Abstract

Introduction: The background of this research is that there are still many food products that have not been halal certified, even though the government through the Halal Product Guarantee Agency (BPJPH) has provided convenience in registering halal products online with free assistance. Especially in this metaverse era, where technology has developed rapidly so that the use of digital technology should be able to encourage development through the halal industry.Purposes of the Research: The purpose of this study, firstly, is to know and understand the meaning of halal in both Islamic law and the Civil Code. Second, understanding the halal industry in the metaverse era in terms of the theory of utilitarianism and Maqashid Sharia.Methods of the Research: This study uses a normative juridical method with a legal-statutory approach and a conceptual approach.Results of the Research: The results of this study are: First, that halal in Islamic Law and the Civil Code have different contexts, but have a similar meaning, namely referring to something that is permitted and not prohibited by law. Second, the halal industry based on utilitarianism has utility value both for business actors who register their food products, as well as for the general public as consumers. Furthermore, based on Maqashid Sharia, halal food is included in the category of protecting the soul (nafs) and protecting the mind (aql).

Abstract

Ketidaksetaraan gender seringkali menjadi salah satu penyebab utama kemiskinan yang berkepanjangan karena perempuan seringkali memiliki akses yang lebih terbatas terhadap sumber daya dan peluang ekonomi. Perkumpulan dan pemberdayaan perempuan telah muncul sebagai kekuatan penting yang mendukung perubahan sosial yang positif. Artikel ini bertujuan untuk memahami peran dan pentingnya perkumpulan serta program pemberdayaan perempuan dalam mendukung kesetaraan gender. Penelitian ini akan menggunakan analisis dokumen hukum untuk mempelajari kerangka hukum serta studi literatur untuk mengumpulkan dan mengevaluasi berbagai sumber tertulis. Perkumpulan perempuan memberikan ruang bagi perempuan untuk saling mendukung dan berbagi pengalaman serta pengetahuan. Namun, dukungan yang berkelanjutan diperlukan untuk memberikan pendanaan, pelatihan, dan pengembangan jaringan bagi perkumpulan perempuan. Perkumpulan perempuan memiliki potensi besar untuk menjadi agen perubahan dalam mencapai kesetaraan gender dan pemberdayaan perempuan secara luas.   Abstract Women's Empowerment through Associations to Promote Gender Equality.Gender inequality is often one of the main causes of persistent poverty as women often have more limited access to resources and economic opportunities. Women's associations and empowerment have emerged as important forces supporting positive social change. This article aims to understand the role and importance of women's associations and empowerment programs in supporting gender equality. The research will use legal document analysis to study the legal framework as well as literature review to collect and evaluate various written sources. Women's associations provide a space for women to support each other and share experiences and knowledge. However, ongoing support is needed to provide funding, training and network development for women's associations. Women's associations have great potential to be agents of change in achieving gender equality and women's empowerment at large.

Abstract

Tahun 2018 DC Comic mengajukan gugatan ke Pengadilan Niaga Jakarta Pusat dengan Tergugat yakni PT Marxing Fam Makmur atas permasalahan sengketa kepemilikan merek Superman di Indonesia. DC Comic sebagai pihak yang mengenalkan merek Superman secara global merasa dirugikan akibat adanya produk dengan nama yang sama secara tanpa ijin Hal ini merupakan pelanggaran terhadap Hak ekslusif yang dimiliki oleh merek Superman DC, yang dapat mengakibatkan adanya pengaburan dan pengurangan kapasitas terhadap merek Superman DC Comic. Ketika mendaftarkan suatu merek perlu diperhatikan syarat syarat agar merek tersebut dapat didaftarkan secara sah di dalam daftar umum merek. DC Comic merupakan perusahaan yang berasal dari negara yang mengikuti Perjanjian International mengenai merek dimana yang disepakati bersama mengenai Hak Prioritas dan Ketentuan Merek Terkenal. Indonesia sebagai negara yang turut serta dalam Perjanjian tersebut tentu harus menghargai Hak hak yang disepakati dalam Perjanjian Tersebut disesuaikan dengan Peraturan perundang undangan di dalam negeri. Maka diperlukannnya penegakan hukum yang tegas dan selaras dengan Perjanjian Internasional tersebut yang sudah diakomodir dengan Undang undang Nomor 20 Tahun 2016 tentang Merek dan Indikasi Geografis.

