Abstract

The Minangkabau indigenous people are people who adhere to the Islamicreligion, as has been confirmed in the Minangkabau traditional proverb whichreads Adaik basandi syarak, syarak basandi Kitabullah which means custombased on Islam, religion based on the book of Allah Subhanahu wa Ta'ala . TheMinangkabau people have their own rules in regulating their society, especiallyin the distribution of inheritance. Pusako or pusako property are all tangible(material) assets, which will be inherited later on to nieces and nephews. ThisPusako is a guarantee for the life and equipment of the nephew's childrenMinangkabau.The purpose of writing this thesis, namely: First, to find out inheritancerights in the occurrence of putu inheritance according to Minangkabaucustomary law. Second: To find out the settlement of inheritance rights disputesin the event of inheritance breaking according to Minangkabau customary law.The type of research used in this study is a type of sociological research,which is a part from study law, though there is also which said that socialresearch on law is not legal research.From the results of the study, inheritance rights in the occurrence ofinheritance discontinuation based on Minangkabau customary law are based onthe principle of primacy that applies to the nephew group. However, based oncustomary functionaries, especially those of IV Jinih, Urang Tuo Suku and theChairman of KAN, what applies to determining the right to inherit regardingsako and harto pusako Tinggi people who are extinct is that while alive theperson who is about to become extinct can appoint or have appointed a personwho will inherit the sako . and the pusako , where the appointed person has acondition, namely the freedom of the extinct person to appoint the person whowill inherit his sako and pusako , where the extinct person knows better who iscloser to his people ( tatak indak tasondak, malenggang indak tapampeh ) .Settlement of inheritance disputes according to Minangkabau customary law canbe carried out by traditional leaders or through the courts.Keywords: Heritage-Inheritance-Indigenous Peoples of Nagari Salayo

Abstract

Domestic Workers are the occupational sector that dominates Indonesian MigrantWorkers. In line with the increase in sending Indonesian Migrant Workers, cases of unpaidwage to domestic workers according to the provisions also increase every year. The problemof unpaid wage in accordance with the provisions of domestic workers still persists to thisday and is most prevalent in the placement country of Malaysia. This type of research isnormative law. The analysis carried out is a qualitative analysis or research that is stated inwriting.From the results of the problem research, it was found that First, the role of theMinistry of Foreign Affairs and the Ministry of Labour in overcoming the problem ofunderpayment is to form regulations, and regional cooperation to discuss rights &obligations as well as wage standards. Second, BP2MI and Migrant Care's efforts in dealingwith the problem of substandard wages are to provide advocacy, assistance both within thecountry and in the recipient country of the worker. Author's suggestion, First, it is hoped thatthe Ministry of Foreign Affairs together with the Ministry of Manpower can optimize therules and agreements regarding wage for domestic workers and their supervision specificallyand monitored. Second, there is a need for a special unit to be formed by BP2MI and MigrantCare which specifically adjudicates the wage of domestic workers who are not paidaccording to the provision.Keyword: Ministry of Foreign, Ministry of Labour, BP2MI, Migrant Care, Yurisdiction,Passive National, Migrant Worker, Wage, Malaysia.

Abstract

The International Criminal Court is an international criminal tribunalthat has jurisdiction over serious crimes under the Rome Statute. In 2021, theICC Pre-Trial Chamber issued a decision related to the implementation of theWar on Drugs policy in the Philippines. This policy against drugs was bornunder the leadership of President Duterte. However, the implementation of thepolicy was not in accordance with applicable regulations and resulted inthousands of people losing their lives.This type of research is normative legal research using the legalprinciples of universal jurisdiction and complementarity. This research isprocessing data using descriptive methods based on data collected throughliterature studies and literature review.The results of this research, the implementation of ICC jurisdictionbased on universal jurisdiction and the concept of admissibility has a reasonablebasis to be implemented against the Philippines in the case of theimplementation of the War on Drugs. In exercising its jurisdiction, the ICC usesthe principle of complementarity with regard to the Philippines' unwillingnessto carry out the national judicial process.Keywords: ICC-Philippine-War on Drugs-Crimes Against Humanity-Complementarity

Abstract

As a form of innovation, information technology is now capable of collecting,storing, sharing and analyzing data. These activities have resulted in various sectors of lifeutilizing information technology systems. Data privacy issues are something that arises whenpersonal data is given to people who are not responsible for committing crimes of misuse ofpersonal data. Privacy is a fundamental human right. Privacy is difficult to define in auniversal sense. Although privacy is difficult to define, the term privacy is used in a broadsense related to the protection of personal data. Thus, it is necessary to increase efforts andefforts to overcome these problems by the police, especially the Riau Regional Police.The purpose of writing this thesis, namely: First, Knowing the law enforcement on the misuseof personal data in Indonesia, Second What are the obstacles in regulating legal protectionagainst misuse of personal data, especially in the formulation of criminal sanctions. Abstract

