Abstract

Kekerasan Dalam Rumah Tangga (KDRT) adalah suatu gejala universal. Permasalahan tergolong unik karena antara pelaku dan korban adalah orang-orang yang saling kenal, terlebih KDRT antara suami dan isteri. Kehadiran UU Nomor 23 Tahun 2004 diharap­kan dapat menyelesaikan permasalahan KDRT di Indonesia dengan baik, termasuk di Sumatera Selatan. Kenyataan­nya tidak­­lah demikian. Nilai-nilai budaya sebagai penopang hukum yang hidup,yang ada di masyarakat termasuk di Sumatera Selatan memegang peranan penting terhadap permasalahan KDRT, karena budaya dapat memberikan peluang besar untuk terjadi­nya KDRT sementara budaya pula yang dipatuhi masya­rakat dalam menyelesaikan permasalahan KDRT. Akibatnya UU Nomor 23 Tahun 2004 diberlakukan.

Abstract

ABSTRAK Undang-undang Nomor 28 Tahun 2014 Pasal 5 dan 9 mengatur tentang hak dan kewajiban Pencipta dan ciptaannya, khususnya hak cipta logo. Hal ini tentang hak moral dan hak ekonomi. Tujuannya adalah untuk melindungi hasil karya ciptaan agar tidak disalah gunakan oleh pihak atau perusahaan lain untuk kepentingan bisnis khususnya hak cipta logo. Seperti halnya kasus pemakaian logo Asian Games 2018 dalam prakteknya masih ada pihak yang menggunakan dan menirukan logo tersebut untuk kepentingan bisnis tanpa izin. Hal ini bertentangan dengan hak moral dan hak ekonomi sebagaimana dijelaskan di dalam Undang- undang Hak Cipta. Jenis penelitian kepustakaan (library research), penelitian ini menggunakan sumber data sekunder yaitu yang sumber-sumber datanya saya ambil dari buku-buku, Undang-undang Nomor 28 Tahun 2014 tentang hak cipta, artikel dan jurnal yang berhubungan dengan hak cipta yang berkaitan dengan pemakaian logo Asian Games 2018 tanpa izin. Hasil penelitian menunjukkan bahwa menggunakan dan menirukan logo tanpa izin untung memperoleh keuntungan bisnis adalah hal yang dilarang di dalam Undang-undang Hak Cipta. Perbuatan sanksi perdata yaitu ganti rugi secara umum diatur dala buku III KUHPerdata dan pidana sesuai pasal 113 angka (3) Undang-undang Hak Cipta. Perlindungan hak cipta logo diberikan secara deklaratif, artinya adalah pemegang pertamalah yang memiliki perlindungan atas hasil ciptaan. Dan juga dasar pemikiran ini bahwa pada dasarnya segala sesuatu bentuk yag berkaitan dengan hukum ekonomi syariah adalah boleh dilakukan kecuali yang dilarang, namun demikian kebolehan juga dibatasi oleh aturan- aturan dan larangan pola-pola yang bathil sehingga jauh dari nilai-nilai prinsip hukum ekonomi syariah oleh karena itu bertujuan bukan hanya untuk memperoleh keuntungan semata, tapi juga harus bisa mengedepankan nilai-nilai sosial dan masyarakat. Kata Kunci : Hak Cipta, Hukum Ekonomi Syariah, Logo, Asian Games 2018 ABSTRACT Law No. 28 of 2014 Article 5 and 9 regulates the rights an obligations of the Creator and his creation, especially the copyright of the logo. It is about moral right and economic rights. The aim isto protect the work of creation so tha it is not misused by other parties or campanies for business purposes, especially copyrights logos. As in the case of the use of the 2018 Asian Games logo in pratice there are still parties who use and imitate the logo for business purposes without permission. This is contrary to moral rights and economic rights as explained in the Copyright Law. The purpose of this thesis is to explain the use of the 2018 Asian Games logo without permission as a violation according to law number 28 of 2014 concerning Copyright. First is to explain the legal protection that can be taken to resolve the copyright logo problem, secondly to find out a review of sharia economic law regarding the use of the 2018 Asian Games logo. The results of the study show that using and imitating logos without permission to gain business profits is prohibited in the Copyright Law. The acts of civil sanstions, namely compensatin, are generally regulated in Book III of the Civil Code and criminal in accordance with article 113 point (3) of Copyright Law. Protection of the copyright of the logo is given declaratively, meaning that is the first holder who has protection for the creation. And also this rationale that basically everything that is related to sharia economic law is permissible except those which are prohibited, however the ability is also limited by rules and prohibitions of illicit patterns so that it is far from the principles of Islamis economic law principle therefore it aims not only to gain profit, but also to be able to prioritize social values and society. Abstract

