Abstract

Many foreigners come to Indonesia to settle in the country, but are limited in their needfor housing and land. According to Indonesian law, foreigners cannot own property rights toland in Indonesia. Thus, foreigners choose a shortcut using a nominee agreement which isindicated as legal smuggling. Seeing the existence of foreign elements in the civil relations thatoccur, and the act of legal smuggling (wetsontduiking) which falls into the realm of PrivatInternational law (PIL). The purpose of this research is to find out the aspects of PIL in thepractice of nominee agreements on land by foreigners and to find out the legal consequencesof controlling land ownership rights carried out by foreigners through nominee agreements inIndonesia from an PIL perspective by first examining the legal force of nominee agreements.The results of this normative legal research are, nominee agreement is an agreementcontaining international aspects made between Indonesian citizens and someone whoaccording to the law cannot be the subject of property rights, namely in order to control landwith property rights. Nominee agreement is a form of legal smuggling to avoid the provisionsof Article 21 paragraph (1) in conjunction with Article 26 paragraph 2 of the UUPA. Based onArticle 1320 of the Civil Code, the nominee agreement does not fulfill the halal causa, so thatthe legal consequences are null and void. Abstract

Countries around the world are increasingly facing crimes that cross nationalborders, one of which is human trafficking. These crimes threaten and force countriesin the world and the United Nations to regulate a rule of law that can prevent andprosecute these crimes. In 2000, the Palermo Convention, known as the UnitedNations Convention Against Transnational Organized Crime (UNTOC), was born.This type of research is normative legal research, namely legal researchcarried out by examining library materials in the form of binding legal rules andsecondary data such as other literature related to this research through a statuteapproach and comparative approach. This research is a qualitative data analysis inwhich descriptions are made of legal data that has been collected logically andsystematically. This research uses dualisme theory and functional dictatorshiptheory.The result of this research is that Member States have an obligation toincorporate legal entities into their national law. The mandate of UNTOC hasimplications for the laws of Indonesia and Malaysia as Member States. Thatimplication is dualism in applying international law through legal transformation sothat international law can apply in the laws of Indonesia and Malaysia. The rules arecreated through policies, so that Law No. 21 of 2007 on the Eradication of the Crimeof Trafficking in Persons in Indonesia and the Anti-Trafficking in Persons Act 670 of2007 in Malaysia were born. These acts regulate legal entities (corporations) aslegal subjects to prevent, prosecute, and punish corporations for committing thecrime of trafficking in persons.Keywords: Legal Person, Human Trafficking, UNTOC

Abstract

Self-defense is the right of self-defense granted by the UN Security Councilcontained in Article 51 of the UN Charter. This right can be used by a state inorder to defend itself from an attack from another country. It is well known thatthe development of theories about state self-defense rights has overridden theconcepts of anticipatory self-defense and pre-emtive self-defense that override theprovisions requiring armed attacks before state self-defense rights arise. Article51 of the UN Charter clearly states that the right to self-defense of UN memberstates, individually as well as collectively, only arises "if an armed attack occurs".Thus a new state can exercise its martial rights if it has happened or is happening.Normative Legal Research Methods use normative juridical approachmethods. The normative approach in juridical is an approach that refers to theapplicable laws and regulations. Furthermore, normative legal research is a typeof legal research methodology that bases its analysis on applicable laws andregulations and is relevant to the legal issues that are the focus of the research.Topics of legal issues that are relevant to be researched using Normative LegalResearch Methods, including regarding; Intentarization of positive law, legalprinciples, etc.The results of the research that have been obtained prove that first ; there isa lot of neglect of the use of this principle by many countries which has resulted inmany violations that have been committed by the State. Meanwhile, the originalpurpose of making this principle according to the provisions of Article 51 of theUN charter was to protect the entity of a state against threats that would arisefrom outside that resulted in destruction and danger within the state itself.Keywords : State Accountability - Armed conflict - Preemtive of State Self-Defense

