Abstract

Today there are many modes or methods used in financial institutions to commit money laundering crimes, if this abuse continues it can harm the country's economy and perpetrators will continue to develop especially in using financial institutions to conduct money laundering. To realize a sound and stable financial system because of the importance of the role of the Financial Transaction Reports and Analysis Center (PPATK), which is an independent institution established in order to prevent and eradicate money laundering in accordance with Article 38 of Law No. 8 of 2010 Regulations concerning Eradication and Prevention of Money Laundering Crimes. The purpose of writing this essay is; First, to find out the role of the Financial Transaction Reports and Analysis Center (PPATK) in preventing money laundering in financial institutions; Second, to find out the countermeasures made by the Financial Transaction Reports and Analysis Center (PPATK) in preventing money laundering in financial institutions. The type of legal research used by the author is a type of normative legal research or library legal research. Normative legal research or library legal research.From the results of the study, there are two main things that can be concluded. First, the role of PPATK in preventing money laundering in financial institutions has been regulated in legislation such as Law No. 8 of 2010 concerning Prevention and Eradication of Money Laundering, Presidential Regulation and PPATK Head Regulation, where the role is in the implementation Procedures for Reporting Cash Financial Transactions, Suspicious Financial Transactions, Fund Transactions from Inside to Foreign Funds. There is a Temporary Termination and Postponement of Transactions, Integrated Service Provider Information System and Application of Principles of Knowing Service Users. Second, the countermeasures undertaken by the PPATK in preventing money laundering in financial institutions include efforts to maintain financial system stability, namely MER cooperation, PPATK Projections for the end of 2018 and its Final PPATK Reflections in 2018 by launching the Public Perception Index on Anti-Money Laundering and Eradication of Terrorism Funding, up to the receipt of financial transaction reports from Providers of Financial Services, and in efforts to overcome the collaboration between law enforcement and the Government.

Abstract

The percentage of errors diagnosed by doctors to patients in online clinics, it is one of the challengesthat must be faced for advancement in the health sector. A study conducted by the association of trial lawyerof America shows that the percentage of doctors misdiagnosed is as much as two percent of the totalpatients who undergo examinations in the clinic. Patients who are misdiagnosed usually have atypicalsymptoms that make diagnosis more difficult. If a diagnosis error by a doctor occurs, the doctor should orcan be held accountable, because in general everyone is responsible not only for the loss caused by hisactions, but also for losses caused by negligence or inadvertence.The formulation of the problem in this research is, first, how is the online clinic's legal positionbased on the Law of the Republic of Indonesia Number 36 of 2009 concerning Health? second, how is thecriminal responsibility against doctors based on the Law of the Republic of Indonesia Number 29 of 2004concerning Medical Practices?The research is a normative legal reseach. From the results of the problem research there are twomain things that are collected, first, the position of online clinical criminal law in the provision of healthservices is based on the Law of the Republic of Indonesia Number 36 of 2009 concerning Health that everyperson has the right to obtain safe, quality and affordable health services. Second, the accountability ofcriminal law against doctors is based on the Law of the Republic of Indonesia Number 29 of 2004concerning Medical Practices, namely if a doctor commits a mistake made by a doctor or other healthworker which causes damage or disability in the victim's body negligently.Keywords:criminal liability, diagnosis, health services

Abstract

In the civil procedural law the judge must listen to both parties (Audi Et Alteram Partem) based on Article 4 paragraph (1) of Law Number 48 Year 2009 concerning Judicial Power. However, in practice the application of this principle has not been well implemented, due to the absence of the defendant in the trial process. Based on this fact, there are 3 problem statements in the writing of this thesis, namely: First How is the application of the Audi Et Alteram Partem principle in the Default Case in the absence of the defendant in the Pekanbaru district court decision? Second How is the resolution of the Audi Et Alteram Partem principle in the Default Case in the absence of the defendant in the Pekanbaru District Court? and the obstacles faced by the Pekanbaru District Court judges in applying the principle of Audi Et Alteram Partem to the Default Case in the absence of the defendant?This type of research is sociological research, because this study the author directly conducts research at the location or place under study in order to provide a complete and clear picture of the problem under study. The study was conducted at the Pekanbaru District Court, while the population and sample were all parties concerned with the problem under study, the data sources used were primary data, secondary data, and tertiary data, the data collection techniques in this study were interviews and literature review.From the results of this study have 3 main things that can be concluded. First. The application of the Audi Et Alteram Partem principle has not gone well in the Pekanbaru District Court. Second, the settlement of the case for default in the absence of the defendant. Abstract

