Abstract

Pengaturan tentang kewajiban penunjukan penasehat hukum bagi terdakwa yangdiancam pidana diatas 5 tahun sebagaimana yang diatur dalam Pasal 56 KUHAP. Namun,dalam praktiknya dipersidangan masih banyak ditemukan terdakwa yang diancam pidanadiatas 5 tahun yang tidak didampingi penasehat hukum, dapat dikatakan bahwa kewajibanpenunjukan tersebut diabaikan atau dikesampingkan oleh aparat penegak hukum.Tujuan penulisan skripsi ini, yakni; Pertama, untuk mengetahui pengaturan idealtentang kewajiban penegak hukum untuk menunjuk penasehat hukum bagi terdakwa yangdiancam pidana diatas 5 tahun, Kedua,untuk mengetahui upaya hukum yang dapat ditempuh terpidana terhadap putusan hakim yangtelah berkekuatan hukum tetap yang dalam proses persidangan tidak didampingi penasehathukum.Jenis penelitian ini dapat digolongkan dalam jenis penelitian hukum normatif.Penelitian ini bersifat deskriptif, yang menggambarkan secara jelas dan terperinci mengenaikewajiban aparat penegak hukum dalam menunjuk penasehat hukum bagi terdakwa. Sumberdata yang digunakan adalah data sekunder yang bahan hukum primer, bahan hukumsekunder, tehnik pengumpulan data dalam penelitian ini dengan metode kajian kepustakaansetelah data terkumpul kemudian dianalisis dan ditarik kesimpulan.Dari hasil penelitian dan pembahasan dapat disimpulkan bahwa yang Pertama,pengaturan ideal tentang kewajiban penunjukan penasehat hukum bagi terdakwa yangdiancam pidana diatas 5 tahun sangat diperlukan,karena Pasal 56 KUHAP masihmengandung banyak kelemahan sehingga tidak menciptakan kepastian hukum bagi terdakwadan terkesan mati suri, oleh sebab itu diperlukan pengaturan yang lebih jelas dan terperincimengenai akibat hukum bagi aparat penegak hukum yang mengesampingkan kewajibanpenunjukan tersebut, Kedua, upaya hukum yang dapat ditempuh terpidana terhadap putusanyang telah berkekuatan hukum tetap adalah upaya hukum luar biasa yakni upaya hukumPeninjauan Kembali (PK), ini merupakan bentuk perlindungan hukum represif bagi terdakwayang tidak didampingi penasehat hukum dipersidangan.Kata Kunci : Pengaturan Ideal - Kewajiban- Penunjukan Penasehat Hukum Terdakwa

Abstract

In the criminal justice system, punishment is not an end in itself and is not the only way to achievecriminal objectives or the purpose of the criminal justice system. The goal to be achieved with a punishmentis to improve the person and the criminal himself and to make people deterred. Judging from the economicalaspect of imprisonment, prison is not really efficient, it should not be applied. So if the penal law criminalpolicy has not been able to provide a deterrent effect for the perpetrators of criminal acts of circulatingnarcotics, it is necessary to apply non-criminal measures.This study is a sociological or empirical research, namely the type of research that usescommunity assumptions in looking for facts that occur in the field to answer an existing problem. Thisresearch was conducted in the jurisdiction of the Riau Prosecutor's Office. While the population and sampleare parties related to the problems examined in this study, the data sources used, primary data, secondarydata, and tertiary data. The technique of collecting data in this study was through interviews and literaturereview.From the results of the study, the authors can conclude, first, the use of nonpenal facilities inefforts to prevent drug trafficking in the Tanjungpinang waters law area is not effective due to the inhibitingfactors in carrying out their duties, especially facilities in the sea or waters so that law enforcement is notoptimal. The obstacles faced by the Bintan Resort Police in the prevention of drug trafficking usingnonpenal facilities are due to their strategic location, the number of rat ports, the vast area of the watersand the lack of personnel from the Bintan Resort Police in carrying out their duties and infrastructure. Theefforts made by the Bintan Resort Police in overcoming barriers to preventing drug trafficking are tocoordinate with Satpolair which has facilities and infrastructure in sea or water lanes.Keywords: Nonpenal Facilities - Circulation of Drugs

