Abstract

Indonesia has passed many government regimes. Regime change is a process of succession of powers in which each journey results in different policies. This also resulted in the establishment of many laws and regulations in accordance with the needs of each power holder, which is part of his policy as well. This then forms a disharmonic and hyper-regulated legal ecosystem. Therefore, a policy breakthrough was initiated in the process of establishing legislation, namely Omnibus Law. But the problem and must first be answered is the concept of Omnibus Law has not been regulated in the legislation. Law No. 15 of 2019 concerning Amendment to Law No. 12 of 2011 concerning the Establishment of Legislation so far has not been drafted with the aim of accommodating the existence of Omnibus Law. It is then able to describe the application of Omnibus Law in the Indonesian Legal System.

Abstract

ABSTRACT:This legal research aims to know the application of the PPDB Zone System in the fulfillment of constitutional rights in the field of education in Kabupaten Kudus, and the obstacles faced. Legal research is empirical or non-doctrinal research. The types of data used are primary data in the form of observations and interviews, as well as secondary data of law. Data collection techniques are carried out by collecting library studies of legal materials related to research as well as data obtained from field observations and interviews. Education is the duty and authority of the Regional Government, so the Government of Kabupaten Kudus is obliged to organize education based on the zonation system by establishing its organization for the fulfillment of the Constitutional Rights in the field of education. In the establishment of the Decision of the Ministry of Education and Culture Number 421/10163 About Acceptance of New Students in Senior High School (SMA) and Vocational High School (SMK) in the State Province of Java Middle Teaching Year 2019/2020 and the decision of the Head of the Department of Education, Youth, and Sports of Kabupaten Kudus on implementation of the zoning system in freeing students who come from outside the area that has the closest distance with the state school of Kabupaten Kudus can enter the area of school zoning in Kabupaten Kudus. The regulation has basically met the fulfillment of constitutional rights in the field of education, but in its implementation there are still obstacles such as the administrative territory of Kabupaten Kudus that entered the zoning and only reached 2-3 villages around the school due to the uneven spread of schools and centralized in the city. This shows that there are some aspects that are slightly contrary to the constitutional right in the field of education.Keywords: zone system; Kabupaten Kudus; PPDB; constitutional rights.

Abstract

ABSTRACTThis study analyze the implementation of student enrollment with zoning system in Junior and Senior High School towards fullfilment of constitutional rights in education and the obstacles faced in the implementation. This research is empirical legal research and is descriptive in nature. This study uses qualitative approach with sources of legal material in the form of primary and secondary legal materials. The legal material collection techniques used were interviews and literature studies. Both student enrollment based on Ministerial of Education and Culture Regulation Number 20 of 2019. Technically, set with Mayor of Surakarta Regulation Number 17 of 2019 and Governor of Central Java Regulation Number 22 of 2019. Junior High School prioritize student from nearest zone radius with minimum quota of 85% while Senior High School prioritize student from nearest zone with minimum quota of 80%. The fullfilment of constitutional rights in education in Junior High School Enrollment running relatively optimal with one of the indicators, by being able to absord all of the registrants, while Senior High School can not accommodate many of the registrants. There are several obstacles faced in 2019’s enrollent, it’s as varied as the unequity school distribution, insufficient schools capacity, sudden policy change, inefficient registration process, area expantion, registrant with “Other Family” status had trouble in registering, and difficult determining the achievement components.Keywords : student enrollment; zoning system; constitutional rights.

Abstract

This writing aims to analyze the Implementation of Village-Owned Enterprises Law Number 6 of 2014 Concerning Villages (Case Study in Musir Kidul Village, Rejoso District, Nganjuk Regency) and the inhibiting factors. The research method used is an empirical legal method with descriptive research characteristics and a qualitative research approach. From the results of this study it can be concluded that the Implementation of Law Number 6 of 2014 concerning Village-Owned Enterprises in BUMDes in Musir Kidul Village, Rejoso District, Nganjuk Regency regarding establishment, organization, business formation, capital, management, and business development, in practice has been running, however there are several obstacles that make the implementation of Law Number 6 of 2014 concerning Villages Related to VillageOwned Enterprises less than optimal. Existing obstacles such as a lack of human resources in managing business units in BUMDesa Makmur Sentosa, unable to meet market demand, lack of public awareness, and the absence of articles governing grants and/or access to capital in Musir Kidul Village Regulation Number 6 of 2021 concerning Business Entities Village Owned.

