Abstract

The Criminal Code Draft Team made efforts to renew the adultery offense, which is about theadulterers who originally were married men and married women as regulated in positive law in the 2017Criminal Code Draft Article 484 includes men and women who are not bound by each legal marriage withother people. In addition to causing pro-contra, this is exacerbated by the protracted discussion of theCriminal Procedure Code that there are no signs that will be ratified since 1963 until an idea emerges toexpand the meaning of zina through the Constitutional Court but it is rejected by the Constitutional Court.The impact of this adultery can damage the moral and religious values that exist in Indonesian society basedon the supreme divinity, so that gradually this action seems to be a legalized act because of the lack of rulesLaw in Indonesian positive law is a threat to national identity.This type of research used in legal research is a normative juridical method, this research isdescriptive, that is a study that aims to describe the problem clearly and in detail. The source of the dataused secondary data and tertiary legal materials. Data collection techniques in this study with the literaturereview method after the data collected is then analyzed to draw conclusions.From the results of the research and discussion, it can be concluded that, First, the reasons derivedfrom the foundation of moral values / national agreements which state that zina violates the values ofmorality (national agreement) that exist in Pancasila which contain values based on national life for theOne Godhead (religious moral values). Second, the regulation of adultery in the Criminal Procedure Codetends to be overcriminalized and does not pay attention to the impacts that can occur. Third; In order toavoid the implications of legal chaos, the regulation regarding zina should not over criminalize or exposethe principle of ultimum remedium and to overcome the protracted drafting of the RKUHP, the progressivelegal breakthrough is needed by the Constitutional Court to expand the meaning of zina in Article 284 of theCriminal Code In the Constitutional Court Decision Number: 46 / PUU-XIV / 2016 the majority of judgesstill use the legal positivist thinking pattern, which results in the rejection of the material test suit. the strongflow of public opinion that wants the Constitutional Court to be a way out of the deadlock that occursbecause the thing being tested is contrary to moral values.Keywords: Criminal Law Policy - Adultery - Judge's Decision

Abstract

In criminal procedural law, witnesses can be divided into several forms, one of which is a crownwitness or a crown witness. The crown witness is a witness originating from or taken from one of the othersuspects or defendants who jointly committed a criminal act in the event that the witness was given a crown.Crown witnesses themselves are not regulated in detail in the Criminal Procedure Code. To be able to makea suspect or defendant as a crown witness must be carried out through the procedure of solving the case filewhich is the authority of the Public Prosecutor. The use of crown witnesses in uncovering a case still posesa problem, because the use of a crown witness is not in accordance with the system of evidence and themodel of the criminal justice system in force in Indonesia.The research entitled "The Application of the Principles of Non-Self Incrimination to CrownWitnesses in the Indonesian Criminal Procedure Code" aims to determine the application of the principle ofnon-self incrimination to crown witnesses and to describe the ideal arrangement for crown witnesses inIndonesian criminal procedure law.This research is normative research or library research. In this study, the authors chose research onlegal principles, namely the principle of non-self incrimination and comparison of law. The data used in thisstudy is secondary data. Then the data is analyzed qualitatively. The theoretical foundation used is thetheory of proof and the concept of the criminal justice system.The results of the study indicate that the application of the principle of non-self incrimination tocrown witnesses is not in accordance with the rules of law stipulated in the Indonesian Criminal ProcedureCode. This can be proven by a system of evidence adopted in Indonesia, where many legal rules regardingthe validity of an evidence in a criminal case are violated and there is a discrepancy between the existingcriminal justice system model and the rules governing the crown witnesses.Keywords : Non-Self Incrimination Principle, Witness Mahkota, Indonesian Criminal Procedure Code.

