Abstract

Parole is a crucial component of the correctional system that aims to reduce prison overcrowding while ensuring legal certainty for inmates. However, the implementation of parole for foreign inmates in Indonesia faces significant administrative and inter-agency coordination challenges. This gap between legal provisions and practical implementation creates obstacles, especially for foreign inmates who face a more complex legal status and cumbersome bureaucratic procedures. This study aims to analyze the implementation of parole for foreign inmates to fulfill legal certainty at the Tanjung Gusta Class I Correctional Institution in Medan. Using an empirical juridical method with a qualitative approach, this study involved document analysis, interviews with prison officers, and direct field observations. The research findings revealed that the parole process for foreign inmates is hampered by complex bureaucracy, a lack of understanding among officers and the public, and inadequate coordination between correctional institutions, immigration authorities, and other related institutions. In addition, unintegrated administrative procedures cause delays in granting the right to parole. This study concludes that improving inter-agency coordination, simplifying administrative procedures, and strengthening outreach efforts to officers and the public are crucial to realizing legal certainty for foreign inmates. These efforts are expected to support the correctional system's goal of rehabilitation. and social reintegration of prisoners while effectively addressing prison overcrowding issues.

Abstract

This research will discuss the substance relating to environmental crimes contained in Law No. 32 on Environmental Protection and Management, whether Cyber Crime in its application is related to environmental crimes that cause pollution and / or environmental damage, because in the process of activity and management of natural resources whose perpetrators are subjects of environmental law in the form of companies in the form of legal entities or non-legal entities will utilize technology and information via the internet for their activities. This research uses normative legal research methods with qualitative methods. Cybercrime is related to environmental crimes contained in Law Number 32 of 2009 concerning Environmental Protection and Management, including environmental crimes committed by corporations, and falsification of data via the internet on manifest waste and other polluting materials that result in losses to the community and the environment

Abstract

Pengelolaan limbah medis sudah diatur dalam regulasi hukum terkait dengan pengelolaan limbah medis puskesmas, pengelolaan limbah sangat penting dilakukan oleh puskesmas. Pengelolaan limbah medis harus dilakukan dengan tepat dan benar agar tidak menimbulkan dampak pada lingkungan dan kesehatan. Permasalahan yang dihadapi staf tenaga medis dan non medis Puskesmas H.A.H. HASAN Kelurahan Payaroba Kota Binjai belum mengetahui dan memahami regulasi yang mengatur tentang pengelolaan limbah medis, pengelolaan limbah medis, dan dampak limbah medis bagi kesehatan dan lingkungan. Berdasarkan hal itu pentingnya kegiatan pengabdian ini dilakukan dengan memberikan edukasi hukum tentang pengelolaan limbah medis pada Puskesmas H.A.H. Hasan. Metode yang digunakan dalam pengabdian ini adalah metode observasi, pemaparan, diskusi/tanya jawab, dan kuesioner. Hasil dari pengabdian ini adalah staf tenaga medis dan non medis Puskesmas H.A.H. Hasan terdapat 2 yang tidak dan 23 yang dapat mengetahui dan memahami terkait regulasi hukum yang mengatur tentang pengelolaan limbah medis, terkait dengan pengelolaan limbah medis terdapat 25 yang dapat mengetahui dan memahami, serta terdapat 25 yang dapat mengetahui dan memahami dampak limbah medis bagi kesehatan dan lingkungan.

Abstract

Color protection as trademark faces harmonization challenges between international and national legal standards. The TRIPS Agreement recognizes color combinations with requirements of distinctiveness through secondary meaning and non-functionality, where developed countries like the United States and Australia even protect single colors as demonstrated in cases like Louboutin v. YSL. However, Indonesia through Law No. 20 of 2016 only recognizes "color arrangements" interpreted as combinations, hindering single color registration. Main obstacles include absence of technical guidelines for proving secondary meaning, imprecise color representation standards, high examiner discretion, and minimal jurisprudence. This creates legal vacuum and uncertainty for businesses, necessitating regulatory reform to recognize both single and combination color registration to provide legal certainty while aligning with international best practices.

