Abstract

Berdasarkan dengan hal tersebut serta sesuai dengan ketentuan Pasal 18 ayat (6) UUD NRI Tahun 1945, Kabupaten Magetan perlu untuk menyusun Peraturan Daerah di bidang penanganan orang dengan gangguan jiwa (ODGJ). Urgensi penyusunan Peraturan Daerah a quo adalah (1) sebagai instrumen kebijakan Kabupaten Magetan dalam pemenuhan hak orang dengan gangguan jiwa (ODGJ) untuk memperoleh penanganan yang lebih baik; (2) sebagai dasar penyelenggaraan penanganan orang dengan gangguan jiwa di Kabupaten Magetan; (3) sebagai upaya untuk mengoptimalkan penanganan orang dengan gangguan jiwa; (4) sebagai upaya untuk meminimalisir orang dengan gangguan jiwa (ODGJ) yang terlantar; (5) sebagai jawaban dan solusi terhadap berbagai persoalan empiris dan sosial di bidang penanganan orang dengan gangguan jiwa (ODGJ). Abstract

Seiring berkembangnya teknologi berbagai inovasi baru yang muncul yang salah satunya dibidang keuangan atau yang biasa disebut dengan Teknologi Keuangan. Manusia sebagai makhluk sosial cenderung memiliki keinginan atau kebutuhan yang pada dasarnya pasti menggunakan uang. Teknologi keuangan merujuk kepada pemanfaatan teknologi dalam memberikan layanan keuangan secara efisien. Teknologi ini mencakup berbagai jenis inovasi teknologi dimana dapat mempengaruhi cara berinteraksi kita terhadap keuangan yang salah satu contohnya adalah pinjaman peer to peer. Didalam implementasinya memerlukan tersedianya peraturan untuk mengatur tentangi peer to peer agar aktivitasnya selalu memperoleh pengawasan dari Otoritas Jasa Keuangan (OJK), dari segi tekonologi Otoritas Jasa Keuangan melakukan pemantauan dengan memberikan persyaratan yang terdapat pada Pasal 7 Nomor 77/POJK.01/2016 guna menjalankan usahanya. Namun dengan adanya teknologi keuangan ini memicu sejumlah permasalahan yang mengenai tentang Kontak Darurat. Kontak Darurat merupakan kontak yang dipilih oleh peminjaman sebagai kontak yang dapat dihubungi oleh pemberi pinjaman dalam situasi darurat atau ketika sipeminjam tidak dapat dihubungi.

Abstract

The sugar import policy issued by the Minister of Trade in 2015 generated significant controversy because it was deemed to contradict existing legal provisions, was carried out without proper inter-ministerial coordination, and posed a potential risk of state financial loss. Although government data indicated a national sugar surplus, import permits were still granted to private entities. This situation raised suspicions of abuse of authority and prompted judicial review through court proceedings. This study aims to examine the legal framework governing sugar importation within the national regulatory system and to analyze the application of the concept of abuse of authority in the Minister of Trade’s discretionary policy, as assessed in Decision Number 34/Pid.Sus-TPK/2025/PN Jkt.Pst. The research employs a normative juridical method using statutory and conceptual approaches. Primary legal materials include laws related to trade, food, customs, sugar import regulations, and the relevant court decision. The data were gathered through library research, while analysis was conducted through normative interpretation, legal reasoning, and examination of factual findings contained in the judgment. The research demonstrates that although the regulatory structure governing sugar imports is comprehensive, its implementation in this case deviated from established procedures. The Minister of Trade issued a permit for the importation of 105,000 tons of raw crystal sugar without conducting the required inter-ministerial coordination meeting or technical verification. The court found that the policy constituted an abuse of office for the benefit of specific parties, resulting in state losses estimated at approximately Rp400 billion. In its considerations, the panel of judges concluded that the actions fulfilled the elements of abuse of authority and violated principles of good governance. The study concludes that discretionary power cannot be exercised arbitrarily, as it must meet cumulative requirements set out in the Administrative Governance Act. The 2015 sugar import policy is proven to be inconsistent with applicable legal standards and contains elements of abuse of authority. The study suggests several implications, including strengthening oversight mechanisms, standardizing technical verification procedures, integrating cross-ministerial data systems, and enforcing strict sanctions to prevent corruption in strategic trade policies.

Abstract

In practice, the transfer of land rights is often conducted without fulfilling formal registration procedures, particularly without the issuance of a deed by the Land Deed Official, resulting in good faith purchasers being unable to register the transfer of title and facing legal uncertainty despite having fulfilled their contractual obligations. This study aims to analyze the form of legal protection afforded to good faith purchasers of land whose ownership rights have not yet been formally transferred, as well as the legal considerations of the panel of judges in the Decision of the Bekasi District Court Number 389/Pdt.G/2023/PN Bks. This research employs a normative legal research method using statutory and case approaches. The results indicate that legal protection is provided through recognition of the material validity of the land sale agreement despite the absence of formal requirements, as well as through a court decision granting authority to the purchaser to process the transfer of land title. The judges’ considerations are based on the fulfillment of the legal requirements of a valid agreement under Article 1320 of the Indonesian Civil Code, the seller’s breach of contract, the purchaser’s physical possession of the land, and the application of the principles of good faith and substantive justice to ensure legal certainty.

Abstract

The weak mechanism for royalty payments to songwriters in Indonesia, despite Law No. 28 of 2014 on Copyright clearly regulating moral rights and economic rights. In practice, there are still various violations in the form of unauthorized use of songs, low compliance with royalty payments, and suboptimal performance of Collective Management Organizations (CMOs) and National Collective Management Organizations (NCMOs). This study aims to analyze the concept of songwriters' economic rights, the mechanism for managing royalties, and the effectiveness of legal protection in its implementation. The research method uses a normative juridical approach by examining laws and regulations as well as conceptual data related to copyright management. The results show that although regulations have provided a strong legal basis, the implementation of royalty payment mechanisms still faces structural and technical obstacles, including the transparency of CMOs, the legal awareness of users of works, and weak law enforcement against violations. This study emphasizes the importance of improving the mechanisms for collecting and distributing royalties so that the protection of the economic rights of creators can be carried out effectively and fairly.
