Abstract

Inheritance law (erfrecht) is a set of norms or rules that regulate the transfer or transfer of rights and obligations (assets) from people who die (heirs) to people who are still alive (heirs) who have the right to receive them. Or in other words, inheritance law is a regulation that regulates the transfer of assets of a person who dies to one or several other people. Customary inheritance law is customary law which contains provisions regarding the system and principles of inheritance law, regarding the transfer of control and ownership of inherited property from the heir to the heirs. Traditional inheritance law is actually the law of passing on assets from one generation to the next. Distribution of inherited assets in the Karo traditional community, which is different from the way inheritance is distributed in law. In the Karo traditional community, the distribution of inherited assets depends on the family, so inherited assets will be passed on to the family and will not be passed on to individuals. Legal plurality. Karo custom places men and women in an unequal position. Boys as clan bearers receive honors in various traditional events, including in the process of dividing inheritance. Karo men are positioned superior to women in various sectors of life. There is a tendency for parents, both men and especially mothers, to give inheritance to their daughters in two ways, namely gift and will.

Abstract

Referring to the Constitutional Court decision Number 46 / PUU-VIII/2010 that recognizes illegitimate children as having a civil relationship with their biological father, so that illegitimate children have inheritance rights. This decision has drawn pros and cons from the public. For those who support it, this decision is seen as legal protection and justice for illegitimate children, whereas for those who reject it, this decision is seen as an opening for crimes of deviation from religious values, such as unregistered marriages, acts of adultery or sexual immorality. This research method is empirical juridical. Types of secondary data sources obtained using library research. The results of the research show that to obtain legal certainty, the heir's statement should include the names of children from unregistered marriages, but this cannot be done, because there are no statutory regulations that determine the names of children resulting from extramarital marriages. is included in the deed, so an inheritance certificate containing the name of a child resulting from an unregistered marriage has legal force, therefore it is recommended that the government immediately do this and make regulations regarding the creation of inheritance certificates for children resulting from an unregistered marriage, so that it has clear legal force and permanent, and binding in general.

Abstract

The Mini Research Assignment for Group 4 from Class B PPKn 2022 is entitled: "Division of inheritance for girls according to the customary laws of the Mandailing community and Islamic civil law (case study of the Tanjung Mompang village community)". This Mini Research examines the position of daughters of the Mandailing Indigenous community in the distribution of inheritance according to the customary law that applies in the Mandailing community as well as according to the distribution of Islamic civil inheritance. The aim of this research is to find out the position of daughters of the Mandailing Indigenous community in the distribution of inheritance according to the customary law that applies in the Mandailing community. This Mini Research uses Qualitative Research Methods with qualitative descriptive research presented descriptively. Data collection techniques Through literature studies by collecting some information related to the research field such as books, journals, scientific works and many other references for collecting relevant data.

Abstract

This analysis aims to explore the legal concept of onrechtmatige daad (act against the law) in the context of a sale and purchase agreement for inherited land that is sold unilaterally according to the Civil Code. The main focus of this analysis is to determine whether the act of unilaterally selling inherited land can be categorized as onrechtmatige daad based on the applicable civil law provisions. This research involves analysis of various relevant articles and court decisions to gain a comprehensive understanding of this issue. It is hoped that the results of this analysis can contribute to enriching understanding of the legal protection of inheritance rights in the context of land sale and purchase agreements according to civil law in Indonesia.In carrying out this analysis, the relevance of court decisions related to similar cases is crucial. Analysis of these decisions will provide an overview of how the law of onrechtmatige daad is applied in the context of a unilateral sale and purchase agreement for inherited land. Through this approach, patterns of court decisions can be identified that can illustrate how civil law is interpreted in similar cases, and how legal considerations are considered in the relevant context.It is hoped that the results of this analysis can contribute to enriching understanding of the legal protection of inheritance rights in the context of land sale and purchase agreements according to civil law in Indonesia.

Abstract

Writing a report entitled Annulment of Pawn Objects for Default in Credit Agreements at Pawnshops Based on Civil Law Studies. The main purpose of writing this journal is to find out that a pawnshop is an agency or organization that operates in the field of money lending services by pawning an item as collateral. Customers who want to get loan money must pawn goods as collateral. If an agreement cannot be fulfilled or an achievement is not fulfilled, this will result in a default. What is meant by default is the non-fulfillment of achievements or obligations that have been determined towards certain parties in an agreement, whether an agreement that arises from an agreement or an agreement that arises due to law. Pawn objects are movable objects that can be tangible or intangible. such as bills, jewelry, electronic goods and motorized goods. The research method used is the empirical normative research method. The normative-empirical legal research method is a research method that includes theoretical and practical aspects in legal observation and analysis.

Abstract

The mini research assignment for group 4 from class E PPKn 2022 is entitled: "The Legal Effects of Distribution of Inheritance on Girls According to Toba Batak Customary Law and Islamic Law". This mini-research examines the distribution of inheritance to daughters according to Toba Batak customary law and Islamic law. The aim of this research is to find out how inheritance is distributed to daughters according to Toba Batak customary law and Islamic law. This mini-research uses Qualitative Research Methods with the type of Normative Legal (Empirical) research. Data collection techniques through interviews, documentation, and data sources taken from the community. If we look at the distribution of inheritance from Toba Batak customary law, it is true that it is more profitable for sons, it is true that daughters also get inheritances, but not as much as inheritances given to sons. This happens because men are the successors of the clan and will carry out greater duties and responsibilities in the family. Meanwhile, women will later become someone else's property and inherit from their husbands. Meanwhile, according to Islamic law, in terms of dividing inheritance, women also receive an inheritance, but not as much as the inheritance given to men.
