Abstract

This study aimed to analyze the obstacles to the settlement of inheritance disputes in the Kajang indigenous people and the efforts to settle inheritance disputes in a just manner in the Kajang indigenous peoples. The type of research used in this study was empirical juridical with an anthropological approach—sources of data obtained from primary and secondary legal materials. Data collection techniques were carried out through interviews. The data obtained were analyzed using descriptive methods. The results of this study indicated that the obstacles to the settlement of inheritance disputes in the Kajang indigenous people were the parties making false confessions, insisting on defending their rights and social status, tending to be emotional, and lacking firmness from the mediator. Efforts to settle inheritance disputes that were fair to the indigenous people of the Kajang tribe are carried out based on local wisdom based on pasang ri kajang through three stages, namely deliberation at the hamlet head level, mediation by the village head, and the customary justice institution.

Abstract

This study aimed to analyze the position of Law Number 24 of 2009 concerning the Flag, Language, State Emblem and National Anthem and Presidential Regulation Number 63 of 2019 concerning the Use of Indonesian Language and the legal consequences of agreements that were not made in Indonesian. The research approach used in this study was a statutory approach and a conceptual approach. Article 31 of the Language Law and Article 26 of Presidential Regulation Number 63 of 2019 required the use of the Indonesian language in every agreement making and were legally compelled. The obligation to use the Indonesian language in every agreement should be carried out. The legal consequences of agreements not made using the Indonesian language were regulated in Law Number 30 of 2004 concerning Notary Positions, which could be resolved on lex specialist derogat lex generalis. The agreement that remained binding has evidentiary power as a private agreement.

Abstract

The responsibility of parents towards fulfilling children's rights must still be carried out even though both parents have divorced. In the Constitutional Marriage it is explained that a father is responsible for all the rights to life for his children, but often the father is negligent in fulfilling his obligations even though there has been a judge's decision in court. Basically in court, actually the implementation of a request in fulfilling the child's maintenance rights can be done if the father is negligent, but the implementation is not easy. This study will examine what are the juridical obstacles to fulfilling children's rights as a result of divorce and how to fulfill children's livelihood rights in the future. The purpose of this study is to describe efforts to fulfill children's livelihood rights as a result of divorce. This research is a normative legal research with a literature study approach, a case approach, and a comparison of efforts to fulfill children's rights to a just life. The results of the research in this description are that it is very necessary to have a supervisory institution that will oversee the level of compliance of fathers in fulfilling their children's right to life due to divorce.

Abstract

This study aims to examine the historical and cultural aspects of Sad Kerthi as a legal terminology that is part of the traditional knowledge of indigenous people in Bali, one of Indonesia’s culturally richest provinces. The recognition and respect for indigenous communities have been a significant topic outlined in Article 18B paragraph (2) of the 1945 Constitution. This Article underpins legislations and regulations aimed to empower indigenous communities to exercise self-governance in their social context within the framework of the contemporary globalised society. By using socio-legal research methods with a statute approach and legal facts, this research finds that the lack of a legal definition of Indigenous people adversely impacts the self-determination of Indigenous people in Indonesia. At the same time, the common problems faced are not unequivocal, by considering Bali, Sad Kerthi as local wisdom is incorporated in Bali Province Act 15/2023. This legislation is further broken down into local regulations that allow Balinese communities to preserve their social structures and self-determination in everyday activities. Based on legal evidence collected from three different types of customary villages in Bali, which are Baliaga, Apanage, and Anyar, the indigenous communities in each of these traditional villages are autonomous and enjoy specific privileges maintained since their ancestors.

Abstract

Marriage is not legally valid or not listed as an issue that is hotly discussed in various perspectives. Registration of marriage is basically necessary as a protection of the state to the parties to the marriage, and also to avoid the tendency of inconsistency in the application of religious teachings and beliefs in a perfect or intact marriage that took place according to religion and belief. This study is a type of normative juridical research. This is because normative juridical research is the type of research that is most relevant to the conflict of norms that occurs and can find detailed and detailed answers to the formulation of the problem to be studied. Based on the Marriage Act No. 1 of 1974 article 1 that marriage is the inner and outer bond between a man and a woman as husband and wife whose purpose is to form a prosperous and eternal family based on the Supreme Godhead. Understanding the inner inner Bond in this marriage is a bond or legal relationship between one man and one woman whose purpose is to live together as husband and wife status. According to the Quran a Muslim is one who has absolutely surrendered to Allah and his commands and believes in pure Tawhid (the oneness of God) that isn't tainted with any shirk and this is why the Almighty has introduced prophet Abraham as a true worshipper. In The Marriage Act No.1 of 1974 Article 2 Paragraph (1) explained that marriage is valid if it is done according to religion and beliefs, with the added sound in Paragraph (2) that each marriage is recorded according to applicable laws and regulations. If the marriage is valid, then the child born from the marriage will obtain legal status as a legitimate child as stipulated by Article 42 of the marriage law. It can be concluded that if the marriage is invalid, then the child born from the marriage does not occupy the position of a legitimate child.

