Abstract

Copyright is intellectual property that needs to be protected in order to encourage respect for creative works and prevent copyright infringement. The aim of this research is to analyze the form of legal protection for copyright as a natural right from a philosophical perspective. The research method used is normative juridical with a philosophy approach. The results of this research are that the philosophy of copyright recognition refers to two theories, namely based on natural law theory and utilitarianism theory. Based on natural law theory, copyright is natural right after the creative work is completed, so the protection is automatic, there is no need for registration or enrollment. Recognition of copyright to creators as a moral right is adopted by Indonesia and France. Meanwhile, based on the Utilitarian theory, recognition of copyright in works, as an economic right, which requires registration, so that recognition and protection is given by the state through law, this theory is followed by America, England and Australia.

Abstract

This study examines two Religious Court decisions in Indonesia, Case Number 9/Pdt.P/2025/Pa.Ngr and Case Number 23/Pdt.P/2025/Pa.Klp, both concerning applications for marriage validation (itsbat nikah). The two cases share similar characteristics because the marriages were unregistered and the wife was underage at the time of marriage. Although both cases were decided by a single judge, their rulings and legal considerations differ, offering insight into judicial discretion and legal interpretation in voluntary cases. This research uses a normative juridical approach focusing on the analysis of Indonesian positive law, including legislation, judicial decisions, and literature. The study aims to identify the legal basis, reasoning, and implications behind the different judicial outcomes. Findings show that in cases of unregistered marriages, judges may either grant or reject marriage validation requests depending on their interpretation of legal norms and the specific circumstances. These differences may create legal uncertainty and disadvantage parties seeking recognition of their marital status. Therefore, it is important for individuals to comply with the legal marriage age requirement of 19 years to ensure the legality and protection of their marital rights under Indonesian law.

Abstract

Environmental pollution caused by inadequate waste management has serious impacts on public quality of life and constitutes a violation of human rights. This research aims to analyze the responsibilities of the state in addressing environmental pollution and examine its relation to the fulfillment of the right to a clean and healthy environment as guaranteed by Article 28H paragraph (1) of the 1945 Constitution of the Republic of Indonesia and international human rights instruments. This study employs a normative juridical method using statute and conceptual approaches. The findings reveal that the state, through central and regional governments, has a constitutional obligation to implement systematic, integrated, and sustainable waste management in order to protect citizens’ rights to a proper environment. Failure to fulfill this responsibility results in environmental degradation, increased public health risks, and human rights violations. Law enforcement, institutional strengthening, public participation, and good environmental governance are necessary to ensure a clean, healthy, and sustainable environment as a form of respect for human dignity.

Abstract

Keputusan hakim merupakan hasil dari proses peradilan pidana yang melibatkan pertimbangan hakim secara lisan maupun tertulis. Pentingnya keputusan hakim untuk mematuhi prinsip-prinsip tertentu, termasuk stabilitas, yang merujuk pada kestabilan sosial sebagai dampak dari keputusan tersebut. Hakim perlu mempertimbangkan dasar filosofis, yuridis, dan sosiologis, terutama dalam konteks teknis yudisial. Oleh karena itu, keputusan hakim harus memperhatikan aspek-aspek formal, terutama sesuai dengan ketentuan yang tercantum dalam KUHAP. Dalam konteks perkara pidana, KUHAP mengatur bahwa keputusan hakim dapat berupa pemidanaan, pembebasan dari tuntutan hukum, atau putusan bebas. Namun, eksistensi vonis nihil, seperti yang terjadi dalam kasus Dimas Kanjeng, dianggap sebagai suatu permasalahan yang kompleks. Praktik putusan ini mengklaim merujuk pada Pasal 10 KUHP yang membatasi kumulatif hukuman penjara paling lama 20 tahun. Namun, praktik putusan nihil sebenarnya menjadi ancaman bagi kepastian hukum dalam paradigma hukum civil law. KUHAP tidak memberikan pedoman yang jelas mengenai vonis nihil, yang menyebabkan ketidakpastian dalam interpretasi hukum. Idealnya, KUHAP seharusnya mengatur dengan jelas bentuk-bentuk putusan yang mungkin terjadi untuk menjaga kepastian hukum. Praktik putusan nihil juga mengganggu stabilitas hukum acara pidana atau hukum prosedural pidana itu sendiri. Prinsip interpretatif dalam putusan nihil menjadi kontroversial karena sering kali tidak digunakan dengan tepat. Mengingat bahwa interpretasi dalam putusan nihil berkaitan dengan masalah sistemik dalam KUHAP, hal ini seharusnya menjadi isu yang memerlukan reformasi dalam hukum acara pidana. Abstract

