Abstract

Law of the Republic of Indonesia No. 52 of 2009 concerning Population Development and Family Development. The movement for controlling and limiting offspring (tahdid al-Nasl) set by the government had become problematic in Islam. The problem is how the practice of family planning in the Law of the Republic of Indonesia no. 52 of 2009 concerning Population Development and Family Development. Then what was the Islamic view on it concerning Population Development and Family Development? After conducting a data study, data exposure, and discussion through existing research methodologies. Population Development and Family Development was an effort to regulate, birth spacing or temporary pregnancy prevention efforts with the agreement of husband and wife due to certain situations and conditions for the benefit of the family, society, and the state. Based on the principles set out in Islam, the program was considered to follow the limits set out in Islam.

Abstract

This study aims to comprehensively describe the endogamous marriages of the Prophet Muhammad's descendants from the perspective of the sociology of Islamic law. The marriage mainly occurs in syarīfah (the female descendants); they are required to marry the prospectives from ḥabīb (male descendants) groups only. Endogamous marriage will be explored holistically by clarifying the reciprocal relationship between social change and Islamic law among syarīfah. This field research examines the enactment of the law in social life. It used a sociological Islamic law approach to reveal the facts about endogamous marriage in Bangil, East Java, Indonesia, because many of the Prophet's descendants live there. Data collection techniques were interviews and literature search, while the analysis technique used is Miles and Hubermen's analytical procedure. After conducting in-depth research, a conclusion was found that endogamous marriage among syarīfah in Bangil is a form of obedience to customs passed down across generations since their ancestors, namely the tradition of marrying someone of equal lineage. Endogamous marriages have been maintained to this day due to religious teachings, the spirit of protecting the Prophet's family, and the social conditions of those who support its preservation.

Abstract

Childfree is a social phenomenon that is becoming an interesting discussion today. It deserves the attention of Islamic law. Nahdlatul Ulama (NU), through the NU Bahtsul Masail Institute (LBM-NU), has issued four fatwas synonymous with the childfree phenomenon. This article aims to analyze the childfree phenomenon from the perspective of the istinbāṭ al-aḥkām method used by NU and its relevance to the four fatwas. This article is qualitative research using a normative Islamic law approach, which examines NU’s legal decisions regarding the denial of childbirth. These decisions are then analyzed to determine the meaning and method of istinbāṭ used. This article finds two things. First, the istinbāṭ al-aḥkām method used by LBM-NU is the qawlī intiqādī method. Second, from the aspect of its application, childfree can be equated in law with decisions that have been determined by LBMNU regarding child refusal, as long as the method adopted is legal. However, from the aspect of substance, where childfree is used as a principle and lifestyle, it requires a new fatwā decision, especially with the manhajī approach.

Abstract

Child marriage is an interesting phenomenon to discuss. There have been many government efforts in dealing with the rampant cases of child marriage in Indonesia. One of them is by enacting the Marriage Law regarding the age limit for marriage. The change in the age limit for marriage regulated in laws and regulations to 19 years for both men and women has actually increased the number of child marriages in Indonesia. This research is a qualitative research with a case study type of research, namely in the Religious Court of Probolinggo City. From the research that has been done, the authors can conclude that even though the age limit for marriage has been regulated in the Marriage Law, a marriage dispensation policy for those w ho still wish to marry under the specified age can still be issued by a judge with various considerations. It cannot be denied that the existence of a marriage dispensation has actually become a boomerang for the effectiveness of the Marriage Law concerning the marriage age limit that has been made. Lawmakers need more attention to further reinforce existing regulations so that the marriage dispensation is not used as a way out for people who want to get married at an early age.

Abstract

Isbat marriage is a determination of the validity of a marriage that is determined by a religious court. Marriage that is consecrated is a marriage that is legally religious but not yet legal by the state. So that the marriage does not get legal certainty. So not a few people do isbat marriage as aform of effort to get legal certainty for the marriage they do. This study reviews the cases of marriage constituencies that are still rife in Probolinggo district. Whith the focus of research namelly the results of the analysis of the judge’s decision at the Probolinggo religious court in accepting, analyzing, determining, and deciding cases of marriage registrations the analysis in question uses to two approaches, namely the perspektif of positif law and islamic law. Marriage isbat cases are cases is ranked number two after divorce cases filed by the local community. From the data the author obtained between 2021 and 2022 there were as many as 41 cases of marriage confirmation recaived by the religious courts. Marriage confirmation both in the perspektive of positif law and islamic law thend, beering in mind that marriage confirmtion is still wideli practiced, unfortunately, the party filing this case is the perpetrathor of the sirri marriage, the author want to make it clear to society in general that marriage confirmation is a matter that is as far as possible be used as the final step in completing siri marriage get vallidity of the marriage they do. This means that the marriage certificate is solely carried out because it is a necessity, not to legalize a sim marriage. The law specifically limits marriage isbat only to a number of urgent matters, primary by conducting interviews with the chief judge, deputy chief judge, and information desk officer. Meanwhile secondary data comes from reference to journals, scientific books and data reports at the Probolinggo religious court. Data collections tecniques include observation, interviews, and documentation.