Abstract

Notaris adalah pejabat publik yang berhak berwenang dalam membuat akta autentik, sesuai dengan Undang-Undang Nomor 2 Tahun 2014 Tentang Perubahan Atas Undang-Undang Nomor 30 Tahun 2004 Tentang Jabatan Notaris. Salah satu syarat akta autentik adalah adanya saksi, yaitu saksi instrumen, saksi instrumen sebagai orang yang diwajibkan untuk hadir pada saat suatu peristiwa untuk menyaksikan, sehingga bila diperlukan dapat memberikan keterangannya yang membenarkan jika peristiwa tersebut benar terjadi. Terkait dengan hukum saksi instrumen ialah saksi dalam akta notaris yang ikut serta dalam hal pembuatan terjadinya akta yang dibuat notaris, saksi tersebut yang nama-namanya dicantumkan dalam akta notaris. Tujuan dari penelitian ini adalah untuk mengkaji urgensi pengaturan hukum saksi instrumen di pengadilan dan kedudukan saksi instrumen di pengadilan. Kedudukan saksi instrumen tidak diatur dalam suatu bentuk peraturan, dimana kedudukan saksi sangat penting dalam akta yang dibuat oleh notaris. Karena saksi turut dipanggil ke persidangan untuk memberikan keterangannya dalam hal akta yang dibuat oleh notaris di perkarakan oleh para pihak. Penelitian ini merupakan penelitian hukum normatif dengan pendekatan peraturan perundang-undangan (statue approach) dan pendekatan secara konseptual (Conseptual Approach). Berdasarkan hasil penelitian saksi instrumen dalam akta notaris belum diatur dalam Undang-Undang Nomor 2 Tahun 2014 Perubahan Atas Undang-Undang Nomor 30 Tahun 2004 Tentang Jabatan Notaris. Saksi instrumen akan ikut terkena proses penyidikan dan dipanggil untuk dimintai keterangannya. Notaris mempunyai hak ingkar sehingga ia bebas untuk tidak hadir dalam proses pemanggilan terkait akta yang dibuatnya. Sedangkan saksi tidak ada suatu aturan yang mengatur kedudukan, hak dan kewajiban nya sebagai saksi. Tidak diatur nya kedudukan saksi instrumen menimbulkan kekosongan norma hukum, diperlukan pembentukan norma baru, norma ini disebut sebagai ius constituendum atau lege ferenda mengenai hukum yang akan dicita-citakan kelak.

Abstract

Human life is inherently paired. So that humans get married. Marriage is a legal and regular offspring connector so as to avoid mixing offspring or bloodline. inbreeding is clearly prohibited in the Marriage Law. The Compilation of Islamic Law also regulates the prohibition of marriage. Then there is a cancellation of marriage from inbreeding. As a result of the cancellation of marriage, the position of children from the cancellation of marriage arises. In terms of the Marriage Law related to the consequences of marriage cancellation in Article 28, the cancellation of marriage begins after a decision from the Court that has permanent legal force and is valid from the time of the marriage. The decision regarding the cancellation of marriage states that it does not apply retroactively to children born from the marriage. This creates uncertainty regarding the position of children from the cancellation of marriage for inbreeding. A marriage is declared invalid according to law and religion if it violates the provisions regarding the conditions or prohibitions in marriage. So can these provisions also apply to the cancellation of marriage for inbreeding. As well as legal protection for the fulfilment of children's rights due to marriage cancellation of inbreeding.

