Abstract

The development of mass media today is growing rapidly to be accepted and consumed by the public, whether news that smells negative or positive. The press and mass media are also very supportive for the success of development and the achievement of a just and prosperous society based on Pancasila in addition to the facilities that support the implementation of other development.As for the problems in this research is the cause of violent crime against journalists who are carrying out duties and professions. The legal rules concerning violent crime committed against journalists who are carrying out their duties and profession and legal protection against journalists who are subjected to criminal acts of violence in carrying out duties according to the Criminal Code and Law No. 40 of 1999. This research includes research normative law, including research on the inventory of positive law, legal principles, clinical law research, systematic legislation, synchronization of a legislation, legal history and comparative law.Legal arrangements against journalists of criminal acts of violence in performing professional duties Article 28 of the 1945 Constitution. Law Number 40 Year 1999 concerning the Press. Law Number 39 Year 1999 on Human Rights. Causes of violence against journalists are Internal Factors, Weak Regulation, Changes in legislation, Incompetence of journalists, Standards competence of journalists against changes in the laws of the press. External factors. Perpetrator of Persecution Not Understanding Journalist is a Profession Protected by Law and Constitution. Journalists who do not work in accordance with journalistic code of ethics and Law no. 40 of 1999. Press companies that have not been total in defending journalists. Criminal law policy against journalists in performing professional duties, namely: Penal Penal path, namely by applying criminal law (criminal law application). Non Penal The non penal path is done in a way that is: prevention without punishment, including the imposition of administrative sanctions and criminal and civil sanctions. Affects the public's view of crime and mass media development (influencing views of society on crime and punishment).

Abstract

The AGO is not only in charge of prosecution, but also as executor of the judge's decision which has obtained permanent legal force, as regulated in Article 270 of the Criminal Procedure Code which appoints the prosecutor as the executor of the court decision. Therefore the Public Prosecutor's Office Indragiri Hulu in addition to the prosecution of criminal acts, also focused on the evidence that has been picked on the content of court decisions. Which is known in terms of execution of judicial decisions by judges about the evidence is so under-emphasized because in the case of the trial, the defendant in the case of the criminal act is focused. Judging from its authority, the prosecutor's office has the right in returning the evidence which has been listed by the judge in the execution of the court decision whether it belongs to the defendant or the victim, judging from the storage place of the evidenced so much, the writer is interested to examine the execution of the judge's verdict which has the permanent legal force for the return of evidence at the Indragiri Hulu State Prosecutor Office.The researcher wants to study and answer the problem of how the execution of the judge's decision which has the permanent legal force over the return of the evidence? as well as the barriers that occur in the implementation of the return of evidence that has obtained legal force remains? and also how the efforts undertaken in overcoming the barrier of return of evidence that has obtained legal force remains?The method that writer use is by method of sociological approach with collecting data as follows: literature study, document study, and interview.The results of the study and discussion can be concluded that the judge made a letter of passage of the verdict, the decisions came out 1 week after the verdict was read by the judge. The petition of the verdict is then granted to the prosecutor for the prosecutor to prepare the minutes of the judge's determination (BA-6) and make the report of the evidence-taking event (BA-20), then (BA-6) and (BA-20) awarded to the defendant or party which is mentioned in the contents of the decisions made by the judge, because the minutes of the proceedings constitute notification of the collection of evidence as stated in the contents of the decision in the Prosecution or RUPBASAN. Abstract

