Abstract

Radicalism, commonly intertwined with terrorism, assumes a critical role in Indonesia's efforts to counter and deradicalize individuals as part of its broader counterterrorism strategies. Despite the incorporation of contra-radicalization and deradicalization measures within the Indonesian Anti-Terrorism Law, the legal framework lacks a precise definition of radicalism. The absence of a clear legal concept prompts ongoing debates among academics and political entities, leaving the definitive elucidation of radicalism largely within the purview of the government. This article contends that for the sake of achieving conceptual uniformity and ensuring legal clarity, a formal regulation addressing the nuanced dimensions of radicalism is imperative. The objective herein is to scrutinize the existing model for gauging radicalism in the Indonesian context and subsequently formulate a robust legal construct surrounding this complex phenomenon. To this end, a set of four criteria—intolerance, fanaticism, exclusiveness, and revolutionary fervor—has been devised to quantitatively measure the extent of radicalism. This measurement process involves the administration of interviews or surveys, with the resultant data shedding light on respondents' inclinations and tendencies. The proposed legal framework posits that an individual or group can be categorized as radical only when they meet the predefined criteria encapsulated within the regulations, encompassing the four specified dimensions. By delineating and operationalizing these criteria, this research endeavors to contribute to the development of a comprehensive legal framework for addressing radicalism in Indonesia. This approach not only facilitates a more nuanced understanding of radicalism but also provides a tangible basis for legal categorization and intervention. Ultimately, the aim is to enhance the effectiveness of counterterrorism efforts by establishing a clear and standardized definition of radicalism within the Indonesian legal landscape.

Abstract

This study delves into an examination of the role played by local wisdom in the protection of forests. The recognition and acknowledgment of local wisdom, enshrined in customary law within the environments of indigenous peoples, encounters challenges, particularly when the legitimacy of customary law itself is in question, especially concerning forest protection. In addressing these concerns, a normative juridical approach was employed to scrutinize legal source materials. The findings of this research affirm that the recognition of indigenous peoples as legal entities, particularly under international law, necessitates collective consideration. Through this conceptual framework, indigenous peoples can assert their aspirations autonomously and even advocate for international policies aimed at safeguarding and upholding the rights of indigenous peoples globally, with predetermined terms and conditions. The study underscores the contribution of local wisdom to forest protection, exemplified by the formulation of customary forest concepts applicable to indigenous communities. Local wisdom has demonstrated efficacy in averting and mitigating forest damage, particularly within customary forest areas, owing to the steadfast adherence of indigenous peoples to the principles encapsulated in their customary law. Moreover, the effectiveness of local wisdom in forest preservation is bolstered by the intrinsic characteristics of traditional indigenous communities, fostering wise and sustainable forest management practices. The study posits that the normative nature of customary law, as a living legal entity, may face ineffectiveness, potentially jeopardizing its own existence. Nonetheless, it contends that the state should formally recognize the exclusivity of customary law through constitutional and legal frameworks, thereby fortifying the application and viability of customary law within predetermined geographical areas and communities designated by the government

Abstract

Living together as unmarried partners, commonly known as cohabitation or “kumpul kebo” in Indonesia, was not prohibited under the old Indonesian Criminal Code (KUHP). However, in light of Indonesia’s cultural emphasis on decency, cohabitation has recently been criminalized. According to Article 412 paragraph (1) of the New KUHP, cohabitation is now considered a criminal offense, punishable by a maximum fine of thirty million rupiahs and imprisonment for up to six months. This legal development sparked significant reactions among university students, who voiced their concerns during protests against the New KUHP. Debates continue regarding the legality of cohabitation, prompting this study to investigate the perception among students in Jambi Province regarding its criminal status. The findings indicate that 55.3% of the 340 respondents from local universities believe cohabitation should not be illegal. They argue that ethical considerations are more pertinent, suggesting that societal and moral sanctions against offenders suffice. Those who contest such views may resort to customary law for civil proceedings against offenders they deem to have transgressed societal norms