Abstract

Tidak dapat dipungkiri, sabda nabi Muhammad saw. atau dikenal dengan hadits merupakan salah satu pedoman umat islam dalam segala hal ihwalnya. Sebagai sumber rujukan, hadits nabi dipastikan kebenarannya karena diyakini maknanya datang langsung dari Allah swt. yang diwahyukan kepada nabi. Seiring waktu, pasca sepeninggal Nabi, pada masa sahabat dan tabi’in banyak qoul-qoul yang disandarkan kepada nabi Muhammad saw., hingga akhirnya merasa sangat perlu untuk mengumpulkan hadits-hadits nabi dan melakukan penelitian apakah hadits itu bersumber dari nabi atau tidak. Dari sinilah kemudian muncul ilmu hadits yang diantaranya mengenai ketsiqohan atau kredibilitas para perawi hadits. Urgensi dan manfaat mengetahui ke-tsiqoh-an rawi. Salah satu faktor yang dapat mempengaruhi dapat atau tidak diterimanya suatu hadits ialah kualitas rawii. Tinggi rendahnya sifat adil dan dabith para perawi menyebabkan kuat lemahnya martabat suatu hadits. Perbedaan cara para perawi menerima hadits dari guru mereka masing-masing mengakibatkan munculnnya perbedaan lafadz-lafadz yang dipakai dalam periwayatan hadits. Karena perbedaan lafadz yang dipakai dalam pennyampaian hadits menyebabkan perbedaan nilai (kualitas) dari suatu hadits.

Abstract

Abstract

Dalam konteks negara Indonesia –negara hukum yang tidak menerapkan hukum Islam-, peraturan-peraturannya dikenal dengan istilah hukum Positif (al-Qonūn al-Wadh`iy). Dimana undang-undang atau peraturan untuk mengatur pergaulan hidup bermasyarakat yang diputuskan dan ditetapkan oleh pemerintah. Dari sini, hukum Positif merupakan produk (hasil pemikiran) manusia untuk sekedar memenuhi kebutuhan mereka yang bersifat temporal dan kasuistik. Tujuannya tak lain biar nuansa kehidupan ini senantiasa harmoni. Beda halnya dengan hukum syar`i, dia datang dari syari` dengan perantara al-Qur`an dan al-Hadist untuk merealisasikan kemashlahatan umat manusia sepanjang masa. Penelitian ini mengkaji tentang tindak pidana korupsi di indonesia perspektif hukum islam dan hukum positif. Hukum positif memandang bahwa Sanksi tindak kriminal korupsi adalah dengan mengekang kemerdekaan pelaku, namun tidak dimaksudkan untuk menderitakan dan merendahkan martabat manusia. Sanksi disini adalah sanksi fisik berupa kurungan penjara dan sanksi materi berupa denda, Sanksi tersebut diharapkan dapat menjerakan sekaligus mendidik pelaku. Hukum islam memandang bahwa Sanksi tindak kriminal korupsi adalah ta'zir, dimana pemberian sanksi disesuaikan terhadap tingkat kriminal yang dilakukan, sikologis pelaku dan lingkungannya, dengan bentuk dan jenis sanksi yang dapat menjerakan pelaku dan mendidik pelaku serta masyarakat lain untuk tidak melakukan kriminal tersebut. Dan termasuk model sanksi dalam hukum islam adalah penjara dan denda.

Abstract

This research aims to find out in detail about the worker wage system from an Islamic economic perspective applied at CV. Motor Jaya 2 Gending In this research, researchers used field study research. Field research used in qualitative research produces data which is interpreted as facts or information from actors (research subjects, information, actors, activities and places are the research subjects). Meanwhile, this type of research uses a case study type. A case study is part of a qualitative method that seeks to explore a particular case in more depth by involving the collection of various sources of information. The data source was obtained directly from the research location at the CV office. Motor Jaya 2 Gending through documents related to the problems studied. Apart from that, data was also obtained through interviews with the company manager and the Accounting Finance Officer Manager. Once collected completely, it is then analyzed descriptively where specific conclusions are drawn from the general data that has been collected. The results of this research show that in general the wage provisions of CV companies.

Abstract

This research examined environmental fiqh issues. Where in the data analysis with descriptive qualitative research. Moreover, the data collection technique is a library or library research. This study concluded that fiqh contributes to the problem of maintaining environmental harmony by providing rules or codes of ethics for human relations with their environment, such as the prohibition of destroying the environment and the obligation to preserve the environment. This arrangement of environmental law is based on tafsiliy arguments, namely the Qur'an-al-Hadith, and the general principles of legal legislation. When jurisprudence takes part in environmental preservation, it is hoped that there will be a new awareness for all Muslim leaders, especially about environmental issues. They have a great concern for the environment. Penelitian ini mengkaji persoalan fikih lingkungan hidup. Dengan tujuan untuk merumuskan fikih lingkungan yang komprehensip, sistematis dan akuntabel serta bisa menangani persoalan pemanasan global. Dimana dalam analisa datanya dengan penelitian Kualitatif Deskriptif. Dan Teknik pengumpulan data yag adalah pustaka atau library research. Dalam penelitian ini disimpulkan bahwa fikih turut andil dalam persoalan upaya menjaga keharmonisan lingkungan dengan cara memberikan aturan atau kode etik hubungan manusia dengan lingkungannya. Seperti larangan merusak lingkungan dan kewajiban menjaga kelestarian lingkungan. Penataan hukum lingkungan ini di dasarkan kepada dalil-dalil tafsiliy, yakni al-Qur'an-al-Hadist, dan prinsip-prinsip umum legeslasi hukum. Ketika fikih ikut andil dalam pelestarian lingkungan, sangat diharapkan adanya kesadaran baru bagi seluruh mukallaf khususnya kesadaran yang terkait dengan masalah lingkungan. Mereka memiliki kepedulian tinggi terhadap lingkungan.