Aspects of positivism with its normative approach are often taught in various law schools as a single perspective. The study of law can be based on legal realism. Nevertheless, there is still a debate about legal realism's working pattern and contribution to juridical science. This study that introduced legal realism worked with socio-legal method based on the literature review. It aimed to elaborate on the concept of legal-realism as an epistemology of the socio-legal school, which leads to the conception of customary law and legal anthropology. With a naturalistic approach and supported by theories of customary law and legal anthropology. This study showed that legal realism as a school in philosophy and juridical studies based on empirical studies need to be developed. It referred to legal realism conceptualized in Scandinavia and America that was suitable to Indonesia's legal context, especially customary law as the law that lives in society. Therefore, the law that lives in society is strengthened through verdict and law enforcement officers as symbols of the state. It suggested that legal realism is also taught in law schools at universities, so that legal academics have diverse points of view, both in the legal discipline and as a research method. Abstract

This research explores the legal aspects of football player transfer transactions in Indonesia, with a focus on Persid Jember. In practice, many transactions involving professional and semi-professional players lack clear contractual agreements, raising concerns about legal certainty. The study formulates two research questions: (1) How is the mechanism of player transfer conducted in Persid Jember? (2) How does Islamic law view the practice of player transfer at Persid Jember? The purposes of this study are to identify whether the mechanism of player transfers in Persid Jember aligns with valid contractual principles and to analyze the practice from the perspective of Islamic law. Using an empirical legal research method, data were collected through interviews, observations, and documentation. The findings show that Persid Jember recruits players through open selection and by signing players from other clubs whose contracts have expired. From the perspective of Islamic law, this practice is permissible because it follows the principles of ijarah (leasing contract), in which one party acts as the lessor (mu’ājir) and the other as the lessee (musta’jir). The validity of the transaction is reinforced by mutual consent and cooperation, fulfilling the essential elements of ijarah.

Abstract

The development of Artificial Intelligence (AI) technology has achieved significant progress across various sectors but has also created new challenges in the field of law, particularly regarding the emergence of new methods of fraud (scam) through electronic communication. AI-based scams, such as the use of deepfake technology to mimic the faces and voices of public figures, have opened opportunities for technological misuse that harms society. This study aims to analyze Indonesia’s legal regulations concerning AI-based scam offenses conducted through electronic communication and to examine the legal certainty in determining the criminal liability of perpetrators. This research employs a normative juridical method with statutory and conceptual approaches. The findings indicate that the regulation of such crimes is already established in the Criminal Code (KUHP), the Electronic Information and Transactions Law (UU ITE), and the Personal Data Protection Law (UU PDP). Article 492 of the KUHP remains relevant since the elements of fraud are fulfilled even when committed digitally, while Articles 28 and 35 of the UU ITE regulate the dissemination of false information and electronic data manipulation, and Articles 65–68 of the UU PDP provide protection for victims’ personal data. Based on the legal principle of geen straf zonder schuld (“no punishment without fault”), the use of AI does not eliminate human culpability, as AI merely serves as a tool controlled by the perpetrator. Therefore, Indonesian law has provided a clear foundation of legal certainty in determining criminal liability for perpetrators of AI-based scams conducted through electronic communication.

