Abstract

Abstrak Skincare menjadi kebutuhan utama masyarakat di semua kalangan, baik perempuan ataupun laki-laki dan dari beragam kelas ekonomi. Akan tetapi hal ini dimanfaatkan oleh beberapa pelaku yang tidak bertanggung jawab usaha atau bahkan dokter yang mengerti akan kandungan kosmetika yang seharusnya tidak untuk digunakan untuk tubuh dengan memproduksi skincare, menambahkan bahan kimia berbahaya steroid. Rumusan Masalah dalam artikel ini adalah Apa peranan Badan Pengawas Obat dan Makanan (BPOM) dalam melakukan pengawasan terhadap produk kosmetik yang bersteroid dan bagaimana tanggung jawab pelaku usaha terhadap kerugian konsumen akibat kosmetik bersteroid. Metode pendekatan yang digunakan adalah metode yuridis normatif. Peranan Badan Pengawas Obat dan Makanan (BPOM) adalah turut serta melakukan kewenangannya sebagai pengawas, dan melakukan suatu pengecekan apabila terjadi suatu kecurigaan terhadap suatu produk yang disinyalir menggunakan suatu bahan yang dilarang oleh pemerintah yang dapat merugikan, dan mengancam keselamatan jiwa terhadap konsumen sesuai dengan Undang-Undang yang berlaku. Tanggung Jawab Pelaku Usaha terhadap konsumen yang mengalami kerugian akibat penjualan kosmetik bersteroid berupa pemberian ganti rugi. Hak ganti kerugian yang diberikan kepada konsumen ini bersifat universal disamping hak-hak pokok lainnya. Kata Kunci : Tanggung Jawab Pelaku Usaha, Konsumen, skincare bersteroid.  Abstract Skincare is a major need of society in all circles, both women and men, and from various economic classes. Increasingly the age of increasing number of types of skincare that can be chosen by consumers. However, this is exploited by some business-responsible actors or even doctors who understand the cosmetics content that should not be used for the body by producing skincare, adding dangerous steroid chemicals. The sale and purchase of skincare, which is carried out specifically by individuals who understand the dangerous ingredients of skincare, are carried out to get the attention of various groups of people. Steroids are active chemicals in sterol fat which, when mixed with other cosmetics, will cause skin scaling. It is this skin erosion that causes the skin to grow white. However, long-term effects caused will cause the skin to become thin and bluish veins will appear that cannot be removed. The effects caused by the presence of steroids cannot be eliminated permanently even with laser action, so the mixing of steroids against cosmetics is very detrimental to consumers. Abstract

Indonesia has a problem increasing the number of iron and steel imports from year to year, but Tiongkok and Vietnam are highlighted differently by government because they have experienced a significant increase, so they are suspected of dumping. And than, what the legal remedies should be taken against the alleged dumping carried out by Tiongkok and Vietnam by competent institutions and related parties and what the legal consequnces are. This research will be analyzed with normative legal research principles, legal doctrines, and international agreements with the law approach and conceptual approach.The Antidumping Code is the basis of Indonesias efforts towards Tiongkok and Vietnam given that the three countries are remembers of the World Trade Organization with General Agreement on Tariff and Trade. The Indonesian Anti-Dumping Committee is an institution that is given the authority to conduct dumping investigations, both offensively or defensively wich is inisiated based on initiatives or requests from the majority of the Domestic Industry of the similar goods. If the investigation process carried out by KADI is proven to be found dumping it will be subject sanctions in the form of the imposition of Anti-Dumping Import Duty according to the amount of dumping margin and if it is not found or deministic margin then the investigation process is terminated. And it is unfortunate because dumping specifically has not been regualated in a law in Indonesia.

