Abstract

With the background of the occurrence of conflict and disunity between the RegionalHead and Deputy Regional Head in Padang Lawas Regency which originated from the tidsk theRegional Deputy Head is involved in the administration of government so that the writer isinterested in researching it.The research method used in this thesis is a sociological legal research that is classifiedin the category of observational research (observational research). With Padang Lawas Regencyas the research location, but the authors chose the Regional Head and Deputy Regional Headwho carry out governmental tasks in Padang Lawas Regency with consideration, while thepopulation in the study was the Regional Head and Deputy Regional Head who served in thePadang Lawas Regency 2019-2024 service period as well as other authorized officials such asAssistant for Government, Head of government, Head of Law. Because the entire population ispossible to be sampled, the authors conducted a total sampling method in this study. While thesource of data in research is primary data obtained from samples and research locations usinginterviews, field observations and secondary data through literature studies and other primarylegal materials.The results of this study are that the Implementation of the Authority of the DeputyRegional Head in Law Number 23 Year 2014 is not clearly regulated because it only explains thegeneral description of the tasks of the Regional Head and Deputy Regional Head, while theauthority of the Deputy Regional Head, is only a delegation and mandate from the RegionalHead whereas the implementation of the division of authority of the Regional Head and DeputyRegional Head in Padang Lawas Regency is not going well which has implications for theoccurrence of conflicts and divisions due to the weak legislation that governs the distribution ofthe authority of Regional Heads and Deputy Regional Heads, both in the form of Laws Law, PP,PERDA, the source of authority granted Law Number 23 year 2014 on Regional Government toDeputy Regional Heads is only mandate / delegation authority not attribution, weakconstitutional basis for the existence of Deputy Regional Heads in the Constitution and politicalagreements such as financial and financial resources PEMILUKADA.The author's suggestion, in order to realize the objectives of regional autonomy theauthors suggest to the Parliament as a UUD 1945 Constitution by clarifying the existence of theDeputy Regional Head in the structure of regional government in Indonesia and strengtheningthe duties and authorities of the Deputy Regional Head in the form of legislation so that it has aposition and authority the stronger one.Keywords : Authority – Deputy Region Head – Regional Goverment

Abstract

Supervision is the process of examining the implementation of an activity that has been previously planned. Supervision of health services at the Bangkinang Hospital is one of the responsibilities of the Kampar District Health Office. In the periodic supervision carried out by the Kampar District Health Office on the Bangkinang Hospital, it is hoped that it can produce results by increasing health services from the Bangkinang Hospital. In this paper the authors focus on monitoring conducted by the Department of Health carried out as for the purpose of writing this paper: First, to find out the oversight conducted by the Health Service Ka Kampar district to Bangkinang Hospital. Second , to find out the inhibiting factors in the supervision process. Third , to find out the efforts made to overcome obstacles in the supervision process.Research conducted by the author, found the results that supervision has been carried out. However, there are still obstacles, one of which is the high expectation of getting excellent health services. So that the Health Office seeks to improve services by increasing the type of Bangkinang Hospital.The author's suggestion is to increase the accuracy of the Health Office in carrying out supervision following up on complaints from the community.Keywords: Department of helth- Hospital Bangkinang - Supervision - Health services.

Abstract

Indonesia applies the concept of the omnibus law in drafting laws. Omnibus law is a concept of making regulations that combines several rules with different regulatory substances, into one regulation under one legal umbrella. However, in the drafting process there were several irregularities that occurred such as the exclusion of public participation and a closed and hasty process which was contrary to Article 5 of Law of the Republic of Indonesia Number 15 of 2019 concerning Amendments to Law Number 12 of 2011 concerning Establishment. LegislationThis type of legal research is normative legal research. The normative legal approach used in this study is the statute approach, while this research is descriptive in nature.The result of this research is the legal politics of the formation of laws using the omnibus law method based on the Indonesian legal system, namely that the discussion was carried out in a hurry so that it collided with other laws, there was no government effort to involve the public, especially from civil society organizations and labor unions. The formulation of the Job Creation Bill is not transparent and lacks openness. The procedure for the formation of laws using the omnibus law method based on the Indonesian legal system, namely in the hierarchy of the order of laws and regulations in Indonesia as stipulated in the Law of the Republic of Indonesia Number 15 of 2019 does not include the omnibus law method as one of the principles in legal sources as well as a methodological framework for revising statutory regulations.Keywords: Political Law, Omnibus Law, Indonesian Legal System

