Abstract

This article examines the significance of Islamic moderation (wasaṭiyyah) in supporting Indonesia’s efforts to achieve the Sustainable Development Goals (SDGs). Employing a qualitative, interpretive design, the study integrates an integrative literature review of classical and contemporary scholarship with systematic document analysis and thematic content analysis of key institutional reports. Drawing upon classical Islamic scholarship, contemporary Indonesian religious thought, and empirical examples across Islamic institutions, the study demonstrates that moderation, embodied by organizations like Nahdlatul Ulama (NU) and Muhammadiyah, provides a culturally grounded framework for advancing inclusive development, contributing directly to SDGs related to poverty alleviation, quality education, gender equality, climate action, and peacebuilding. However, the study also identifies complex challenges, including political polarization, digital radicalization, institutional fragmentation, and resource disparities, that constrain its effectiveness. The article concludes that enhancing policy coordination, expanding religious literacy, and empowering community leaders are essential for maximizing moderation’s role in Indonesia’s pursuit of the SDGs. Future research should empirically quantify the impact of specific faith-based initiatives on SDG indicators and comparatively analyze the Indonesian model of moderation with other Muslim-majority contexts to assess its broader applicability.

Abstract

Transcendentally, the basis of legal reform in Muslim-majority Southeast Asian countries includes cultural and religious pluralism, social justice, modernity and tradition, globalization and interconnectivity, and politics and policy. Emancipatory family law reform is not only related to moral values. But it is also influenced by government policies, political dynamics, and the formation of laws that are responsive to the rights of children and women. The study aimed to analyze the politics of family law unification in Indonesia, Malaysia, and Brunei Darussalam and efforts to unify family law to protect women and children from an emancipatory transcendental perspective. The research method was normative empirical. Data analysis carried out inductively and structured from the politics of the formation and renewal of family law in Southeast Asia: Indonesia, Malaysia, and Brunei Darussalam. Through this research analysis, it concluded that political initiatives for family law reform are influenced by pressure from civil society, non-governmental organizations, human rights movements, and gender equality. Family law reform reflects power relations in society. Emancipatory transcendental analysis can deeply explore the structure of family law as a foundation for maintaining or changing policy direction, particularly regarding gender and individual rights under family law. This analysis creates the concept of emancipatory transcendental politics, which combines religious, customary, and Western law and creates gender equality and social justice in efforts to unify family law in Indonesia, Malaysia, and Brunei Darussalam.

Abstract

The disruption of the digital era has changed patterns of interaction, communication, and parenting within Muslim families, while simultaneously presenting various challenges to family social resilience, such as exposure to negative information, declining quality of interpersonal communication, and increased vulnerability to domestic conflict. This article aims to analyze the role of Muslim family digital literacy as an instrument for strengthening social resilience through a collaborative governance model from the perspective of Maqashid al-Syari'ah Jamaluddin Athiyyah. This study uses a qualitative approach with a library research method that examines various scientific literature, public policies, and relevant sources related to digital literacy, family resilience, collaborative governance, and Maqashid al-Syari'ah. Data were analyzed using content analysis and critical interpretation techniques. The results show that strengthening Muslim family digital literacy requires multi-stakeholder collaboration involving the government, educational institutions, religious organizations, community groups, and families as the main actors. From the perspective of Maqashid al-Syari’ah Jamaluddin Athiyyah, the collaborative governance model contributes to the protection of religion (hifz al-din), life (hifz al-nafs), reason (hifz al-‘aql), descendants (hifz al-nasl), and property (hifz al-mal). This study confirms that digital literacy based on Islamic values ​​can be an effective strategy in building adaptive, resilient, and competitive Muslim families amidst the dynamics of digital society.