Abstract In people's lives, poverty is a social problem because this problem affects every aspect of human life and also does not rule out possible contradictory actions against one's religious behavior. That in the community there is a phenomenon of begging among the poor. Begging is one way that is used by some people to seek sustenance and even many of them make begging as their daily work to earn money. In their activities, beggars are not all poor or homeless, they only pretend to attract the sympathy of many people by carrying or carrying babies, or even hiring children to other people to be invited to beg for people's mercy. The problems studied are about Seeking Livelihood By Utilizing Toddlers By Street Beggars In A Sharia Economic Law Perspective. This research is a field research (field research), using qualitative research methods by collecting data through observation, interviews and documentation. Data analysis using deductive method. Based on the results of the study that the law of begging in Islam in general is makruh and is a work that is not noble. But when viewed from the beggar mode that brings the toddler, then the law of begging becomes unclean, because beggars bring toddlers only to be used as a mode to get the mercy of others. Abstract

This research is entitled Three Ends Program to End Economic Gap for Women in the Perspective of Sharia Economic Law (Study at the Office of Women's Empowerment and Child Protection, South Sumatra Province). The background of this research is that women are often considered to have many limitations in their participation in economic activities. Women's obligations are considered only in social activities in the family. This shows a gap between men and women in economic activity. In fact, women have an important role in economic activities, especially to increase family income, if the woman is responsible for the economy for her family. Based on this background, the writer wants to know more about: First, how is the implementation of the three ends program to end economic inequality for women in the Office of Women's Empowerment and Child Protection, South Sumatra Province? Second, how do the three ends program to end economic inequality for women from the perspective of Islamic economic law? The method used in this research is field research with data collection techniques, namely observation, interviews, and documentation at the Office of Women's Empowerment and Child Protection of South Sumatra Province and with data analysis techniques in the form of data reduction, data presentation and drawing conclusions. The results of this study can be concluded that the implementation of the three ends program to end economic inequality for women in the Office of Women's Empowerment and Child Protection of South Sumatra Province, namely by helping women to have businesses in home industry activities and PRIMA Village in the form of goods or business equipment assistance and business training. This program does not conflict with the principles of sharia economic law and is very suitable for the benefit of improving the family economy.

Abstract

ABSTRACT Unemployment is a serious problem that until now the Indonesian government has not been able to solve it. Like a younger sibling, unemployment and poverty areinseparable. Because with the increase in unemployment, the poverty level in this countrywill automatically increase. The government as the holder of policy authority is expectedto be able to play a role in overcoming unemployment and poverty problems. From these problems the authors are interested in taking the title of a thesis reviewof sharia economic law against presidential regulation number 76 of 2020 amendments topresidential regulation number 36 of 2020 concerning the development of work potentialthrough the pre-employment card program, which is to find out what is the legal basis froma philosophical point of view. , sociological, and juridical creation of pre-employmentcards, as well as a review of sharia economic law in terms of the principle of benefit andthe principle of justice. The results of this study are the philosophical foundation of this preemploymentcard policy. Realizing justice in the goals of the State, namely realizing the welfare of theIndonesian nation, from a sociological basis, namely to the people's need for decent workto achieve community welfare and from a juridical perspective, namely providing a clearlegal basis. against the corruption eradication commission that corruption destroys everyorder of life of a nation. and from the principle of benefit, namely helping to reducetraining costs borne by participants as well as getting training modules and in terms of theprinciple of justice, justice in terms of the pre-employment card program is only justice inincentive costs and facilities pre-employment card. Abstract

Tujuan penelitian ini adalah untuk mengetahui prosedur penangkapan dan penahanan anak di bawah umur dan bagaimana tinjauan fiqih jinayah. Penelitian dilakukan dengan menggunakan pendekatan secara yuridis normatif dan pendekatan yuridis empiris. Adapun sumber dan jenis data dalam penelitian ini adalah primer yang diperoleh dari studi lapangan. Dan data sekunder diperoleh dari studi kepustakaan, kemudian diolah, dan di analisis secara kualitataif guna mendapatkan sutu kesimpualan. Penelitian ini menyimpulkan bahwa penangkapan dan penahanan anak dilakukan oleh penyidik anak yang telah ditentukan oleh Undang-Undang dan dalam Islam penangkapan di benarkan berdasarkan tindakan Rasulullah yang menahan anak yang melakukan tindak pidana akan tetapi tindakan Rasulullah bukan untuk menghukum akan tetapi hanya ingin memberikan pelajaran terhadap anak tersebuta agar tidka mengungi perbuatannya.

