Abstract

The 1945 Constitusion of the Republic of Indonesia Article 28G stipulates that a personhas the right to project himself, family, honor, dignity, and wealth as well as a sense of securityfrom all forms of the threats that exist from his possession. And in Law No.30 of 1999concerning Human Right, Article 29 Everyone has the right to protection of personal, family,honor, dignity and property right. And in Article 32 of Law Number 39 Year 1999, it is explainedthat independence and confidentiality in correspondence, including communication by electronicmeans, cannot be disturbed, except by order of a judge or other legal outhority in accordancewith the provisions of the legislation.This research will be compiled using the juridical normative research type, which isresearch focused on examining the application of the norm of positive law. The approach used inthis research is to use a normative approach, namely literature law research.The results of the research conducted by the outhor are, first, to find out how theprotection of the law and the responsibility of the State for the protection of personal data inIndonesia in the context of protecting human rights and to obtain the right to protect personaldata for the public is part of the implementation of protecting human right. Furthermore, inorder to know the ideal concept of personal data protection, citizens have the right to obtainpersonal data protection information.Keywords: State Responsibility - Personal Data Protection

Abstract

Health is a human right and one of the elements of welfare that must berealized. The times and technology have made progress in the field of health andmedical science, such as online doctors who use web-based health services andapplications, known as telemedicine. The existence of telemedicine certainly has animpact and influence on the birth of a regulation or rule which regardingtelemedicine is regulated through the Minister of Health Regulation Number 20 of2019. The regulation of telemedicine which is regulated in the Minister of HealthRegulation Number 20 of 2019 concerning Telemedicine, regulates the presence ofdoctors and health service facilities that use the website and an application toconnect patients with doctors which is done online. the presence of a rule of courseto provide legal certainty, justice and benefit where the Minister of HealthRegulation Number 20 of 2019 concerning Telemedicine is the legal umbrella fortelemedicine.The results of this study examine and analyze the current regulations,namely the Minister of Health Regulation Number 20 of 2019 as a legal umbrellaregarding telemedicine where the regulation and content of this Minister of Healthdoes not provide legal certainty and regulations regarding telemedicine have beenleft behind from the development of progress in the health sector which is notfollowed by developments. constitutional law in legal reform in the health sector,especially in terms of regulations regarding telemedicine, the ideal concept of theaspired law (ius constituendum) regarding the regulation of telemedicine must referto the Health Act and the Law on Medical Practice as well as the Minister ofHealth's Regulation on telemedicine as well must contain content about thefulfillment of health in remote areas and regional responsibilities in the fulfillmentand implementation of telemedicine so that the issuance of regulations that trulyprovide certainty to the community as a form of fulfillment of the concept ideal ofa rule.Keywords: telemedicine, implementation of telemedicine, legal politics.

Abstract

Joint Ministerial Decree is a decision made by more than one minister on amatter which each minister concerned has an interest in regulating. Decree withthe minister is not regulated in Indonesian laws and regulations. Theimplementation of the position and legal force of the Joint Ministerial Decree isstill a matter of debate in terms of several aspects, such as the definition, content ofthe Joint Ministerial Decree. One example of a controversial SKB is SKB No.2/KB/2021 Concerning the Use of Uniforms and Attributes for Students, Educators,and Education Personnel in Schools Organized by Local Governments atElementary and Secondary Education Levels and Number KEP-033/A/JA/6/2008Concerning Warnings and Orders to Adherent Members, and/or Members of theManagement of the Indonesian Ahmadiyya Congregation (JAI) and members of thepublic.The purposes of this study are: First, to find out how the position and legalpower of joint ministerial decisions in the perspective of legislation in Indonesia,Second, to find out the ideal concept of the position and legal power of jointministerial decisions in the perspective of laws and regulations in Indonesia.The author conducted this research using a normative research method orliterature study which discusses the vertical and horizontal synchronization of lawrelating to the Joint Ministerial Decree in the perspective of legislation inIndonesia. In addition to issuing regulations, the minister also has the authority toissue policies in the form of decisions. Second, the ideal concept of this Ministerialdecree is a change to law No. 12 of 2011 and the president issues a regulation(presidential regulation) that confirms the position, substance, and procedure of ajoint ministerial decree.Keywords: Joint Decree, Minister, Legislation.

