Abstract

Before the emergence of Covid-19 which developed throughout the world, the Indonesian Central Government had issued Law Number 6 of 2014 concerning Villages, which is a policy that regulates the level of Village administration. However, in this law there is no allocation of development funds and village empowerment which is the basis of the community at the level of village government administration (Gampong). Funds sourced from APBN, APBD Province or Regency, hope to support the progress of the village to become an independent village capable of organizing and managing. The allocation of village funds in the form of a Village Revenue and Expenditure Budget (APBG) is directed to finance government activities, development and community empowerment. For this reason, the Government has issued a special policy to handle Covid-19 by allocating Village Funds to address problems arising from the Covid-19 pandemic. Especially for the economic sector through the formation of Village-Owned Enterprises (BUMG) which is a business driver to improve the quality of life and realize the welfare of rural communities. With a descriptive qualitative approach using three methods, namely observation, interviews and documentation analysis. This study aims to determine business potential with local wisdom through a SWOT analysis with a focus on Village-Owned Enterprises. Based on the SWOT analysis, in the end, Village-Owned Enterprises will facilitate activities in realizing plans in accordance with local wisdom for the welfare of the community, especially in the era of the Covid-19 pandemic.

Abstract

Studi ini untuk mengetahui implementasi dan upaya pengelolaan bantuan langsung tunai Covid-19 di Kecamatan Kuta Makmur, serta mengetahui faktor penghambat bagi pemerintah kecamatan Kuta Makmur dalam mengimplementasikan kebijakan bantuan langsung tunai. Salah satu upaya yang dilakukan pemerintah untuk mengatasi permasalahan kemiskinan dimasa pandemi Covid-19 adalah dengan memanfaatkan Dana Desa, yaitu melalui Program Bantuan Langsung Tunai. Berdasarkan hal tersebut, pemerintah akhirnya menetapkan Peraturan Menteri Keuangan Nomor 40/PMK.07/2020 tentang Pengelolaan Dana Desa. Penelitian ini merupakan penelitian yuridis sosiologis dengan pendekatan kualitatif. Data diperoleh melalui kegiatan penelitian kepustakaan dan penelitian lapangan. Analisis data dilakukan sejak awal dan terus berjalan sepanjang proses penelitian berlangsung yaitu pengumpulan data, reduksi data, pengkajian data dan penarikan kesimpulan. Berdasarkan hasil penelitian, Implementasi Kebijakan Pengelolaan Bantuan Langsung Tunai Desa telah dijalankan sebagaimana yang tertuang dalam Peraturan Menteri Keuangan Nomor 40/PMK.07/2020, namun terdapat beberapa hal yang tidak di implementasikan dengan baik, salah satunya adalah proses seleksi calon penerima bantuan. Serta terdapat beberapa faktor penghambat dalam proses implementasi kebijakan bantuan langsung tunai. Kata Kunci: Implementasi, Bantuan Langsung Tunai, Dana Desa.

Abstract

This study reported that the Regulation of the State Minister for Women's Empowerment and Child Protection Number 11 of 2011 concerning Child-Friendly City Development has been executed through the equipment of public facilities for children in the Lhokseumawe city, Aceh Province. However, this program has not effectively been implemented and well-designed. Numerous obstacles are found such as a lack of friendly public spaces supported for children and no restrictions on smoking in public places. Therefore, the improvement and evaluation for the Child-Friendly City Development are needed in the city. This study suggests that the local government should immediately issue a policy on providing free certificates for children and building friendly public spaces. Another effort is to encourage society to actively participated in the program through campaigning the Child-Friendly City Development program. The authors also suggested that if the city is planned to be expanded into a friendly city for children, the local government must fulfill supported public facilities such as schools, libraries, playgrounds, and so on. All facilities must also meet the safety and comfort for children, and be safe from child abuse (e.g., violence, discrimination, racism, sexual abuse, and excessive exposure to children's data).