Abstract

Artikel ini akan membahas tentang kebijakan peraturan tentang mediasi di agama pengadilan dan cara penyelesaian sengketa melalui mediasi dan pelaksanaan mediasi dalam kasus pengadilan di Pengadilan Agama Kelas I A Palembang. Penelitian ini merupakan penelitian kualitatif. Sumber data yang digunakan adalah data primer dan data sekunder. Dari penelitian ini diketahui bahwa latar belakang aturan kebijakan mediasi di Pengadilan Agama adalah (a) manfaat yang bisa diperoleh jika mediasi digunakan sebagai alat dalam penyelesaian sengketa, yaitu proses mediasi bisa mengatasi masalah akumulasi materi, proses mediasi dipandang sebagai sarana penyelesaian sengketa yang lebih cepat dan lebih murah daripada proses litigasi, penegakan mediasi dapat memperluas akses bagi semua pihak untuk memperoleh rasa keadilan, (b) penyediaan upaya perdamaian mereka dalam undang-undang. (c) masyarakat Indonesia adalah masyarakat yang suka damai. Pelaksanaan proses mediasi di pengadilan agama dilakukan dengan dua cara, yaitu mediasi litigasi awal, dan mediasi lebih litigasi.This article will discuss about regulatory policy on mediation in religious courts way dispute resolution through mediation according to Islamic law and implementation of mediation in settlement court cases in Religious Courts Class I A Palembang. This research is qualitative research Source of data used is primary data and secondary data primary. Data derived from field and secondary data consisted of a literature study. From this research note Background to the policy rules on mediation in the Religious Courts is (a) the benefits to be gained if mediation used as a means in the settlement of disputes, namely the mediation process could overcome the problem of accumulation of matter, the mediation process is viewed as a means of dispute resolution that is faster and cheaper than the litigation process, enforcement of mediation can expand access for all parties to gain a sense of justice, (b) provision their peace efforts in legislation. (c) Indonesian society is a society that likes peace. Implementation of the mediation process in the religious court done in two ways, namely mediation initial litigation, and mediation over litigation.

Abstract

Tulisan ini judul “Peran Perempuan Dalam Perencanaan Keluarga Responsif Gender Berbasis Agama Di Desa Mulyo Rejo Kecamatan Sungai Lilin Kabupaten Musi Banyuasin”. Diawali dari hasil observasi dan pemikiran tentang perlunya dilakukan pengkajian lebih mendalam tentang hukum keluarga dalam kaitannya dengan hubungan relasi gender dalam keluarga pada masyarakat Desa Mulyo Rejo Kecamatan Sungai Lilin. Agar tujuan PAR tercapai yakni: (1) agar terwujudnya keluarga yang responsive gender yakni keluarga yang telah memperhatikan kebutuhan keluarga tanpa adanya diskriminasi, (2) adanya perubahan dan perilaku/tindakan sosial langsung yang bermula dari keluarga, (3) penambahan pengetahuan mengenai situasi keluarga yang responsif gender yang terencana dan penambahan kemampuan bagi dampingan untuk mengubah situasi mereka mewujudkan keluarga yang responsif gender berbasis agama, maka program aksi riset ini dilakukan dengan menggunakan strategi dan langkah-langkah PAR. Sebagaian kecil warga dampingan sudah mulai menerapkan pengetahuan mengenai perencanaan keluarga responsif gender berbasis agama dalam keluarga mereka terutama melalui peran isteri bersama suami.This paper entitled "The Role of Women in Responsive Gender of Family Planning Based on Religion in Mulyo Rejo Village Sungai Lilin Musi Banyuasin". Starting from the observation and thought about the need to do much broader about family law in relation to gender relationships within the family in society of Mulyo Rejo village in Sungai Lilin. For the purpose of PAR achieved as follows: (1) for the realization of the family that has responsive gender, i.e families who have noticed the family's needs without discrimination, (2) the changes and behavioral / social action directly originate from the family, (3) the addition of knowledge concerning the family situation on responsive gender planned and the addition of capabilities for assistance to change their situation embodies responsive gender in family based on religion, then the action program of research is done by using strategies and measures PAR. Small part of residents has started to apply knowledge of responsive in family planning based on religion in their families, especially through the role of the wife with her husband.

Abstract

Talking about the "freedom" that is rooted in the word has several senses, such as: loose at all, apart from the demands, liabilities and feelings of fear, not be punished, not bound or limited by rules and independent. From that sense would be able to make an impression that the lack of recognition of the rights of people. Furthermore, the adage that freedom be freely interpreted relativism trapped in a box.ملخص: الحديث عن "الحرية" التي تعود جذورها إلى كلمة ديها العديد من الحواس، مثل: فضفاضة على الإطلاق، بغض النظر عن المطالب والالتزامات ومشاعر الخوف، لا يعاقب، ليست ملزمة أو تقتصر بقواعد ومستقلة. من هذا المنطلق ستكون قادرة على خلق انطباع أن عدم الاعتراف بحقوق الناس. وعلاوة على ذلك، فإن القول المأثور أن حرية تفسيرها بحرية نسبية المحاصرين في صندوق.
