Abstract

In the Covid-19 era, the Minister of Public Health uses non-cash transactions, non-cash transactions that reduce direct interaction are the QRIS (Quick Response Code Indonesian Standard) payment system, with a QR Code Scan of successful payment transactions. So according to researchers, traditional markets in Batam city are places that often use cash transactions, so it is good if QRIS payments can be made in traditional markets. The research used by the researcher is empirical which goes directly to the field to see the market situation and how effective the implementation of QRIS is by conducting interviews with business actors in the traditional market. The researcher obtained data from DISPRINDAG, Bank Indonesia and Conventional Banks for effective implementation of QRIS in Traditional Markets because of the 51 Traditional Markets in Batam City only 3 traditional markets have implemented QRIS, so the solution is according to Government Progressive Law, Bank Indonesia and Conventional Banks that support QRIS must conduct socialization to traditional market businesses and the community to explain more clearly and help business actors who want to implement QRIS so that the implementation of QRIS can run effectively, and can suppress the transmission of Covid-19, at the Batam City Traditional Market by utilizing the non-cash payment method using QRIS

Abstract

Protection of personal data is a human right that must be given legal protection. However, Indonesia does not yet have special rules governing the protection of personal data and the Personal Data Protection Supervisory Agency. As for when compared to Germany, which has special rules regarding the protection of personal data in full to the Institution that oversees the implementation of the rules for protecting Personal Data. The research method used by the author is a legal comparison method with the type of research being normative research. The author uses secondary data to analyze the results of the data, namely, primary materials, secondary materials, and tertiary materials. The analytical method used by the author is a qualitative method. Similarities and differences in personal data protection between Indonesia-Germany and the legal contributions of personal data protection that he can adopt or apply in Indonesia such as special arrangements for personal data protection, data classification, one of which is the deletion of personal data, and the establishment of a Personal Data Protection Supervisory Agency and the rules that govern it

Abstract

The growth of peer-to-peer lending requires robust legal regulations to protect stakeholder rights and facilitate continued economic development in Indonesia through enhanced access to funding. This article seeks to analyze the legal developments surrounding peer-to-peer lending in Indonesia, Singapore, and Australia. Utilizing a doctrinal legal research methodology with a comparative approach, the findings reveal that Singapore and Australia can effectively leverage existing regulations without the need to create new ones, thereby mitigating the risk of legal dissonance. In contrast, while Indonesia has implemented specific regulations for peer-to-peer lending, it has not provided sufficient normative legal protection within this sector and has failed to safeguard the rights guaranteed by those regulations. These findings suggest that a specific regulatory approach may not be the most effective strategy for Indonesia's legal development, thereby contributing to the ongoing discourse surrounding legal advancements in the fintech industry.How to CiteViona Puspita et. al. Abstract

Human Trafficking is a global issue that continues to escalate, including in Batam City, one of Indonesia's Human Trafficking hotspots. This study aims to analyze the effectiveness of combating Human Trafficking Crimes (Human Trafficking) in Batam City by comparing Indonesian and Singaporean laws. The research addresses the implementation of Indonesian laws, regulatory comparisons between the two countries, and recommendations for ideal solutions.The study employs normative and empirical legal methods with legislative, conceptual, and sociological approaches. Data were collected through literature reviews and interviews with relevant institutions in Batam. The findings reveal that although Indonesia’s Law No. 21 of 2007 provides a comprehensive legal framework, its implementation faces challenges such as weak inter-agency coordination, limited support facilities, and low public legal awareness. In comparison, Singapore has more effective regulations with severe sanctions and advanced technology. Recommendations include revising specific articles in Law No. 21 of 2007, strengthening cross-sectoral coordination, enhancing victim protection facilities, providing intensive training for law enforcement officers, and applying technological support. These measures are expected to optimize the fight against Human Trafficking in Batam City.

Abstract

Verdict of Indonesian Constitutional Court No. 100 / PUU-X / 2012 and No. 114 / PUU-XIII / 2015 raises the new values in the expiration claims in the field of labor. This study aims to reveal the description of the new values that applicate at the dogmatic level related to the expiration claims after the Indonesian Constitutional Court Verdict No. 100 / PUU-X / 2012 and No. 114 / PUU-XIII / 2015 on the corporate perspective. This study uses normative juridical research, by analyzing secondary data obtained, including related legislation and court Verdicts. The results of this study are: there still found inconsistencies in the level of implementation of the cases which related to the expiration claim in the labor law, that causes legal uncertainty. This inconsistency is influenced by the philosophical basis used by the Indonesian Constitutional Court to decide the Indonesian Constitutional Court's Verdict No. 100 / PUU-X / 2012 and No. 114 / PUU-XIII / 2015. It is necessary and immediate to change the law related to the regulation of the expiration claims in the field of labor that prioritizing the principle of the good faith to see the interests of all parties in employment.