Abstract

Abstract       Indonesia as a country that has customs, habits and cultural diversity with characteristics in each region. Cultural diversity itself is clearly seen in the geographical, ethnic, socio-cultural, religious and belief aspects. Traditional Cultural Expressions are one source of communal intellectual property containing the characteristics of traditional heritage produced, developed, and maintained by indigenous communities. Traditional Cultural Expressions become an attraction for commercial use so that it becomes one of the reasons for the need for legal protection of Traditional Cultural Expressions through the Integrated Cultural Data Collection System. The type of research in this paper uses normative juridical by examining various legal rules such as laws and literature containing theoretical concepts which are then linked and discussed in this paper. AbstrakIndonesia sebagai salah satu negara yang memiliki adat istiadat, kebiasaan serta keberagaman budaya dengan ciri khas di setiap daerahnya. Keberagaman budaya itu sendiri terlihat jelas pada aspek-aspek geografis, etnis, sosio cultural, agama dan kepercayaan. Ekspresi Budaya Tradisonal merupakan salah satu sumber dari kekayaan intelektual komunal yang mengandung karakteristik warisan tradisional yang dihasilkan, dikembangkan, dan dipelihara oleh komunitas masyarakat adat. Ekspresi Budaya Tradisional menjadi daya tarik untuk dimanfaatkan secara komersial sehingga menjadi salah satu alasan perlunya perlindungan hukum terhadap Ekspresi Budaya Tradisional melalui Sistem Pendataan Kebudayaan Terpadu. Tipe penelitian dalam penulisan ini menggunakan yuridis normatif dengan mengkaji berbagai aturan hukum seperti undang-undang dan literature yang berisi konsep-konsep teoritis yang kemudian dihubungkan dan dibahas dalam penulisan ini.

Abstract

Introduction: During the pandemic Covid-19, the global soybean market experienced a shock which resulted in the availability of imported soybeans in several countries decreasing and soybean prices increasing. This also has an impact on small and medium industries that cannot afford soybeans for their processed food raw materials, one of which is the production of “tempe”. Purposes of the Research: The purpose of this study is to explain the concept of cooperation to provide legal protection to soybean farmers based on a muzara'ah akad with a murabahah system. Methods of the Research: The research method used is normative legal research with a statute legal approach and a conceptual approach. Results of the Research: The result of this study include 2 (two) things, namely the concept of cooperation and the form of legal protection. The concept of cooperation consists of: The first scheme, cooperation between the government (Pemda) with soybean farmers and Islamic banks. The second scheme is the cooperation of Islamic banks with soybean farmers using a murabahah akad. The third scheme, namely cooperation between soybean farmers and cultivator using muzara’ah akad. In connection with the form of legal protection, it is divided into 2 (two) namely: first, external legal protection regulated in Law Number 19 of 2013 concerning Protection and Empowerment of Farmers, which was later changed to Law no. 11 of 2020 concerning Job Creation, and second, internal legal protection, namely 3 (three) concepts of cooperation as outlined in a written agreement as a form of guarantee of legal certainty for the parties, especially for soybean farmers.

Abstract

Perkembangan ekonomi dan teknologi yang pesat pada era Industri 5.0 menuntut adanya lulusan hukum yang tidak hanya memahami hukum secara teknis tetapi juga memiliki keterampilan kewirausahaan dan teknologi. Program LawPreneur merupakan suatu langkah strategis untuk mencetak lulusan hukum yang memiliki keahlian tambahan dalam bidang bisnis berbasis hukum dan teknologi. Program ini bertujuan untuk menjembatani kesenjangan antara kemampuan lulusan hukum dan kebutuhan pasar akan profesional hukum yang siap bersaing, dan berinovasi di sektor legal-tech. Dalam beberapa tahun terakhir, lulusan hukum dihadapkan pada tantangan baru di pasar kerja. Selain peran tradisional seperti advokat, jaksa, atau hakim, muncul kebutuhan terhadap peran inovatif seperti konsultan hukum bagi bisnis teknologi, pengelola startup hukum, dan profesional hukum di perusahaan digital. Sebagai respons, Program LawPreneur menawarkan pendidikan yang mengintegrasikan hukum, kewirausahaan, dan teknologi, didukung oleh mitra-mitra bisnis, salah satunya HeyLaw. Melalui pelatihan dan magang, mahasiswa mendapatkan pengalaman praktis dalam mengelola bisnis hukum berbasis teknologi. Penelitian ini bertujuan untuk menganalisis konsep dan implementasi Program LawPreneur di fakultas hukum dalam membentuk profil lulusan yang kompeten dalam kewirausahaan hukum berbasis teknologi, serta mengidentifikasi arah pengembangan LawPreneur untuk meningkatkan daya saing lulusan di dunia kerja dan memenuhi kebutuhan industri 5.0.  Metode yang digunakan adalah penelitian kualitatif untuk memperoleh pemahaman menyeluruh tentang pelaksanaan program. Teknik pengumpulan data meliputi wawancara mendalam, observasi partisipatif, dan studi dokumentasi. Analisis dilakukan secara kualitatif interaktif, dengan memvalidasi data melalui triangulasi sumber. Luaran yang diharapkan dari penelitian ini mencakup rekomendasi strategis bagi pengembangan Program LawPreneur, peningkatan keterampilan lulusan, dan pemetaan kompetensi yang sesuai dengan kebutuhan industri 5.0. Penelitian ini selaras dengan roadmap Riset Unggulan UNEJ yang berfokus pada daya saing lulusan dan kesiapan menghadapi era digital.