Abstract

Penelitian ini menganalisis dan mengkaji tentang implementasi Peraturan Daerah Kota Surakarta Nomor 1 Tahun 2013 Tentang Penyelenggaraan Perhubungan dalam mewujudkan Kota Surakarta ramah pesepeda. Penelitian hukum ini menggunakan penelitian empiris yang bersifat deskriptif dan menggunakan pendekatan kualitatif yang menghasilkan data deskriptif analisis di Kota Surakarta. Sumber data yang diperoleh adalah sumber data primer dan data sekunder. Teknik pengumpulan data dalam penelitian ini yaitu wawancara dan observasi. Penelitian ini menunjukkan hasil yang diperoleh bahwa dalam implementasi Peraturan Daerah tersebut Pemerintah Kota dalam hal ini Dinas Perhubungan masih belum sesuai dengan ketentuan peraturan tersebut dan hal itu dapat dilihat dari tidak ditindaklanjuti beberapa aturan pelaksana dalam hal ini Peraturan Wali Kota yang berkaitan dengan pesepeda yaitu Rencana Induk Jaringan Daerah dan Pemasangan Perlengkapan Jalan. Kemudian, metode yang digunakan dalam mewujudkan Kota Surakarta ramah pesepeda justru merujuk kepada aturan yang dikeluarkan oleh Pemerintah Pusat dalam hal ini Kementrian Perhubungan. Hambatan yang dihadapi adalah: 1) substansi Peraturan Daerah yang tidak jelas; 2) sumber daya manusia dalam hal ini mengenai pemahaman konsep yang masih bias dan keterbatasan waktu dan tenaga; 3) harmonisasi antar instansi yang masih belum sinergi; 4) Partisipasi masyarakat.

Abstract

ABSTRACTThe aim of this research is to determine the judicial review problems by Supreme Court and Constitutional court. Using empirical and normative approach, data collected by literature studies, interviews, Focus Group Discussion (FGD) and observation. Data were analyzed by using the hermeneutics (interpretation) and deductive method.This research reveals that the legal framework of judicial review by Supreme Court and Constitutional Court are the Article 24 A paragraph (1) and Article 24 paragraph C (1) Indonesia basic law 1945. Constitutional court follow up the legal framework by issued PMK No. 06/PMK/2005 on guidelines of the judicial review procedure, while supreme court follow up the legal framework by issued supreme court regulation No 1/2011 There are two problems on judicial review by supreme court and constitutional coourt. First, conceptually, the implementation of judicial review by supreme court and constitutional court will make hard the control of norms herarchy in the manner of constitution enforcement. Second, operationally, the implementation of a judicial review by Supreme Court and the constitutional Court will create a conflict between state body due to the disparities on the verdict and regulation interpre- tation they have dealt with.Keywords: Judicial Review, Supreme Court, Constitutional courtABSTRAKPenelitian ini bertujuan mengetahui problematika pengujian peraturan perundang-undangan oleh Mahkamah Agung dan Mahkamah Konstitusi. Penelitian ini menggunakan pendekatan normatif sekaligus empiris. Pengumpulan data melalui Studi kepustakaan, Wawancara, Focus Group Discussion (FGD) dan Observasi. Data dianalisis dengan menggunakan metode hermeneutik (interpretasi) di samping deduktif. Hasil penelitian menunjukkan Pengaturan judicial review oleh Mahkamah Agung dan Mahkamah Konstitusi diatur dalam ketentuan Pasal 24 A ayat (1) dan Pasal 24 C ayat (1) UUD NRI 1945. Pelaksanaannya oleh MK ditindak lanjuti melalui PMK No 06/PMK/2005 tentang Pedoman Beracara dalam Perkara Pengujian Undang-Undang sedangkan oleh MA ditindaklanjuti melalui Peraturan Mahkamah Agung No. 1 Tahun 2011. Problematika judicial review melalui Mahkamah Agung dan Mahkamah Konstitusi, Pertama, secara konseptual pelaksanaan pengujian peraturan perundang-undangan ditangan MA dan MK akan menyulitkan integrasi pengawalan hirarki norma mulai dari perda sampai UUD dalam rangka penegakkan konstitusi. Kedua, secara operasional pelaksanaan judicial review antara MA dan MK akan menimbulkan konflik antar lembaga diakibatkan dari perbedaan putusan atau penafsiran peraturan perundang-undangan yang ditangani.Kata kunci: Pengujian peraturan perundangan, Mhkamah Agung, Mahkamah Konstitusi

Abstract

The fulfillment of adequate housing is the part of the fulfillment of human rights as stated in the constitution. The state can not  ignore and have to do it when he has the ability to comply the adequate housing for poor people.  Adequate housing is more than material it is correlated with the human existence, hence it is categorized as human rights. As part of human rights, the fulfillment of this adequate housing is need to be respect, comply, and protect either by the state and society. The state need to take part to the fulfillment of adequate housing for those who can not afford it. As the state have the capability to realize the adequate housing for the poor, they can not ignore the human rights unfulfillment.  This research focused on law guarantee recognition and the pattern of the adequate housing fulfillment in Indonesia. It is revealed that the pattern is correlated with the state political law which is the policy in the form of laws and local regulation that decided the direction, purpose, and the law substance in housing. Beside its society, the policy also need the private sector involvement, as a result the fulfillment of the adequate housing rights has to be done by the three party.