Abstract

Accountability and openness are forms that are pursued in creating good governance. The accountability that must be carried out by the government is an embodiment of efforts to provide information related to every action or activity of government administration that has village finances. In this case, it cannot be separated from both the central government to the smallest level, namely the village government which is the focus of this research. As for the form of village government accountability in the form of an obligation to provide transparency in the form of budget realization, realization of activities, remaining budget and address of complaints to the village community as stated in article 72 of the minister of home affairs regulation number 20 of 2018 concerning village financial management. However, in this case, the village government of Kasikan, Tapung Hulu Subdrict, Kampar District, has not implemented it optimally.This type of research is a sociological juridical which emphasizes a research approach to the legal aspects related to the subject matter to be discussed, related to the facts or facts in the research location. This research was conducted in Kasikan Village, Tapung Hulu District, Kampar District, Riau Province. By conducting research in the Kasikan village government, the Kasikan Village Consultative Body, Customary Figures, PKK, and Kasikan Village Communities.In the result, there are three main points that can be concluded. First, the accountability and tranaprency of reports on the use of village finances to the community carried out by the kasikan village government have not been implemented properly according to the mechanism in accordance with applicable regulations. Second, the inhibiting factor in implementing the fulfillment of community rigths related to village finances by the village government is due to the wide area of the kasikan village, inadequate human resources, weak community participation, and inadequate facilities and infrastructure in village administration. And third, efforts to fulfill village financial reporting obligations to the community by the village government are only carried out in the form of banners and billboards in front of the kasikan village office. However, the village government will strive to increase community participation and further increase the suvervision of the village consultative body.Keyword: Accountability-Financial-Village

Abstract

Indonesia adheres to the separation of power system and adheres to the Trias politica un-derstanding, where the government system is divided into 3 rooms, legislative, executive and judicial, each of which carries out its duties and functions with a mechanism of checks and bal-ances both in normal and abnormal conditions (state of emergency). Covid-19 which became a world epidemic attacked and affected the state of a country, until Indonesia with the authority given to the 1945 Constitution to the Executive in this case the President to deal with crises and emergencies by issuing a government regulation in lieu of Law Number 1 of 2020 concerning financial policy, where it is hoped that this Government Regulation in Lieu of Law will be able to overcome the economic crisis and become a legal umbrella in terms of diverting APBN funds for the benefit of health recovery and economic recovery. The formulation of the problem pro-posed is how the mechanism of checks and balances against the government in the issuance of Law Number 2 of 2020 regarding financial policy and what is the compelling urgency in the background of the government Regulation in Lieu of Law Number 1 of 2020 concerning finan-cial policy in terms of the decision of the Constitutional Court Number 138 of 2009.This research is a normative juridical research, research conducted based on legal materials and legislation. The approach taken is close to the library approach, namely by studying books and legislation. The types of data used are primary data types, secondary data sources, namely data sources derived from books and other regulations.The theory used in this research is the theory of Trias Politica and the theory of Emergency Constitutional Law. From the research results, the trias politica theory requires a clear separation of powers in order to prevent centralized power and the issuance of government regulation in lieu of Law Number 1 of 2020 concerning financial policy into Law Number 2 of 2020 concern-ing financial policy. the important roles and tasks of the legislature, especially in terms of budg-eting or budgeting tasks with the argument to facilitate policy directions in dealing with the co-rona pandemic. And the president takes refuge in the provisions of the 1945 Constitution Article 22 paragraph (1) it is stated that in matters of urgency that force the president to have the right to stipulate government regulations in lieu of the law. This study also conducted a study on whether the issuance of this Government Regulation in Lieu of Law Number 1 of 2020 fulfilled the ele-ment of compelling urgency in accordance with the provisions of the Constitutional Court's deci-sion Number 138 of 2009.Keywords: Government regulation in lieu of law Number 1 of 2020, Trias Politica, Checks and balances, Coercive Crisis.