As contained in Article 1 number 21 of Law Number 6 Year 2011 on Immigration, Tingga Permit is a permit granted to foreigners by an immigration official or an official of a foreign office to reside in the territory of Indonesia. It permits the stay by foreigners is a provision which is prohibited by law no mor 6 of 2011 on immigration governed by Article 122 which reads, shall be punished with imprisonment for a period of 5 (five) years and a maximum fine of Rp500. 000.000,00 (five hundred million rupiah): a. Any foreigner who deliberately misuses or performs activities that are inconsistent with the intent and purpose of granting a residence permit granted to him; b. Any person who orders or gives opportunity to a foreigner misuses or undertakes activities that are inconsistent with the intent or purpose of granting the residence permit granted to him or her.The type of research or approach done by the author is juridical sosilogical legal research. This research was conducted at the Office of Immigration Class I Pekanbaru. This location was chosen because the criminal case of immigration permit misuse was done by foreigners in Pekanbaru area. In this study the authors menggunakas data sources that can be grouped as beriku: Primary data, ie data obtained directly in the location of research. Secondary data, that is data obtained indirectly through a library (library research).From the research problems that dihad fire by the Immigration Office Class I Pekanbaru, namely: First, the law enforcement carried out by the criminal act of abuse of immigration to the residence permit by foreigners. Second, obstacles or experienced pengahambat factor k piha weld Immigration All I Pekanbaru in conducting law enforcement abuse of a residence permit is the lack of immigration officials is not comparable to the work area. Abstract

This study discusses about the Political Law of Dissolution of SocialOrganizations in Government Regulation in Lieu of Law No. 2 of 2017. Thehistory of the publication is based on the government's claim that Law No. 17 of2013 on Community Organizations is not effective in preventing the massorganizations that are against the Pancasila. Prior to this Lieu of Law, the case ofthe dissolution of mass organizations was carried out through the District CourtHowever, in Lieu of Law No. 2 of 2017 Chapter 80A which stipulates that inrevocation of certificates registered by the Minister at the same time declareddissolved. The President shall have the right to enact a Government Regulationin lieu of law. As this is not in accordance with the state of Indonesia when theissuance of this lieu of law. The aims of writing this thesis are; First, to knowwhat is the political law in Government Regulation Substitute Law No. 2 of 2017.Second, to know whether Lieu of Law No. 2 of 2017 in accordance with theprovisions of Chapter 22 Point (1) of the Constitution The Republic of Indonesiaof 1945.This research is normative legal type research in finding the truth ofcoherence. This normative legal research uses secondary data, the data collectingtechnique of this research is using literature studies.From the results of the research, there are two main things that can beconcluded. First, the legal politics of the establishment of Lieu of the Law No. 2 of2017 is the process of dissolution of accelerated social organizations in terms ofits mechanism; Secondly, the appropriateness of crucial meanings between Lieuof the Law. No. 2 of 2017 and the provisions of Chapter 22 Point (1) of The 1945Constitution is not fully fulfilled. The writer's suggestion, Firstly, in forming thelaw the government have to establish the direction of the policy with theobjectives of the state of Indonesia; Secondly, the President should analyze theelements of the interests of the force based on the considerations of the experts oflaw as well as the consideration of state circumstances.Keywords: Political Law - Dissolution - Mass Organization

Abstract

Crime has become a universal phenomenon, meaning there is no society without any evil. Sadly crimes occurs within the scope of law enforcement itself is the police whose duty to maintain order and welfare of the community. The rise of cases of police misuse of firearms make the lack of public confidence in the Police. Criminal politics as a rational effort of society in tackling crime operationally can be done either through penal facilities or non penal means. Given the limitations / capabilities of criminal law in combating crime misuse of firearms that can not only use penal means but also using non-penal means. When viewed from the perspective of criminal politics on a macro basis, the policy of handling criminal acts of weapons misuse by using facilities outside of criminal law or non penal policy is the most strategic policy. This is because non-penal efforts are more as a precaution against the misuse of firearms. Abstract

