Abstract

The enforcement of enviroment law according to the environment management law can be implemented both in a preventive and repressive manner. The legal instrument used is administrative law, in the formot an obligation imposed upon each person who intends to run a business, to first obtain an environmental impact assessment of the proposed business. The represive enforcement of law aims to reduce and abate exising environmental damage of pollution by using administrative law civil law and criminal law. The protection of crime can be done with dragging mutilation perpetrator and or environmental contamination to court. Sanction fallout of administration, compensatory suing and area recovery, and criminal prosecution done to mutilation perpetrator and or environmental contamination in the same case is not ne bis in idem.

Abstract

ABSTRAK Tujuan penelitian ini adalah untuk mengetahui dan menganalisis faktor yang menjadi penyebab penyalahgunaan narkotika oleh pegawai negeri sipil dikota gorontalo serta upaya penanggulangan terhadap penyalahgunaan narkotika oleh pegawai negeri sipil di kota gorontalo. Jenis Penelitian yang digunakan oleh peneliti dalam menyusun Penelitian ini adalah jenis Penelitian normatif-empiris, Adapun pendekatan yang digunakan oleh peneliti dalam menyusun penelitian ini adalah, antara lain: Pendekatan Perundang-Undangan (Statue Approach); Pendekatan kasus (case approach). Hasil penelitian ini menunjukan bahwa faktor-faktor terjadinya penyalahgunaan narkotika yang melibatkan pegawai Negeri Sipil di Kota Gorontalo di akibatkan oleh beberapa faktor, baik faktor internal maupun faktor eksternal, faktor internal yaitu dengan mencoba-coba untuk menyalahgunakan narkotika, dan faktor eksternal yaitu dengan faktor lingkungan tempat tinggal dan lingkungan pergaulan. Dan upaya-upaya dalam penanggulangan penyalahgunaan narkotika oleh Pegawai Negeri Sipil dilakukan mulai dari upaya preventif yang dilakukan dengan cara penyuluhan dan sosialisasi tentang bahaya narkoba, upaya Represif yang bersifat tindakan penegakan hukum yang dilakukan oleh Polres Gorontalo Kota dan Badan Narkotika Nasional Provinsi Gorontalo, dan melakukan upaya Rehabilitasi secara sosial dan secara fisik, selain itu melakukan tes urine secara berkala disetiap instansi, harus adanya sosialisasi secara rutin dan penindakan hukum secara tegas bagi PNS yang melakukan penyalahgunaan Narkotika. Kata kunci: Kriminologi; Pegawai Negeri Sipil; Narkotika ABSTRACT The purpose of this study was to determine and analyze the factors that cause narcotics abuse by civil servants in the city of Gorontalo and efforts to combat drug abuse by civil servants in the city of Gorontalo. The type of research used by researchers in compiling this research is a type of normative-empirical research. The approaches used by researchers in compiling this research are, among others: the statutory approach (Statue Approach); The case approach (case approach). The results of this study indicate that the factors in the occurrence of narcotics abuse involving civil servants in Gorontalo City are caused by several factors, both internal and external factors, internal factors, namely trying to abuse narcotics, and external factors, namely environmental factors. place of residence and social environment. And efforts in overcoming narcotics abuse by civil servants are carried out starting from preventive efforts carried out by means of counseling and socialization about the dangers of drugs, repressive efforts that are law enforcement actions carried out by the Gorontalo City Police and the National Narcotics Agency of Gorontalo Province, and carrying out Rehabilitation efforts socially and physically, apart from conducting regular urine tests in every agency, there must be routine outreach and firm legal action for civil servants who commit narcotics abuse.

Abstract

This article is a study of the legal politics of regulating self-defense actions in Indonesia as well as describing the practice of law enforcement against acts of self-defense. This article will be analyzed normatively using a statutory approach and case approach. The results of the analysis show that tha act of self-defense regulated in the Criminal Code as the basis of criminal law in Indonesia shows the principles of the rule of law, as well as being a form of protection for citizens in defending their lives, especially in situations of threats and crimes.Factually, there are actions from law enforcement not continuing the law enforcement process of self-defense actions as felt by Irfan and Rofiqi in Tangerang and by Amaq Shinta in lombok. However, there are still differences in the settlement and handling of cases rleated to acts of self-defense as experienced by ZL in Malang. This Actually shows that there is injustice because there is process that influences criminal policy so that it has an impact on not fulfilling a sense of justice for every citizen as one of the guarantees in a legal state like Indonesia.

Abstract

This article aims to determine and analyze the application of the law to drug abusers and addicts based on Law Number 5 of 2009 on Narcotics and Law Number 1 of 2023 on the Criminal Code. Furthermore, to know, analyze, and construct drug crime arrangements that ensure legal protection for drug abusers and addicts. This article is normative research with a statutory approach, a case approach, a historical approach, and a conceptual approach. The results show that first, the application of the law against drug abusers and addicts has many problems, especially in the implementation of the law on narcotics. This problem has implications for regulatory bias in some articles, such as in Articles 4 and 54, which cause differences in subjects who are obliged to undergo medical rehabilitation and social rehabilitation. Furthermore, there is a tendency to use Article 111 or Article 112 charged with Article 127 (if an alternative charge) or without Article 127 (if a single charge) against drug abusers and drug users. This trend illustrates that the approach used is criminal, even if it is towards drug users, not drug dealers. Furthermore, the regulation of drug crimes in the New Criminal Code basically does not eliminate these problems because the provisions maintained through the New Criminal Code are only copies of repealed articles and no longer apply to the law on narcotics. Second, criminal regulation that ensures legal protection for drug abusers and addicts can be realized by revising the law on narcotics, which focuses on subject consistency in Article 54, Article 55, and Article 103, changing the elements of Article 127 paragraph (3) and abolishing the Explanation to Article 54.