Abstract

ABSTRACT Conflict is an inevitable part of plural societies and may threaten social harmony when not managed constructively. In Indonesia, the increasing number of cases brought before courts highlights the need for alternative dispute resolution mechanisms that are accessible, participatory, and rooted in local values. This study aims to explore the concept and implementation of a Mosque-Based Mediation Corner as a community peacebuilding model through the utilization of religious institutions. The research employed a qualitative approach using the Asset-Based Community Development (ABCD) framework to identify community assets and social potentials that support peaceful conflict resolution. The research stages included community asset identification, social capital mapping, community participation strengthening, and the implementation of the Mediation Corner at Baitul Hakim Mosque, UIN Sayyid Ali Rahmatullah Tulungagung. The findings reveal that the mosque’s spiritual authority, community trust, and human resource involvement constitute key social capital in establishing an inclusive and non-litigation mediation mechanism. The integration of Islamic values, including shūrā (consultation), ‘adl (justice), and ukhuwwah (brotherhood), promotes empathetic dialogue, prevents conflict escalation, and strengthens community social cohesion. This study concludes that the Mosque-Based Mediation Corner has significant potential as a sustainable community peacebuilding model and may serve as a replicable alternative dispute resolution mechanism in multicultural societies. ABSTRAK Konflik merupakan bagian yang tidak terpisahkan dari kehidupan masyarakat plural, namun berpotensi mengganggu keharmonisan sosial apabila tidak dikelola secara konstruktif. Di Indonesia, meningkatnya jumlah perkara yang diajukan ke pengadilan menunjukkan perlunya alternatif penyelesaian sengketa yang lebih mudah diakses, partisipatif, dan berbasis nilai-nilai lokal. Penelitian ini bertujuan mengeksplorasi konsep dan implementasi Pojok Mediasi Berbasis Masjid sebagai model penciptaan perdamaian komunitas melalui pemanfaatan institusi keagamaan. Penelitian menggunakan pendekatan kualitatif dengan kerangka Asset-Based Community Development (ABCD) untuk mengidentifikasi aset dan potensi sosial yang dimiliki komunitas masjid dalam mendukung penyelesaian konflik secara damai. Tahapan penelitian meliputi identifikasi aset komunitas, pemetaan modal sosial, penguatan partisipasi masyarakat, serta implementasi Pojok Mediasi di Masjid Baitul Hakim UIN Sayyid Ali Rahmatullah Tulungagung. Hasil penelitian menunjukkan bahwa otoritas spiritual masjid, kepercayaan masyarakat, serta keterlibatan sumber daya manusia menjadi modal utama dalam membangun mekanisme mediasi yang inklusif dan non-litigasi. Integrasi nilai-nilai Islam seperti shūrā (musyawarah), ‘adl (keadilan), dan ukhuwwah (persaudaraan) dalam proses mediasi terbukti mendorong dialog empatik, mencegah eskalasi konflik, serta memperkuat kohesi sosial masyarakat. Penelitian ini menyimpulkan bahwa Pojok Mediasi Berbasis Masjid memiliki potensi sebagai model perdamaian komunitas yang berkelanjutan dan dapat direplikasi sebagai alternatif penyelesaian sengketa dalam masyarakat multikultural.

Abstract

This study examines the limitations of family visitation services for incarcerated women in correctional institutions in Lampung Province through the perspectives of relational justice and mubādalah. The central problem arises from the 15–30 minute visitation duration, which tends to be treated as an administrative procedure, although family visits play a crucial role in maintaining mother-child relations, marital relations, psychological stability, and readiness for social reintegration. This study aims to analyze the impact of limited visitation, explain family relations through the framework of mubādalah, and formulate a service model based on family time. The study employs a qualitative approach with an empirical juridical and multidisciplinary design. Data were obtained through in-depth interviews with 42 incarcerated women, supporting interviews with correctional officers, observation, and document study, and were analyzed using thematic analysis. The findings indicate that short visits weaken family communication, increase emotional burdens, and hinder relational recovery. This article offers a structured, just, gender-sensitive reconstruction of family time services that is relevant to the development of Islamic family law and more humane correctional policy. The article contributes by conceptualizing visitation as a space of mutuality that connects prisoners’ rights, family protection, rehabilitation, and state responsibility within Indonesia’s correctional system in a more concrete, just, measurable, and sustainable manner.

Abstract

This study analyzes the paradox between the use of religious symbolism in local election campaigns in Indonesia in 2024 and the corruption committed by several Muslim local leaders after their election. The study employs a qualitative design that combines a normative-juridical approach with comparative socio-political analysis through case studies of five regional heads in East Kolaka, Ponorogo, Central Lampung, Bekasi, and Riau who were arrested by the Corruption Eradication Commission (KPK) in 2025. Normative data were obtained from the literature on siyāsa sharʿiyya, anti-corruption laws and regulations, and official KPK documents. In contrast, empirical data were analyzed using Pierre Bourdieu’s concept of symbolic capital and Max Weber’s theory of charismatic authority. The results indicate that religious symbolism plays an effective role in building electoral legitimacy but does not translate into ethical commitment in governance. Religious identity functions more as political capital than as a foundation for public integrity. These findings suggest that the combination of the instrumentalization of religious symbols and high electoral costs creates incentives for post-election rent-seeking. In practical terms, this study recommends strengthening political integrity through electoral financing reform, ethical oversight of public officials, and the development of leadership indicators that emphasize integrity alongside religious symbolism.

