Abstract

The state has an obligation to prosper all its citizens from poverty as mandated in thePreamble of the 1945 Constitution of the Republic of Indonesia, including caring for thepoor. As stated in Article 34 paragraph (1) of the 1945 Constitution which states that "Thepoor and abandoned children are cared for by the state". Efforts to respect, protect and fulfillthe right to basic needs are state obligations that are carried out in order to be free fromconditions of destitution and poverty. These efforts must be made by the state as a top priorityin national development, including for the welfare of the poor.The type of research used is normative research, or it can be called library research,namely conducting a study of the applicable law and how it is in reality in society throughanalysis of library data. Data collection techniques in this research using literature studiesby analyzing books, laws and regulations to policy-related studies and other literature.From the results of the study, it is concluded that, first, the State, in this case theGovernment of Indonesia, is responsible for fulfilling the right to obtain businessopportunities for the poor in accordance with Article 17 of Law Number 13 of 2011concerning Handling the Poor despite the Covid-19 Pandemic, Second, the Governmentfaces various obstacles in fulfilling business opportunities, including restrictions due to theCOVID-19 Pandemic itself, the large number of people who work in the non-formal sector,poor data collection on recipients of social assistance, socialization that is not optimal andcases of corruption by officials against existing assistance.Keywords: State Responsibility – Poverty – Covid-19 Pandemic

Abstract

Indigenous peoples still use their customary laws in resolving crimes andviolations that occur in customary areas, especially crimes in theft that occur incustomary forbidden forests. The purpose of writing this thesis is first, to find outthe role of the tribal chief in maintaining the existence of customary law againstcrimes of theft in the imbo putui customary forest, Petapahan Village, TapungDistrict, Kampar Regency. Second, how is the application of customary sanctionsagainst crimes of theft in the customary forest of Imbo Putui, Petapahan Village,Tapung District, Kampar Regency.This type of research uses sociological or empirical legal researchmethods. This research was conducted in Petapahan Village, Tapung District,Kampar Regency, Riau Province. While the population and sample are all partiesrelated to the problems studied in this study, the data sources used are primarydata, secondary data and tertiary data, data collection techniques in this studyare interviews and document studies.The results of this study indicate that the important role of the tribal chiefis in maintaining the existence of customary law against crimes of theft incustomary forests and the application of customary sanctions against crimes oftheft in Imbo Putui customary forests because the perpetrators of theft assumethat the forest belongs to all people who know the forest, so the perpetrators donot know the customary law that applies in the area of the indigenous people ofPetapahan Village. The author's suggestion is for the nagari government and itsinstruments to improve oversight of the customary prohibition forest and makenagari regulations that regulate all categories of theft, so that not only timbertheft but everything that can be said to be theft is regulated in the nagariregulations and work together with local government authorities to conductoutreach to the community, so that the community knows that customary law inPetapahan Village still exists today and will not fade with the times.Keywords: The Role of the Head of the Tribe - Customary Law - ForestProhibition of Customs - Theft

Abstract

Article 19 Paragraph (2) of Pekanbaru Mayor Regulation Number 94 of 2016 states that thetask of the road and bridge preservation section is to preserve roads and bridges in order tomaintain steady road conditions in accordance with the level of service and ability when theroad is built and operated. However, it is still not applied, especially on roads in PekanbaruCity which is the authority of the Pekanbaru Public Works and Spatial Planning Office incarrying out road preservationThis type of research is sociological legal research, because it is based on field research,namely by collecting data from interviews, questionnaires, and literature reviews that have arelationship with the problem to be studied assisted by primary, secondary and tertiary dataThis research was conducted in the Regional People's Representative Council of PekanbaruCity, Public Works and Spatial Planning Office of Pekanbaru City, while the population andsample are all parties related to the problem studied. This study used qualitative data analysisand produced descriptive data.It can be concluded that, First, the Implementation of the Authority of the Public Works andSpatial Planning Office of Pekanbaru City on Road Preservation Based on Pekanbaru MayorRegulation number 94 of 2016 has not performed its duties well in the road preservationprogram Second, the inhibiting factors for the implementation of the authority of thePekanbaru City Public Works and Spatial Planning Office on Road Preservation based onPekanbaru Mayor Regulation number 94 of 2016 are poor drainage factors, weather factors,WWTP (Wastewater Management Plant) project factors, human resource factors and budgetfactors. Third, efforts made to overcome inhibiting factors are to preserve roads in PekanbaruCity regularly, improve drainage on damaged roads, and supervise the implementation of themayor's regulation.Keywords: Authority-Mayor Regulation-Road Preservation