Abstract

International organization take a role in the problem of space explorationand exploitation, for this reason an international organization that is engaged inspace law is needed, namely the United Nations Committee. on the Peaceful Usesof Outer Space (UNCOPUOS technology. In the case of COVID-19 remotesensing technology plays a role in mitigating the spread of COVID-19, butproblems arise when not all can take advantage of satellite technology, especiallydeveloping countries like Indonesia.The type of research used in this paper uses normative legal researchmethods. In this research, the authors conducted research on legal principles inspace treaties and theories about the role of international organizations whichwill examine the extent of UNCOPUOS role and how to use remote sensingsatellite technology during the COVID-19 pandemic.The results of the problem research it was found that: First, UNCOPUOShad not carried out its role in making the regulations listed in UN MU ResolutionNo. 1472 (XIV) dated December 12, 1959, especially in the regulations for the useof remote sensing technology which were not yet adequate and could even be saidto be still a vacuum in relation to remote sensing activities via satellite. Second,the use of remote sensing satellite technology during the COVID-19 pandemicwhere LAPAN only provided information and was not directly involved in its use.UNCOPUOS' efforts as an international organization are only limited todiscussions at the UNOOSA scientific sub-committee, therefore it is stillconsidered not to guarantee that developing countries like Indonesia will get theirrights.Keywords: Space Law - UNCOPUOS - Remote Sensing Satellite

Abstract

As an archipelagic country with a larger sea area than land, there are challengesin maintaining its territorial sea area. The challenge faced is in the form of efforts inenforcing the law of the sea. Currently, in law enforcement in the Indonesian seas, thereare many institutions that have the same authority and too many laws and regulationsgoverning maritime security in Indonesia. Therefore, the idea arose to simplify theinstitution of sea and coast guards in Indonesia. The purpose of this paper is to find outthe legal politics of simplifying the institutional simplification of Indonesia's sea andcoast guards and to know the implications of simplifying the sea and coast guardinstitutions in Indonesia onthe efficiency of other institutions that have authority in seaand coast guarding in Indonesia.This research is normative juridical, it is based on literature research that takesexcerpts from reading books, or supporting books that have a connection with theproblem to be studied. This study uses secondary data sources consisting of primary,secondary and tertiary legal materials. This study also used qualitative data analysisand produced descriptive data.As for the results of this study, several conclusions can be drawn, namely: First,Law Enforcement in the Indonesian Sea is running ineffectively because manyinstitutions have the same authority in law enforcement in the Indonesian sea. Second,the institutions that have existed will insist on maintaining their respective existences.So it is necessary to integrate maritime security regulations for the effectiveness of lawenforcement in Indonesia's territorial sea areas.Keywords: Simplification-Institutions-Authority

Abstract

AbstractThe authority of the government and regional governments to carry out marine management for the greatest prosperity of the people through the utilization, and exploitation of marine resources by using blue economy principles. This approach aims to improve sustainable marine management, and marine conservation, and coastal resources, and their ecosystems in order to realize economic growth with the principles of community involvement, resource efficiency, minimizing waste and multiple revenue streams. Rupat island, as the outermost island of Indonesia, has local wisdom potential that must be identified in order to be declared to support sustainable development goals. This research aims to find out the local wisdom of coastal communities that have the potential to be a blue economy in order to achieve the sustainable development goals. This research isnormative legal research, using data from literature studies, interviews, and observations. This is descriptive research that aims to provide a detailed and clear description of the problem to be studied. The results of the identification of the local wisdom of coastal communities that have the potential for blue economy are the rituals and processes of fishing procedures and the use of traditional fishing gear, wise management of mangroves and local community cultural arts that support marine tourism. AbstrakKewenangan pemerintah dan pemerintah daerah melakukan pengelolaan kelautan untuk sebesar-besarnya kemakmuran rakyat melalui pemanfaatan dan pengusahaan sumber daya kelautan dengan menggunakan prinsip blue economy. Pendekatan ini bertujuan meningkatkan pengelolaan kelautankerkelanjutan serta konservasi laut dan sumber daya pesisir beserta ekosistemnya dalam rangka mewujudkan pertumbuhan ekonomi dengan prinsip-prinsip keterlibatan masyarakat, efisiensi sumber daya, meminimalkan limbah, dan multiple revenue. Pulau Rupat sebagai pulau terluar Indonesiamemiliki potensi kearifan lokal yang harus diidentifikasi untuk dapat dinyatakan mendukung sustainable development goals. Penelitian ini bertujuan untuk mengetahui kearifan lokal masyarakat pesisir pantai yang berpotensi blue economy dalam rangka pencapaian sustainable development goals. Penelitian ini merupakan penelitian hukum normatif, dengan menggunakan data hasil studi literatur, wawancara dan observasi. Sedangkan sifat penelitian ini adalah penelitian deskriptif yang bertujuan memberikan gambaran secara rinci dan jelas tentang permasalahan yang akan diteliti. Hasil identifikasi kearifan lokal masyarakat pesisir pantai yang berpotensi blue economy adalah ritual dan proses tata cara penangkapan ikan serta penggunaan alat tangkap ikan tradisional, pengelolaan mangrove secara arif dan seni budaya masyarakat lokal yang mendukung wisata bahari.