Abstract

The State of Indonesia is a state of law that adheres to the principle of decentralization in the administration of government, one of which is the equalization of high school religious teachers based on the Principle of Professionalism in Law Number 14 of 2005 concerning Teachers and Lecturers in government affairs in Riau Province, which at present is not in accordance with what was claimed - tell me the invitations. The research method in this study is a research method with sociological juridical research or sociological legal research. The theoretical basis used is the theory of regional governance, and law enforcement theory.The purpose of this thesis discussion, namely: to discuss the implementation of the Riau provincial government in examining high school religious teachers on the principle of professionalism in Law number 14 of 2005 concerning teachers and instructors in Riau Province, secondly to find out what is related to the Riau provincial government in equitable distribution high school religious teachers based on the principle of professionalism in law number 14 of 2005 concerning teachers and lecturers in Riau province, thirdly to find out the provincial government of Riau in overcoming the problem of examining high school religion teachers on the basis of professionalism in law number 14 of 2005 about teachers and lecturers in Riau Province.From the results of research and discussion it can be concluded that the implementation of the provincial government in the distribution of high school religion teachers based on the principle of professionalism in Law number 14 of 2005 on Teachers and Lecturers in Riau Province has not been carried out in accordance with what is envisioned by the law, religious teachers what is really needed as an educator of religious values for students is not available and not fulfilled in every region. Factors that are considered by the provincial government are internal and external factors, and to overcome this. So some efforts were made by the provincial government to examine religious teachers at the high school level, namely: conducting data collection and mapping of religious teachers in all high schools regarding the needs of religious teachers; then the provincial government submits data on the needs of religious teachers to the central government to be asked to meet the needs of further religious teachers and the provincial government conducts training of new and old religious teachers for training and socialization of semester expenditure / curriculum materials. Thus the examination of top-level religious teachers based on the principle of professionalism in law number 14 of 2005 concerning teachers and lecturers in Riau province can be realized properly.Keywords: Implementation, Equality, Religious Teachers

Abstract

The process of resolving criminal offenses was carried out through the Sentra Gakkumdu forum. The Integrated Law Enforcement Center (Gakkumdu) consists of the Republic of Indonesia Bawaslu, the Republic of Indonesia National Police and the Indonesian Prosecutor's Office. The period of the investigation and prosecution process that is too short can cause the perpetrators of election crimes to avoid legal proceedings. Certainly this will greatly injure the value of justice in the law itself. Efforts to achieve substantive justice and electoral justice are limited by procedural justice alone. This certainly has an impact and a bad precedent for the enforcement of criminal acts of regional elections.What is the juridical analysis of the provisions of the time limit in the investigation of election criminal acts based on Law Number 1 of 2015 Jo Law Number 10 of 2016 concerning Election of Governors, Regents and Mayors who discuss protection? How to manage the future? How do you set the term of office? Absorption of Pilkada criminal acts based on Law Number 1 of 2015 Jo Law Number 10 of 2016 concerning Election of Governors for Regents and Mayors?Theories used in this research include justice theory and court legal policy theory. This type of research can be classified in normative legal research, namely legal research conducted by examining library materials. This study examines the subject matter in accordance with the scope and identification of problems through a statute approach carried out by examining the legislation and regulations relating to the legal issues under study.The conclusion that can be obtained from the results of the study is the limitation of time provisions in the investigation of criminal acts of elections that are regulated in Law Number 10 of 2016 concerning the Election of Governor of Regents and Mayors is still not clearly regulated. The process of enforcing the law against the crime of regional elections has not provided a sense of justice for the people.. The provisions of a brief investigation must be harmonized with a quick and short trial process. Abstract