Abstract

AbstrakPerkawinan antar warga negara sangat dimungkinkan untuk terjadi, bahkan hal ini telah terjadi di Indonesia sejak zaman kolonial Belanda. Sebuah perkawinan akan membawa beberapa akibat hukum, dari segi status kewarganegaraan, harta kekayaan, anak, hingga pewarisan. Perkawinan beda warga negara (perkawinan campuran) sangat dimungkinkan adanya harta bersama atau harta bawaan, yang akan melibatkan lintas negara.  Setiap negara memiliki ketentuan yang berbeda mengenai Waris, bahkan di Indonesia tiap daerah atau suku budaya memiliki pandangan dan cara pembagian waris yang berbeda beda.  Tulisan ini menitikberatkan terhadap hukum waris yang terdapat unsur asing, dengan menggunakan pisau analisis Normatif deskriptif, yaitu dengan membandingkan antara hukum waris di Indonesia (menurut Kitab Undang-undang Hukum Perdata) dengan hukum waris di Jerman, sehingga diharapkan dapat dijadikan jawaban dan ukuran ketika terjadi suatu permasalahan waris yang mengandung unsur asing. AbstractMarriage between citizens is very possible to occur, even this has happened in Indonesia since the Dutch colonial era. A marriage will bring several legal consequences, in terms of citizenship status, property, children, and inheritance. The marriage of different citizens (mixed marriage) is very possible for the existence of joint property or inherited property, which will involve cross-country. Each country has different provisions regarding inheritance, even in Indonesia, each region or cultural tribe has different views and ways of dividing inheritance.  This paper focuses on inheritance law that contains foreign elements, using a descriptive Normative analysis knife, namely by comparing inheritance law in Indonesia (according to the Civil Code) with inheritance law in Germany, so that it is expected to be used as an answer and measure when there is an inheritance problem that contains foreign elements.

Abstract

This study examines the normative meaning of the phrase “urgent reasons” (alasan sangat mendesak) in marriage dispensation cases, emphasizing the need for harmonization between Law Number 16 of 2019 on Marriage and Supreme Court Regulation (PERMA) Number 5 of 2019 on Guidelines for Adjudicating Marriage Dispensation Applications. The main issue addressed in this research concerns the ambiguity (vague norm) of the phrase, which leads to varied interpretations among religious court judges, resulting in inconsistent decisions and a weakened principle of legal certainty. Employing a normative juridical approach with a qualitative analysis method, this study draws upon primary, secondary, and tertiary legal materials obtained through library research. The findings reveal that the absence of clear normative indicators in PERMA No. 5 of 2019 causes judges to rely more on social and moral considerations rather than assessing the child’s psychological readiness, indicating that the principle of the best interest of the child has not been fully realized. Therefore, a normative reconstruction is needed by establishing objective criteria, utilizing psychosocial assessment tools, and strengthening judges’ capacity through child protection–oriented training. This research contributes conceptually to the development of Indonesia’s family law system by proposing a model of legal harmonization that integrates legal certainty, substantive justice, and child protection, thereby promoting a more consistent, fair, and human rights–based practice of marriage dispensation. Abstract

Ketentuan Pasal 29 ayat (1) UU Perkawinan pasca Putusan Mahkamah Konstitusi Nomor 69/PUU/XII/2015 memberikan perubahan dalam pembuatan perjanjian perkawinan dimana sebelumnya perjanjian perkawinan hanya dapat dibuat sebelum perkawinan berlangsung menjadi dapat dibuat sebelum, pada saat dan selama perkawinan berlangsung. Selain itu Putusan Mahkamah Konstitusi Nomor 69/PUU/XII/2015 memberikan kewenangan baru kepada Notaris untuk mengesahkan perjanjian perkawinan. Pasal 29 ayat (1) UU Perkawinan pasca Putusan Mahkamah Konstitusi Nomor 69/PUU/XII/2015 terkait bentuk perjanjian perkawinan dalam bentuk perjanjian tertulis dan disahkan oleh Pegawai Pencatat Perkawinan seringkali salah dimaknai sebagai akta autentik, sehingga terjadi ketidaharminisan peraturan pelaksanaan terkait dengan bentuk dari perjanjian perkawinan. Kata Kunci : Kewenangan baru Notaris, perjanjian perkawinan, pengesahan perjanjian perkawinan. Tujuan Penelitian untuk menganalisis dasar dan sifat kewenangan baru Notaris dalam mengesahkan perjanjian perkawinan pasca Putusan MK No. 69/PUU/XII/2015  metode penelitian yang dipakai yaitu hukum normatif karena fokus kajian berangkat dari kekaburan norma, menggunakan pendekatan: statute approach, conceptual approach, serta analytical approach. Hasil penelitian menunjukkan bahwa kewenangan Notaris diperoleh secara atributif langsung dari Pasal 29 ayat (1) UU Perkawinan, dan bentuk perjanjian perkawinan pasca putusan MK adalah akta di bawah tangan yang dilegalisasi, bukan akta autentik notariil.