Abstract

This study aims to analyze legal regulations, forms of criminal liability, and legal considerations of judges regarding business entities that commit environmental pollution exceeding the established quality standards. A good and healthy environment is a fundamental right of every citizen as guaranteed in Article 28H paragraph (1) of the 1945 Constitution of the Republic of Indonesia and further regulated in Law Number 32 of 2009 concerning Environmental Protection and Management. However, in practice, environmental pollution by business entities still frequently occurs, thus giving rise to legal issues related to the effectiveness of enforcing corporate criminal liability. This study uses a normative juridical research method with a descriptive analytical nature, a statutory regulatory approach, and case studies. Research data were obtained through literature studies covering relevant laws and regulations, legal documents, books, dictionaries, mass media, and internet sources, then analyzed qualitatively. The results of the study indicate that: (1) legal regulations related to violations of environmental quality standards normatively reflect the values ​​of justice, legal certainty, and legal benefits, but the effectiveness of their implementation still depends on coordination between law enforcement agencies; (2) the criminal liability of business entities is based on the provisions of Article 116 of Law Number 32 of 2009 which allows for the prosecution of legal entities and/or their managers; and (3) the legal considerations of judges in decisions regarding the criminal liability of business entities are based on the application of positive law while still paying attention to the values ​​of justice, benefit and legal certainty.

Abstract

The attack on Iran’s consular premises in Damascus underscores significant legal challenges concerning the special duty of the receiving State to protect foreign representations. In international law, the protection of diplomatic and consular missions is a fundamental obligation of the receiving State, as regulated under the 1961 Vienna Convention on Diplomatic Relations and the 1963 Vienna Convention on Consular Relations. This research aims to analyze the obligations of Syria, as the receiving State, in protecting the consular premises of Iran in Damascus from third-party attacks based on diplomatic law. This research employs a normative legal research method with a descriptive approach, utilizing an analysis of international legal instruments, legal doctrines, and relevant State practices. The results indicate that Syria, as the receiving State, failed to fulfill its obligation to take all appropriate steps to protect the inviolability of the consular premises and the safety of consular officers. Such failure constitutes a breach of the protective obligations stipulated in Article 22 paragraph (2) of the 1961 Vienna Convention and Article 31 paragraph (3) of the 1963 Vienna Convention, specifically regarding the receiving State's duty to prevent any form of attack, damage, or disturbance of the peace of the consular mission. This research provides an academic contribution by strengthening the understanding of the nature of the receiving State's obligations in the context of consular protection as an obligation of conduct, as well as a practical contribution in affirming the standards of State responsibility within the context of modern armed conflict under diplomatic law.

Abstract

Palm oil mills have become an integral part of the economy in North Sumatra Province, but the growth of this industry often has negative impacts on the environment. In this context, the implementation of environmental administration law enforcement is very important to ensure sustainable environmental protection and management. This research aims to analyze the implementation of environmental administrative law enforcement related to environmental approvals and permits for palm oil mills in North Sumatra Province. Through a qualitative approach and case studies, data was collected from various sources, including legal documents, government policies, and interviews with relevant stakeholders. The research results show that although there are strict regulations and regulations regarding environmental approvals and permits for palm oil mills, the implementation of environmental administrative law enforcement still faces challenges. Factors such as a lack of human resources, the inability of institutions to supervise effectively, and local political interference are the main obstacles to implementing effective law enforcement. However, this research also found several positive initiatives, such as increasing environmental awareness among the palm oil industry and efforts to strengthen the capacity of environmental law enforcement agencies. The resulting recommendations include expanding trained human resources, increasing transparency in the licensing process, and strengthening cooperation between government, industry, and civil society to achieve sustainable environmental management in North Sumatra Province.

