Abstract

Law of the Republic of Indonesia No. 52 of 2009 concerning Population Development and Family Development. The movement for controlling and limiting offspring (tahdid al-Nasl) set by the government had become problematic in Islam. The problem is how the practice of family planning in the Law of the Republic of Indonesia no. 52 of 2009 concerning Population Development and Family Development. Then what was the Islamic view on it concerning Population Development and Family Development? After conducting a data study, data exposure, and discussion through existing research methodologies. Population Development and Family Development was an effort to regulate, birth spacing or temporary pregnancy prevention efforts with the agreement of husband and wife due to certain situations and conditions for the benefit of the family, society, and the state. Based on the principles set out in Islam, the program was considered to follow the limits set out in Islam.

Abstract

Among the forums to solve the problem are collectively known as 'bahtsul masa'il'. the legal decision is collective, derived from the consensus of the participants. His method of searching references (maraji ') to find answers regarding the existing problems, known as Madzhab Qauli, madzhab which is understood as the opinion or fatwa of a Mujtahid or Mufti in deciding fiqhiyyah law. However, not infrequently stagnation (maukuf) in the termination of the law. Because there are no references or books that explain the problem. As a result, if enforced (laws with existing references) result in unfair decisions and other issues for the community.From this manifestation of schools began to be considered important to be developed. That is a way to answer the problems faced by following the way of thinking and the rule of law which has been drawn up by the madzhab priest as described above. This last method is actually an attempt to decide the law by directly returning al-Qur'an, al-Hadits and so on by using tools qawa'id ushuliyyah and qawa'id fiqhiyyah. Everyone can not run this method individually. because the legal instrument of the legal system must be completely mastered. Therefore this Manhaji Method can be developed by means of ijtihad Jama'i that is the hard effort of some experts in their respective fields maximally in exploring the law of syar'i which is dhanni by using the method of istimbat. The decision is based on the agreement of the ulama or by acclamation, which is to take the most votes from the results of the deliberations. Keyword: Madzhab Qouli, Madhab Manhaji, Bahtsul Masa`il

Abstract

Dalam pandangan politik Syi’ah Imamah bukanlah masalah kepentingan pribadi yang diberikan kepada pilihan publik, akan tetapi adalah salah satu pilar agama atau asal-usul dan dasar perinsip agama. Syi’ah memiliki sejumlah doktrin penting, doktrin Imamah menempati kedudukan sentral dalam aspirasi politik Syi’ah. Hak politik adalah mutlak dimiliki oleh kalangan Ahlul Bait. Bagi kaum Syi’ah, konsep Imâmah adalah kelanjutan dari konsep nubuwwah. Kriteria Imamah: Ishmah dan Ilmu. Dalam perkembangan pemikiran tentang Imâmah ini, bisa disebut tiga kelompok besar Syi’ah Imamiyah, yaitu: Isna ‘Asyariyah, Zaidiyah dan Isma’iliyah. Keywords: Imamah, Syi’ah, Pemikiran Politik.

Abstract

Abstract This research aims to examine the realization of a peace family with the equivalent rights for married couples. Problems that arise, whether there is equality for husband and wife, related to peace in his marriage. the method used in this research is descriptive qualitative research which type library research. Where this author analyze the concep of kafa’ah and a peace family in documents form of a yellow books, reference, journal and other print media. Peaceful family can be achieved with the efforts of each partner in building a household. Peaceful family done after a marriage bond and will arise because there is a sense of belonging for husband and wife. Anyone and anytime without being bound by the necessity of equality between husband and wife. Keywords: marriage ties, equality rights, peaceful family.

Abstract

In the implimentation of these research activities, then an intensive and deep we dig into the data that is primary an secondary literature of several yellow book, considering that this study are typologically prescriptive explanatory, the purpose of this study was to describe the breadth and depth of the object of our research purpose, of this we do after analyzing of data we obtained, in wich the implementation we used the method of content analysis, that is a pttern of oure text assessment of various literature related and associated with the object of this study, to then take the yarn conclusions as answer to same problems we formulated earliner. the views of jurisprudence space to the commercialization of minarets as telecommunications towes is included of a lease contract, which party takmir as mu'jir, the telecommunications company as musta'jir and towers being rented is musta'jar and ton contract lika this an be fine. Because although there are opinions that do not allow either makruh or haram, all of them groundless if it would cause distress of mafsadat, and there is no need. As for now, a lot of management or commercialize takmir mosque to tower in order to prosper, empower and increase operational funds the moeques and to optimize the function of one part of the mosque building. And all these takmir efforts are froms of an effort to create the benefit of the mosque.