Crime of Body Image Shaming (Body Shaming) is a crime that is rife in Indonesia. Criminalinsulting body image (Body Shaming) gives a bad impact for individuals who experience it such asdepression, and eating disorders. Perpetrators of Criminal Actions for defamation of body image (BodyShaming) can be charged with applicable Laws, although in reality there is no article that specificallyregulates the criminal conduct of body image defamation. There should be a more specific regulationregarding the crime of insulting body image (body shaming) on social media because Indonesia is a countrythat adheres to the principle of legality, if a crime occurs then it will be seen whether there are legalprovisions that govern it and whether the existing rules can be applied to criminal offenses that occur thebody is not ideal and / or not like body shapes in general. Based on this understanding, the authors identifytwo problem formulations, First how to regulate the crime of insulting body image (Body Shaming) in thepresent condition of crime (Body Shamig) on social media in criminal law. Second, how the reformulation ofthe crime of insulting body image (Body Shaming) on social media is related to the principle of legality.This type of research can be classified in normative juridical research, because this research isconducted by examining secondary data and approaches to law, this normative research examines theprinciples of legal principles of law. The data sources used are, primary data, secondary data, tertiary data,data collection techniques in this study are normative juridical, the data used is library research.Based on the results of research and the problem in this study is the regulation of criminal acts thatinsult body image (body shaming) in criminal law in Indonesia refers to Article 315 of the Criminal Codeabout insults and Article 27 Paragraph (3) of the ITE Law. In the ITE Law, there are articles which areconsidered more suitable to ensnare the perpetrators of the crime of insulting body image (Body Shaming).In Article 27 Paragraph (3) of Law Number 11 Year 2008 Changes to Law Number 19 of 2016 ElectronicInformation and Transactions lacks a definite rule regarding body shaming criminal acts which causesmany problems or losses experienced by the victim. Police Notes Certificate is officially given by the police to an individual citizen is concerned for the sake of fulfilling a request for such a purpose because of the prerequisite conditions based on the results of antecedents that person.That the Police Notes can take precautions against citizens ever committing a crime and facilitate the police in uncovering the incident or crime through the person's record notes. Then the execution of internal coordination within the agency and outside the region in agencies as well as with other agencies is needed in order to realize the internal security .In fact Execution in Kampar district police to Pekanbaru Police have not been able to run well purpose of this thesis is to find out; First, how the Implementation Coordination of Internal Police in Kampar to Pekanbaru Police Police Notes issuance. Secondly, what the Implementation Coordination constraints faced by Kampar district police in Publishing Pekanbaru Police Police Notes, Third, efforts to overcome the Implementation Coordination is not running and address of the Breach Publishing Police Notes. This research used kind of research Yuridis sosiologis that is seen by correlation between law and society. This research is done in society organization class II A pekanbaru, meanwhile population and sample is all of sides that relate with the problem that is researched. In this research, the source of data is used primer data, sekundar data and tertier data, technique for collecting the data in this research are interview, literature, and questioner From the research , there are three main things that can be concluded first , that the implementation of the Police Coordination Kampar and Pekanbaru Police are still not operating effectively . Abstract

The holding of elections is held every five years, this is reflected in Article 22E paragraph (1) of the1945 Constitution which states that "General Elections are carried out directly, publicly, freely, secretly,honestly and fairly every five years". Quality elections are influenced by many factors. Tight competitionbetween advanced regional head candidates can create the potential for various fraudulent practices so thatthey can damage the real purpose, which is honest and fair elections and obtain pure and quality results.The purpose of this thesis is to find out the law enforcement of post-conflict local election actions and to findout the factors that cause the crime of post-conflict local election and in the police law area of Kamparregency resort.This type of research can be classified in the type of sociological juridical research, because in thisstudy the author immediately conducts research on the location or place under study in order to provide acomplete and clear picture of the problem under study. This research was conducted in the jurisdiction ofKampar Regency, while the population and samples were all parties related to the problems examined inthis study, data sources used, primary data, secondary data, and tertiary data, data collection techniques inthis study with interviews and literature review.From the results of the research that the author did, it can be concluded, First, the law enforcementof criminal acts of post-conflict local election in the resort area of Kampar regency police is to establish anintegrated law enforcement center (Gakkumdu center). Abstract

The increasing growth of business activities in the field of public entertainment makesthe government need to conduct control and structuring so that the realization of qualitypublic entertainment services, efficient and more positive impact on the wider community. Inthe investigation stage, it will be determined who becomes the suspect or suspectedperpetrator of a crime. The purpose of writing this thesis, namely: First, to find out theinvestigation of criminal acts against violations of public entertainment operating hoursbased on Pekanbaru City Regulation Number 3 of 2002 Concerning Public Entertainment.Second, to find out the barriers to investigating criminal acts in violation of operating hoursbased on Pekanbaru City Regulation Number 3 of 2002 concerning Public Entertainment.This type of research used in this study is a sociological juridical legal research in theform of research that takes a rigorous approach to the nature of the law and is in accordancewith keyataan in society or the correlation of law with society, so as to be able to reveal theeffectiveness of the law in society and identify the law unwritten that applies to thecommunity, then proceed with research on primary data in the field or in accordance with therealities of life in the community.From the research results, there are two main things that can be concluded. First, theinvestigation of criminal acts against violations of public entertainment operational hoursbased on Pekanbaru City Regulation Number 3 of 2002 Regarding Public Entertainment, hasnot been carried out properly and optimally. This is proven by the fact that there are still alot of public entertainment businesses that violate operational hours in the city of Pekanbaru,but not all of them are carried out in full in accordance with applicable regulations. Second,barriers to investigating criminal acts against operating hours violations based onPekanbaru City Regulation Number 3 of 2002 concerning Public Entertainment. In lawenforcement, there are still many obstacles and obstacles that arise from inside and outsidethe law enforcement agencies which result in the inadequacy of the investigation process inaccordance with applicable law.The author's suggestion, First, is expected to the investigative officer in conductingthe investigation process in accordance with the rule of law and the investigating officer issupported by understanding and equipped with infrastructure. Second, for the sake of thesmooth and upholding of the law in accordance with Pekanbaru City Regulation Number 3 of2002 concerning Public Entertainment, to reduce obstacles in the process of lawenforcement, it is necessary to increase the legal awareness of the public entertainmentbusiness owners and the public by conducting legal socialization conducted by experiencedand insightful officers broad, improve the correlation between relevant agencies withbusiness actors and the wider community for the achievement of legal ideals.Keywords: Education-Operating Hours-General Entertainment-Criminal acts

