Abstract

This study discusses refugees who have been stranded in a transit country for years. These protracted refugees have to deal with a reality that the chance of getting resettlement in a third country has become slim, and the option of returning to their country of origin will only jeopardize their lives. Indonesia is not a state party to the 1951 Refugee Convention that lays a responsibility to assimilate refugees in the resettlement countries. Indonesia, however, has opened its door for refugees based on humanity’s solidarity and the fact that Indonesia’s legal framework on human rights acknowledges the right to seek asylum in other countries and abides by the non-refoulement principle. The situation has become problematic when the number of refugees coming to Indonesia has continued to increase, but Indonesia does not have a comprehensive refugee policy to support them. By looking at the case of refugees living in Pekanbaru, this study concludes that Indonesia should consider the local integration option as one of the viable solution to the protracted refugee situations in Indonesia.

Abstract

This study discusses the problem of overlapping claims of the  Exclusive Economic Zone (EZZ) between Indonesia and Vietnam in North Natuna Waters in 2017-2019. Indonesia’s vast sea area allows for border disputes with neighboring counries, especially if the country’s maritime boundaries have not been resolved. In addition to causing disputes, it also raises other problems such as illegal fishing violations in the jurisdiction and ownership of indonesia. In discussing the various overlapping EZZs, the authors use qualitative research methods, with data collection techniques based on library research derived form literary sources such as books, journals, official documents, and scientific articles. The perspective that the author uses is the Realism Perspective, which always prioritizes the interests of the state in making any policy. This study uses Border Dispute Theory which relates values and other problems that expand the boundary problem. This study shows that in an insignificant negotiation between the two countries, the difference in views between the EZZ regime and the Continental Shelf, causing the results of the negotiations between Indonesia and Vietnam to be not very favorable for Indonesia. The problem of overlapping EZZ boundaries causes other problems such as the number of illegal fishing carried out by neighboring countries, especially by Vietnam. Thus, Indonesia took firm action by implementing the Sink The Vessel (STV) Policy to reduce the occurrence of fishing violations in Indonesian jurisdictions. Now negotiations on national borders to resolve border are still being carried out by the second country to strengthen border diplomacy.Key Notes: EEZ, Border Dispute, Illegal Fishing, STV, Vietnam.

Abstract

This study analyses the implementation of good governance principles for the economic revitalization program under Riau Province’s Badan Restorasi Gambut (Peatland Restoration Agency) supervision. One of the aims of this program is to support the haze-free ASEAN 2020 roadmap. Riau province is an area prone to forest fire disasters. Its peatland area, which is twice as large as Malaysia’s peatland, have a very high potential for damage due to forest fires. To mitigate the damages, BRG initiated the 3R program: Rewetting, Revegetation, and Revitalization. What makes this topic interesting is BRG emphasizes the aspects of economic empowerment of local communities to prevent further forest and peatland damages. To assess the implementation of BRG’s program, our research team conducted several interviews with representatives from Indonesia’s Ministry of Environment and Forestry, NGOs, academics, farmers, and villages’ facilitators who assisted local communities that received the BRG’s assistance packages. Our study shows that BRG’s economic revitalization program had succeeded in creating small scale economic activities such as honey industry, pineapple farming, and catfish farming. However, the ineffective coordination and communication between BRG and the local communities had prevented them from constructing an effective method to prevent future forest fires.