Abstract

The factual symptoms show that the fluctuating state of public trust and the sub-systemsof social life do not work in balance and harmony with what the public wants because the worldof people's lives is shrinking in the face of power and the power of the money system. Whenthe active participation of the people is removed from the decision-making arena and directlytaken over by the control of power, the people, who are in fact the holders of sovereignty, areonly justified in claiming decisions in the name of democracy. This phenomenon is clearly seenin the legislative process in Indonesia.We can never forget that, in the last 5 (five) years alone, there have been many "injuries"in the minds of the people due to haphazard and annoying legislative processes, for example,the Job Creation Law, the Revised KPK Law, the Revised General Election Law, the Revisionto the Regional Head Election Law, the Law on the Formation of Three New Provinces inPapua, the Revision to the State Financial Policy Law, the Law on Sexual Violence, the Lawon Community Organizations, the revision to the Constitutional Court Law, and many others.Departing from the description of the problem above, this must be radically reformed in orderto avoid the destruction of the Indonesian legislative system. So, it is necessary to conductresearch using a normative approach and analyze it qualitatively. The theoretical frameworkemploys Jurgen Habermas' theory of discourse ethics as an analytical tool for delivering writingon solutions to problems with conclusions that lead to legislation with a foundation in people'slegitimacy.Keyword: Discourse ethics, crisis, system, Indonesian legislation

Abstract

The existence of the Sultan Syarif Kasim II airport, which is currently inthe middle of Pekanbaru City, of course, dramatically influences the spatialplanning of the Pekanbaru City area. This condition will cause urban land use inPekanbaru to become less than optimal. The purpose of writing this thesis is, first,to find out the whereabouts of the Sultan Syarif Kasim II airport based on theRegional Regulation of the Riau Province Number 10 of 2018 concerning the RiauProvince Regional Spatial Plan for 2018-2038. Second, to find a bright spot for theRegional Government in relocating the existence of the Sultan Syarif Kasim IIairport.This type of research is sociological, legal research conducted at theRegional Development Planning Agency of Riau Province, Commission IV of theRegional People's Representative Council of Riau Province, and the Meteorology,Climatology, and Geophysics Agency (BMKG). The population and sample usedare all parties related to the problems studied in this study.The results of this study indicate the existence of Sultan Syarif Kasim IIAirport, which wants to be developed into a primary-scale collector airport thatserves passengers with a total of 5,000,000 (five million) people per year.Construction and development at the current airport location are not feasiblebecause the land is narrow or there is no space to develop the airport to remain inthis location. Therefore it is necessary to relocate the existence of Sultan SyarifKasim II Airport. The government's obstacles in relocating the airport arelocation factor, land condition and land slope factor, land acquisition factor, winddirection, wind speed factor, and budget factor. The government must coordinatewith Angkasa Pura II and equate the perception of the concept of the RegionalSpatial Plan (RTRW) and the Flight Operations Safety Area (KKOP) so that itruns synergistically. The government must immediately make a regulation in theform of a Detailed Spatial Plan (RDTR), which regulates the height of thebuilding and the Basic Coefficient of Buildings and Extraordinary Events aroundthe Sultan Syarif Kasim II Airport area.Keywords: Airport-Spatial planning

Abstract

Fungsi penyelenggaraan pelayanan kesehatan mencakup seleksi fasilitas kesehatan, penyediaan jaringan fasilitas kesehatan, pemberian pelayanan kesehatan secara terstandarisasi, terstruktur, berjenjang, dan terintegrasi. Pemerintah menetapkan regulasi-regulasi yang mengatur standar infrastruktur pelayanan kesehatan, standar pelayanan kesehatan, standar tenaga kesehatan, tarif pelayanan, daftar sediaan obat dan tarif obat, serta standar dan tarif alat medis. Selanjutnya, regulasi-regulasi tersebut menjadi dasar hukum bagi kontrak kerjasama antara BPJS Kesehatan dan fasilitas kesehatan untuk pemberian pelayanan kepada peserta. BPJS menetapkan kriteria seleksi fasilitas kesehatan dan menyeleksi fasilitas kesehatan yang layak untuk bekerjasama. Penetapan kriteria ini bertujuan untuk menjaga kulitas pelayanan kesehatan yang akan didapatkan oleh masyarakat. Oleh karena itu pada proses penyelenggaraannya BPJS Kesehatan berkoordinasi dengan Dinas Kesehatan Kabupaten/Kota setempat, dalam hal mengeluarkan rekomendasi bahwa fasilitas kesehatan tersebut dianggap memenuhi kriteria menjadi mitrakerja/vendor dalam sistem JKN. Peraturan khusus (lex specialis) tentang pengadaan barang jasa pemerintah mempedomani Peraturan Presiden (Perpres) Nomor 12 Tahun 2021 tentang Pengadaan Barang Jasa Pemerintah yang merupakan perubahan dari Peraturan Presiden No 16 Tahun 2018. Adapun petunjuk tertulis dari Perpres ini tertuang didalam Peraturan Lembaga (Perlem) Kebijakan Pengadaan Barang dan jasa Pemerintah (LKPP) Nomor 9 tahun 2018. Dalam Perlem LKPP Nomor 9 tahun 2018 tentang syarat kualifikasi administrasi/legalitas penyedia Barang/Jasa bahwa pimpinan dan pengurus badan usaha bukan sebagai pegawai kementerian/ lembaga/perangkat daerah. Fakta yang ditemukan dilapangan, tidak semua pemilik fasilitas kesehatan swasta mitrakerja BPJS Kesehatan merupakan pelaku usaha non pemerintah, namun ada juga pelaku usaha yang berprofesi sebagai Pegawai Negeri Sipil (PNS) yang mana mereka terlibat secara langsung ataupun tidak langsung didalam proses pengadaan seleksi penunjukan penyedia fasilitas kesehatan swasta dalam sistem JKN. Data ini dapat ditemukan dari informasi yang dipublikasikan oleh BPJS kesehatan, yang dapat diakses oleh masyarakat. Fenomena ini berpotensi terjadinya tindak pidana korupsi (tipikor). Tindak pidana korupsi adalah suatu perbuatan melawan hukum, memperkaya diri sendiri, orang lain, atau suatu badan yang secara langsung atau tidak langsung merugikan keuangan negara, atau diketahui atau patut disangka olehnya bahwa perbuatan tersebut merugikan keuangan negara dan perekonomian negara.