Abstract

Digital technologies have reconfigured the landscape of public discourse, religious expression, and civic participation, generating both democratic opportunities and profound ethical challenges. While existing legal frameworks seek to regulate harmful online behavior, law alone proves insufficient to cultivate responsible digital conduct. This article argues that wisdom (ḥikmah) constitutes a critical, yet under- explored, ethical capacity for navigating the digital public sphere. Employing a normative–philosophical legal methodology, this study integrates three normative traditions: international human rights law, Indonesia’s Electronic Information and Transactions Law (EIT Law/UU ITE), and Progressive Fiqh grounded in maqāṣid al-sharī’ah, maṣlaḥah, and istiḥsān. Through conceptual and comparative analysis, the article demonstrates how wisdom functions as a mediating moral rationality that harmonizes freedom of expression with human dignity and social responsibility. The findings propose a model of “digital wisdom” that shifts governance from reactive legal control toward anticipatory ethical responsibility. This framework contributes to contemporary debates on digital governance, Islamic legal theory, and human rights by offering a culturally grounded yet universally resonant model of ethical digital citizenship. Future studies are encouraged to empirically examine how wisdom-based ethical frameworks can be institutionalized through digital literacy education, judicial practice, and religious discourse in diverse socio-legal contexts

Abstract

This article examines the proposed redenomination of the Indonesian Rupiah through a normative–conceptual legal-policy analysis informed by the Maqāṣid al-Sharīʿah framework. The study evaluates the legal foundations, philosophical justification, and policy implications of redenomination within Indonesia’s current macroeconomic and institutional context. Drawing on primary legal materials such as Law No. 7 of 2011 on Currency, Bank Indonesia regulations, and Ministry of Finance instruments alongside doctrinal writings and legal-philosophical scholarship, the research integrates doctrinal interpretation, legal-policy analysis, and maqāṣid reasoning. The findings indicate that redenomination is normatively grounded in constitutional mandates to ensure currency sovereignty and monetary stability. It enhances transactional efficiency, supports price transparency, and strengthens currency credibility when implemented under stable macroeconomic conditions. From the Maqāṣid framework, redenomination aligns with ḥifẓ al-māl (protection of wealth), al-ʿadālah (justice), and maṣlaḥah (public welfare). This study contributes an interdisciplinary framework bridging legal doctrine, public policy, and Islamic legal philosophy. Limitations arise from reliance on secondary sources, indicating the need for empirical and comparative research.

Abstract

Purpose – This study aims to formulate a collaborative governance model for the prevention and mitigation of early divorce among Muslim families in the Tapal Kuda region of East Java through the perspective of Maqashid al-Syari’ah as developed by Jamaluddin Athiyyah. The increasing rate of marital instability and early divorce has become a critical social issue that threatens family resilience and the achievement of Islamic family welfare. This study argues that collaborative governance involving multiple stakeholders can strengthen family resilience and reduce divorce risks through an integrated and value-based approach. Design/methods/approach – This research employs a qualitative approach with a case study design. Data were collected through in-depth interviews, observations, and document analysis involving religious affairs offices, religious courts, local governments, Islamic organizations, community leaders, marriage counselors, and affected families in the Tapal Kuda region. Data were analyzed using an interactive model consisting of data reduction, data display, and conclusion drawing, while the analytical framework was based on collaborative governance theory and Jamaluddin Athiyyah’s Maqashid al-Syari’ah. Findings – The study reveals that effective divorce prevention requires collaborative engagement among governmental, religious, and community institutions. The collaborative model contributes to strengthening five dimensions of family resilience: religious, educational, economic, social, and psychological resilience. The implementation of premarital education, family counseling, economic empowerment, and community-based mediation significantly enhances family stability and aligns with the maqashid objectives of preserving religion (hifz al-din), family lineage (hifz al-nasl), intellect (hifz al-‘aql), wealth (hifz al-mal), and human dignity (hifz al-karamah). Research implications/limitations – The findings are limited to the socio-cultural context of the Tapal Kuda region and may not be fully generalizable to other regions with different demographic characteristics. Originality/value – This study offers a novel integration of collaborative governance and Jamaluddin Athiyyah’s Maqashid al-Syari’ah framework as a comprehensive strategy for strengthening Muslim family resilience and addressing early divorce through multi-stakeholder cooperation.

Abstract

Since the enactment of Law Number 16 of 2019, which amended Law Number 1 of 1974 on Marriage, the Religious Court of Malang Regency has experienced a significant surge in marriage dispensation applications compared to the period when the previous Marriage Law was still in effect. This research aims to construct the concept of maqāṣid asy-syarī’ah fī ḥifẓ al-awlād by analyzing judicial reasoning of judges in determining marriage dispensations at Malang Regency Religious Court. It specifically explores how judges’ interpretations of the best interests of the child can be formulated into a new derivative of maqāṣid theory. This research is a normative-empirical juridical research with a case approach. The data were collected through interviews with three male judges and two female judges from the Religious Court of Malang Regency. Informants were selected using purposive sampling, targeting judges with the most extensive experience in handling marriage dispensation cases. As data saturation had been reached, the number of informants was deemed qualitatively representative. Data were also obtained from official documentation of legally binding marriage dispensation rulings (inkracht van gewijsde). All data were analyzed using a descriptive-analytical approach, and conclusions were drawn through the application of an interactive cyclical method. The principle of the best interests of the child in determining marriage dispensations aims at providing protection for the child, both physically and psychologically. It includes the age of the prospective bride and groom, economic adequacy, reliable guidance and assistance from the family, and adequate religious safety and protection of children in the womb.