Customary law is a living law because it embodies the real legal feelings of the people.According to Islamic law, adultery is any act or sexual intercourse (male genitals have enteredthe female genitalia) that are carried out outside of marriage. The application of customary lawagainst adulterers, especially in Tanah Bekali Village, Pangean District, Kuantan SingingiRegency. The main problems in this study are: first, what are the rules of adultery based on thecustomary law of the Tanah Bekali community, Pangean District, Kuantan Singingi Regency?Second, how is the settlement of adultery cases before carrying out a marriage in the village ofTanah Bekali, Pangean District, Kuantan Singingi Regency?This research is sociological legal research, namely research that is carried out directlyon the location or in the field to obtain data to provide a complete and clear picture of theproblem being studied, this research was conducted in Tanah Bekali Village, Pangean District,Kuantan Singingi Regency. The sample population is all parties related to the problems studiedin this study. The data sources used are primary data sources and secondary data. Datacollection techniques used, interviews and literature review.From the results of the study there are two main problems that can be concludedFirst, the Adat of Tanah Bekali Village, Pangean District, Kuantan Singingi Regency is anunwritten rule of life, customary sanctions or fines given to perpetrators of adultery accordingto customary law in Tanah Bekali village, namely Didoro or at 100 o'clock. sticks, married,ostracized from society, expelled from the village. Second, the problem of adultery in TanahBekali village is resolved with several levels of settlement that have been determined accordingto customary law in force in Tanah Bekali village, namely: family settlement or mamak soko,settlement by deliberation with Ninik Mamak and community leaders. To prevent the occurrenceof adultery, the ninik-mamak in Tanah Bekali village should be more active in guiding andteaching the applicable customary rules/stipulations, so that awareness and communitycompliance with customary rules will be created. It is better for the people of Tanah Bekalivillage to make village rules that prohibit teenagers or young people from carrying out activitiesuntil after 10 pm except for activities that are indeed held by the village or school, so that thingsdo not happen that are beyond our control and prevent damage to the younger generation..Keywords : Customary Law – Adultery – Customary Sanctions

Abstract

At the end of 2020 the DRC (Denish Refugee Council) issued a reportthat the Croatian border security had taken action against refugees. Theuncontrolled condition of Covid-19 is the reason Croatia has refused the entryof refugees. As a participating country in The Convention Relating to theStatus of Refugees 1951, Croatia has an obligation to comply with existingregulations, including the prohibition against turning away refugees asstipulated in Article 33 paragraph 1. However, the Covid-19 pandemic hascaused Croatia to reject the entry of refugees. This has an impact on theresponsibility of providing protection to refugeesThe type of this research is normative research using literature studiesin searching for data. This research is descriptive by using the existing rulessynchronization method. In this study using qualitative methods in analyzingthe data that has been collected by the author. The data used is secondary datain the form of codified rules.The results of this study explain that the responsibility to provideprotection for refugees has changed to become the responsibility of UNHCR.This is because the condition of Covid-19 in Croatia has an impact onCroatia's inability to carry out its obligations as a participating country to the1951 Convention. The form of protection that can be provided to refugees isin the form of implementing the UNHCR program, namely Human Assistanceto protect refugees in the Balkans. the author's suggestion, namely theimplementation and implementation of the UNHCR mandate to protectrefugees, and the increase in cooperation between countries through theBalkan route and also UNHCR in implementing human assistance programsto protect refugees during the Covid-19 pandemic.Keywords: Croatia, Refugee, Covid-19

Abstract

Abstract

Each region in Indonesia has a comm unity unit that has inhabited the territory ofIndonesia for centuries and has its own distinctive character. This community unit is anorganized community group, has rulers, has their respective customary laws and has their ownwealth in the form of tangible or intangible objects and controls natural resources within theirreach. Indigenous peoples have local wisdom which is the potential and strength in managing aforest area, land, and river. The problem In this case, river management means thatenvironmental management must pay attention to the impact between generations, with wiseuse, effective protection and prevention of impacts that will arise in the future. The impact isgold mining without a permit, the indigenous people around can no longer use the river as theirlivelihood, because it is damaged and polluted. Therefore, this study aims to examine theenvironmental damage caused by PETI (unlicensed gold mining) as well as to analyze what arethe sanctions for those who damage Singi River waters due to PETI and environmentalmanagement carried out by traditional stakeholders. The method used in this research issociological or empirical research, which is a type of research that uses communityassumptions in finding facts that occur in the field to answer an existing problem. , primarydata, secondary data, and tertiary data. Abstract

Countries around the world are increasingly facing crimes that cross nationalborders, one of which is human trafficking. These crimes threaten and force countriesin the world and the United Nations to regulate a rule of law that can prevent andprosecute these crimes. In 2000, the Palermo Convention, known as the UnitedNations Convention Against Transnational Organized Crime (UNTOC), was born.This type of research is normative legal research, namely legal researchcarried out by examining library materials in the form of binding legal rules andsecondary data such as other literature related to this research through a statuteapproach and comparative approach. This research is a qualitative data analysis inwhich descriptions are made of legal data that has been collected logically andsystematically. This research uses dualisme theory and functional dictatorshiptheory.The result of this research is that Member States have an obligation toincorporate legal entities into their national law. The mandate of UNTOC hasimplications for the laws of Indonesia and Malaysia as Member States. Thatimplication is dualism in applying international law through legal transformation sothat international law can apply in the laws of Indonesia and Malaysia. The rules arecreated through policies, so that Law No. 21 of 2007 on the Eradication of the Crimeof Trafficking in Persons in Indonesia and the Anti-Trafficking in Persons Act 670 of2007 in Malaysia were born. These acts regulate legal entities (corporations) aslegal subjects to prevent, prosecute, and punish corporations for committing thecrime of trafficking in persons.Keywords: Legal Person, Human Trafficking, UNTOC
