Abstract

Penelitian ini bertujuan menganalisis ketidaksesuaian prosedur penanganan persengketaan tanah wakaf yang belum tersertifikasi di Kantor Urusan Agama (KUA) Wonosobo terhadap ketentuan Pasal 37 Undang-Undang Nomor 41 Tahun 2004 tentang Wakaf. Latar belakang penelitian didasarkan pada masih dominannya praktik pengelolaan wakaf tanpa registrasi formal dan verifikasi nazhir yang memadai, sehingga menimbulkan kerentanan yuridis dan konflik horizontal di masyarakat. Urgensi penulisan terletak pada kebutuhan penguatan supremasi hukum agraria wakaf sebagai rezim hukum khusus guna menjamin keberlanjutan fungsi sosial wakaf. Penelitian ini menggunakan metode penelitian hukum normatif dengan pendekatan peraturan perundang-undangan, konseptual, dan kasus. Hasil penelitian menunjukkan bahwa ketidakterpaduan koordinasi antara KUA, Badan Wakaf Indonesia, dan Badan Pertanahan Nasional menyebabkan potensi nullitas pengelolaan nazhir, risiko pidana sebagaimana Pasal 67 UU Wakaf, serta disintegrasi aset wakaf. Kondisi ini melemahkan kepastian hukum sebagaimana dikemukakan Gustav Radbruch dan tujuan kemanfaatan hukum menurut Roscoe Pound, serta bertentangan dengan Pasal 33 ayat (3) UUD 1945. Penelitian ini menyimpulkan perlunya percepatan sertipikasi massal, penguatan kapasitas nazhir, mekanisme penyelesaian sengketa bertahap, dan reformasi koordinasi tripartit sebagai kebaruan temuan untuk memperkuat tata kelola wakaf.

Abstract

This study aims to analyze the detrimental social impacts arising from non-comprehensive compensation determination in land acquisition for public interest development on affected communities, and to identify social variables influencing the livelihood sustainability of affected communities following land acquisition. Furthermore, this study seeks to reconstruct a sustainable land acquisition compensation system by considering social impacts and livelihood sustainability of affected communities, particularly farmers who previously depended on their land as their primary income source. This research employs a doctrinal normative legal approach, utilizing library research to collect and analyze legal sources in formulating solutions to the issues examined. The findings indicate that compensation must not be limited to monetary forms, but must also encompass resettlement, provision of replacement land for farmers, and preservation of community structures to prevent social disintegration. The current compensation system contains legal gaps in its implementation and has a strong tendency to produce detrimental social impacts on affected communities, particularly regarding livelihood sustainability following land acquisition.

Abstract

Indonesian migrant workers encounter significant challenges in adapting to the legal, social, and cultural environments of their destination countries. Limited knowledge of local legal systems and employment regulations often increases their vulnerability to labor exploitation and legal disputes. This study examines the challenges faced by Indonesian migrant workers in the adaptation process and analyzes the role of legal education in strengthening their legal awareness and capacity for social integration. Employing a socio-legal approach, the research utilizes primary data obtained through interviews and institutional information, complemented by secondary data from legislation, academic literature, and relevant policy documents. The findings reveal three key issues. First, Indonesian migrant workers face legal, linguistic, cultural, and socio-economic barriers that hinder effective adaptation in host countries. Second, limited access to legal information and education reduces their ability to understand and exercise their rights and obligations under the legal framework of the destination country. Third, the Continuing Education (CE) Program developed by the Universitas Terbuka for Overseas Students provides an accessible legal education platform that enhances legal literacy, supports social adaptation, and promotes awareness of workers' rights and responsibilities. This study argues that legal education constitutes a preventive mechanism for migrant worker protection by empowering individuals to navigate foreign legal systems and reduce legal vulnerability. It further highlights the importance of state support through accessible and sustainable educational programs as an integral component of migrant worker protection and empowerment.

Abstract

Introduction: Child marriage remains a challenge in Pemalang Regency. Numerous studies have shown that child marriage has significant impacts on children’s health, education, and future, particularly for girls. Purposes of The Devotion: This article aims to develop a community-based strategy for preventing child marriage through the empowerment of the Children’s Forum, grounded in a child rights and gender equality approach. Method of The Devotion: This community service program is designed to enhance public understanding—especially among teenagers—of the negative consequences of child marriage and the importance of fulfilling children’s rights through the Children’s Forum community. The program involves training and interactive discussions, strengthening the capacity of the Children’s Forum as agents of change, and fostering collaboration with local government, community leaders, and other stakeholders. This approach is expected to create a community that is more attentive to children’s rights and gender equality, while also supporting Pemalang Regency’s efforts to maintain and improve its Nindya status as a Child-Friendly Regency. Results Main Findings of the Devotion: The outcomes of this community service initiative will be evaluated through success indicators such as the strengthened role of the Children’s Forum in advocating for children’s issues—particularly the prevention of child marriage—and, subsequently, increased public awareness and a reduction in child marriage cases.