Abstract

For the sake of implementing the handling of the poor to provide optimal, effective, and efficient social assistance, which is carried out by government agencies, it is necessary to evaluate appropriate recipients of this assistance. It is necessary to carry out a process of monitoring and evaluating recipients of social assistance who are not suitable to be a beneficiary in order to produce provision of targeted social assistance. This study aims to observe closely how to optimize the provision of social assistance to the poor at the Office of Social Affairs, Women's Empowerment and Child Protection in North Aceh Regency, Indonesia, and the obstacles or challenges encountered in its implementation. A qualitative approach was employed in the data collection process. The results of this study indicate that the social problems for the poor occurring in North Aceh Regency are increasingly complex and continue to develop. This condition requires the local Government to give priority to the implementation of social welfare in the field of handling the poor. This is relevant to the population and the complexity of social problems that exist in North Aceh District which tends to increase annually.

Abstract

This study aims to identify the effectiveness of implementing administrative sanctions toward personal tax income at the Tax Office in Aceh province. A qualitative method was applied in collecting the data through observation, semi-structured in-depth interviews, and document analysis. The finding reported that most taxpayers in the city did not submit their reports honestly and appropriately. They did not register to become taxpayers when the income earned has exceeded the lower limit of income following Law Number 36 of 2008 concerning Income Tax. Besides, the number of addresses of taxpayers is incomplete or incorrect, making it difficult for officers to visit their homes or offices. Invalid Taxpayer Identity also makes it difficult for officers to send Tax Bill (STP) to taxpayers. To realize the implementation of administrative sanctions operating efficiently, the community (taxpayer) is required to understand the purpose and benefits of taxes. The citizen needs to realize that the tax will be used by the government to build infrastructures for the city and develop social prosperity and well-being through improving health, nutrition, education, and social services.

Abstract

Dana desa yang diberikan oleh pemerintah seringkali tidak terkelola dengan baik. Penggunaan dana desa yang tidak maksimal serta sesuai kebutuhan masyarakat disinyalir menjadi penghambat kemajuan desa. Dalam rangka mensukseskan program dana desa ini, tim pelaksana kegiatan pengabdian kepada masyarakat Fakultas Hukum Universitas Malikussaleh mengadakan “Penyuluhan Hukum Terkait Penggunaan Dana Desa di Tengah Pandemi Covid-19”. Kegiatan penyuluhan hukum ini dilakukan dengan menggunakan metode ceramah dan diskusi. Peserta penyuluhan hukum diberikan pemahaman mengenai penggunaan dana desa sesuai dengan peraturan perundang-undangan serta variasi penggunaan dana desa. Selanjutnya, peserta penyuluhan hukum diberikan kesempatan untuk bertanya serta mendiskusikan persoalan yang berkaitan dengan kebijakan prioritas penggunaan dana desa di tengah pandemi Covid-19, kegiatan diskusi ini dilakukan sebagai bagian dari menjaring persoalan yang terjadi dalam masyarakat, khususnya Desa Mon Geudong, Kota Lhokseumawe. Kegiatan penyuluhan hukum terkait penggunaan dana desa dan tupoksi di tengah pandemi Covid-19 di Desa Mon Geudong, Kota Lhokseumawe berjalan dengan baik. Hasil penyuluhan hukum yang didapatkan adalah adanya perubahan pola penggunaan anggaran desa untuk yang sifatnya produktif. Dapat disimpulkan dari kegiatan ini, semua peserta penyuluhan sangat antusias mengikuti acara hingga selesai dan merasakan manfaat penyuluhan hukum bagi perencanaan dan kemajuan desa demi kesejahteraan masyarakat. Banyak pertanyaan yang muncul terkait persoalan desa, masyarakat mengharapkan supaya kampus jangan meninggalkan desa dan terus bersinergi dalam pembinaan sumberdaya manusia serta penyuluhan-penyuluhan hukum yang sangat banyak memberikan manfaat, terutama kondisi ditengah pandemi-Covid-19.

Abstract

Anak merupakan amanah dan karunia Tuhan Yang Maha Esa yang memiliki harkat dan martabat sebagai manusia seutuhnya. Untuk menjaga harkat dan martabatnya, anak berhak mendapatkan pelindungan khusus, terutama pelindungan hukum dalam sistem peradilan. Adapun tujuan penelitian yaitu untuk mengetahui bagaimanakah penerapan restorative justice terhadap anak yang berhadapan dengan hukum di Kota Banda Aceh serta hambatannya dalam penerapan restorative justice. Penelitian hukum yang digunakan adalah yuridis empiris (sosiologis) dilakukan analis secara deskriptif kualitatif. Hasil penelitian antara lain penerapan restorative justice dilksanakan sesuai dengan ketentuan yang berlaku baik ditingkat kepolisian, kejaksaan maupun pengadilan serta Badan Narkatika Nasional di Aceh. Hambatan dalam pelaksanaan restorative justice adalah uang ganti rugi yang begitu besar, tidak sesuai dengan perbuatan yang dilakukan oleh anak. Selanjutnya, belum meratanya pemahaman aparatur desa dalam melakukan restorative justice terhadap anak yang berhadapan hukum