Abstract

Business actors at the Bungkul gas station 34.45232 located on Jalan Soekarno Hatta, Bojong Sari Village, Indramayu Regency, West Java have been proven to have committed fraud in filling fuel oil at the gas station which was found by the Directorate General of Consumer Protection and Orderly Commerce. permissible error limit. Business actors in this case cause harm to consumers, consumer rights and protection issues. The use of measuring instrument technology in the business world is needed in the hope of satisfying consumers but in reality it causes many problems. There is an additional tool at the fuel measuring pump in the form of an electronic circuit to commit fraud. This practice results in harm to people who are not aware that they have been cheated while refueling. Various modes are carried out by the SPBU officers, one of which is by manipulating the measuring instrument at the gas station so that it seems as if the fuel that is served by the consumer is in accordance with the price paid. Business actors violate consumer rights, especially the right to obtain measurements, measurements, scales, comfort and safety in using goods and/or services. Then the method used is the statutory approach, the conceptual approach. The results of this study indicate that the Bungkul gas station must be responsible for providing compensation or compensation in the form of a refund of the amount that has been harmed. Abstract

The industrial design protection system in Indonesia uses registration requirements, without registration, there is no protection. This is in contrast to the UK’s existing industrial design protection system, where the UK implements two protection systems, namely the registered design right or unregistered design right. This unregistered protection system is used in products that do not last long on the market such as fashion products and as an alternative for companies to test design prospects on the market. Unregistered protection systems are also used as design protection alternatives to prevent copying or plagiarizing of designs that do not yet have registration numbers. This article will discuss the following issues: 1) The legal protection of Korean pop idol clothing designs is reviewed based on Indonesian and English laws; and 2) The urgency of legal novelty in the industrial design law in Indonesia. In this study, the legal research method used is normative legal research with an approach through statutory regulations, a conceptual approach, and a comparative approach. The legal materials used are primary legal materials and secondary legal materials. The conclusion is that the industrial design protection system in Indonesia still has to go through the registration process, this is irrelevant to products or goods that cannot last long in the market because trends change easily. This is different from that in the UK where it implements an unregistered design right system where industrial design rights are obtained automatically.

Abstract

ABSTRACT: Nowadays, data that contains the content of privacy matters has become a valuable commodity that is often associated with effective instruments for identifying a person. The case of Lion Air Group passenger data leakage in online forums that has harmed passengers as consumers is contained in Article 36(1) of the Regulation of the Minister of Communication and Information Technology of the Republic of Indonesia Number 20 of 2016 concerning Personal Data Protection in Electronic Systems is only subject to administrative sanctions in the form of oral warnings, written warnings, temporary suspension of activities, and announcements on online sites. The absence of steps taken by Lion Air Group to provide certainty or matters that are compensatory to the consumer makes the rights of consumers are not fulfilled. This paper uses the doctrinal method in dealing with problems relating to unlawful acts committed by two former GoQUo employees as Malindo Air's partners in online flight ticket booking service providers in the leakage of Lion Air Group passenger data. The results of the discussion showed that accessing and stealing other people's personal data as well as spreading information that contains other people's personal data without rights is an illegal act that causes liability in the form of compensation. Losses suffered by consumers both materially and immaterially can be resolved through non-litigation and litigation channels.

Penelitian ini dilatarbelakangi oleh adanya berbagai perkembangan pengaturan tentang pekerja salah satunya pekerja Bank.Sejak diberlakukan pada tanggal 21 Maret 2023, Undang-Undang Nomor 6 Tahun 2023 Tentang Penetapan Peraturan Pemerintah Pengganti Undang- Undang Nomor 2 Tahun 2022 Tentang Cipta Kerja, terdapat beberapa pasal yang cukup mengkhawatirkan bagi para pekerja. Perlindungan hak pekerja tereliminir dengan semakin banyaknya aturan yang berpihak pada pengusaha atau investor.Perjanjian Kerja Bersama merupakan salah cara yang dapat digunakan untuk meminimalisir dampak pengundangan Cipta Kerja tersebut.Permasalahan penelitian adalah Bagaimana Kedudukan perjanjian kerja bersama dapat memberikan perlindungan hukum bagi pekerja bank pasca Pemberlakuan Undang Undang Nomor 6 Tahun 2023 Tentang Cipta Kerja?.Penelitian menggunakan jenis penelitian normatif dengan berbagai pendekatan,yaitu pendekatan perundang- undangan dan pendekatan konseptual.Sumber bahan hukum menggunakan bahan hukum primer, bahan hukum sekunder dan bahan hukum non hukum. Hasil penelitian bahwa perjanjian kerja bersama dapat memberikan perlindungan hukum bagi pekerja bank pasca Pengundangan Undang Undang Nomor 6 Tahun 2023 Tentang Cipta Kerja dengan cara dibuat dengan formulasi yang lebih baik dari formulasi yang ada pada Undang-Undang Nomor 6 Tahun 2023 Tentang Cipta Kerja serta mengedepankan hak- hak pekerja bank.Pelaksanaan kewajiban Perbankan sebagai pihak yang menggunakan pekerja bank sebagai sumberdaya atas keberlanjutan praktek perbankan memiliki potensi tidak optimal dilaksanakan selaras dengan semakin banyaknya ketentuan yang mendegradasi hak hak pekerja bank.Perlu segera dibuat kebijakan khusus berkaitan kewajiban dan tanggungjawab bank dalam perjanjian kerja bersama agar perlindungan hukum pekerja bank dalam formulasi perjanjian kerja bersama dapat terealisasikan