Abstract

In managing the administration of marriage, in addition to the conditionsstipulated in the Marriage Law in Nagari Simpang Lama Inderapura, theprospective bride and groom who are about to marry must be granted the writtenapproval for marry from the Ninik Mamak. This requirement is based on theadditional rules of Nagari Simpang Lama Inderapura which require writtenapproval from the Ninik Mamak for the marriage of his nephew's child that tookplace before they register their marriage to the authorized Office of ReligiousAffairs. Without the written approval from the ninik mamak, the Walinagari officeas the party to create the marriage recommendation letter for the KUA will notfurther process the administration of the marriage file before the marriage permitis completed from the ninik mamak.The purpose of this study was to find out the implementation of marriagein Nagari Simpang Lama Inderapura and to find out the role of ninik mamak inmarriages in Nagari Simpang Lama Inderapura. The type of research for thisthesis is sociological legal research, namely research conducted directly onlocation or in the field to obtain data to provide an overview completely andclearly about the problem under study. The location of this research wasconducted in Nagari Simpang Lama Inderapura. Data collection techniques inthis study were interviews and literature review. The collected data is thenanalyzed qualitatively using the deductive method, namely drawing conclusionsfrom things that are general in nature to be specific.From the results of the research conducted, it can be concluded thatfirst.in the marriage administration needs, aside of the conditions stipulated in theMarriage Law, every niece's who is about to marry in Nagari Simpang LamaInderapura need to seeking for a written marriage approval from the ninikmamak. In practice, without a marriage license from the ninik mamak, the KUAwill refuse to carry out the marriage because this marriage license is as importantas other marriage conditions. Second,the role of the ninik mamak in marriage aasa tribal or clan leader cannot be ignoret. Abstract

Law Number 28 of 2014 concerning copyright, hereinafter referred to as theCopyright Law in Article 1 Paragraph 1, says that copyright is the copyright of thecreator that arises automatically based on the declarative principle after a work isrealized in a tangible form without reducing the complexity in accordance withthe provisions of the legislation. One of the intellectual property products includedin intellectual property rights is a song. The use of songs accompanied by materialbenefits, one of which is in radio media. As quoted from Government RegulationNumber 56 of 2021 Article 3 paragraph (1) that "everyone can make commercialuse of songs and or music in the form of commercial public services by payingroyalties to creators, copyright holders, and or rights owners." related throughLMKN. The purpose of writing this thesis namely; First, the implementation ofroyalty payments for songs used by radio in Pekanbaru city. Second, factors thatbecome obstacles in implementing royalty payments for songs used by radio inPekanbaru city.This type of research can be classified into the type of sociologicaljuridical research, examining the legal aspects by looking at the applicablelegislation and comparing it with the implementation obtained in the field. Thisresearch was conducted at the RRI and Gress FM radio companies, while thepopulation and sample were all parties related to the problems studied in thisstudy. Sources of data used are primary data and secondary data. Methods of datacollection in this study by interviews and literature study.From the results of the research problem, there are two main things thatcan be concluded. First, the implementation of royalty payments on both privateradio and state radio in Pekanbaru has a difference, where royalty payments byprivate radio in Pekanbaru do not carry out according to applicable regulations,while on radio The country, namely RRI radio, stated that the central RRI radiohad paid according to the procedures in force. Second, the factor that becomes anobstacle in the payment of royalties is that private radio does not benefit from theJOM Fakultas Hukum Universitas Riau Volume X No. 1 Januari – Juni 2023 Page 2songs that must be paid royalties and the second factor is due to a lack ofunderstanding of the rules governing the payment of royalties. Author'ssuggestion, First, LMKN must immediately create and use a Song and MusicInformation System and optimize its use to facilitate royalty management.Second, LMKs need to make improvements in collecting royalties, LMKNs needto socialize the Copyright Law, Content, and the rules contained in the Law inorder to increase understanding of the importance of paying royalties.Keywords: Payment-Royalty

