Abstract

The open proportional system implemented in Indonesia since the 2009 elections was designed to enhance democratic participation and strengthen legislative accountability. Nevertheless, in practice, this electoral model has produced structural problems that have significantly undermined the quality of representative democracy. This study seeks to address a critical question: to what extent does the open proportional system generate structural imbalances in the distribution of political power within Indonesia’s democratic framework? A normative legal method is employed, utilizing the Structural Approach to Election Law developed by Samuel Issacharoff and refined by Nicholas Stephanopoulos and Yasmin Dawood. The research is based on doctrinal analysis of election laws, Constitutional Court decisions, relevant legal literature, and democratic theory. The findings indicate that the system reinforces the dominance of wealthy candidates, erodes the ideological foundations of political parties, and perpetuates structural exclusion of marginalized social groups. Furthermore, it demonstrates that election law, as an institutional structure, is not ideologically neutral and may be exploited to preserve unequal power relations. The study concludes that electoral reform is necessary to achieve structural justice, particularly through the reconstruction of electoral districts, revision of the parliamentary threshold, implementation of transparent campaign finance regulations, and revitalization of political parties as ideological entities. The structural approach offers a critical and holistic analytical framework for building a more just, inclusive, and substantively democratic electoral system in Indonesia.

Abstract

Perjanjian sewa-menyewa mobil merupakan salah satu bentuk perikatan yang banyak digunakan dalam kegiatan usaha jasa transportasi. Dalam praktiknya, perjanjian tersebut sering menimbulkan permasalahan hukum berupa wanprestasi yang dilakukan oleh penyewa mobil, sehingga diperlukan mekanisme penyelesaian yang memberikan kepastian hukum dan perlindungan bagi para pihak. Penelitian ini bertujuan untuk menganalisis penyelesaian wanprestasi oleh penyewa mobil rental dalam perjanjian sewa-menyewa di Kota Gorontalo. Metode penelitian yang digunakan adalah yuridis empiris dengan pendekatan sosiologis hukum. Data diperoleh melalui wawancara dengan pemilik usaha rental mobil serta studi kepustakaan terhadap peraturan perundang-undangan dan literatur hukum yang relevan. Hasil penelitian menunjukkan bahwa penyelesaian wanprestasi pada umumnya dilakukan melalui jalur nonlitigasi dengan mengedepankan musyawarah dan kesepakatan bersama, seperti pemberian denda keterlambatan dan ganti rugi atas kerusakan kendaraan. Jalur nonlitigasi dipilih karena dianggap lebih efektif, efisien, serta mampu menjaga hubungan baik antara pihak yang menyewakan dan penyewa. Namun demikian, dalam hal wanprestasi yang bersifat berat, seperti penggelapan kendaraan atau tidak dikembalikannya mobil sewaan, penyelesaian melalui jalur litigasi menjadi pilihan terakhir untuk memperoleh perlindungan dan kepastian hukum. Dengan demikian, penyelesaian wanprestasi dalam perjanjian sewa-menyewa mobil rental sangat bergantung pada tingkat pelanggaran, kejelasan isi perjanjian, serta itikad baik para pihak.

Abstract

The study identified shortcomings in Law No. 5 of 1999 on algorithmic discrimination in the e-commerce business. The study employs normative legal methods, incorporating a legislative, conceptual, and algorithmic justice approach, as well as a comparative analysis of EU and US regulations. Secondary data, including ICC cases, were analyzed through literal, co-curricular, and teleological interpretations. This highlights the limitations of existing norms in addressing digital dynamics. Law No. 5/1999 does not have explicit regulations on automated algorithms, including definitions, transparency, or auditing of systems. Real cases, such as Shopee's internal delivery priority, harm small businesses through biased weighting factors, violating Article 19(d) and Article 25(1)(a). The first step is to mandate that major platforms disclose their algorithmic principles and conduct quarterly independent audits. Furthermore, strengthen ICC with technologists and data management rules. Long-term measures include international cooperation and the application of Pancasila-based ethics to achieve social justice, which is crucial for protecting SMEs in Indonesia's digital market, aligning with the global dominance of algorithms, and in line with ICC's principles aimed at combating AI collusion. Reform promotes healthy and inclusive competition.

Abstract

Penelitian ini mengkaji pengaturan dan implikasi hukum terkait pelanggaran royalti musik dalam performing rights di Indonesia dengan menyoroti dinamika regulasi, kelembagaan, serta praktik penegakannya. Fokus utama diarahkan pada analisis kewajiban pembayaran royalti terhadap pemanfaatan musik dalam ruang publik, baik secara langsung maupun melalui media digital, sebagaimana diatur dalam Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta serta Peraturan Pemerintah Nomor 56 Tahun 2021. Kajian normatif yang digunakan menelusuri ketidaktegasan pengaturan tentang pihak yang bertanggung jawab, dualisme kewenangan antara LMK dan LMKN, serta kelemahan prosedural seperti kewajiban mediasi yang kerap diabaikan. Analisis terhadap beberapa kasus menunjukkan bahwa pelanggaran performing rights dapat menimbulkan konsekuensi perdata, administratif, dan pidana, yang seluruhnya bertujuan menjaga nilai ekonomi karya serta memberikan perlindungan yang layak bagi pencipta. Pengaruh perjanjian internasional, terutama Konvensi Bern, TRIPS, dan WIPO Copyright Treaty, menjadi landasan penting yang memperkuat urgensi harmonisasi regulasi nasional dengan standar global. Kajian ini menegaskan perlunya reformasi menyeluruh terhadap tata kelola royalti musik untuk mencapai sistem yang adil, transparan, dan adaptif terhadap perkembangan industri kreatif.