Abstract

Republic of Indonesia is state based on law. The purpose of law is to reach the better life in society. If some one do something which is crime, then he will be punish. Basically the punishment is not only to give affliction to one person or more but there is a guidance from the state. Punishment to criminal carried in correctional institution.In corecctional institution, convicted criminal here right appropriate with Subsection 14 clause (1) latter i Undang-Undang Nomor 12 Tahun 1995 about Pemasyarakatan that at one of rights for convicted criminal is get reduced period the (Remition). Remition given is the convicted criminal rights that have to give from state if the convicted criminal already fulfill the reguirement that has been specified in the regulation.But in the Peraturan Pemerintah Nomor 99 Tahun 2012 about Syarat dan Tata Cara Pelaksanaan Hak Warga Binaan Pemasyarakatan has been strictly about remition given to corruption case convicted criminal, this point is prejudice those convicted criminal. This case related with yurisdiction wich is the function of correctional institution do founding in order to the convict criminal can get their right which is the remition appropriately with correctional system in Indonesia.Stricting the remition given to corruption case convicted criminal are not suitable with the lex of human right. Abstract

One of the problems that occur in the Criminal Justice System is the violation of rights at one or all levels of examination. These violations can be in the form of procedural violations, administrative violations, personal violations of the suspect to serious violations such as the fabrication of witnesses and the fabrication of evidence of a case. If a suspect's information which is allegedly committed a criminal act is used as evidence for the investigator, it turns out that the acquisition is based on pressure or coercion that results in psychological and physical suffering and creates fear. Acquisition of information as evidence must be declared invalid because it may contain an engineered confession. Violations of procedures and misidentification of victims of criminal acts that still occur today are seen as a result of the weak professionalism of law enforcement officers. Cases of wrong procedures and wrong investigations can lead to errors in determining the culprit or what is often called a wrong arrest. This happened in Case Number 47 / Pid.B / 2018 / PN Mandailing Natal. The purpose of writing this thesis, namely: first, knowing juridical analysis of Decision Number 47 / Pid.B / 2018 / PN Mandailing Natal on victims of wrongful arrest based on Law Number 8 of 1981 concerning KUHAP. Second, knowing the basic analysis of judges' consideration of Case Decision Number 47 / Pid.B / 2018 / PN Mandailing Natal for victims of wrongful arrests under Law No. 8 of 1981 concerning KUHAP.The type of research used in this legal research is the normative juridical method. Therefore, it is used an analysis with a qualitative measure based on the substance of the data collection in drawing conclusions. In drawing conclusions the author uses the method of deductive thinking, which is a way of thinking that draws a conclusion from things that are general to things that are specific.From the results of research and discussion it can be concluded, first, the existence of law enforcement officers who are not professional in carrying out their duties in accordance with the provisions of Law No. 8 of 1981 concerning KUHAP. Second, the judge in deciding a criminal case must consider the formal requirements of evidence and regarding the strength of evidence the judge must see firsthand whether there is correspondence between one and another evidence, the judge should look at the facts that occur in the trial.Keywords: Criminal Justice System, Wrong Arrest, Decision