Law Number 1 of 2011 in Article 98 paragraph (3) concerning Housing and Settlements, it is explained that the regional government has the authority to conduct arrangements and determine the location of slum housings and urban slums. This is what underlies the Regional Government of Siak Regency to have a role in identifying various local wisdoms in its region. The existence of the local wisdom of the indigenous people of Siak can be viewed from the legal aspect of structuring the location of housing and slums as mandated by legislation and implemented in the Letter Regent Decree Number 523/HK/KPTS/2014 concerning Determination of Slum and Slum Housing Locations in Siak Regency and Regent Decree Number 302/HK/KPTS/2017 concerning Slum and Slum Residential Housing Locations in Siak Regency. The result is the existence of the local wisdom of Indigenous people of Kampung Buatan II, Koto Ghasib Subdistrict did not work optimally, because it had not maximized the role of the Riau Malay Customary Institution in Siak Regency. However, the noble values of local wisdom in Malay indigenous communities in structuring the location of housing and slums are known from their ancestors expressed in a proverb or customary expression in preserving nature around us to create a clean, healthy life by understanding the meaning of development, understanding the ins and outs of religion and culture and the social norms of the people, so that development is truly beneficial for all levels of society.

Abstract

Customary law is religiously functional law, so that customary law fulfills a social function or social justice. Thus, the community and its members carry out these normative orders without seeing them as coercion, but because they assume they are as such. The aim of the law is justice, expediency and legal certainty, and these three elements constitute an inseparable unity. Justice is the moral foundation of the law and, at the same time, the benchmark for a positive legal system. In other words, justice has always been the basis of the law. Without justice, a rule can not be called a law. The highest possible justice to be achieved in the mediation of sanctions is the agreement of the parties involved in the criminal case.

Abstract

Kampung Temusai has been designated as a village worthy of children designated by the Bungaraya District. The formulation of the problem in this study is, what are the forms of child-friendly village programs as an effort to prevent child abuse in Temusai village and what are the factors that become obstacles in the implementation of the child-friendly village program and what are the efforts done in coming these obstacles. This research was conducted in Temusai Village. This type of research is sociological juridical with an emphasis on field research. The sociological juridical approach is carried out because the problems studied revolve around how the law applies in society. Judging from its nature, this research is descriptive, because it intends to describe the reality clearly and systematically. The Child Friendly Village Program that has been carried out in Temusai Village is the Community-Based Integrated Child Protection Campaign (PATBM), Maghrib study Program, Collaboration and coordination with various parties in supporting the Child Friendly District Program (KRA). The factors that become obstacles in implementing the child-friendly village program in Temusai village are Lack of Professional Human Resources, Limited technical guidance, Limited budget in running existing programs, Lack of supporting facilities and infrastructure for the Child Friendly Village Program and Lack of awareness community in supporting the Child Friendly Village program. Efforts made to overcome obstacles in the implementation is Coordinating with the local government regarding the budget which is still very minimal,

Abstract

Bagi pelaku usaha mikro kecil dan menengah (UMKM) untuk memulai usahanya perlu memikirkan perlindungan Hak Kekayaan Intelektual (selanjutnya disebut HKI). Jikalau, para pelaku usaha mikro kecil dan menengah (UMKM) tidak memikirkan perlindungan HKI, maka karya para pelaku usaha dapat mudah terjadi pelanggaran HKI. Oleh karena itu, pada masa awal memulai bisnisnya, mereka seharusnya sudah memberikan perlindungan HKI-nya, sebab HKI sejatinya dapat menjadi aset berharga yang bisa menyelamatkan perusahaan di masamasa sulit. HKI sejatinya adalah hak yang muncul dari hasil oleh pikir atau kreasi manusia yang pada akhirnya menghasilkan suatu produk atau proses yang berguna bagi manusia. Dalam dunia bisnis, HKI bisa menjadi elemen penting karena dapat memberikan keunggulan berkompetisi ketika bermain di pasar yang dibidik bagi pemiliknya. Bahkan, tak menutup kemungkinan pula HKI ini dapat menjadi pemicu untuk memunculkan berbagai inovasi baru bagi pelaku usaha mikro kecil dan menengah (UMKM) yang pada akhirnya dapat menguntungkan publik juga para pelaku usaha itu sendiri, misalnya dalam menghadapi perdagangan bebas ASEAN. Tujuan dilaksanakan kegiatan pengabdian masyarakat ini adalah sosialisasi aspek HKI bagi para pelaku UMKM di Kabupaten Kampar. Metode penerapan yang dipilih adalah sosialisasi atau desiminasi ilmu pengetahuan, dalam hal ini adalah penyebaran informasi tentang HKI dan tata cara pendaftaran HKI. Dari kegiatan pengabdian ini, pelaku usaha UMKM di Kabupaten Kampar menyadari penting aspek HKI untuk kemajuan usaha.