Peran BPD (Badan Pemusyawaratan Desa) merupakan lembaga perwujudan demokrasi dalampenyelenggaraan pemerintahan desa. Perumusan peraturan desa adalah penjabaran dari berbagai kewenanganyang dimiliki oleh desa, tentu saja berdasarkan kebutuhan dan kondisi desa setempat, serta mengacu padahukum dan peraturan yang lebih tinggi. Sebagai produk hukum, peraturan desa tidak boleh bertentangandengan peraturan yang lebih tinggi dan tidak boleh merugikan kepentingan publik. Sebagai produk politik,peraturan desa disusun secara demokratis dan partisipatif, yaitu proses persiapan yang melibatkanpartisipasi masyarakat. Masyarakat memiliki hak untuk mengusulkan atau memberikan masukan kepadakepala desa dan kepala desa dalam proses penyusunan peraturan desa.Penelitian ini dilakukan di Desa Pulau Panjang Hilir, Kecamatan Inuman, Kabupaten Kuansing, dariinformasi di lapangan dan kondisi sosial, menunjukkan bahwa kewenangan lembaga BPD dalamberpartisipasi dalam mempersiapkan APBD sebagian dilaksanakan dan sesuai dengan apa yang diharapkan.memainkan peran optimal. Banyak faktor yang memicu rendahnya kinerja BPD Pulau Panjang Hilir dalammenjalankan fungsi legislasi baik faktor internal maupun eksternal. Faktor internal yang menghambat peranBPD dalam menjalankan tugasnya meliputi tingkat pendidikan anggota BPD yang masih rendah rata-ratauntuk lulusan sekolah dasar, menengah pertama, fasilitas pendukung kerja dan infrastruktur yang masihkurang persyaratan, sehingga sebagai anggota BPD yang berfungsi sebagai badan legislasi desa tidak dapatberfungsi secara optimal.Untuk itu semua pihak yang terlibat dalam pemerintahan desa diharapkan mampu memahami danmenyadari fungsi, peran dan kewenangan masing-masing sehingga ke depan tidak akan ada kesalahpahamantentang posisi antara BPD dan pemerintah desa. Dan sinergi atau kerja sama antara pemerintah desa danBPD harus diperkuat dan mendorong masyarakat desa untuk lebih mengekspresikan aspirasi mereka kepadapemerintah desa dan BPD. Dan pendidikan anggota BPD harus dipertimbangkan karena itu adalah prosestransformasi pengetahuan dari seseorang ke orang lain secara sistematis dan pengembangan dasar. Dengankata lain, pendidikan adalah upaya mendorong pengembangan cara berpikir dan merangsang tumbuhnyapola pikir anggota BPD.

Abstract

Criminal liability can not be discharged from the discussion of a criminal act. It is impossible for a person to be convicted or liable if the person does not commit a crime. The person must take criminal liability if he has made a mistake. Thus, the occurrence of criminal liability because there has been a crime committed by a person. Doctor Co-ast devote themselves in the health field and have sufficient knowledge and skills to make health efforts. The young doctor is a medical graduate student who follows the medical coercion counselor's office to obtain a medical profession degree. In this case, many of us see there are some hospitals that use the services of Doctor Co-ast. There are, however, some doctors in hospitals who use the services of a Young Doctor or Doctor Co-ast in dealing with the patient if the Doctor is not in place or is examining another patient. However, looking at some examples of cases, there has been an omission done by the dokter co-ast in the hospital he placed but the negligence is not yet known how the accountability of the hospital itself and also from the young doctor. The problems and objectives that will be discussed in this thesis is to know how the criminal responsibility of the candidate of health worker and the hospital for negligence in the medical action done by the prospective health worker.This type of research is normative juridical, because in this study the authors match or evaluate a decision to the law that has been valid, the source data used, primary data, secondary data and tertiary data, data collection techniques in this study by interview and literature study .From the results of this study it can be concluded that the mistakes made by doctor co-ast directly related to the doctor as a party yag party can be held legally accountable that does not show the activities of the young doctor's office during his learning activities in the hospital. And if the occurrence of an action in the form of negligence, then the party responsible for such negligence is the supervisor of the hospital.Keywords: Accountability - Criminal - Medical Personnel - Medical Actions

