Abstract

Elections are the main means of realizing democracy in a country. The substance of the election isthe voice of the people to form representative institutions and government as state administrators. In theprocess of organizing the elections in 2018 in Riau Province there were still many violations of electioncrimes. The formulation of the problem in this study (i) How is the enforcement of criminal acts by theElection Supervisory Agency in the election of Governor and Deputy Governor of Riau in 2018 (ii) What arethe obstacles and efforts to overcome criminal law enforcement by the Election Supervisory Board in theelection of Riau Governor and Deputy Governor in 2018.This type of research can be classified as sociological, because it is based on how to obtain it fromprimary data sources, namely data obtained directly from the main source. This research was conducted atthe Election Supervisory Body of Riau Province, while the population and sample are all parties related tothe problems examined in this study, data sources used primary data, secondary data, and tertiary data,data collection techniques in this study with interviews , observation and literature study.From the results of the research it can be concluded that Law Enforcement of criminal acts by theElection Supervisory Board in the 2018 Governor and Deputy Governor Election has not run optimallybecause there are still frauds committed by the community and there is no Bawaslu authority in attemptingto call the alleged / reported parties in the process information request and lack of expertise of the RiauProvincial Bawaslu staff in the process of taking information or in the process of extracting informationfrom reporters, witnesses and suspects or reported and short handling times is one of the obstacles in theviolation handling process so that the process has not fulfilled enough strong to determine a violation whilethe handling of violations has almost expired. So that the role of Riau Provincial Election Supervisory Bodycannot work optimally in carrying out its duties and functions in supervising the implementation of regionalhead elections, so that there are still cases of electoral crimes that have not been resolved completely in theelection of Governor and Deputy Governor of Riau in 2018.Keywords: Law Enforcement - Bawaslu - Criminal Act on Election.

Abstract

ABSTRAKMunculnya wacana menghidupkan kembali GBHN atau yang dalam istilah baku dikenal dengan reformulasi sistem perencanaan pembangunan nasional dengan model GBHN yang berasal dari rekomendasi MPR RI Periode 2009-2014. Munculnya wacana menghidupkan kembali GBHN dilihat dalam perspektif politik hukum merupakan pilihan sulit, karena akan berhadapan dengan beberapa kebijakan MPR yang sudah ada sebelumnya melalui amandemen UUD NRI Tahun 1945. Metode penulisan ini dalam penulisan ini dengan menggunakan jenis penelitiannya adalah penelitian hukum doktrinal (doctrinal) atau normatif, yang mengkaji hukum sebagai norma. Hasil pembahasan bahwa sekiranya keinginan untuk menghidupkan kembali GBHN dalam sistem ketatanegaraan Indonesia mesti harus ada konsensus yang harus dilakukan sebelum MPR melangkah pada proses perubahan UUD NRI Tahun 1945.Kata kunci: Reformulasi, GBHN, Ketatanegaraan.ABSTRACTThe emergence of discourse reviving GBHN or in standard terms is known as the reformulation of the national development planning system with the GBHN model derived from the recommendations of the Republic of Indonesia MPR for the 2009-2014 period. The emergence of the discourse of reviving GBHN seen in the perspective of legal politics is a difficult choice because it will deal with a number of pre-existing MPR policies through the 1945 constitution amendments to the Republic of Indonesia. This writing method using this type of research is doctrinal (doctrinal) or normative, which examines law as the norm. The results of the discussion that if the desire to revive GBHN in the Indonesian constitutional system must have a consensus that must be carried out before the MPR steps in the process of the 1945 Constitution of the Republic of Indonesia.Keyword: Reformulation, GBHN, State Administration.

Abstract

After the enactment of Law Number 6 of 2014 concerning Villages on 15 January 2014, the Republic of Indonesia now has laws specifically regulating the administration of village governance. A very important part is the arrangement of village regulations. Village regulations are set by the village head after obtaining approval with the Village Consultative Body. In the process of establishing village regulations, community participation is needed, so that the output of village regulations can fulfil aspects of local community needs that are conveyed through the Village Consultative Body. The aspirations of the local community in the form of input and contribution ideas are more effective, because community complaints and opinions are taken into consideration in decision making. Related to this matter, the formulation of the problem in this study is how is community participation in the process of establishing Village Regulations in Koto Masjid Village, District XIII, Koto Kampar, Kampar Regency? There are still very many village organizers (Village Heads and Village Consultative Bodies) and village communities who do not yet have the knowledge and expertise in the field of legislation. This has the potential to affect the success of the implementation of the Law on Villages, and even does not rule out the possibility of creating legal chaos, among others, the occurrence of conflicts and overlapping laws and regulations. So that in the future knowledge of the establishment of legislation is needed which is able to encourage people to participate in the formation of village regulations, realize Village Regulations that are aspirational, responsive, obedient, harmonious and harmonious vertically and horizontally in the framework of developing national legal systems based on The 1945 Constitution of the Republic of Indonesia, and produced a Draft Law and Regulations that could be accounted for philosophically, juridically and sociologically. Knowledge can be obtained through legal counselling, especially legal counselling related to community participation in the process of establishing village regulations in Koto Masjid Village, District XIII Koto Kampar, Kampar District.