Abstract

Riau Province's Dumai City is a popular tourist destination. Since the opening of the Permai (Pekanbaru-Dumai) toll road connecting Pekanbaru City and Dumai City in less than two hours, Dumai has grown in popularity among travelers. The impact of the short journey, one of which is increased mobility among those who travel to Dumai City. Dumai City's souvenir businesses have benefited as a result of this. As a consequence, familiarity with existing provisions is required, particularly in relation to consumer rights to consume food. Several consumer protections provisions have been issued by the government, including Law No. 8 of 1999 and BPOM Regulation No. 31 of 2018. As a result, the purpose of this program is to inform MSME actors about relevant legal provisions. In the field of law, counseling or socialization is used as a method. The socialization was done in collaboration with the City of Dumai's Office of Industry, Cooperatives, and Small and Medium Enterprises. Souvenir makers gain legal knowledge as a result of this socialization, and they are expected to be able to apply that knowledge in their products.

Abstract

Hukum humaniter internasional atau dikenal juga dengan Internasional Humanitarian Law applicable in armed conflict yang lazim disebut dengan hukum humaniter merupakan nama baru bagi laws of war atau hukum perang. Dalam kenyataannya masih sering terjadi bahwa ketentuan-ketentuan dalam Konvensi Jenewa 1949 dan perjanjian internasional serta kebiasaan internasional lainnya yang berkaitan dengan hukum humaniter tidak ditaati oleh pihak-pihak yang terlibat konflik bersenjata. Dalam sejarah penegakan hukum humaniter, mahkamah pidana internasional ad-hoc pernah dibentuk untuk mengadili pelaku-pelaku kejahatan perang, misalnya ICTY dan ICTR. Dengan telah lahirnya Mahkamah Pidana Internasional (ICC) melalui Statuta Roma, maka pelaku kejahatan perang dapat juga diajukan kepada ICC dengan memperhatikan pengaturan- pengaturan dalam Statuta Roma.

Abstract

Based on the regulation of the drug and food regulatory agency number 12of 2018 concerning the organization and work procedures of technicalimplementing units within the drug and food regulatory agency. Based onresearch by researchers at the UPT BBPOM Pekanbaru, it is still not optimal interms of implementing supervision and Regulation of the Minister of Health of theRepublic of Indonesia Number 15 of 2018 concerning the Implementation ofComplementary Traditional Health Services, this regulation is technical in theimplementation related to complementary traditional health services. Regulationof the Minister of Health of the Republic of Indonesia Number 15 of 2018Concerning the Implementation of Complementary Traditional Health Services, itis necessary if a study both philosophically, sociologically and juridically in theimplementation of complementary traditional medicine in Pekanbaru is inaccordance with these regulations. This type of research can be classified into thetype of sociological legal research.The conclusions that can be obtained from the research results are First,the responsibility of the Pekanbaru City Drug and Food Supervisory Agency(BBPOM) regarding the supervision of traditional herbal medicine productionbased on BPOM agency regulations number 12 of 2018 and Permenkes number15 of 2018 in Pekanbaru, namely starting from issuing permits to supervision inthe product distribution Second, the Inhibiting Factors for Oversight of thePekanbaru City Drug and Food Control Center regarding the production oftraditional herbal medicine Third, the efforts made by the Pekanbaru City Drugand Food Control Center to supervise and control the production of traditionalherbal medicine in Pekanbaru, namely issuing distribution permits for productsand certificates in accordance with standards and requirements for safety,efficacy/benefits, and quality, as well as drug and food testing in accordance withstatutory provisionsKeywords: Responsibility, Traditional Medicine, Traditional Health.