In fact the Senateoften doesn’t representation of public’s law, but prioritised their concerns.State’s will representation in national politics, which is statementsto appliesnational law and towards of the system formed would be developed.The purpose is :First, Islamic Political Parties contribution to forming alaw since reformation, Second, the extent Islamic Political Parties implicationto forming a law since reformation.The kind of the research is normative legal research, the research basedon the understanding that coherence of the truth, that law is prescriptive andapplied, jurisprudence of research in natural sciences and social sciencescan’t be applied in Legal studies.The conclusion of the research result is hadtwo points. First, formed law is authority House of People’s Representativesbased on 1945’s constitution. Islamic Political Parties contribution to forminga law there’s no regulation about Islamic Political Parties initiative to appliedbecomes Indonesia’s active law. But on process Islamic Political Parties usetheir constitutional rights to arrange their ideology becomes materials ofactive law, although not necessarily accepted. Abstract

Law enforcement is a series of efforts, processes and activities to make the law apply as it should. Tax is seen as very important in a welfare state that is as an income to improve the social welfare of the people in the country. But in reality in Indonesian society in general, often there are criminal acts in the field of taxation in the form of negligence and intentionality, both by the taxpayer itself. So that there is a loss of state financial revenue that comes from taxes. The purpose of writing this thesis is First to find out the law enforcement conducted by the Directorate General of Tax of Riau and Riau Islands against the perpetrators of taxation crimes in Riau. Secondly, to find out the factors that cause taxpayers to commit taxation crimes at the Directorate General of Tax Riau and Riau Islands. Third, to find out the obstacles faced by the Directorate General of Tax Riau and Riau Islands in carrying out the enforcement of taxation criminal law by taxpayers.From the results of research conducted there are three main things that can be concluded. First, law enforcement in the field of taxation in general has not been optimal and implemented as expected. Because in the implementation of taxation criminal law enforcement prioritizes tax criminal law which is ultimum remedium meaning criminal acts as a last resort if previous efforts such as appeals, coaching then inspection of taxpayer compliance is not ignored. Second, there are several factors that cause taxpayers to commit taxation crimes, especially factors from humans themselves. Third, there are several obstacles and must be resolved faced by the Directorate General of Tax, Riau and Riau Islands, in carrying out enforcement of taxation criminal acts by taxpayers.Keywords: Law Enforcement-Tax-Tax Crime

Abstract

Judicial Review of the Voters List in the implementation of the legislative elections based on the Regulation of the General Election Commission Number 9 of 2013 on the Compilation of the General Election List of Legislative Members has clearly stated that the process of updating the voters list from the Temporary Voter List (TVL), Temporary Voter List Result of Improvement (TVLRI), Permanent Voter List (PVL), Supplementary Voter List (SPVL) and Special Voters List (SVL) have been neatly arranged through synchronization or matching of population data conducted by the Minister of Home Affairs to the General Election Commission (GEC). The main problem in this research is how the process of compiling the voter list and the efforts that can be done by the General Election Commission (GEC) of Riau Province as the organizer of the General Election.This type of research uses sociological legal research method, which is a legal research that wants to see the correlation between law and society so that it can know the enactment of positive law within the society or review the existing problems in the field related to the applicable legal aspects and which regulate the problem.The result of this research is that the failure of the realization of the implementation of program / activity of stages pemutkhiran data of Voters and the compilation of voter list by General Election Commission (GEC) Riau Province and ranks, General Election Commission (GEC) of Riau Province and its staffs do not want to involve Election Supervisory on supervision preliminary data requirements, Aggregate Data of Population (ADP) and matching by the General Elections Commission (GEC) of Riau Province, in addition to the participation of the General Election is less concerned with the prevailing laws and regulations in publicizing and socializing regulations related to the determination of the voters list as a precautionary measure of the violation of the General Election.Keywords: Updates-List of Voters-General Election.