Abstract

Provision of criminal sanctions against children as perpetrators of criminal acts of theft with violence and denial which have complied with the provisions of Article 365 paragraph (2) to the 2nd Criminal Code (Penal Code) with imprisonment for 1 (one) year and 6 (six ) month for perpetrators who are aged 14 years is considered not appropriate when viewed from the concept of punishment of children. A special imprisonment has a negative impact on the child's development. Sanctionsweet against misbehaved children (juvenile delinquency) may be given action in the provision of Article 82 paragraph (1) of Law Number 11 Year 2012 on Child Criminal Justice System. type of normative juridical research, whose purpose with normative juridical research is a study that discusses legal principles, legal system, law-law level, legal history, and comparative law. Judging from the nature of the research used Descriptive, The purpose of this study is to provide a systematic description of the level of self-law in the criminal responsibility of children as perpetrators of theft with violence. Sources of data used, primary data and secondary data and tertiary data, data data techniques in this study with literature review. From the results of this study the authors can be concluded. First, the responsibility of the child in committing a crime is a responsible and ready child to be investigated, prosecuted and tried in court. It's just that there are provisions where a child is not the same as the parents. Secondly, the judge in making a legitimate child criminal verdict is sufficient only to base on what has been written and regulated in the Act. And in juridical considerations in the case of children, there is clearly a difference regarding the provisions of material offenses and the provisions of the formal offense. Abstract

The child is a mandate from God Almighty that in itself is attached to the dignity and dignity of a whole person.. Based on Law Number 35 of 2014 concerning Amendments to Law Number 23 of 2002 concerning Child Protection is someone who is not yet 18 (eighteen) years old, including children who are still in the womb. Children's rights are part of human rights that must be guaranteed, protected, and fulfilled by parents, family, community, government and the state. As for the purpose of writing this thesis, namely: First, to find out the implementation of coaching carried out by Class IIB Pekanbaru Child Correctional Institution against the recidivism of child offenders. Second, to find out the obstacles in the implementation of guidance on child recidivism perpetrators of crimes. Third, to find out the form of efforts to overcome obstacles in fostering the recidivism of child offenders.This research is a sociological juridical research. Sociological juridical is legal research that uses secondary data as the initial data, which is then followed by primary data or field data, examining the effectiveness of a law and research that wants to find a relationship (correlation) between various symptoms or variables as a data collection tool consisting of studies documents and interviews.The conclusion of this study is, First correctional system is held in order to form correctional prisoners including children who are dealing with the law, should be in the context of coaching between children of perpetrators and repeat perpetrators of criminal offenses. Secondly, the constraints faced by officers of child-specific development institutions (LPKA) Pekanbaru II Class, namely the low level of education of children and the lack of skilled personnel, thus hampering the process of coaching carried out by LPKA and the changing mindset of the perpetrators of criminal offenses. Third, the efforts carried out by the Special Penitentiary Center for Class IIB Pekanbaru Children are by increasing the quality of education and human resources, playing an active role in social activities, treating the same and increasing awareness (monitoring) of the perpetrators of recidivism. The author's suggestion of the problem under study is First For the perpetrator of a crime a child or child who is dealing with the law must be made an effort to restorative justice. Second Pekanbaru Class II B LPKA Officer must further improve the quality of service in fostering children with criminal acts such as, improving the quality of Human Resources, Coaching Facilities, Religious Facilities and so on. Third, the Central Government and Regional Government especially the Ministry of Law and Human Rights Humans must pay more attention to the condition of LPKA Klas IIB Pekanbaru, because in accordance with Law No. 12 of 1995 concerning Correctional Correctional System is organized in order to form a Corrected Community in order to become a complete human being.