Abstract

Abstract: This research examines the inconsistency in the application of the concept of participation (medeplegen) based on legal regulations in Indonesia. Indonesia as a state of law (rechtsstaat) requires consistency in the application of legal norms, including criminal law. However, in practice, there are often inconsistencies in the application of participation regulations as stipulated in Article 55 of the Criminal Code (KUHP) in conjunction with Article 20 of the National Criminal Code (KUHP Nasional) of 2023. This study uses normative legal research methods with statutory and case approaches. The results of the research indicate that first, the juridical provisions regarding the concept of participation in the criminal law system include several forms: pleger (person who commits), doen pleger (person who causes another to commit), medepleger (person who participates in committing), and uitlokker (person who incites). Second, the inconsistency in applying the concept of participation occurs due to differences in interpretation between law enforcers, lack of clear guidelines in distinguishing forms of participation, and the transition period between the old Criminal Code and the National Criminal Code of 2023. This research recommends the need for technical guidelines from the Supreme Court and intensive socialization regarding the implementation of participation provisions in the new national criminal law. Keywords: Participation, Medeplegen, Criminal Law, Inconsistency, National Criminal Code Abstrak: Penelitian ini mengkaji inkonsistensi penerapan konsep penyertaan (medeplegen) berdasarkan peraturan hukum di Indonesia. Indonesia sebagai negara hukum (rechtsstaat) menghendaki konsistensi dalam penerapan norma hukum, termasuk hukum pidana. Namun dalam praktiknya, seringkali terjadi inkonsistensi dalam penerapan regulasi penyertaan sebagaimana diatur dalam Pasal 55 Kitab Undang-Undang Hukum Pidana (KUHP) juncto Pasal 20 KUHP Nasional Tahun 2023. Penelitian ini menggunakan metode penelitian hukum normatif dengan pendekatan perundang-undangan dan pendekatan kasus. Hasil penelitian menunjukkan bahwa pertama, ketentuan yuridis konsep penyertaan dalam sistem hukum pidana mencakup beberapa bentuk: pleger (orang yang melakukan), doen pleger (orang yang menyuruh melakukan), medepleger (orang yang turut serta melakukan), dan uitlokker (orang yang menganjurkan). Kedua, inkonsistensi penerapan konsep penyertaan terjadi karena perbedaan penafsiran antaraparat penegak hukum, tidak adanya pedoman yang jelas dalam membedakan bentuk-bentuk penyertaan, serta masa transisi antara KUHP lama dengan KUHP Nasional 2023. Penelitian ini merekomendasikan perlunya pedoman teknis dari Mahkamah Agung dan sosialisasi intensif mengenai implementasi ketentuan penyertaan dalam hukum pidana nasional yang baru. Abstract

Flying hot air balloons in East Javanese society is a custom before welcoming Eid al-Fitr, but in this case, this custom has the potential to be dangerous to public safety. The case of flying a hot air balloon that endangers an aircraft that will be studied in this research is a case of a hot air balloon flown by several people and is considered a criminal offense as has permanent legal force based on Court Decision Number 68 / PID.B / 2022 / PN Png and Decision Number 114 / Pid.B / 2022 / PN Mjy. The research method uses a normative method. The results of the study state that the legal regulation of flying hot air balloons within the framework of traditional traditions in Indonesia is regulated in the Minister of Transportation Regulation Number 40 of 2018, however, as the regulation is a ministerial regulation, its substance is limited to regulating the procedures for supervision and administration in flying hot air balloons. The qualifications for criminal acts that endanger aviation are according to Law Number 1 of 2009 concerning Aviation. As seen from Article 411 of the Law, it does not explicitly mention criminal provisions for the actions of people who fly hot air balloons. The judge's consideration in applying Article 411 in Decision Number 68/Pid.B/2022/PN Png and Decision Number 114/Pid.B/2022/PN Mjy considered that the defendants had endangered the flight by flying the hot air balloon.

Abstract

Diskriminasi terhadap siswa dari kelompok minoritas sosial, seperti yang terjadi di SMA Swasta Markus Medan, merupakan tantangan serius dalam menciptakan lingkungan pendidikan inklusif dan adil. Ketimpangan perlakuan berdasarkan latar belakang sosial, budaya, atau kemampuan siswa menghambat perkembangan akademis, psikologis, dan hubungan sosial yang sehat. Pendidikan inklusif yang menghargai keberagaman dan memberikan dukungan yang adil sangat diperlukan untuk memastikan setiap siswa berkembang dalam lingkungan aman, nyaman, dan mendukung. Kegiatan pengabdian masyarakat menggunakan metode observasi, presentasi PowerPoint, video edukasi, serta sesi diskusi untuk meningkatkan kesadaran siswa terhadap anti-diskriminasi. Sekolah memiliki tanggung jawab menciptakan lingkungan inklusif di mana keberagaman dihargai dan setiap siswa diperlakukan secara setara. Dengan melibatkan siswa, orang tua, dan masyarakat, pendidikan dapat berperan dalam membangun budaya toleransi dan keadilan sosial. Saran untuk mengatasi isu diskriminasi mencakup penguatan kebijakan inklusif, integrasi pendidikan anti-diskriminasi dalam kurikulum, serta pelatihan rutin bagi guru dan staf sekolah. Dengan langkah-langkah ini, diharapkan diskriminasi dapat ditekan, sehingga semua siswa berkembang secara setara tanpa memandang latar belakang sosial atau budaya mereka.