Abstract

The use of fine categories is intended to provide a clear pattern for the highest sanctions set for various offenses, in this case offenses against protected animals. Protected animals are animals that are protected by the government. The decision of Jambi District Court Judge is considered to have exceeded the maximum penalty provided for in Article 40 (2) Law Number 5 of 1990 concerning Conservation of Natural Resources and Ecosystems, so that it becomes Article 65 (2) KUHP. The problem discussed in this work is how the judge uses legal considerations in imposing a fine exceeding the maximum limit the amount of the verdict and the judge's consideration in imposing a fine exceeding the maximum pada Putusan Nomor: 401/Pid.Sus.LH/2021/PN Jmb. The research was conducted using a prescriptive legal approach. Data collection was carried out by means of literatures study. This research resulted in conclusions. That is, the judge's decision is considered to exceed the maximum criminal limit of Article 40 (2) Law Number 5 of 1990. Based on the conclusions, it’s recommended that prosecutors be more careful in determining the punishment and be more specific in preparing the prosecution. The need to change the criminal provisions in the judge's decision. Abstrak Tujuan penggunaan kategori denda adalah untuk memiliki pedoman yang jelas mengenai jumlah denda maksimal yang dapat dikenakan untuk berbagai jenis tindak pidana, seperti dalam kasus tindak pidana terhadap satwa yang dilindungi. Satwa yang dilindungi adalah satwa yang mendapatkan perlindungan dari pemerintah. Putusan hakim dari Pengadilan Negeri Jambi dianggap melampaui batas maksimum pidana denda yang ditetapkan dalam Pasal 40 ayat (2) Undang-Undang Nomor 5 Tahun 1990 tentang Konservasi Sumber Daya Alam Hayati dan Ekosistemnya, sehingga bertentangan dengan Pasal 65 ayat (2) KUHP. Fokus dari skripsi ini adalah untuk menganalisis pertimbangan hukum yang digunakan oleh hakim dalam menjatuhkan pidana denda yang melebihi batas maksimum, serta melakukan analisis hukum terhadap pertimbangan hakim dalam kasus Putusan Nomor: 401/Pid.Sus.LH/2021/PN Jmb. Penelitian ini dilakukan melalui pendekatan yuridis normatif dan pengumpulan data dilakukan melalui studi pustaka. Hasil penelitian menyimpulkan bahwa Putusan hakim tersebut melewati batas pidana denda maksimum yang ditetapkan dalam Pasal 40 ayat (2) Undang-Undang Nomor 5 Tahun 1990 tentang Konservasi Sumber Daya Alam Dan Ekosistem. Berdasarkan kesimpulan ini, disarankan agar Jaksa Penuntut Umum lebih teliti dalam menetapkan ketentuan pidana dan menyusun surat dakwaan dengan tepat. Juga diperlukan revisi terhadap ketentuan pidana dalam Putusan hakim yang melampaui batas maksimum pidana denda tersebut.

Abstract

This article aims to analyze the criminal liability of hacktivists in Indonesia. In an increasingly advanced digital era, hacktivism has become a significant phenomenon in cyberspace. Hacktivists are individuals or groups who use hacking techniques to voice socio-political ambitions or convey ideological messages related to issues that occur in society. Specifically, this article concerns how the criminal liability of hacktivists in Indonesia and how the legal policy of criminal liability by hacktivists in Indonesia in the future. As normative juridical research, this article refers to the applicable laws and regulations. The results of this study indicate that hacktivists criminal liability in Indonesia experiences several obstacles, including the absence of specific regulation of hacktivism in legislation and obstacles in law enforcement that affect criminal liability by hacktivists. Therefore, it is necessary to reform the criminal law into legislation so that hacktivism can be specifically sanctioned as well as more effective cybercrime countermeasures. In addition, close cooperation between authorities and law enforcement agencies is needed to improve the ability to deal with cyber attacks and ensure effective criminal liability for hacktivists. Abstrak Artikel ini bertujuan untuk menganalisis pertanggungjawaban pidana hacktivist di Indonesia. Dalam era digital yang semakin maju, hacktivisme telah menjadi fenomena yang signifikan di dunia maya. Pelaku yang melakukan hacktivisme disebut hacktivist, ialah individu atau kelompok yang menggunakan teknik peretasan untuk menyuarakan ambisi sosial politik atau menyampaikan pesan ideologi terkait isu-isu yang terjadi di masyarakat. Secara khusus, artikel ini mempermasalahkan bagaimana pertanggungjawaban pidana hacktivist di Indonesia dan bagaimana kebijakan hukum dari pertanggungjawaban pidana hacktivist di Indonesia ke depannya. Sebagai penelitian yuridis normatif, artikel ini mengacu pada peraturan perundang-undangan yang berlaku. Hasil penelitian ini menunjukkan bahwa pertanggungjawaban pidana hacktivist di Indonesia mengalami beberapa hambatan, antara lain tidak diaturnya hacktivisme secara khusus dalam peraturan perundang-undangan dan hambatan dalam penegakan hukum yang mempengaruhi pertanggungjawaban pidana oleh hacktivist. Oleh karena itu, diperlukan pembaharuan hukum pidana terhadap peraturan perundang-undangan agar hacktivisme dapat dikenakan sanksi secara khusus serta upaya penanggulangan cybercrime yang lebih efektif. Selain itu, diperlukan kerjasama yang erat antara pihak berwenang dan lembaga penegak hukum untuk meningkatkan kemampuan dalam menangani serangan siber dan memastikan pertanggungjawaban pidana yang efektif terhadap hacktivist.

Abstract

The purpose of this article is to formulate the concept of restorative justice which balanced to protect between child offenders and the victims through the diversion (Victim-offender oriented). This goal will be realized through normative research (legal research) based on Restorative Justice concept.  In Law Number 11 of 2012 concerning the Child Criminal Justice System the process (SPPA Law), its prioritizes the Diversion Process (Settlement outside the court) carried out through a Restorative Justice approach. Article 5 paragraph (2) of the SPPA Law states Restorative Justice is the settlement of criminal cases by involving perpetrators, victims, families of perpetrators /victims, and other related parties to jointly to find a fair solution by emphasizing recovery and not based on revenge. Empirical conditions show that balanced legal protection between criminal offenders and victims has not implemented. Evaluation of Law Number 11 of 2012 is needed to formulating the Integrated Child Criminal Court.