Abstract

The 1945 Constitution of the Republic of Indonesia in Article 18 paragraph 4 which isthat the Governor, Regent and Mayor are democratically elected to function to lead their regionswhich have been given the trust of the people who have given their votes in the regional headelection. However, problems related to Regional Autonomy seem never to be resolved. Theproblem that has arisen in the relationship between the central and regional governments is thedistribution of power and the allocation of financial resources. The exsistence of a deputy regentin principle aims to help ease the tasks of the regional head. The representative should be a“trusted person” or right-hand man of the regional head who has an emotional attachment toone another. This trust will be a obtained if a regional head can freely choose his representativewithout being bound to a system or management that is coercive.This type of research can be classified in the type of Normative legal research, whichreveals legislation relating to legal theories that are the object of research. The approach takenuses a qualitative analysis approach by looking for data both in books, journals and otherscientific works related to this research. The data sources used are primary and secondary legalmaterials.The conclusion that can be obtained from the results of the research is first, the filling ofthe position of Deputy Regent has been regulated based on law number 10 of 2016 after thesecond amendment to Law number 1 of 2015 concerning the Establishment of GovernmentRegulation in lieu of Law number 1 of 2014 concerning Governor Election Regent and Mayorrelated to the vacant position of deputy regent, it is stated in law number 10 of 2016 article 176.Second, the ideal arrangement for filling the position of Deputy Regent in the Constitutionmandates in Article 18 Parageraph 4 oh the 1945 Constitution thet “Governor, The Regent, andthe Mayor respectively as the heads of the provincial, regency and city regional governments aredemocratically elected. “An important issue that arises is related to the existence and urgency ofthe position of Deputy Governor, Deputy Regent, or Deputy Mayor. Abstract

Indonesia has a wealth of natural resources that abound. Fertile soil surface and in it also contained a variety of mineral in the form of minerals, ores, various chemical elements and various stones including precious stones that can be processed for the welfare of the people, especially oil and gas. Realized oil and gas is the livelihood of many people, the Indonesian government since the first has been working to protect the natural resources of this country. Abstract

Advocates in carrying out their professional duties provide a defense for clients, so that in carrying out their professional duties, advocates carry out actions or actions in accordance with their duties and authority as advocates, but do not mean that legal proceedings can be violated by lawyers without undergoing legal proceedings. or commit acts that violate the law by taking refuge in the right of immunity of a lawyer. Because the right of immunity that is owned by an advocate does not apply if an advocate commits an act or act that violates the law or is not in accordance with the laws and regulations and commits a criminal offense that can be snared with applicable criminal sanctions. The number of actions that are deterring the judicial process of corruption (obstruction of justice), but only a few are followed up. Normatively, the act of blocking the judicial process has been regulated in Article 21 of Law Number 31 of 1999 concerning the Eradication of Corruption Crimes.The purpose of this study is to analyze the boundaries and arrangements of advocates' advocacy in providing legal services to clients associated with obstruction of justice. The research method used in this paper is normative legal research, legal research conducted by examining library materials or secondary data, can be called normative legal research or library research. This study uses the methodology of legal principles research.The limits of the defense advocates do in providing legal services to clients include providing legal advice in accordance with criminal procedural law (formal law), not fabricating evidence of criminal acts of corruption, and others. Regarding the obstruction of justice in Article 21 of Law Number 31 of 1999 concerning the Eradication of Corruption Crime, advocates can also be subject to sanctions and be held responsible for acts of obstructing the legal process.

Abstract

Supervision and Spatial planning that are not properly implemented in Pelalawan district in accordance with law No. 16 of 2016 regarding the position, organizational structure, duties and functions, as well as work service and spatial planning for Pelalawan Regency of course it will cause a lot of spatial planning problems that occur in Pelalawan district. Problems that arise due to poor spatial planning in Pelalawan Regency, such as; floods, air pollution, lack of supervision and monitoring of spatial use and many other problems related to lack of spatial planning supervision. So the need for the Head of Spatial Planning to supervise the existing spatial planning in Pelalawan Regency. The type of research that the author uses is sociological juridical, which is a research approach that emphasizes the legal aspects related to the subject matter to be discussed, associated with the reality that occurs in the field. In this case the authors conducted research on the Spatial Planning Sector of Pelalawan Regency and the Public Works and Spatial Planning Office of Pelalawan Regency regarding the problems of spatial planning supervision in Pelalawan Regency. From the results of this study it can be concluded that there are three main problems. First, to carry out the duties of the Head of Spatial Planning which is regulated in Regent Regulation Number 16 of 2016 concerning Position, Organizational Structure, Duties and Functions as well as Work Procedure of the Public Works and Spatial Planning Service, Ppelalawan Regency has the function of controlling and supervising the utilization of Detailed Spatial Planning (RDTR) , building and environmental plans (RTBL). The two factors that become obstacles to the Head of the Spatial Planning Division of Pelalawan Regency are Human Resources, Fund Allocation, Policy, Facility and Infrastructure Factors, and Community Legal Awareness. The third effort that the Head of the Division can make in realizing good spatial planning supervision in Pelalawan Regency is to make rules related to the use of green open space (RTH), supervise the use of spatial planning, disseminate information about spatial planning to the community, supervise control over spatial use.Key words : Supervision, Head of Division, Spatial Planning.