Abstract

This research background by the existence of Dewi Rengganis Batik which is the characteristic of Jatiurip Village, Krejengan District, Probolinggo Regency, where each batik motif tells about the figure of Dewi Rengganis who is the daughter of Prabu Brawijaya from the Majapahit Kingdom, but the batik has not been registered. This resulted in the owner of Batik Dewi Rengganis not getting legal protection. The results of this study using normative Legal Research with statute approach and conceptual approach are to provide an explanation and understanding of the importance of copyright registration to protect the copyrighted works of Batik Dewi Rengganis, and  describe  legal  protection  for  owners  of Batik Dewi Rengganis works in Jatiurip Village, Krejengan District Probolinggo Regency.

Abstract

This research is aimed to find a new model of legal protection for the product of genetic engineering in the field of agricultural biotechnology. The concept of legal protection as coined by Philipus M. Hadjon is limited to administrative law in the relationship between the people and the government, not applicable to all fields of law. The legal protection for genetic engineering in the field of agricultural biotechnology is covered in laws and their derivative regulations as it evidently provides forum of compensation for the infringement of intellectual property resulted in genetic engineering in agricultural biotechnology. The contract becomes a special instrument of legal protection between owners of intellectual property in the field of agricultural biotechnology dealing with civil laws.

Abstract

The implementation of buying and selling will not always be in accordance with what has been agreed. As an example of the case between Johandi Akman who is consumer and PT.Putra Adhi Prima who is a seller or business actor. In this case the panel of judges in the Cibinong Court Decision Number: 57/Pdt.G/2021/Pn.Cbi on 12 July 2021 stated that PT. Putra Adhi Prima had committed an unlawful act where there were hidden defects in the NE-21 villa that was purchased by Johandi Akman. The formulation of the problem in this writing is; First, how is the validity of the binding sale and purchase agreement (PPJB) of villa NE-21 which contains hidden defects? Second, what are the legal consequences of the binding sale and purchase agreement (PPJB) of villa NE-21 which contains elements of an unlawful act? Third, what are the legal considerations in the decision number. 57/Pdt.G/2021 is in accordance with the provisions of Law Number 8 of 1999 concerning Consumer Protection? The research method used is normative juridical with a statutory and conceptual approach. The results obtained from the research are the invalidity of the binding sale and purchase agreement which contains hidden defects, legal consequences of the binding sale and purchase agreement which contains elements of unlawful acts, so the injured party can claim responsibility for the losses suffered, and the legal considerations in decision number 57/Pdt.G/2021/Pn.Cbi are in accordance with applicable legal provisions.

Abstract

The development of technology affects the work system in all fields, including in the field of Business. Technological developments in the business sector are characterized by the emergence of new companies that utilize the internet, these new companies are in the form of Start Up. Business using the internet is more profitable for businesses and consumers so that it makes people flock to open businesses. With the increasing number of business actors, business competition is getting tighter and the potential for business competition violations is also increasing. This is a challenge for the Business Competition Supervisory Commission as an institution that oversees business competition. therefore, this research will discuss the role of the KPPU in enforcing business competition law. this research aims to increase understanding for business actors regarding the legal certainty of business competition in the digital economy era. The research was conducted using normative juridical research methods that are qualitative in nature. In this research, the discussion chapter is a description of the research results. From this research, a new regulation was found regarding violations of fair business competition in business through the internet/digital. As well as known about the actual functions, powers and duties of KPPU.
