Abstract

This study aims to find out and analyze the effectiveness of structuring the function of the Green Open Ruan in Gorontalo City, as well as to find out the factors that hinder the availability of Green Open Space in Gorontalo City. The type of research used is empirical research where this research places a system of statutory norms when interacting with the community. Next described in the descriptive form to explain the results of the study. The research obtained by the authors in conducting this study includes the arrangement of Green Open Space in the City of Gorontalo, which provides ecological, socio-cultural, aesthetic, and economic benefits. However, it has not been maximized because the availability of Gorontalo City Green Open Space does not reach the standard compared to the overall Green Open Space area that has been set. Furthermore, based on the results of research obtained, the obstacles encountered in efforts to realize Green Open Space, namely barriers to inadequate land availability, as well as low community culture in maintaining and preserving urban Green Open Space.

Abstract

This study discusses the Criminalization of Homosexual acts. This research uses normative legal research. It is legal research that places law as a building system' of norma. The system' of Norm build include principals, norms, rules of law, court decision, agreements, doctrins (teachings). The author finda the conclution on this study that the legal vacuum regarding the regulation of same-sex sexual relations is something that we must pay attention to because the absence of law Governing this matter is a matter that is very urgent for the government to review and must make arrangements as soon as possible. Detailed and clear so that it is precise and easy to implement by law enforcement officials.

Abstract

This study aims to analyze the chronology of cases of forced defense decisions. Normative research methods using statutory research approaches and case approaches and analytical techniques used to process legal materials are legal hermeneutics. The results of this study indicate that the decisions 794/Pid.B/2014/PN.Llg and No.257/Pid.B/2015/PN.Sky has fulfilled the elements of the noodweer requirement, namely that defense is coercive, what is being defended is oneself ), there was a very imminent threat of an imminent attack at that time, and that attack was against the law. has also fulfilled the element of the principle of subsidiarity which is the benchmark for forced defense. The disparity of decision No. 794/Pid.B/2014/PN.Log and the decision No. 257/Pid.B/2015/PN.

Abstract

The purpose of writing to be achieved in this paper is to know and analyze the return of state losses in the investigation process that can eliminate criminal perpetrators of corruption.  This research is a normative legal research using  the statutory approach "statute approach", the case approach "case approach", and the  conceptual approach "conceptual approach".  This study used analytical descriptive analysis techniques. The results of this study show that the return of state financial losses in the investigation stage of corruption can stop the process of handling criminal acts through police discretion. One of the elements of corruption is the element of state loss, meaning that when it has been returned, it means that the element has been lost, meaning there is no loss as a logical consequence of the Constitutional Court decision No. 25/PUU-XIV/2016. But with the condition that it must be before the investigation stage through police discretion and if it is based on  the Lex Posterior Derogate Lege Priori, meaning that the new law overrides the old  law, meaning that the new regulation ignores or overrides the old regulation in the same respect

Abstract

The purpose of this study is to analyze and construct a model of legal protection for victims of illegal investment crimes.  This research is a type of normative research using several approaches, namely the statute approach,  case approach, and conceptual approach.  The analytical technique used in this study is using analytical descriptive techniques. The results showed that the legal protection model for victims of illegal investment is to reform the Money Laundering Law with an asset recovery approach to the Corruption Eradication Law. The concept contained in Article 18 of the Corruption Eradication Law is an additional crime that can be conceptualized in the provisions of the Money Laundering Law.

Abstract

This study aims to determine the police's efforts in tackling the crime of child abuse, and to find out the factors that hinder the police in handling cases of child abuse in the jurisdiction of the Bone Bolango Police. The type of research used is empirical research with a case approach. The results of the study show that the police's efforts to deal with criminal acts of child molestation are carried out through preventive and repressive efforts. Abstract

The purpose of this research is to determine the implementation of diversion efforts against children who commit crimes at LKS Ummu Syahidah Gorontalo. The research method used in this research is an empirical research method using a qualitative approach. The results of this research are that the application of diversion in resolving criminal acts of abuse committed by children at LKS Ummu Syahidah Gorontalo is not yet optimal because from 2021 to 2023 there are only nine criminal acts that meet the requirements for diversion. One of these criminal acts was abuse committed by L who was under 17 (seventeen) years of age. However, in terms of compliance with procedures and regulations, all stages of diversion at LKS Umm Syahidah Gorontalo are in accordance with applicable laws and regulations by the child perpetrator or family, such as asking for compensation that is too large which the child perpetrator or party cannot afford. family so that the implementation of diversion does not reach a successful agreement.
