Abstract

Customary inheritance dispute might occur when the heirs cannot reach agreement between divisions of property or during inheritance law point which will be used. Indonesia acknowledges 3 existing inheritance laws which are western civil inheritance law, Moslem's inheritance law, and customary inheritance law. Legal action of inheritance law is usually resolved by deliberation but if there is no agreement reached between these processes, therefore court mechanism can be used to make law suit and dispute resolution. UU No 3 of 2006 about religious jurisdiction is a legal product that is issued to provide improvement (Amendment) against UU No 7 of 1989 about religious jurisdiction. UU No 3 of 2006 is giving significant impact against the existence of custom inheritance law in Indonesia. Before this constitution is created, religious jurisdiction can accept customary inheritance disputes for Moslem people according to the criteria which have been stated in UU No 7 of 1989. Since UU No 3 of 2006 is created, therefore customary inheritance law, even though the heirs are Moslem, must follow the district court mechanism. This will provide increasingly narrow space for the existence of customary law in the future. This program is held in Pati, Central Java, where custom inheritance law still exists and is being used in Pati community. Dissemination and harmonization regarding customary law is important to maintain sustainability and existence of customary law in Indonesia.

Abstract

This paper aims to describe and analyze the contribution of Islamic law in the regulation (policy formulation) of the death penalty in the context of reforming the national criminal law. Determining the death penalty as a means to tackle crime is a policy choice because capital punishment is a pro and con issue among legal experts. Because the debate about the death penalty is related to the right to life which in international legal instruments and the 1945 Constitution is included in the category of rights that cannot be reduced under any circumstances (non-derogable rights). Islamic law recognizes the death penalty in a crime that has been determined by Allah SWT. in the Al-Qur’an. The death penalty in Islam gives its color with the idea of balance that does not only focus on the perpetrators of the crime but also the victim. Of course, this idea of balance is following the basic values of Pancasila. The death penalty in Islam in the qishahs punishment recognizes the concept of forgiveness from the victim’s family which needs to be developed in the future, especially in the draft Criminal Code which until now has not been ratified as a means for national law reform.

Abstract

AbstractWithin the landscape of Indonesia’s ethnic and religious diversity, the Chinese Muslim community in Semarang occupies a unique position as a “minority within a minority,” navigating sociocultural pressures from the non-Muslim Chinese milieu and the predominantly Javanese Muslim majority. Located in a city shaped by centuries of Sino-Javanese interaction, the community’s lived experience offers valuable insight into the harmonious coexistence of cultural heritage and Islamic values. This study examines how identity preservation and da‘wah strategies are negotiated within this context, drawing on in-depth interviews, participant observation, and document analysis. Employing Dick Hebdige’s subcultural theory, this study finds that the community actively incorporates Chinese cultural symbols such as language, rituals, and traditional festivals into inclusive da‘wah practices. Through such integrative approaches, the community resists cultural erasure while simultaneously promoting social cohesion. This study highlights the potential of culturally embedded religious practices to strengthen interfaith dialogue, enhance public understanding of diversity, and inform policy frameworks for minority integration. By situating the lived experiences of Chinese Muslims within broader discourses on multiculturalism and interfaith harmony, the study contributes to a deeper understanding of hybrid identities as a foundation for inclusive and resilient societies in Indonesia and across Southeast Asia.

Abstract

This study examines ecoliteracy among students as a form of environmental  awareness transformation in green Islamic boarding schools (pesantren) in Indonesia from a literacy perspective. Pesantren are not only Islamic educational institutions but also have great potential in shaping the character of students who care about the environment. Through the integration of Islamic values, environmentally friendly practices, and an ecological literacy approach, green Islamic boarding schools create a learning ecosystem that fosters ecological awareness. This study highlights how students experience changes in their perspectives, behaviors, and active participation in environmental protection through literacy based on Islamic values and the pesantren's local context. This transformation demonstrates that ecoliteracy is not only about ecological knowledge, but also the internalization of spiritual, social, and cultural values in building sustainable environmental awareness.

Abstract

This study critically examines Ismail Raji Al-Faruqi's (1921-1986) Islamization of Knowledge (IOK) project, focusing on its philosophical consistency, real-world application, and connection to global decolonial ideas. Through a tripartite methodological approach combining critical hermeneutics, comparative epistemology, and empirical case studies, we assess the enduring contributions and limitations of Al-Faruqi's framework. Our textual analysis reveals that while the Tawhidic (Divine Unity) paradigm effectively challenges Western epistemological fragmentation, its potential for epistemic essentialism requires mitigation through greater contextual flexibility. Comparative examination demonstrates that IOK's five-step methodology, though theoretically robust for traditional disciplines, demands significant adaptation for contemporary challenges in STEM fields and digital humanities. Empirical investigations at institutions implementing IOK principles (including IIIT and IIUM) further identify a critical gap in addressing intra-Muslim power asymmetries, particularly regarding gender and cultural diversity in knowledge production. Building on these findings, the study proposes an enhanced "decolonial-Islamic" framework that: (1) maintains Al-Faruqi's core metaphysical foundations while incorporating pluralistic epistemological approaches; (2) develops discipline-specific adaptation protocols for emerging academic fields; and (3) integrates institutional assessment tools to evaluate Islamization outcomes. These contributions advance three key academic discourses: Islamic epistemology's engagement with decolonial theory, practical models for educational reform in Muslim-majority societies, and interdisciplinary approaches to knowledge decolonization. The paper concludes with policy recommendations for implementing this refined framework in contemporary Islamic higher education contexts.
