Abstract

Copyright is intellectual property that needs to be protected in order to encourage respect for creative works and prevent copyright infringement. The aim of this research is to analyze the form of legal protection for copyright as a natural right from a philosophical perspective. The research method used is normative juridical with a philosophy approach. The results of this research are that the philosophy of copyright recognition refers to two theories, namely based on natural law theory and utilitarianism theory. Based on natural law theory, copyright is natural right after the creative work is completed, so the protection is automatic, there is no need for registration or enrollment. Recognition of copyright to creators as a moral right is adopted by Indonesia and France. Meanwhile, based on the Utilitarian theory, recognition of copyright in works, as an economic right, which requires registration, so that recognition and protection is given by the state through law, this theory is followed by America, England and Australia.

Abstract

This study examines two Religious Court decisions in Indonesia, Case Number 9/Pdt.P/2025/Pa.Ngr and Case Number 23/Pdt.P/2025/Pa.Klp, both concerning applications for marriage validation (itsbat nikah). The two cases share similar characteristics because the marriages were unregistered and the wife was underage at the time of marriage. Although both cases were decided by a single judge, their rulings and legal considerations differ, offering insight into judicial discretion and legal interpretation in voluntary cases. This research uses a normative juridical approach focusing on the analysis of Indonesian positive law, including legislation, judicial decisions, and literature. The study aims to identify the legal basis, reasoning, and implications behind the different judicial outcomes. Findings show that in cases of unregistered marriages, judges may either grant or reject marriage validation requests depending on their interpretation of legal norms and the specific circumstances. These differences may create legal uncertainty and disadvantage parties seeking recognition of their marital status. Therefore, it is important for individuals to comply with the legal marriage age requirement of 19 years to ensure the legality and protection of their marital rights under Indonesian law.

Abstract

Environmental pollution caused by inadequate waste management has serious impacts on public quality of life and constitutes a violation of human rights. This research aims to analyze the responsibilities of the state in addressing environmental pollution and examine its relation to the fulfillment of the right to a clean and healthy environment as guaranteed by Article 28H paragraph (1) of the 1945 Constitution of the Republic of Indonesia and international human rights instruments. This study employs a normative juridical method using statute and conceptual approaches. The findings reveal that the state, through central and regional governments, has a constitutional obligation to implement systematic, integrated, and sustainable waste management in order to protect citizens’ rights to a proper environment. Failure to fulfill this responsibility results in environmental degradation, increased public health risks, and human rights violations. Law enforcement, institutional strengthening, public participation, and good environmental governance are necessary to ensure a clean, healthy, and sustainable environment as a form of respect for human dignity.

Abstract

Keputusan hakim merupakan hasil dari proses peradilan pidana yang melibatkan pertimbangan hakim secara lisan maupun tertulis. Pentingnya keputusan hakim untuk mematuhi prinsip-prinsip tertentu, termasuk stabilitas, yang merujuk pada kestabilan sosial sebagai dampak dari keputusan tersebut. Hakim perlu mempertimbangkan dasar filosofis, yuridis, dan sosiologis, terutama dalam konteks teknis yudisial. Oleh karena itu, keputusan hakim harus memperhatikan aspek-aspek formal, terutama sesuai dengan ketentuan yang tercantum dalam KUHAP. Dalam konteks perkara pidana, KUHAP mengatur bahwa keputusan hakim dapat berupa pemidanaan, pembebasan dari tuntutan hukum, atau putusan bebas. Namun, eksistensi vonis nihil, seperti yang terjadi dalam kasus Dimas Kanjeng, dianggap sebagai suatu permasalahan yang kompleks. Praktik putusan ini mengklaim merujuk pada Pasal 10 KUHP yang membatasi kumulatif hukuman penjara paling lama 20 tahun. Namun, praktik putusan nihil sebenarnya menjadi ancaman bagi kepastian hukum dalam paradigma hukum civil law. KUHAP tidak memberikan pedoman yang jelas mengenai vonis nihil, yang menyebabkan ketidakpastian dalam interpretasi hukum. Idealnya, KUHAP seharusnya mengatur dengan jelas bentuk-bentuk putusan yang mungkin terjadi untuk menjaga kepastian hukum. Praktik putusan nihil juga mengganggu stabilitas hukum acara pidana atau hukum prosedural pidana itu sendiri. Prinsip interpretatif dalam putusan nihil menjadi kontroversial karena sering kali tidak digunakan dengan tepat. Mengingat bahwa interpretasi dalam putusan nihil berkaitan dengan masalah sistemik dalam KUHAP, hal ini seharusnya menjadi isu yang memerlukan reformasi dalam hukum acara pidana. Abstract

Aspects of positivism with its normative approach are often taught in various law schools as a single perspective. The study of law can be based on legal realism. Nevertheless, there is still a debate about legal realism's working pattern and contribution to juridical science. This study that introduced legal realism worked with socio-legal method based on the literature review. It aimed to elaborate on the concept of legal-realism as an epistemology of the socio-legal school, which leads to the conception of customary law and legal anthropology. With a naturalistic approach and supported by theories of customary law and legal anthropology. This study showed that legal realism as a school in philosophy and juridical studies based on empirical studies need to be developed. It referred to legal realism conceptualized in Scandinavia and America that was suitable to Indonesia's legal context, especially customary law as the law that lives in society. Therefore, the law that lives in society is strengthened through verdict and law enforcement officers as symbols of the state. It suggested that legal realism is also taught in law schools at universities, so that legal academics have diverse points of view, both in the legal discipline and as a research method.