Abstract

Industri fashion yang semakin menjamur telah menuntut setiap pelaku usaha untuk memiliki nilai, inovasi, maupun ciri khas dalam menjalankan usahanya agar tetap eksis terutama dalam bentuk, konfigurasi atau komposisi garis atau warna atau gabungan di antaranya dengan tujuan memberikan kesan estetika dalam menghasilkan suatu produk atau barang. Tidak jarang dalam implementasinya terjadi hal plagiarisme terkhusus dalam pola atau desain, sehingga menyebabkan terjadinya kerugian baik materiil maupun immateriil. Penelitian ini bertujuan untuk menganalisa permasalahan terkait plagiarisme mode pakaian dalam ranah hukum Desain Industri di Indonesia. Metode penelitian yang digunakan adalah metode yuridis normatif. Hasil penelitian menunjukkan bahwa perlindungan Desain Industri terkait plagiarisme desain mode di Indonesia telah didasari oleh teori perlindungan hukum melalui dua cara, yakni perlindungan hukum preventif guna mencegah atau menghindari plagiarisme dan perlindungan hukum represif untuk mengadili pelaku plagiarisme dengan pemberian sanksi atau denda, di mana keduanya mengacu pada pemberlakuan Undang-Undang Nomor 31 Tahun 2000 tentang Desain Industri.

Abstract

Public service is a way to realize a prosperous country. Notaries are officials who provide public services in the field of legal services for the community. The role of notaries is very important in providing legal certainty. The purpose of this study is to analyze notary services in the Riau Islands Province and the role of the supervisory board in supervising the performance of notaries. The method in this study is empirical juridical. In answering the problem in this study, the legal basis namely Law Number 2 of 2014 Concerning the Position of Notary and theoretical basis is used, namely the theory of legal certainty by Hans Kelsen and legal protection theory by Philipus M. Hadjon. The results of the study show that notary services still face various problems, especially in the Batam City area. However, there still needs to be synergy between regional and central supervisors in taking firm action against notaries who do not provide good public services. The role of regional supervisors in providing guidance to notaries is expected to provide preventive and repressive protection. The preventive role can be carried out through guidance and repressive can be carried out with the active role of supervisors at the central level in providing sanctions for permanent dismissal based on recommendations from the supervisory board at the regional level.

Abstract

The simultaneous election model that separated the implementation of national and local elections has created various problems, such as election worker fatigue, logistical burdens, and limited attention to local issues. Constitutional Court Decision No. 135/2024 subsequently corrected this model by establishing a new arrangement that separates the conduct of National Elections and Regional Elections. This study was a normative legal research employing qualitative juridical analysis aimed at examining the effectiveness of the previous simultaneous model, testing the constitutionality of the new model, and analyzing its implications for the term of office of Regional Heads and local parliament members (DPRD) elected in 2024. The findings show that the previous simultaneous model was ineffective, the new model has a strong constitutional basis, and the most rational solution to its transitional implications is to shorten the term of office of Regional Heads and DPRD members elected in 2024 and to hold Regional Elections in 2028. In this regard, it is recommended to amend the Election Law and the Regional Election Law and to regulate the transitional period in accordance with constitutional principles.

Abstract

Smart Contracts offer significant potential for contractual processes in Indonesia, much like their utilization in the United States under the prevailing regulations of both countries, including the Electronic Information and Transactions Law Number 11 of 2008, the Civil Code, the Uniform Electronic Transaction Act, the Electronic Signatures in Global and National Commerce Act, the Blockchain Technology Act, as well as Arizona House Bill 2417 and Nevada Senate Bill No. 398. This study aims to pragmatically analyze the legal perspective regarding the legal capacity to facilitate the use of Smart Contracts as a form of blockchain technology, using the legal framework of the United States as a comparative basis. The research employs a comparative legal research method with a legislative approach. The analysis reveals the inadequacy of the legal framework in Indonesia, despite recent revisions, which still exhibit numerous shortcomings in facilitating the utilization of Smart Contracts. Suggestions for regulatory aspects are proposed to support comprehensive legal development, as an effort to adapt to the evolving times. Smart Contract menawarkan potensi pemanfaatan yang baik dalam proses berkontrak di Indonesia, sebagaimana yang telah mulai dimanfaatkan di Amerika Serikat melalui peraturan perundag-undangan yang berlaku di kedua belah negara, yaitu Undang-Undang Nomor 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik, Kitab Undang-Undang Hukum Perdata, Uniform Electronic Transaction Act, Electronic Signatures in Global and National Commerce Act, Blockchain Technology Act, dan Arizona House Bill 2417, Nevada Senate Bill No. 398. Penelitian ini bertujuan untuk menganalisis secara pragmatisme dalam perspektif hukum perihal kecakapan hukum untuk memfasilitasi pemanfaatan Smart Contract sebagai bentuk teknologi blockchain, dengan menggunakan kerangka hukum Amerika Serikat sebagai bahan komparasi. Penelitian ini menggunakan metode penelitian komparatif dengan pendekatan perundang-undangan. Analisis menemukan adanya ketidakcakapan kerangka hukum di Indonesia, meskipun telah didukung dengan revisi pengaturan terbaru, yang nyatanya masih memiliki banyak kekurangan dalam kecakapan untuk memfasilitasi pemanfaatan Smart Contract.