Abstract

Sending Russian military troops into a sovereign state territory to carry out occupationsand special military operations according to international law is a form of violation of statesovereignty or what is known as an invasion. This is an act that violates international peaceand is rejected by the international community because it gives many bad influences to theinternational legal order which influence one another. Besides that, the act of attacking thesovereignty of other countries is also contrary to the theory of sovereignty to internationalcustoms.The type of research used by the author is normative legal research or what is knownas "legal research". which means that legal research is conceptualized as what is written inlaws and regulations (law in book) or law. Regarding how International Law responds to theattack carried out by Russia against Ukraine as a violation of International Law which isdetrimental to many parties, especially Ukraine.The status of the attack carried out by Russia against Ukraine according tointernational law is aggression according to what is stipulated in the UN General Resolution,because the invasion or military attack carried out by Russia against Ukraine is a form ofaggression recognized by international law. As a violation of international law in general,Russia as the aggressor must be legally responsible. The legal responsibility of the aggressoraccording to International Law is regulated as the definition of aggression was first regulatedin the UN General Resolution by giving power to the UN Security Council. Legal accountabilityto the aggressor state can also be carried out through its implementation at the ICJ(International Court of Justice) and individual accountability at the ICC (InternationalCriminal Court).

Abstract

The development of the internet provides many conveniences for humans tocontinue to make it easier to carry out their daily activities, including buying andselling. Many people create effective and efficient systems such as e-commerce. E-commerce is experiencing very rapid development so that companies createMarketplaces, one of which is Shopee. Shopee has a variety of payment systems,one of which is the Cash on Delivery (COD) system, Payment is made when thegoods reach the by buyer's. However, in this payment system there are somedrawbacks, such as price changes that occur when paying, two case about pricechanges experienced by some consumers that the author got from the Twitterplatform and one of the author's friends did not escape the incident. Things like thisare certainly very detrimental to consumers, because they require consumers to paymore than what is stated when they want to make a transaction. Based on the case,the authors are interested in studying, researching and relating this phenomenonbased on Law Number 8 of 1999 concerning Consumer Protection in writing thisthesis.The purpose of this research is to find out the COD system works on theShopee marketplace and protects consumers as a result of price changes intransactions with the COD payment system according to Law Number 8 of 1999concerning Consumer Protection. This research was conducted using a normativejuridical research approach. The method of normative juridical research approachis library law research which is carried out by examining library materials orsecondary data. In this study, the scope of research be carried out by drawing legalprinciples, which are carried out on written and unwritten positive laws.From the results of this study, that consumers should properly know therules and be careful when doing the transaction, consumers must set awarenessabout anything that harm. An institution is needed for consumer protection, whichsupervises consumer rights in e-commerce. Business actors must uphold highintegrity in carrying out their business. Electronic service providers should createa special service and complaint procedure for consumers who feel their rights arenot being fulfilled.Keywords: COD, Consumer, Shopee

Abstract

Plastic pollution is a global problem and must be tackled in a sustainable manner. Oneform of effort to protect the marine environment is found in the 1982 United NationsConvention on the Law of the Sea (UNCLOS 1982) which can be seen in article 235UNCLOS 1982, and the International Convention for the Prevention of Pollution from Ships1973, (MARPOL Convention 1973), In MARPOL 1973 Annex which regulates theprevention of marine pollution from plastic waste is Annex 5 concerning the prevention ofwaste pollution from ships, contained in Regulations 3 (Disposal of Garbage Outside SpecialAreas). This study aims to determine the role of international law in regulating issues ofsingle-use plastic waste pollution against the protection of the marine environment ofIndonesia and Indonesia's role in implementing efforts to reduce single-use plastic pollutionthrough provisions of international law.This type of research includes the type of normative juridical research. To obtain datain this legal research, the authors use several approaches, namely the statute approach, caseapproach. This research uses literature research by obtaining secondary data in the form ofliterature books, research results, journals, articles, and legal regulations related to the objectof research.From the results of the research that has been done, there are two main things that canbe concluded. First, with the continuing increase in the amount of single-use plastic wastepollution in the sea, this proves that the role of UNCLOS 1982 and MARPOL 1973 has notbeen able to stop the rate of pollution that is occurring, plus UNCLOS 1982 has notspecifically regulated plastic waste, this has had a negative impact on marine biota which canalso impact the economy, health, social. Second, International Law and National Law haveregulated the prevention of environmental pollution. Both UNCLOS 1982 and Law 32 of2009 have regulated pollution prevention rules. One of the main challenges in overcomingthe problem of marine plastic waste in Indonesia is the absence of specific laws that regulatemarine plastic pollution. Even though Indonesia already has a legal basis for protecting andmanaging the marine environment, such as Law Number 32 of 2009 concerning theProtection and Management of the Environment, and Law Number 32 of 2014 concerning theSea, there is no law that specifically deals with marine plastic waste.