Abstract

Salah satu bentuk datang orang asing ke Indonesia yakni pengungsi. Pengungsi merupakan orang asing yang berada di wilayah Negara Kesatuan Republik Indonesia dikarenakan oleh ketakutan akan terjadinya persekusi dari negara asalnya dengan alasan-alasan ras, suku, agama, kebangsaan, anggota kelompok sosial tertentu, perbedaan politik serta tidak mendapatkan perlindungan dari negara asalnya. Pengungsi merupakan bentuk datangnya orang asing yang mempunyai ciri berbeda dengan perpindahan penduduk, sehingga berpengaruh terhadap mekanisme perlindungan yang diterapkan. Realitas sosial saat ini, masyarakat Aceh dihadapkan dengan kedatangan pengungsi dari luar negeri. Yayasan geutanyoe mencatat kedatangan pengungsi Rohingya ke Aceh sejak Tahun 2009-2022 sebanyak 17 kali, yaitu Tahun 2009-2021 sebanyak 15 kali dan Tahun 2022 ada dua kali, Kedatangan pengungsi tersebut sebagai bagian dari tamu yang diperlakukan secara kemanusiaan dan adat setempat. Pemulia jame merupakan suatu tradisi yang melekat bagi masyarakat Aceh tanpa membedakan suku, bangsa yang harus dilayani secara baik dan sesuai dengan syari’at Islam. Perlindungan terhadap pengungsi pada dasarnya merupakan tanggung jawab setiap negara. Masalah perlindungan kepada pengungsi menjadi masalah internasional, namun sampai saat ini Aceh belum mempunyai peraturan khusus mengenai penanganan pengungsi dari luar negeri yang masuk ke dalam wilayah Aceh. Hal ini menjadi masalah karena Aceh salah satu tujuan yang didatangi pengungsi luar negeri sehingga tentunya perlu mendorong Pemerintah Aceh untuk membuat suatu peraturan pemerintah atau Qanun khusus untuk menangani pengungsi luar negeri yang masuk kedalam wilayah Aceh

Abstract

The condition of the Covid-19 pandemic requires the country to focus more on the protection of citizens, especially regarding the use of social assistance. Meanwhile, supervision of the distribution of social assistance funds is very important to be improved in order to avoid various practices of irregularities that open loopholes for corruption. The research used in this research is juridical empirical. The results of research related to the supervision of social assistance carried out by the police and the prosecutor's office in this supervision continue to conduct monitoring/monitoring as a form of prevention. Legal counseling and information were carried out in terms of the use of Covid-19 funds as well as the right targeted social assistance distribution mechanism. The next step is to continuously coordinate between stakeholders. The next step is to continuously coordinate between stakeholders. The implication of this research is that cooperation, coordination and harmonization between the central government, regional governments and private institutions are needed to be right on target, effective and efficient and supported by a good, integrated, transparent and accountable system in the distribution of social assistance. There has not been an accurate record of recipients of social assistance, so the monitoring process by both the National Police and the Attorney General's Office is not running optimally. Furthermore, there is still a lack of local government transparency regarding social assistance.

Abstract

This study aims to examine the authority, obstacles and efforts made by the Forestry Service in tackling the crime of Illegal Logging in Pakpak Bharat Regency. This research uses empirical legal research with a sociological juridical approach. Based on the research results, it is known that the authority of the forestry service in dealing with illegal logging crimes in the Pakpak Bharat district begins with reports, inspections by forest police and the forestry service. Patrol every forest that has experienced damage, but the implementation is not yet optimal because there are several obstacles or barriers to the implementation of tackling the criminal act of illegal logging, which is related to the lack of public awareness about the importance of forests and the impact of these activities, forestry officers and forest police are very minimal. Lack of supporting facilities to patrol to tackle illegal logging crimes in Pakpak Bharat Regency.