Abstract

Treaty law recognizes the terms debt and receivables, but in the legal regulations of agreements or beyond it, it turns out that what is meant by debt and receivables is very limited in its explanation. Likewise, default whose definition appears only limited to the opinions of experts. Regulation will be very important because debts, receivables and defaults have legal consequences for creditors or debtors. Thus, it is very necessary to include the definition of debt, receivables and defaults in laws and regulations to provide certainty and legal protection for the parties to the engagement, especially the law of agreements. The type of research used is normative juridical research using primary legal materials, namely laws and regulations, secondary, namely books by law scholars and tertiary materials in the form of dictionaries. The approach used is a conceptual approach and a legislative approach. From the results of the study, there is a void in norms regarding receivables. Receivables in general cannot arise without obligation, for certain conditions receivables may arise without prior obligation. Receivables are not only the opposite of the word debt. Receivables are the right to sue given by law. In this case, receivables can be interpreted as protection provided by the state to the subject in the law of the agreement. Default is not the same as debt and a defaulter cannot have receivables.

Abstract

The issue of apostasy, especially the annulment of marriage on the grounds of apostasy, is a highly intricate and contentious issue at the intersection of Islamic law and human rights. This article seeks to undertake a critical comparative analysis of the legal frameworks, jurisprudence, and practical applications surrounding this issue within Indonesia and Malaysia—two prominent Muslim-majority countries. Through in-depth insight into the relevant laws and court cases with scholarly literature reviews, this paper examines the different approaches taken by these countries and the deeply entrenched challenges in resolving the principles of Islamic legal doctrine with the main tenets of international human rights. This examination requires treading the line carefully, as religious traditions and individual freedoms clash. An inclusive and balanced dialogue can be done to further the protection of human rights and respect the rich tapestry of religious and cultural perspectives. Indeed, the proper application of Islamic law can be viewed as a fundamental human right since the freedom to practice one’s faith is part and parcel of the core tenets of international human rights standards. It is in a holistic approach—one that respects both Islamic legal principles and universal human rights—that apparent tensions can be resolved and fair treatment can be ensured for everyone. Moreover, the Islamic jurisprudents take the invalidation of marriage by way of apostasy as unanimous since it is a permissible action in case of a defect or some damage in the marriage. However, clear and specific regulations are urgently needed with a view to legal certainty and unity within the community.

Abstract

Abstrak Undang-Undang Nomor 2 Tahun 2014 tentang Jabatan Notaris mengatur kewajiban notaris untuk memberikan layanan pembuatan akta autentik secara cuma-cuma kepada masyarakat tidak mampu. Namun, implementasi ketentuan ini masih menghadapi berbagai kendala dalam praktiknya. Penelitian ini menggunakan metode yuridis empiris dengan pendekatan peraturan perundang-undangan serta wawancara dengan notaris dan tokoh masyarakat di Kabupaten Lombok Utara. Data dianalisis secara deskriptif kualitatif untuk mengidentifikasi faktor-faktor yang mempengaruhi efektivitas penerapan Pasal 37 Ayat (1) UU Jabatan Notaris. Penelitian ini bertujuan untuk mengevaluasi sejauh mana aturan ini diterapkan dan hambatan yang dihadapi dalam pelaksanaannya. Hasil penelitian menunjukkan bahwa meskipun notaris memahami kewajiban tersebut, implementasi masih terbatas karena kurangnya kepastian hukum mengenai kriteria penerima layanan serta minimnya pengawasan dan fasilitas pendukung. Selain itu, rendahnya pemahaman masyarakat mengenai hak mereka terhadap layanan cuma-cuma ini juga menjadi kendala utama. Kesimpulannya, diperlukan perbaikan regulasi, penguatan pengawasan, serta edukasi hukum kepada masyarakat agar aturan ini dapat diterapkan secara lebih efektif. Abstract Law Number 2 of 2014 on the Notary Position regulates the obligation of notaries to provide free notarial services for the underprivileged. However, the implementation of this provision still faces various challenges in practice. This study uses an empirical juridical method with a legislative approach and interviews with notaries and community leaders in North Lombok Regency. The data were analyzed descriptively qualitatively to identify the factors influencing the effectiveness of implementing Article 37, Paragraph (1) of the Notary Position Law. This study aims to evaluate the extent to which this regulation is implemented and the obstacles encountered in its execution. The findings show that, although notaries understand this obligation, the implementation is still limited due to the lack of legal certainty regarding the criteria for recipients of the service and insufficient supervision and supporting facilities. Additionally, the low public understanding of their rights to this free service also becomes a major barrier. In conclusion, regulatory improvement, strengthened supervision, and legal education for the public are necessary to enable more effective implementation of this provision.