Abstract

The implementation of the ijon system by the community, especially farmers, has become a habit that has been passed down from generation to generation and has become entrenched in a number of areas, including Gorontalo. The 1945 Constitution, especially in Article 18B paragraph two (2) which reads that the State recognizes and respects customary law community units along with their traditional rights as long as they are still alive and in accordance with the development of society and the principles of the Unitary State of the Republic of Indonesia, which is regulated in law. Even so, buying and selling under the debt bondage system, in the eyes of the law, is strictly prohibited because in buying and selling the bonded bond system is very unclear because this is a form of extortion that can harm other people. The sale and purchase of the ijon system has also been confirmed in article 8 paragraph 3 of Law number 2 of 1960 concerning production sharing agreements, which reads: "payments by anyone, including owners and cultivators, to cultivators or owners in whatever form they have elements of ijon, are prohibited". The provisions used as the legal basis for the use of standard contracts in Indonesia are Article 1338 Paragraph (1) of the Civil Code which stipulates: "all agreements made legally apply as laws for those who make them" from the words all can be interpreted that every legal subject can make an agreement with any content, there is freedom of the legal subject to determine the form of the agreement. In other words, through the principle of freedom of contract, legal subjects have the freedom to make agreements, including opening opportunities for legal subjects to make new agreements that have not been regulated in the Civil Code so that they can follow the needs of society due to the times

Abstract

This study analyses the impact of Dutch colonial law on the evolution of the Indonesian legal system following independence, as well as the integration of local and global principles in the establishment of National Legal Policy across several historical periods. The primary issue encountered was the legal duality between Dutch law and customary law, alongside the difficulty of establishing an autonomous national legal system. This study employs normative legal methodologies and a literature-based methodology to examine the progression of legal systems from the colonial era to the reform period. The findings indicated that, although Indonesia's independence, the remnants of colonial law continue to prevail within the legal framework, particularly in civil and criminal domains. Legal reforms initiated in the late 1990s aimed to eliminate colonial influences and include local values with global standards. The difficulty in achieving equilibrium between these two elements remains a significant topic of discussion in Indonesia's legal reform.

Abstract

Penguatan demokrasi lokal berbasis kearifan lokal dan perlindungan inklusif terhadap hak-hak kelompok rentan merupakan fondasi penting untuk mewujudkan tata kelola pemerintahan desa yang partisipatif, responsif, dan berkeadilan. Kegiatan pengabdian kepada masyarakat di Desa Talulobutu dilaksanakan untuk menjawab tantangan dan hambatan rendahnya partisipasi kelompok rentan dalam musyawarah desa serta belum adanya instrumen hukum yang menjamin keterlibatan mereka. Metode yang digunakan dalam pengabdian kepada masyarakat ini meliputi observasi lapangan, pelaksanaan pendidikan hukum dan hak asasi manusia, pendampingan advokasi hukum dalam penyusunan dan perancangan peraturan desa berbasis konsep Desa Inklusif, serta pelaksanaan monitoring dan evaluasi. Hasil pengabdian kepada masyarakat ini berhasil memberikan pemahaman baru dan peningkatan kesadaran akan demokrasi lokal. Selain itu, hasil lainnya adalah integrasi nilai-nilai kearifan lokal Huyula (gotong royong) dan Dulohupa (musyawarah mufakat) telah memperkuat legitimasi sosial dalam pembentukan kebijakan desa yang inklusif. Dengan demikian, pengabdian kepada masyarakat ini telah memberikan kontribusi nyata bagi pengembangan hukum daerah yang demokratis dan inklusif, serta menjadi model pemberdayaan desa yang menekankan kesetaraan, partisipasi, dan penghormatan terhadap hak asasi manusia.

Abstract

This study examines the disharmony between Gorontalo City Regional Regulation No. 1 of 2018 on Public Order and Mayoral Regulation No. 4 of 2010 on nighttime entertainment operations. Although regulating similar matters, the two instruments lack coherence, causing uncertainty in implementation, particularly in Leato Selatan Village. The research employs a normative legal method through statutory and conceptual approaches, supported by interviews with relevant authorities. The findings reveal vertical, substantive, normative, and hierarchical inconsistencies resulting from weak institutional coordination, inadequate legislative scrutiny, and outdated provisions. This disharmony is both normative and structural, indicating deficiencies in the regional legislative framework. Accordingly, reform is necessary, including revising the Mayoral Regulation, strengthening inter-institutional cooperation, and enhancing the role of legislative drafters to ensure coherent, adaptive, and socially responsive regulations.

Abstract

This study analyzes the form and implementation of legal protection for election supervisors in the 2024 General Election in Bone Bolango Regency and formulates an ideal model for future protection. It adopts a normative legal approach supported by empirical data, using statutory and conceptual methods. The findings indicate that existing protection is inadequate due to a normative gap in Law No. 7 of 2017, which does not explicitly regulate the occupational safety of supervisors. Furthermore, Article 491 remains repressive and limited to the campaign stage. In practice, supervisors experience psychological pressure and intimidation without effective advocacy mechanisms. The proposed model consists of three main pillars: regulatory reconstruction through the introduction of a *lex specialis* addressing violence against election officials; institutionalization of preventive and repressive protection measures, including hotlines and advocacy units; and optimization of institutional synergy, particularly through strengthening the role of the Gakkumdu Center and enhancing support from local governments.