Abstract

The 1945 Constitution of the Republic of Indonesia emphasizes that theIndonesian state is a unitary state divided into provinces, districts or cities. Article 18Bparagraph (2) of the 1945 Constitution of the Republic of Indonesia recognizes customarylaw community units and their traditional rights as long as they still exist and are inaccordance with the principles of the Unitary State of the Republic of Indonesia. The basicidea of Article 18B paragraph (2) is to give respect and recognition to villages that havetraditional rights or in other terms origin rights. Village administration is led by the villagehead. The village head is directly elected by the people as a form of democracy or villagepeople's sovereignty. However, this election has potential problems, one of which is thedispute over the results of the village head election. Law Number 6 of 2014 concerningVillages stipulates that disputes over village head election results are resolved by theRegent/Mayor. This has the potential not to solve the problem because it is not in accordancewith the original village autonomy. The principle of recognizing the origins of villagecommunities which is accommodated as the principle of independence in the Village Law isnot fully implemented in the articles. As evidence, there is still intervention or interferencefrom the district/city government in resolving disputes over the results of the Village Headelection which should be submitted to the Village through deliberations.This type of research is normative legal research because it uses literaturestudies in searching for data. This research is descriptive in nature which provides detaileddata on the existing problems. This study uses qualitative data analysis, which meansexplaining and concluding regarding the settlement of disputes over the results of villagehead elections based on laws and regulations and the form of arrangement of village headelection organizers. This study uses secondary data or scientific data that has been codified.The results of this study explain that first, the granting of authority to regional heads in orderto resolve disputes over village head election results will raise new problems. Second, thevillage head election dispute resolution model that prioritizes deliberations according to theprinciple of genuine village autonomy must be implemented by the government if it fails toproceed with the alternative of appointing a neutral third party and the second alternativethrough a special court. Third, strengthening the position by including village head electionsas one of the electoral regimes in Indonesia. Fourth, there is a need for ad hoc institutionalrestructuring of village head election organizers by including district KPU and districtBawaslu as part of the organizers.Keywords: Village Head Election, Disputes, Village Head Election Institutions

Abstract

With this, it is hoped that Narcotics abusers will be snared in accordance with Article 127 ofLaw Number 35 of 2009 concerning Narcotics, where the judge can decide or stipulate to orderaddicts to undergo Rehabilitation. The main problems in this research are: What are thebenchmarks for giving rehabilitation sanctions for narcotics users based on Law Number 35 of2009 and what are the shortcomings in providing rehabilitation sanctions for narcotics abuse inIndonesia.This type of research can be classified in the type of sociological law, because in this studythe author directly conducts research on the location or place under study in order to provide acomplete and clear picture of the problem under study. This research was conducted in thejurisdiction of the Pekanbaru City National Narcotics Agency. while the population and sample areall parties related to the problems studied in this study, the data sources used are primary data,secondary data, research subjects, related to data collection in this study by observation, interviewsand literature studyThe determination of sanctions on drug abuse and addicts is the absolute right of the judge.Because the provisions of Law Number 35 of 2009 concerning Narcotics explain that judges aregiven the authority to determine and impose imprisonment or rehabilitation measures on narcoticsaddicts. In handling cases of narcotics addicts, the judge applies the provisions of Article 127 ofLaw Number 35 of 2009 concerning Narcotics regarding criminal sanctions and Article 103 of LawNumber 35 of 2009 concerning Narcotics regarding sanctions for rehabilitation. The rulesregarding Narcotics should be regulated strictly in the eradication of narcotics crimes andoverlapping rules should be regulated to be able to complement each other.Keywords: Criminal, Narcotics, Rehabilitation.
