Abstract

This study employs a normative juridical approach. Following the enactment of the new Indonesian Criminal Code (Kitab Undang-Undang Hukum Pidana/KUHP) through Law Number 1 of 2023 concerning the Criminal Code and the new Indonesian Code of Criminal Procedure (Kitab Undang-Undang Hukum Acara Pidana/KUHAP) through Law Number 20 of 2025 concerning the Code of Criminal Procedure, both of which came into effect on 2 January 2026, there has been a paradigm shift in the focus of criminal punishment from a retributive justice approach to restorative justice. This paradigm shift arose because retributive justice has been unable to resolve the root causes of crime, has failed to provide adequate space for victim recovery, and has negatively affected social interactions within society. The restorative justice approach offers the concept that punishment should not merely be oriented toward retaliation, but should also take into account the rights and losses suffered by victims, while simultaneously seeking the restoration of social relations within the community. The paradigm of restorative justice is reflected in the minutes of the first session of the Investigating Committee for Preparatory Work for Indonesian Independence (Badan Penyelidik Usaha-Usaha Persiapan Kemerdekaan/BPUPK) held from 29 May to 1 June 1945, which became the embryo for the birth of Pancasila, stating that: “…so that in this era the State of Indonesia may be established, where people can live safely and prosperously, moving toward the attainment of perfect humanity. Therefore, the foremost legal requirement must be respect for human rights and obligations in the deepest sense.” Law enforcement cannot be separated from respect for humanitarian values, both from the perspective of perpetrators and victims, in order to realize a safe and prosperous society in accordance with the philosophy of Pancasila. Abstract

Starting from the number of applications for judicial review that were granted by the Constitutional Court, this should be translated as a failure in the legislative process. The submission of a judicial review by the public is the result of the constitutional rights of citizens being violated and conflicting so that public participation is a way out by accommodating all the interests of the community in the formation of laws. This research resulted in two discussions, first, that Pancasila is the main foundation in drafting laws, this can be seen in Law Number 12 of 2011 concerning the Formation of Legislation which states that the philosophical basis for forming laws must originate from Pancasila. which is a determinant of validity, content and testing. The two four Pancasila precepts are the basis for public participation to be involved in the formation of laws that can be carried out at the stages of submission, discussion and approval by implementing meaningful participation, so that the laws formed can support the public interest. Abstrak Bertitik tolak pada banyaknya pengajuan judicial review yang dikabulkan oleh Mahkamah Konstitusi seharusnya diterjemahkan sebagai gagalnya proses legislasi.  Pengajuan judicial review oleh masyarakat merupakan akibat dari adanya hak-hak konstitusional warga negara yang dilanggar dan bertentangan sehingga partisipasi publik merupakan jalan keluar dengan di akomodasinya seluruh kepentingan masyarakat dalam pembentukan undang-undang. Penelitian ini menghasilkan dua bahasan, pertama, bahwa Pancasila merupakan landasan utama dalam penyusunan undang-undangan, hal tersebut dapat di lihat dalam Undang-Undang Nomor 12 Tahun 2011 tentang Pembentukan Peraturan Perundang-Undangan yang menyatakan landasan filosofi pembentukan undang-undang harus bersumber dari pancasila yang merupakan penentu validitas, isi dan pengujiannya. Kedua sila ke-empat Pancasila merupakan landasan adanya partisipasi publik untuk dapat terlibat dalam pembentukan undang-undang yang dapat dilakukan pada tahap pengajuan, pembahasan dan persetujuan dengan menerapkan meaningful participation, sehingga undang-undang yang dibentuk dapat menopang kepentingan publik

Abstract

This study examines two Religious Court decisions in Indonesia, Case Number 9/Pdt.P/2025/Pa.Ngr and Case Number 23/Pdt.P/2025/Pa.Klp, both concerning applications for marriage validation (itsbat nikah). The two cases share similar characteristics because the marriages were unregistered and the wife was underage at the time of marriage. Although both cases were decided by a single judge, their rulings and legal considerations differ, offering insight into judicial discretion and legal interpretation in voluntary cases. This research uses a normative juridical approach focusing on the analysis of Indonesian positive law, including legislation, judicial decisions, and literature. The study aims to identify the legal basis, reasoning, and implications behind the different judicial outcomes. Findings show that in cases of unregistered marriages, judges may either grant or reject marriage validation requests depending on their interpretation of legal norms and the specific circumstances. These differences may create legal uncertainty and disadvantage parties seeking recognition of their marital status. Therefore, it is important for individuals to comply with the legal marriage age requirement of 19 years to ensure the legality and protection of their marital rights under Indonesian law.