Abstract

Marriage dispensation is legal assistance from the Religious Courts to prospective brides and grooms, one or both of whom have not reached the age requirement in the state regulations as stipulated in the Law. In the latest Marriage Law on Marriage, No. 16 of 2019 reads, "Marriage is only permitted if the man and woman have reached the age of 19" and the dispensation of marriage is discussed in paragraph (2) which reads, "In the event of deviation from the age requirement as referred to in paragraph (1), the parents men and women can ask for dispensation to the Court on the grounds that it is very urgent accompanied by sufficient supporting evidence ". The existence of the latest Law which is an amendment of the 1974 Marriage Law, the application for marriage dispensation is a problem, both for the applicant (prospective husband and wife) as well as for the Religious Courts or judges. From this, it is interesting to conduct research on how judges consider the decision of dispensation of marriage and the factors behind the application for marriage dispensation at the Kraksaan Religious Court in 2019. With this research, it is hoped that it can increase knowledge about judges' considerations in granting or rejecting dispensation requests and increase knowledge about the factors behind the submission of a marriage dispensation application so that it can be used as a basis for the next trial.

Abstract

Corruption has made the life of the state have porous joints. Economy as the mainstay of the joint life experience fragility, currency values decline significantly. Social joints also suffer the same fate, now corruption has become commonplace in everyday life portrait began to level the structure of RT (Neighborhood) up to the level of institution of the President. In fact, even this body of organisms may have been "plagued" the virus of corruption that is far more devastating impact than physical disease viruses. Many people suspect that corruption in Indonesia is still running and even increased in almost every element of the institution due to the form of sanctions contained in the positive law. Where sanctions are used as a "cure" the disease is not effective or have no impact on the offender and not relevant to apply again. From the above problem, the author wishes to conduct research regarding the form of criminal sanctions for corruption in Indonesia using qualitative approaches that are library research (literature study), and data collection techniques using documentary study of the books, scientific works, newspapers, magazines, and scholarly journals. After doing research, followed by analyzing each of the data obtained, the researchers found a conclusion that could answer the focal issues under review, islamic law view that corruption is a criminal sanction ta'zir, where the imposition of sanctions tailored to the level of crimes committed, sikologis actors and their environment, with the shape and type of sanctions that may deter perpetrators and educate the offender and other people not to commit criminal them. And including sanctions model in Islamic law is a prison and a fine. The rules contained in Islam and the state (positive law) have the same goal, namely to create peace between humans. For this reason, positive criminal law must not conflict with Islamic law. Although the regulations stipulated in Indonesia are not taken from the texts of the al-Qur`an or al-Hadith. But still in line with the basic principles set out in Islamic law. Abstrak Korupsi telah membuat sendi kehidupan bernegara mengalami kekeroposan. Sendi perekonomian sebagai penopang utama kehidupan mengalami kerapuhan, nilai mata uang secara signifikan mengalami kemerosotan. Sendi sosial juga bernasib sama, saat ini korupsi telah menjadi hal lumrah dalam potret kehidupan keseharian mulai tingkat struktur RT (Rukun Tetangga) hingga ke tingkat Lembaga Kepresidenan. Bahkan organisme tubuh inipun mungkin telah “dijangkiti” virus korupsi yang jauh lebih dahsyat dampaknya dari virus-virus penyakit jasmani. Banyak kalangan menduga, korupsi di Indonesia tetap berjalan dan bahkan meningkat hampir di setiap elemen lembaga dikarenakan bentuk sanksi yang terdapat dalam hukum positif. Dimana sanksi yang dijadikan "obat" terhadap penyakit tersebut tidak efektif atau tidak berdampak apapun terhadap pelaku dan tidak relevan untuk diterapkan lagi. Dari masalah diatas, penulis berkeinginan untuk melakukan penelitian tentang bentuk sanksi pidana korupsi di Indonesia dengan menggunakan pendekatan kualitatif yang bersifat library research (penelitian kepustakaan), dan tehnik pengumpulan datanya menggunakan telaah dokumenter terhadap kitab-kitab, karya ilmiah, surat kabar, majalah, dan jurnal keilmuan. Setelah melakukan penelitian yang dilanjutkan dengan menganalisa setiap data yang diperoleh, peneliti menemukan kesimpulan, Hukum islam memandang bahwa Sanksi tindak kriminal korupsi adalah ta'zir, dimana pemberian sanksi disesuaikan terhadap tingkat kriminal yang dilakukan, sikologis pelaku dan lingkungannya, dengan bentuk dan jenis sanksi yang dapat menjerakan pelaku dan mendidik pelaku serta masyarakat lain untuk tidak melakukan kriminal tersebut. Dan termasuk model sanksi dalam hukum islam adalah penjara dan denda. Aturan-aturan yang terdapat dalam islam dan negara (hukum positif) adalah memiliki tujuan yang sama, yaitu untuk menciptakan kedamaian antar umat manusia. Untuk itulah hukum pidana positif harus tidak bertentangan dengan hukum islam. Walau peraturan-peraturan yang ditetapkan di indonesia tidak diambil dari nash-nash al-Qur`an maupun al-Hadits. Tetapi tetap selaras dengan prinsip dasar yang ditetapkan dalam hukum islam.