Abstract

Community empowerment in an effort to prevent narcotics abuse is needed to protect the nation's future generations, thus it will help create a great community and independent village and will be able to create more creativity and wider work. The problem that occurs is community empowerment against the legal consequences of narcotics abuse in Naumbai Village, Kampar District, Kampar Regency, Riau Province. The purpose of community service activities that will be carried out is to provide knowledge and understanding of the importance of staying away from narcotics so as to create a healthy and creative society. The benefits are expected to have a good impact in terms of health, economy and social so that women can help the family economy and village communities, so that the people of Naumbai Village, Kampar District, Kampar Regency, Riau Province can obey and obey the law and are not involved in narcotics abuse.

Abstract

Political reforms in 1998 which was followed by a free and democratic elections in 1999, has a fairly fundamental change relationship patterns that characterized the President and the Parliament many political parties that play a role in the constitutional structure. Abstract

Letak strategis Provinsi Kepulauan Riau yang berada pada wilayah perbatasan, dimana secara geografis Provinsi Kepulauan Riau terbentang dari selat Malaka sampai dengan laut (Natuna) Cina Selatan dan berbatasan langsung  dengan Vietnam, Malaysia, Kamboja dan Singapore sebagai pusat perdagangan dunia menjadikan Provinsi Kepulauan Riau memiliki peran strategis dalam lalu lintas perdagangan dunia. Abstract

The Kampar Regency Government issued Kampar Regency RegionalRegulation Number 4 of 2014 concerning Buildings to regulate building permits,precisely in Article 16 paragraph 1 letter (a) which states that every person orlegal entity including government agencies must submit an IMB application to theRegent to carry out building construction activities and/or building infrastructure.However, after the enactment of the regional regulation, there are still manyviolations that occur in the implementation of buildings in Kampar Regency, atotal of 156 buildings that were put in order by Satpol PP as of 2019-2021. Thepurpose of this thesis research is first, to determine the implementation of buildingpermits in Kampar Regency based on Kampar Regency Regional RegulationNumber 4 of 2014 concerning Building Buildings. Second, to find out theinhibiting factors in the implementation of the Building Permit rules in KamparRegency. Third, to find out the efforts in overcoming obstacles in theimplementation of building permit rules in Kampar Regency.From the results of the study, it was concluded that, first, theimplementation of building permits in Kampar Regency based on KamparRegency Regional Regulation Number 4 of 2014 concerning Buildings has notgone well. Second, the inhibiting factors in the implementation of the BuildingPermit rules in Kampar Regency are the area, budget and socialization,coordination between Satpol PP and related agencies, the role of the community,and community legal awareness. Third, efforts to overcome obstacles in theimplementation of the Building Permit rules in Kampar Regency, namely satpolPP providing education to the community and inviting the community to play anactive role in reporting on buildings that do not have a permit, the need to reportwith the Kampar Regency DPRD regarding budget problems, forming a judicialteam which is a combination of all related agencies led by Kasat Satpol PP.DPMPTSP in the future will educate the public so that the community can betterparticipate in supervising the implementation of buildings. Then the DPRD willapproach and socialize the Regional Regulation to the community from theDistrict level to the Village level and call relevant parties to record how theimplementation of the Regional Regulation and tighten up how to follow up on theproblem.Keywords: Implementation, Regional Regulation, Building Permit.

Abstract

The Attorney General’s Office of the Republic of Indonesia as regulated in LawNumber 16 of 2004 concerning the Prosecutor’s Office of the Republic of Indonesia is agovernment institution that carries out state duties in the field of prosecution and otherauthorities based on law. Where one of his duties is in the field of Civil and StateAdministration where the prosecutor with special powers can act both inside and outside thecourt for and on behalf of the state or government which is referred to as the State Attorney.In practice, the task as state attorney in handling State Administrative dispute cases can alsobe carried out by lawyers who are advocates. During the last three years, there have onlybeen two cases of State Administrative disputes handled by the State Attorney of the RiauHigh Court. So that the writing of this thesis aims to determine the criteria for StateAdministrative cases that can be handled by the State Attorney in the field of StateAdministration at the Riau High Court and to find out how the implementation of theauthority of the State Attorney in the State Administration at the Riau High Court.This type of research can be classified in the type of sociological research which iscarried out by direct research on the place under study to provide a complete and clearpicture of the problem being studied. This research was conducted in the High Service Officeof Riau, while the population and the sample are the parties related to the problem studied inthis study. The data sources used are; primary data, secondary data, and tertiary data, thedata collection techniques in this study were methods and interviews and literature study.From the results of this study, two conclusions can be drawn. First, cases or StateAdministrative disputes that can be handled by the Riau High Court. Second, this studydiscusses the implementation of the authority of the State Attorney at the Riau High Court.The researcher’s suggestions are, firstly, there is a correction of the prosecutor’s duties andauthorities in the field of state administration. Second, the provisions on the separation ofauthority are clearer for State Attorneys in both the Civil and State Administration scope.Third, strict provisions to be addressed to government agencies, state institutions,BUMN/BUMD to cooperate using the services of a State Attorney when there is a stateadministrative dispute.Keywords: Public Prosecutor – State Lawyer – Authority