Abstract

In a democratic country, the existence of a Regional People'sRepresentative Council or referred to as a legislative body is a must. The reasonis that the legislature is the people's representative in making laws or regionalregulations that will be applied to the people. By law the DPRD has the moststrategic position in carrying out the supervisory function of local governments.One of the central council functions is the supervisory function, while the actionsreferred to by the institution are more preventive in nature which impliesevaluating and supervising local government programs. Likewise in RiauProvince, the Riau Provincial DPRD has supervised the use of the budget for theacceleration of the handling of the Covid-19 Panemdi in the 2020 APBD. Asstated in the explanation of Article 41 of Law Number 32 of 2014 concerningRegional Government, it states that "DPRD has functions, among otherslegislative function, supervisory function and budget function.This type of research is empirical juridical research or sociologicallegal research, namely a research approach that emphasizes the legal aspectsregarding the subject matter to be discussed, linked to the reality in the field. Thisresearch was conducted at the Riau Provincial DPRD Office and withConstitutional Law Experts in the city of Pekanbaru. while the sample populationis the whole party related to the problem under study. Sources of data used areprimary data and secondary data, data collection techniques in this study is byobservation, questionnaires, interviews and literature review.In the results of the research problem there are two main things that canbe concluded. First, in optimizing the supervisory function of the Riau ProvincialDPRD on the use of the budget for the acceleration of handling the COVID-19pandemic in the 2020 APBD, it went quite well. Pekanbaru City Regional Regulation Number 10 of 2006 concerning Water Resourcesand Infiltration Wells Article 19 paragraph (1) stipulates "Every applicant for a Building Permitis required to plan and construct infiltration wells. Making infiltration wells is the developer'sobligation in housing areas in Tangkerang Labuai Village, but based on facts on the ground, 20housing estates in Tangkerang Labuai Village do not build infiltration wells. The purpose of thisresearch is to find out; first, Implementation of Infiltration Well Development Based onPekanbaru City Regional Regulation Number 10 of 2006 concerning Water Resources andInfiltration Wells in Tangkerang Labuai Village, Pekanbaru City, second, inhibiting factors forImplementation of Infiltration Well Development Based on Pekanbaru City Regional RegulationNumber 10 of 2006 concerning Water Resources and Infiltration Wells in Tangkerang LabuaiVillage, Pekanbaru City, thirdly, efforts to maximize the implementation of making infiltrationwells based on Pekanbaru City Regulation Number 10 of 2006 concerning Water Resources andInfiltration Wells in Tangkerang Labuai Village, Pekanbaru City.The type of legal research used by the author is sociological legal research. In thissociological study the authors took primary data and secondary data with the population andsamples, namely the Office of Investment and One Stop Integrated Services (DPMPTSP)Pekanbaru City, Public Works and Spatial Planning (PUPR) Pekanbaru City, HousingDevelopers in Tangkerang Labuai Village, Practitioners Pekanbaru City Planning, Secretary ofthe Lurah of Tangkerang Labuai Village, Head of RW in Tangkerang Labuai Village andresidents of housing in Tangkerang Labuai Village.Based on the results of this study, it can be concluded that the Implementation of MakingInfiltration Wells Based on Pekanbaru City Regulation Number 10 of 2006 concerning WaterResources and Infiltration Wells in Tangkerang Labuai Village, Pekanbaru City does not work atall. This is because the relevant Regional Apparatus Organizations (OPD) have not implementedthe Perda a quo properly and law enforcement against permit applicants who do not buildinfiltration wells is not carried out and the monitoring process is not carried out properly.Keywords: Implementation-Infiltration Wells-Regional Regulations-Building Permit (IMB)