Abstract

This research aims to examine and analyze the opinion of Syafi'iyyah scholars about intention in prayer. On this problem, Syafi'iyyah scholars are divided into two opinions, namely from the previous period scholars (Mutaqoddimin) whit his opinion intention of al-Muqoronah al-Hakikiyyah, and from the contemporary scholars (mutaakhkhirin) whit his opinion intention of al-Muqoronah al-Urfiyyah. This research is important because the intention in prayer is compulsory case (rukn) and is the beginning of all forms of worship. Other than that many Muslims doubt in his intention so anxiety arises in them. As research that examines the opinions of the scolars, the method used in this research is library research which descriptive qualitative research, where the object of study is literature in the form works in the yellow books, journal and other books. From the explanation and studies that has done, the intention of al-Muqoronah al-Hakikiyyah as stated by the previous period scholars is a law of origin, one must do when praying. Whereas the intention of al-Muqoronah al-Urfiyyah as stated by the contemporary scholars is rukhsah wajibah because of the udzur that befell a person while doing the prayer.

Abstract

This study aims to examine the Hadith in the Syafi'iyah Ulama. Historically, the style of thought of the scholars has focused on two schools, namely: the mutakallim school pioneered by the Syafi'iyyah scholars and the Ahnāf school, known as the fuqahā', which the Hanafi scholars built. These two schools have different paradigms, including in the study of Hadith, especially when istinbāṭ al-Ahkām. There are three points obtained in this study; first, the Syafi'iyyah scholars divide the Hadith (from the aspect of quantity) into two, namely the mutawātir Hadith and the ahād Hadith. Second, the scholars agree that Mutawātir hadith can be used as a basis for a source of law. At the same time, the ahād Hadith and the mursal Hadith of the Syafi'iyyah scholars provide certain conditions in making the ahād Hadith and mursal Hadith sources of law. Third, from the aspect of qat'iy-ẓanniy and 'ām-takhs, in the view of the Syafi'iyyah scholars that the word 'āmm is Zanni, so the pronunciation of 'āmm, what is in the Qur'an can be interpreted with the Hadith ahād and Qiyas because they are both Zanni. Zanni argues that there is no obstacle to assessing the Zanni. Penelitian ini bertujuan untuk mengkaji tentang hadis dalam Ulama Syāfi’iyah. Dalam sejarahnya, corak pemikiran para ulama terpusat pada dua aliran, yaitu aliran mutakallimīn yang dipelopori oleh ulama Syāfi’iyyah dan aliran Ahnāf atau dikenal dengan fuqahā’ yang dibangun oleh ulama Hanafiyah. Dua aliran ini memiliki paradigma yang berbeda termasuk didalamnya dalam kajian Hadis, khususnya ketika istinbāṭ al-Ahkām. Ada tiga poin yang didapatkan dalam penelitian ini, pertama dalam aspek pembagian, ulama Syāfi’iyyah membagi hadis (dari aspek kuantitas) menjadi dua, yaitu Hadis mutawātir dan hadis ahād. Kedua dalam aspek kedudukan hadis dalam menggali hukum, dalam hal hadis Mutawātir para ulama sepakat bahwa hadis Mutawātir dapat dijadikan landasan sebagai sumber hukum. Sementara hadis ahād dan hadis mursal ulama Syāfi’iyyah memberikan syarat-syarat tertentu didalam menjadikan hadis ahād dan hadis mursal sebagai sumber hukum. Ketiga, dari aspek qat’iy-ẓanniy dan ‘ām-takhsīṣ, dalam pandangan ulama Syāfi’iyyah bahwa lafaz ‘āmm adalah ẓanni sehingga lafaz ‘āmm yang ada dalam al-Qur’an bisa di takhsīṣ dengan hadis ahād dan qiyas karena sama-sama bersifat ẓanni. Dalil ẓanni tidak ada halangan untuk men-takhshīṣ yang ẓanni.
