence of crime and minimal witnesses. Secondly, the information of legal experts in the proof of criminal acts of bank warning fraud in the form of blank checks at the Riau Regional Police is still needed in supporting the investigation process due to the lack of evidence ie the minimal witnesses and the lack of expert police in handling the case of the crime of blank check. The effort to overcome the obstacle of investigation of criminal acts of bank fraud in the form of blank checks in Riau Regional Police is to make strict action against every crime that happened, build partnership with other institution (stakeholder) especially banking party and also need the increase of number of investigator personnel, Enhancement of investigator capability through special training in banking. Abstract

Local government budgets of Riau Province have deficits. The local government of Riau Province assigns budget rationalization policy to the implementation of the regional budget. this research intends to find out impact budget rationalization policy towards the implementation of regional budget and learn any factor causative local government applies budget rationalization policy.This research is sociological law research because it is based on field research using the interview method as primary data supported by library research as secondary data. this study uses qualitative data analysis and produces descriptive data.Conclusions in this research, first are concluded that budget rationalization policy has an impact very influential to Local government department indicative funding ceilings for all department local governments, but not very impactful to Riau province development. second, the factor causative applied factor budget rationalization policy because local revenue that received not according to revenue target.The author's advice is, first, to the regional government of Riau province, please use the budget principles appropriate with the general principles of regional financial. second, within in preparing the budget should more carefully in setting the regional revenue target. because planning is the key to success towards good regional financial governanceKeywords: Impact – Local Government Budget - Deficit

Abstract

Domestic violence is not a new thing, but it is a crime that has long been rooted in the culture of society. As set forth in Article 51 to Article 53 of Law Number 23 Year 2004 on the Elimination of Domestic Violence is a complaint offense, in which the victim can determine whether the case has been reported to be terminated and revoked by his complaint or will continue until before the demand is read out at Court. In some cases of domestic violence that often ends in the settlement of cases Domestic Violence ends a verdict for the imposition of a prison sentence to the perpetrator.Based on the background of the problems that the authors describe above, the authors are interested to conduct research with the title: "Removal of Complaints in Cases of Criminal Acts of Domestic Violence Under Article 75 Criminal Law Code Related to Justice Restorative Justice (Case Study Police Sector Tampan Pekanbaru)" . With the formulation of the problem that is how the process of settlement of Criminal Violence in Households based on restorative justice by Pekan Sector Police Tampan Pekanbaru? And what are the obstacles to solving domestic violence based on justice of restorative justice by Pekanbaru Charming Sector Police?This research is a type of sociological legal research (empirical), which is the research of sociological law is as an effort to see the effect of the validity of positive law on the life of the community, because in this study the authors directly conduct research on the location or place studied in order to provide a complete picture and clear about the problem under study. From this study the authors obtained the result that the process of revocation of the complaint must be approved by the victim which is done through the mediation process suggested by the Tampan Police. Abstract

This study aims to find out how legal politics related to the formation of a supevisory board is associated with the independence of the judicial authority of the corruption eradication commission. The formulation of the problem raised is how the Judicial Eradication Commission’s judicial authority arrangements after the decision of the Constitutional Court and how the legal politics of establishing a supervisory board is related to the independence of the Corruption Eradication Commission’s judicial authority.This research is a normative juridical research, research conducted based on legal material and legislation. The approach taken includes the literature approach, namely by studying books and legislation. The type of data used is the type of premier data, namely the source of data obtained through laws related to the Corruption Eradication Commission’s, secondary data sources namely data sources originating from books and other regulations, consisting of premier legal material, statutory regulation governing the Corruption Eradication Commission’s.The theories used in this research are the theory of state institutions and legal political theory. The results of this study indicate that after the enactment of Law Number 19 of 2019 concerning the second Amendment to Law Numbe 30 of 2002. Concerning Corruption Eradication Commission’s (KPK), the position of the KPK which was originally a non-governmental institution is now included in the executive power cluster, and the existence of the addition of articles in Law Number 19 of 2019 related to the exsistence of a Board of Trustees contained in Article 12B and Article 12C. With the addition of Article concerning the Supervisory Board, the KPK in carrying out its duties and authority is no longer independent and weakens the independence of the KPK.Whereas in the Constitutional Court Decision Number 36/PUU-XV/2017 states, “That the KPK can be object of the DPR’s questionnaire rights in its oversight function, the DPR can exercise its constitutional rights including the inquiry right to the KPK only limited to matters relating to implementation of the duties and authority of the KPK in addition to carrying out the duties and authorities relating to its judicial duties and authorities (investigation, investigation and prosecution)”. According to Law of the Republic of Indonesia Number 22 of 2009 concerning Road Traffic and Transportation Article 277 "Any person who enters a motor vehicle, trailer, and attached train into the territory of the Republic of Indonesia, manufactures, assembles, or modifies which causes a change in type, train. trailer, attached carriage, and special vehicles operated domestically that do not fulfill the type test obligation, will be subject to a maximum imprisonment of 1 year or a maximum fine of Rp. 24,000,000 ", but in practice there are still many motorists who modify motorized vehicles without paying attention to the provisions. - the provisions in the Law. This research is a sociological legal research, which is a study that seeks to see the unity between law and society with the gap between das sollen and das sein. The nature of this research is descriptive research, which is a method intended for exploration and clarification of a social phenomenon or reality by describing a number of variables relating to the problem and the unit under study. The data source is secondary data which is divided into 3 (three), namely primary, secondary and tertiary legal materials. The purpose of this study was to determine how law enforcement, constraints, and how the efforts to apply to traffic violations related to law enforcement against traffic violations in the form of violations of two-wheeled motor vehicle modification in the legal area of the Dumai City Police. Abstract