Abstract

The existence of a royalty system is a form of protection and fulfillment of economic rights for creators, copyright holders and owners of related rights to songs and/or music. In order to carry out royalty management for songs and/or music in Indonesia, a Collective Management Institution (which is referred to as LMK) and a National Collective Management Institution (which is referred to as LMKN) were formed. LMK and LMKN in this case have the authority to attract, collect, and distribute royalties. Through this article, the author wants to explain the management of royalties on songs and/or music in Indonesia, related to institutions authorized to carry out royalty management on songs and/or music in Indonesia, the implementation of royalty management on songs and/or music, as well as the settlement efforts that can be taken if there is a dispute over royalty management on songs and/or music in Indonesia. This research is a normative juridical research type, using the Legislation Approach and Conceptual Approach. Through this research, it can be concluded that LMK and LMKN are both entitled to carry out royalty management of songs and/or music in Indonesia. Where the withdrawal of royalties is carried out by LMKN, while the collection and distribution are carried out by LMK and LMKN. Regarding dispute resolution efforts, if there is a dispute regarding the distribution of royalties, the resolution is mediation through LMKN, while for royalty withdrawal disputes can be resolved in accordance with the provisions contained in the Copyright Law.

Abstract

The issue of food security in Indonesia through the Department of Agriculture has been designated as a policy priority in agricultural development. This is due to the lack of adequate food availability for the community as shown d by the continued import of staple food ingredients from other countries, especially rice that is the main food source for the Indonesian people. The price of rice is increasing due to the decline in rice harvest area and also driven by the impact of El Nino, so that efforts are needed to maintain food security. This research is based on the concept of mudharabah bil mukhabarah which combines the rules of Islamic law and positive law in Indonesia that are applied to agricultural cooperation as an effort to maintain food security. The research method used in this research is a normative legal research type with a statutory and conceptual approach. The results of the research are that cooperation based on a mudharabah bil mukhabarah agreement combines three parties, namely (1) the Government (BULOG) as a provider of capital in the form of fertilizer, superior plant seeds and agricultural equipment, (2) the land owner who provides agricultural land, and ( 3) Cultivator farmers who manage agricultural land using the expertise, energy and time they have. The harvest results in this collaboration are sold back to BULOG and the profits are distributed to the parties according to the ratio agreed at the beginning of the agreement, so that food supplies can be met with fairness, transparency and sustainability in every transaction and relationship between the parties in maintaining national food security.

Abstract

A notary is a public official who, in carrying out their duties, refers to the Notary Position Law, which stipulates that the creation of deeds must be done face to face with clients. However, in the provisions of the Notary Law itself, Article 15 Paragraph (1) letter m provides that cyber notaries can be implemented. This research aims to assess the application of artificial intelligence (AI) in the development of cyber notaries in the era of digital transformation and to examine to what extent AI will support or replace the role of notaries as public officials. This study uses normative legal research with a legislative and conceptual approach through literature studies that are analyzed descriptively. The results of this study indicate the position of AI in the Notary Position is only as a supporting tool, not as a substitute for the notary position, because AI cannot legally replace the role of a notary, regarding the position of AI there are also no clear norms in the laws and regulations. So the position of AI in cyber notary is only as a supporting tool for Notaries which provides many conveniences for notaries in carrying out their duties. The application of AI as part of cyber notary by optimizing AI performance so that notaries can work more effectively and efficiently. With the existence of legal provisions that are in line with the application of AI in cyber notary, it will certainly make it easier for notaries to carry out their duties, in addition to the guarantee of electronic storage of notary protocols, there also needs to be legal provisions with the guarantee of client data security.

Abstract

Legal uncertainty related to the use of artificial intelligence (AI) in storing notary protocols, which is part of the implementation of the cyber notary concept in Indonesia. The background of this research is the era of the Industrial Revolution 4.0 and Society 5.0, which demands high efficiency, security, and accessibility in storing notary documents, especially to reduce the risk of damage to physical documents due to natural disasters and other factors. Although the use of AI in storing notary protocols promises better efficiency and security, there is no legal certainty that supports this application, due to the overlap and inconsistency between the Notary Law and the Information and Electronic Transactions Law. This study uses a normative legal methodology with a statutory and conceptual approach to analyze related legal regulations and explore issues that arise due to the legal vacuum in the use of AI by notaries. The results of the study show notaries have an obligation to make minutes of deeds and archive them as a form of action from the notary protocol. The obligation to store these minutes of deeds aims to maintain the authenticity of the deed. Storage of notary protocols until now still uses printed media stored in a separate archive room at the Notary's office, this certainly poses a high risk to the safety of the notary protocol if there is force majeure at the Notary's Office. Storage of Notary protocols using AI does not guarantee legal certainty, because there are no comprehensive and explicit regulations regarding the use of AI in Storing Notary protocols. However, this is a challenge whose implementation requires more specific implementing regulations so that notaries have clear guidelines in carrying out the document digitization process safely and legally.