Abstract

Basically, meeting the need for a house as a place to live or occupy is theresponsibility of the community itself. However, the government, local governments, andprivate companies engaged in housing development are encouraged to be able to assist thecommunity in meeting the need for a house as a place to live or shelter. In the use of space forresidential areas in Pekanbaru City is not evenly distributed, we can see this from the divisionof clustered built areas. Therefore, the Government must make a policy to even out thedevelopment of residential areas. The purpose of writing this thesis, namely: First, todetermine the synchronization of Pekanbaru City Regional Regulation No. 12 of 1998concerning the General Spatial Plan of Law no. 1 of 2001 concerning Housing and SettlementAreas in spatial use for residential areas in Pekanbaru City. Second, to determine the role ofthe Government in the use of space for housing and residential areas.This research is a sociological juridical legal research, which is a research approachthat emphasizes the legal aspects (laws and regulations) with respect to the subject matter tobe discussed, linked to the realities in the field. This study uses primary data sourcesconsisting of primary, secondary and tertiary legal materials.From the research results, it is concluded that, first, that the synchronization betweenPekanbaru City Regional Regulation Number 12 of 1998 concerning General Spatial Planningwith Law Number 1 of 2011 concerning Housing and Settlement Areas fully supportspreserving the environment by utilizing space for residential areas according to with itsdesignation as long as it does not conflict with statutory regulations. By directing policieswisely in controlling spatial use through zoning regulations, licensing, providing incentivesand disincentives, and imposition of sanctions. Second, the role of the Pekanbaru CityGovernment is an embodiment of the distribution of powers in carrying out governmentaffairs, having full authority to regulate its own regional household affairs as mandated inArticle 18 of the 1945 Constitution of the Republic of Indonesia. Abstract

This research was motivated by giving amnesty to sister Baiq Nuril who triggered various legal problems. Because it’s in a legal habit international and Indonesian constitutional practices, amnesty was only granted to the perpetrator of a politically motivated crime. So that a legal problems, namely the existence of legal uncertainty, absence equality before the law, and contrary to constitutionalism. The research question in this study is about how the criteria for granting amnesty and the ideal concept of granting amnesty? Next for the methodology used in this research is legal research normative, and analyzed qualitatively using Stufenbau theory (stufentheorie) and Hans Kelsen’s theory of positive law. In a draw the conclusion of the author uses the inductive thinking method.Of all the regulations governing the granting of amnesty, the criterion is not clear, even between Article 14 paragraph (2) of the 1945 Constitution and Law no. 11 of 1954 About Amnesty is not harmonious so that it is against stufentheorie. In ideal concept, the President must obtain amnesty approval from the DPR, in order to comply with constitutionalism. However based on analysis that has been done, it can be concluded that the legal basis of giving the criteria for amnesty by the President of the Republic of Indonesia are not clear and tend to be the direction of absolutism. Therefore, ideally the implementation of amnesty by the President Republic of Indonesia, it is based on international legal traditions and traditions Indonesian constitutional law which will be written in the regulations legislation. So the government should give amnesty, first should amend the constitution, make the Presidential Institute Law, amend it The Amnesty Law and changes to the Law on Clemency in order attainment of justice with legal certainty for all Indonesian citizens.Keywords: Amnesty Criteria – Amnesty Concept

Abstract

Since the existence of the assimilation program in the context of preventing and overcoming the spread of COVID-19, there are problems that need to be addressed, with the assimilation given whether the purpose of punishment, which is to provide a deterrent effect for perpetrators, has been fulfilled, whether it has guaranteed convicts who have received COVID-19 assimilation.. Recidivist or repetition of a criminal offense occurs in the event that a person commits a criminal act and has been sentenced to a criminal offense with a judge's decision who continues to commit another criminal act. In recidivists, it can be assumed that in the same way as the Realist discourse, a person commits more than one crime. Another factor that encourages recidivists is the ineffectiveness of the supervisory function by the Supervisory Agency (BAPAS).This research will be compiled using the juridical normative type of research, which is research that is focused on examining the application of the rules or norms in positive law. The approach used in this research is to use a normative approach, namely literature law research. This study examines the subject matter according to the scope and identification of problems through the statute approach (statue approach) is carried out by examining statutory regulations and regulations related to the legal issue under studyThe results of the research conducted by the author are, first to know the provision of assimilation to inmates in the context of preventing and overcoming the spread of COVID-19 based on the regulation of the minister of law and human rights number 10 of 2020 related to the theory of punishment, then the answer is how to achieve criminal responsibility for convicts who take recidivist action due to assimilation in the context of preventing and overcoming the spread of COVID-19 in Indonesian criminal law.Keywords: Assimilation Giving - COVID-19- Recidivist