In running the government, a state not escape from the disruption of sovereignty, whether from the outside, as well as from within the country itself. One real nuisance is a threat to the security of a country. Crimes againts state security, or often referred to as treason, is an act which aimed to destroy, overthrow, or take over the administration of the specific reasons. One plot events that occurred in Indonesia is in motion the events of September 30 in 1965 movement (G30S). One of the key figures in the G30S is a Lieutenant Colonel Untung. Purpose of this thesis, namely : first, criminal responsibility of Lieutnant Colonel Untung in the crime treason on G30S. Second, the application of the crime of treason chapter in the trial of Lieutenant Colonel Untung is appropriate or not yet. This type of research is normative juridical, who performed with the approach to find the law to a case in concerto, which approaches seek how to find the relevant facts, and then find the law in abstracto the right to object at carefully. Data sources used include primary data, secondary data, and the data tertiary. Data collection techniques using literature study. Of the research problem, there are two main things that can be concluded. First, if we dissect the action of the elements that can be accounted for, Lieutenant Colonel Untung criminal liability can be requested on he did in the crime of treason in G30S. Second, in the proceedings of Lieutenant Colonel Untung, the judges stated that he is guilty of committing criminal offenses including Article 107 Paragraph 2, Article 108 Paragraph 2, Article 110, of the Criminal Code (KUHP) and Article 2 of The Presidential Edict No. 5 In 1959. Suggentions author, first, improve the national judicial system to be more balanced between the rule of law and sense of justice. Abstract

Combating Corruption Commission (KPK) is a special institution established as an institution for combating corruption is formed by Act No. 30 of 2002 on the Corruption Eradication Commission. The Commission has the authority that an arbitrary one of the main organizers is to monitor the state government. Monitoring is an activity that is carried out to check the appearance of the activity that is being done. Sector Monitoring Commission, in charge of running the oversight of government agencies, especially that could affect the growth or shrinkage of the corruption perception index. commission work together with the Commission's internal watchdog agency to talk about how to create an effective supervision. Internal watchdog agency is spearheading the supervision of an institution or department. Abstract

Indonesia is a rich country. Riau Province is one of the areas that have natural resources and non-biological abundant, and the forest is one of the riches contained in it. The extent of forest area in the province is directly proportional to the number of forestry crime happened. One of the criminal act occurred, ie forestry plantation activities without permission minister in forest areas under Article 17 Paragraph (2) Letter B Act No. 18 of 2013 concerning the Prevention and Combating Deforestation and criminal sanctions provided for in Article 92 Paragraph (1). Throughout 2014 there has been a 5 cases of this criminal act. Ditreskrimsus Police in Riau as one of the law enforcement agency should be able to run perananya properly and optimally so as to suppress and reduce the occurrence of such crime. The purpose of this thesis are: First, What is the role Ditreskrimsus Riau Regional Police in enforcement of Article 17 Paragraph (2) Letter b Law No. 18 Year 2013. Secondly, Is Ditreskrimsus barriers Riau Regional Police in enforcement of Article 17 Paragraph (2) Letter b Law No. 18 Year 2013. Third, How are Ditreskrimsus Police in Riau in overcoming barriers to enforcement of Article 17 Paragraph (2) Letter b Law No. 18 Year 2013 concerning the Prevention and Eradication of forest destruction.The research results can be concluded first, Role conducted by Ditreskrimsus Riau Regional Police in law enforcement against criminal acts plantation activities without permission minister in the forest in Riau Province is by taking action preemptive, preventive, and repressive. Second, obstacles encountered in implementing the law enforcement include: financial barriers (financial), lack of facilities and infrastructure barriers, lack of human resources law enforcement officials, community barriers and factors territory. Third, efforts made by Ditreskrimsus Police in Riau to overcome obstacles in law enforcement is to propose the addition of operating costs, cooperation and coordination with other relevant agencies, improve the delivery of public education about the forest and the applicable law and to reform internally.Keywords: Role-Enforcement-Plantation-Forest Area