Abstract

Online Lending Services are regulated by The Financial Services Authority(OJK) Number 77/POJK/01/2016 concerning Information Technology-BasedBorrowing and Borrowing Services. When a customer makes an online loantransaction, the desk collector will fill out the customer’s debt. However not a fewof these desk collectors cause criminal acts for their customers, many of theircustomers are constantly threatened by desk collectors so they feel threatened andare afraid of the threats from the desk collectors. Regarding criminal liability, it isoften limited to being borne by third parties. The main issues in this research are:How is law enforcement against Online Loan Services causing criminal actsagainst consumers of online loans; How is the criminal liability of online loanservices that causes criminal acts against consumers of online loans.The type of research used in this research is normative legal research or itcan also be called doctrinal legal research. Normative legal research is library lawresearch. This research is focused on legal principles. The principle of law used inthis research is the principle of expediency. The data analysis used in this researchis qualitative data analysis which will produce descriptive data.From the study results, it was concluded that, first, based on the legalanalysis conducted, law enforcement has not been fully applied to online loanservices as corporations. This is marked by the burden of criminal liability whichis only borne by third parties when it should have been the online loan services whowill take responsibility However, law enforcement is still minimal, even thoughArticle 53 paragraph (1) of the Financial Services Authority Regulation Number1/POJK.07/2013 concerning Consumer Protection in the Financial Services Sectorhas directed this matter. Second, criminal liability so far has only focused on thirdparties, while online loan services as business entities are not subject to criminalliability. This is because regulations regarding online loan arrangements havelimitations in terms of specific rules (lex specialis) which result in online loanservice businesses still being able to operate even though the desk collector hascommitted a crime and has been given a sanction.Keywords: Criminal Liability – Online Loans – Criminal Acts - Consumers

Abstract

This research raises the background of the problem regarding LawNumber 20 of 2001 concerning Corruption Crimes Associated with LawNumber 2 of 2020 concerning State Financial Policy and Financial SystemStability for Handling the Corona Virus Disease 2019 (Covid-19)Pandemic. Second, Social Assistance Program Deviations Practices Seenfrom the Perspective of Law Number 20 of 2001 Related to Law Number 2of 2020. Third, regarding criminal responsibility for deviations fromsocial assistance programs related to efforts to tackle Covid-19.This study aims to: First, to know and understand the practice ofdeviating from social assistance from the perspective of Law Number 20of 2001 in relation to Law Number 2 of 2020. Second, To know and knowcriminal responsibility for deviations from social assistance programsrelated to Covid-19 countermeasures.This research uses juridical-normative research (library lawmethod) because the purpose of this research is to provide a systematicand comprehensive picture or picture. The data analysis used in thisresearch is qualitative, namely the descriptions made by the researcher onthe data collected by not using numbers but in the form of descriptions ofsentences arranged systematically according to the problems beingdiscussed.The results of this study can be drawn from the conclusion that thepractice of deviating social assistance from the perspective of LawNumber 20 of 2001 is associated with Law Number 2 of 2020 committedby an irresponsible party is an act of corruption because it has fulfilledthe elements - elements contained in Law Number 31 of 1999 jo. LawNumber 20 of 2001, this act is classified as a crime, namely corruption.Criminal liability for perpetrators of social assistance programirregularities related to efforts to deal with Covid-19 can be sentenced toimprisonment and fines or can also be sentenced to death, seeing thatcertain elements of circumstances are fulfilled during the Covid-19emergency.Keywords: Covid-19, Social Assistance, Corruption Crime

Abstract

Pertanggungjawaban atas tindak pidana kejahatan internasional akan sulit direalisasikan apabila suatu negara tersebut bukan merupakan negara yang terikat dengan suatu perjanjian. Sedangkan disisi lainnya, penegakan hukum harus dijalankan untuk mengaja, mengawal dan menghantarkan hukum agar tetap berdiri semestinya. Tindak pidana yang dilakukan oleh individu dari negara yang bukan peserta Statuta Roma 1998 menyebabkan terjadinya hambatan dalam penegakan hukum internasional. Tujuan dari penulisan ini ialah untuk mengetahui dan memecahkan permasalahan dari kedudukan suatu negara yang bukan peserta Statuta Roma di Mahkamah Pidana Internasional. Dengan menggunakan metode penelitian hukum normatif yang melakukan pendekatan berdasarkan norma-norma hukum dan membahas peraturan perundang-undangan yang berlaku. Penulisan ini menghasilkan kedudukan dari negara bukan peserta dapat dibawa ke Mahkamah Pidana Internasional melalui Resolusi Dewan Keamanan PBB atau warga negara bukan peserta melakukan kejahatan di yurisdiksi Mahkamah Pidana Internasional serta negara bukan peserta mengakui yurisdiksi dari Mahkamah tersebut.