Abstract

AbstractKnowing the harmonization level of regional taxes legislation in Sukoharjo, Surakarta, and Karanganyar district with the act of regional tax and retribution is the aim of this research. This is normatif and empirical research. Literature studies, interviews, and observations used as data collecting instruments. The collected data drafted and analyzed systematically using qualitative methods. Data presented by deductive inductive thought (general-specific) and then find out for the logical relationships between related aspects. This research revealed that: First, the Central Government Policy through the regional tax and retribution act No. 28 of 2009,  makes the design of local taxes more organized and well arrangement. Second, there has been a harmonization of the policy formation of district legislation with the act of regional tax and retribution in three district. Without violating the limits defined by the Act, the type and the rates of the taxes determined varied according to the conditions of each region AbstrakPenelitian ini bertujuan untuk mengetahui taraf harmonisasi Peraturan Perundang-undangan Pajak Daerah di Kabupaten Sukoharjo, Kota Surakarta dan kabupaten Karanganyar dengan Undang-Undang Pajak Daerah dan retribusi Daerah. Penelitian menggunakan pendekatan secara normatif sekaligus empiris. Instrumen pengumpul data menggunakan studi kepustakaan, wawancara, dan observasi. Data yang terkumpul disusun dan dianalisis secara sistematis dengan menggunakan metode kualitatif. Penyajian data dilakukan dengan menggunakan logika deduktif-induktif (umum-khusus) dan kemudian dicari hubungan logis diantara aspek-aspek yang berhubungan. Hasil penelitian ini antara lain : Pertama, Kebijakan Pemerintah Pusat dalam mengatur Pajak Daerah melalui UU No 28 Tahun 2009 tentang Pajak Daerah dan Retribusi Daerah, membuat desain penataan pajak daerah lebih tertata dan teratur. Kedua, telah terjadi harmonisasi kebijakan pembentukkan Peraturan Daerah ditiga kabupaten/kota dengan Undang-Undang Pajak dan retribusi Daerah. Penentuan jenis dan tarif pajak dirumuskan secara variatif/ beragam disesuaikan dengan kondisi daerah masing-masing tanpa melanggar batasan yang telah ditentukan oleh UU.

Abstract

This article examines how the implementation of the functions of the Village Consultative Body (BPD) of Tanjungsari Village in the formation of village regulations in Tanjungsari Village, Gunungtanjung District, Tasikmalaya Regency. This article is compiled based on descriptive empirical legal research with a qualitative approach, the types and sources of research data used are primary data and secondary data, with data collection techniques through interviews, questionnaires and textual study information retrieval to assess secondary data, then further analyzed. using data analysis techniques with a qualitative analysis model. The results show that the BPD of Tanjungsari Village when carrying out its function in the formation of village regulations has not played its role optimally in one of the stages of forming village regulations, where the role of the Tanjungsari Village BPD is at the discussion stage of the village regulation draft which should discuss and agree on the village regulation draft, BPD Desa Tanjungsari only agreed on the final result and did not participate in discussing it, then the BPD of Tanjungsari Village also did not do much in terms of channeling the aspirations of the community towards the Tanjungsari Village Government which led to a mutual agreement between the Tanjungsari Village Government and the BPD of Tanjungsari Village in forming village regulations to be inconsistent with aspirations the people. This happens because there are still several factors that hinder the implementation of the functions of the BPD of Tanjungsari Village in the formation of village regulations including, first communication, second inadequate resources, the third disposition, in this case the attitude or character of the Tanjungsari Village BPD leadership and the four bureaucratic structures that have not yet been implemented well.

Abstract

This study describes and examines the problems of: firstly how the implementation of usage management priority of the village funds, especially in Laban Village the Sub-district of Mojolaban of Sukoharjo Regency in 2017, secondly what are the obstacles that occur in the process of implementing the use of Village. This study is the type of empirical legal research. Sources of data in this study using primary data sources, and secondary data sources. The techniques of data collections are from interview and observation techniques, from data that has been collected, then will be analyzed.The results of this research indicate that implementation of usage management priority of the village fund in 2017 is focused on the development of basic infrastructure, such as road construction, culverts, ducts, and dams. The budget of the Village Fund in 2017 had not been used for community empowerment. Obstacles that occur in the usage of Village Funds such as: the level of community participation in the planning stage is less than maximum, the liquefaction stage is delayed because arrangment of the APBDes is too long, the implementation stage is not accordance with the Village Ministerial Regulation Number 22 Year 2016 about implementation of usage management priority of the village fund in 2017, lack of community to oversee the usage of the Village Fund, and inadequate human resources in making accountability reports.