Abstract

Rumusan masalah dalam penelitian ini adalah bagaimana tinjauan yuridis  pergeseran batas wilayah Kota Pekanbaru dengan Kabupaten Kampar, dan mengapa terjadi penolakan terhadap Permendagri Nomor 18 Tahun 2015, metode yang digunakan dalam penelitian ini adalah yuridis sosiologis. Tujuan Penelitian ini adalah untuk mengetahui aspek hukum pergeseran batas wilayah Kota Pekanbaru dengan Kabupaten Kampar dan mengetahui faktor penyebab terjadinya penolakan terhadap Permendagri Nomor 18 Tahun 2015. Adapun hasil dari penelitian adalah, bahwa Permendagri Nomor 18 Tahun 2015 cacat secara yuridis karena bertentangan dengan asas lex superiori derogat lex inferiori, dan terjadinya penolakan dari masyarakat terhadap Permendagri Nomor 18 Tahun 2015, karena proses keluarnya Permendagri Nomor 18 Tahun 2015 tidak melibatkan partisipasi masyarakat serta pemberlakuannya berdampak terhadap pergeseran wilayah administratif, yang berimplikasi terhadap status hukum hak-hak keperdataan masyarakat.

Abstract

The regions that will hold the election consist of 7 Provinces, 76 Regencies, and 18 Cities. One of them is Pekanbaru City. 5 pairs of Mayor of Pekanbaru 2017, in the implementation of campaign by all Mayor and Vice Mayor Candidates there is a violation involving parties that are prohibited by legislation to assist in campaign process.The purpose of writing this thesis are: First, law enforcement in Article 70 of Law Number 10 Year 2016 on the Election of Governors, Regents and Mayors in the election of Regional Heads and Deputy Heads of Regions simultaneously in Pekanbaru City, Second, law enforcement inhibiting factors in Article 70 of Law Number 10 Year 2016 on the Election of Governors, Regents and Mayors in the election of Regional Heads and Deputy Regional Heads simultaneously in Pekanbaru City, Third, the efforts made to overcome the obstacles of law enforcement in Article 70 of Law Number 10 Year 2016 About the election of Governors, Regents and Mayors in the implementation of the election of Regional Head and Deputy Regional Heads simultaneously in Pekanbaru City. The type of research conducted in this study the author uses the type of sociological law research, research location in this study is Pekanbaru City. Population and sample are all parties related to the problem under study. Sources of data used are: primary data, secondary data, data collection techniques using unstructured interviews.From the research results there are three main issues that can be concluded. Firstly, the enforcement of the law of Article 70 is not in accordance with the rules contained in the Law on Regional Head Election, Second, the Factor inhibiting law enforcement in Article 70 of Law Number 10 Year 2016 on the Election of Governors, Regents and Mayors in the Implementation of the Election of Regional Head and Deputy Head of Serentak Region in Pekanbaru City is: there is fear of loss of position, political interest factor, political promise given to ASN, Internal Panwaslu factor, Third, Efforts made to overcome obstacles Law Enforcement Article 70 Law Number 10 Year 2016 about the election Governor, Regent, and Mayor in the implementation of elections of Regional Head and Deputy Regional Heads simultaneously in Pekanbaru City are: Providing socialization to ASN / PNS, emphasizing to ASN / Civil Servants regarding their alignment only to the people's interest, monitoring ASN / Civil Servants so as not to eat political promises . Author suggestion, Firstly, It is expected that supervision done by law enforcers in the future is better, there should be no system of tolerance to the enforcement of election rules. Law enforcers are expected to perform their duties in accordance with the prevailing regulations, The existence of transparency of law enforcement in following up reports or findings are reported. It is expected that the revision of the legislation related to the sanctions either be criminal sanctions or administrative sanctions for candidate pair and ASN / Civil Servants and it is expected that the addition of provisions concerning membership of District / Municipal Panwaslu (human resources) amounting to only 3 people related to the provisions of Article 72 paragraph 2) point c of Law Number 15 Year 2011 regarding the Implementation of General Elections.Keywords: Law Enforcement - Election Implementation – Regional Head