Abstract

This article analyzes Mediation in Supreme Court Regulation (PERMA) Number 1of 2016 as an effort by the Religious Court to resolve inheritance disputes from the perspective of legal purpose theory. The theory of legal purpose is used to see the content of legal certainty, justice, and benefit in PERMA Number 1 of 2016 which is the legal basis for Mediation of inheritance disputes. This research is a yuridical normative research of the library research type. The results of this study indicate that Mediation regulated by PERMA Number 1 of 2016 contains legal objectives in the form of certainty, justice, and legal benefits, so that Mediation must be implemented by the court as the first way to resolve inheritance disputes. Keywords: Mediation; PERMA Number 1 of 2016, Inheritance Dispute, Legal Objective Theory

Abstract

Marriage as a legal institution not only gives rise to a personal relationship between husband and wife, but also produces significant legal consequences for the status of property. Within the Indonesian positive-law system, the regulation of marital property is a crucial aspect, particularly when a legal event in the form of the bankruptcy of one of the parties to the marriage occurs. The problem becomes even more complex where the marriage is contracted without a prenuptial agreement governing the separation of property. This study aims to analyse the legal regulation of marital property under positive law in Indonesia and to examine the legal implications for marital property in the event of the bankruptcy of a husband or wife in the absence of a prenuptial agreement. The research method employed is normative juridical, using a statute approach and a conceptual approach. The statute approach is carried out through an examination of the Marriage Law, the Civil Code, and the Bankruptcy and Suspension of Payment (PKPU) Law, while the conceptual approach is used to examine the principles, doctrines, and legal concepts relating to joint property and bankruptcy. The results show that in marriages without a prenuptial agreement the principle of community of property applies, so that property acquired during the marriage is qualified as joint property. If one of the parties is declared bankrupt, the joint property is in principle absorbed into the bankruptcy estate (boedel pailit) and administered by the curator for the benefit of the creditors. Nevertheless, the law continues to protect brought-in property (harta bawaan) and personal property acquired through gift or inheritance. This study affirms the importance of understanding and regulating marital property as a preventive measure to minimise the legal risks arising from bankruptcy in a marriage.

Abstract

The philosophy of law has developed significantly over time, and many figures have made important contributions to its development. One significant figure who has had a great influence on the development of legal philosophy is Immanuel Kant. Kant was an 18th-century German philosopher famous for his works on epistemology, ethics, and aesthetics. Kant's theory of law and justice has influenced the development of a legal philosophy movement known as "universal legal philosophy." In this movement, law is seen as a universal concept that can be applied to all societies and cultures, regardless of local customs or beliefs. In this article, we will discuss Kant's important contributions to the development of universal legal philosophy and how Kant's views can be implemented in the context of modern law. This article will cover Kant's views on law, justice, and morality, as well as the relevance of Kant's theory in the contextof global law.   Pemikiran filsafat hukum telah berkembang secara signifikan dari waktu ke waktu, dan banyak tokoh telah memberikan kontribusi penting dalam pengembangan pemikiran ini. Salah satu tokoh penting yang memberikan pengaruh besar dalam pengembangan pemikiran filsafat hukum adalah Immanuel Kant. Kant adalah seorang filsuf Jerman abad ke-18 yang terkenal dengan karya-karyanya tentang epistemologi, etika, dan estetika. Teori Kant tentang hukum dan keadilan telah mempengaruhi pengembangan aliran filsafat hukum yang dikenal sebagai "filsafat hukum universal". Dalam aliran ini, hukum dipandang sebagai suatu konsep universal yang dapat diterapkan pada semua masyarakat dan budaya, tanpa terkait dengan kebiasaan atau kepercayaan lokal. Dalam artikel ini, kami akan membahas kontribusi penting teori Kant dalam pengembangan pemikiran filsafat hukum universal dan bagaimana pandangan Kant dapat diimplementasikan dalam konteks hukum modern. Artikel ini akan membahas pandangan Kant tentang hukum, keadilan, dan moralitas serta relevansi teori Kant dalam konteks hukum global.

Abstract

Pancasila, as the state ideology, embodies the value of justice, which serves as the foundation for the formation and enforcement of law in Indonesia. However, its implementation still faces various problems, such as legal inequality, low integrity of officials, and weak protection of the poor. The method used is normative legal research with a philosophical and conceptual approach. The results show that Pancasila justice has a unique character because it integrates humanitarian values, balance between rights and obligations, social justice, and moral and spiritual dimensions. Analysis of the theories of justice of Aristotle and John Rawls shows that Pancasila justice is oriented not only toward the distribution of rights and protection of vulnerable groups, but also toward harmony between the interests of individuals and society. This research also found a gap between the values of Pancasila justice and law enforcement practices, which still face issues of unequal legal treatment, corruption, and limited access to justice.

Abstract

This article examines the rights of Indigenous Peoples from the perspective of Pancasila’s social justice by positioning Pancasila as the philosophical foundation for the protection of communal rights. The research employs a normative juridical method with philosophical and statutory approaches. The findings indicate that the values of social justice, humanity and national unity embodied in Pancasila provide a normative basis for the recognition and protection of Indigenous Peoples’ rights. However, their implementation continues to face various challenges, including regulatory constraints, exploitative development orientations and weak legal recognition mechanisms. Therefore, stronger regulatory frameworks and policies that are more aligned with the values of Pancasila’s social justice are required to ensure the sustainable protection of Indigenous Peoples’ rights.