Abstract

Corruption is a violation of social rights and economic rights of the community, so that criminal acts of corruption can no longer be classified as ordinary crimes but have become extraordinary crimes. Protection for reporters related to corruption is regulated in Government Regulation No. 43 of 2018 concerning Procedures for the Implementation of Community Participation and the Appreciation of the Prevention and Eradication of Corruption. Therefore, the formulation of the problem of this thesis writing is: First, how is the legal protection for the reporters of criminal acts of corruption based on Government Regulation Number 43 of 2018 concerning Procedures for the Implementation of Community Participation and Awarding in Prevention and Eradication of Corruption Crimes? Secondly, is legal protection given to Reporters whose reports do not contain the truth?.This type of research used by the author is normative legal research, also called doctrinal legal research. In this normative legal research, the author is interested in conducting research using the systematic criteria of law. Sources of data used, namely: primary data, secondary data and tertiary data. Data collection techniques in this study using the method of literature study that is the researcher analyzes based on books, legislation and other literature related to the problem under study. Data analysis was carried out qualitatively ie the data obtained were not using statistics or mathematics or the like. In drawing conclusions the author uses the method of deductive thinking that is a way of thinking that draws conclusions from a statement or general proposition into a statement or case that is specific.Conclusions from the results of the study, first, the rules regarding protection for reporters are not maximally provided such as protection for witnesses and victims. Article 2 of the Republic of Indonesia Law No. 31 of 2014 concerning Amendments to Law Number 13 of 2006 concerning Protection of Witnesses and Victims provides protection for witnesses and victims at all stages of criminal justice in a court of law. Whereas the reporter who is also a witness did not receive an award for the report he reported and there was no legal certainty. Second, the reporter whose report does not contain the truth means that there is no legal protection. Abstract

Investigation of the efforts made by investigators seeking information and gather evidence that he explained crime. As for the criminal acts that often occur in the community that violence or persecution, the presence of such actions certainly abuse victims take legal steps by making a police report. In the passage of the investigation process is often the case for peace between the victim and reported. In this case the investigation of criminal offenses related to maltreatment by Civil Service Police Unit against demonstrators associated with the peace made by the parties in the resort city of Pekanbaru police. The purpose of this thesis, namely: First, the Crime Investigation persecution conducted by Civil Service Police Unit Against Protesters, Second, Crime Persecution Peace Process conducted by Civil Service Police Unit Against Protesters Can Be The Reason For Termination of Investigation Process.This type of research can be classified in this type of sociological juridical research because in this study the authors directly conduct research on the locations or places studied in order to provide a complete and clear picture of the issues examined. This research was conducted at the City Police Pekanbaru, while the sample population is a whole party with regard to the issues examined in this study, the data source diginakan, primary data, secondary data and tertiary data collection techniques in research in the observation , interviews and a literature review.From the research, there are two fundamental rights problem that can be inferred. First, Investigation Crime of Torture conducted by Civil Service Police Unit Against Protesters, that the criminal acts of persecution carried out by the Civil Service Police Unit has memenuhui element of the sentence, but in terms of the passage of the investigation, Warrant Commencement of Investigation (SPDP) was never delivered to the public prosecutor (prosecutor). As Article 109 of the Criminal Procedure Code since the start of the investigation the investigator must give written notification of the commencement of the investigation. Second, the Peace Process Crime persecution conducted by Civil Service Police Unit Against Protesters Can Be The Reason For Termination Process of Investigation, while the peace process made by the victim and reported, in line with the Letter of the Chief of Police No. Pol: B / 3022 / XII / 2009 / SDEOPS, dated December 14, 2009 on Alternative Dispute Case Handling Through Resolusion (ADR). Selanjtnya for legal certainty investigation process carried his case to terminate the investigation.