Abstract

Penelitian ini bertujuan 1) untuk mengetahui dan menganalisis pengaturan perlindungan hukum pidana terhadap penyebaran data pribadi (doxing) jurnalis di Indonesia dan 2) untuk mengetahui dan menganalisis kebijakan hukum pidana terhadap penyebaran data pribadi (doxing) jurnalis dalam rangka perlindungan data pribadi di Indonesia pada masa yang akan datang. Metode penelitian yang digunakan adalah metode penelitian yuridis normatif dan pendekatan yang digunakan adalah pendekatan perundang-undangan dan pendekatan konseptual dan pendekatan kasus. Analisis bahan hukum yang digunakan dalam penelitian ini dilakukan dengan cara menginterprestasikan, mengevaluasi dan menilai semua peraturan perundang-undangan serta menilai bahan-bahan hukum yang relevan. Hasil penelitian menunjukkan bahwa 1) pengaturan perlindungan hukum pidana terhadap penyebaran data pribadi (doxing) jurnalis di Indonesia bahwa sesuai dengan Pasal 8 Undang-Undang Nomor 40 Tahun 1999 Tentang Pers, yang menentukan bahwa: “Jurnalis/wartawan mendapat perlindungan hukum dalam menjalankan profesinya”, fasilitas perlindungan bagi wartawan pada tingkat undang-undang dijamin; 2) kebijakan hukum pidana terhadap penyebaran data pribadi (doxing) jurnalis dalam rangka perlindungan data pribadi di Indonesia pada masa yang akan datang bahwa kebijakan hukum pidana terhadap penyebaran data pribadi (doxing) jurnalis dalam rangka perlindungan data pribadi di Indonesia pada masa yang akan datang bahwa upaya perlindungan terhadap jurnalis dalam menghadapi tantangan dan serangan siber masih jauh dari optimal. Kelemahan ini disebabkan oleh belum adanya regulasi yang memadai, seperti yang terlihat pada Undang-Undang Nomor 40 Tahun 1999 tentang Pers yang belum secara rinci mengatur mengenai kekerasan berbasis digital. Perlindungan hukum yang masih terpaku pada Undang-Undang ITE juga belum cukup efektif dalam menanggapi kasus kekerasan terhadap jurnalis di ranah digital.

Abstract

Every advancement in artificial intelligence and every application built on it must be accompanied by considerations of law, ethics, and humanity. Complex legal issues are inextricably linked to this quick development. The purpose of this study is to determine, examine, and address the legal liability that results from defects in artificial intelligence. Criminal liability is the primary focus of the artificial intelligence issue. The report offers comprehensive insights into recent legal developments, regulatory initiatives, and suggestions to get over these challenges as a result of this investigation. As a result, this study advances knowledge of the legal dynamics surrounding AI legal liability and encourages more conversation in this field.

Abstract

Program Nawacita adalah suatu program yang diranangkan pemerintah dengan mengedepankan prinsip pembangunan mulai dari pinggir atau level terdekan dengan masyarakat yaitu dari desa dengan memperkuat pembangunan daerah melalui pedesaan. Desa merupakan unsur terkecil dalam pemerintahan Indonesia merupakan ujung tombak terdepan. Melalui Undang-Undang Nomor 6 Tahun 2014 Tentang Desa mengatur tentang alokasi dana desa yang diharapkan dapat mewujudkan otonomi desa. Dana Desa yang mencapai 1 milyar perdesa perlu dikelola dengan baik dan pengawasannya atas pemanfaatannyapun harus dilakukan dengan benar karena dana desa ini berpotensi untuk terjadinya praktik korupsi. Untuk itulah melalui pelaksanaan pengabdian ini diharapkan dapat mencegah terjadinya praktek korupsi atas dana desa di Desa Sungai Bungur Kecamatan Kumpeh Kabupaten Muaro Jambi.

Abstract

Perkembangan peredaran dan penyalahgunaan narkoba saat ini telah mencapai situasi yang sangat mengkhawatirkan, korban penyalahgunaan narkoba di Indonesia semakin bertambah dan merambah pada kalangan masyarakat desa. BNN melalui Deputi Bidang Pencegahan telah melaksanakan berbagai terobosan dan inovasi, antara lain yang menjadi unggulan adalah Program Desa Bersinar (Bersih Narkoba) Oleh karna itu sangat diperlukan peran semua pihak dan stackholder terkait ikut berperan serta melaksanakan program dari BNN dalam rangka mencegah peredaraan dan penyalahgunaan narkoba di Indonesia seperti yang diamanatkan oleh Pasal 104-108 Undang-Undang Nomor 35 Tahun 2009 Tentang Narkotika yang mengatur mengenai Peran Serta Masyarakat. Tujuan dari kegiatan ini adalah menambah pemahaman masyarakat Desa mengenai ruang lingkup Narkotika dan peran serta masyarakat di desa dalam mewujudkan Desa Bersih Narkoba (Desa Bersinar). Kegiatan pengabdian kepada masyarakat ini dilaksanakan di Desa Bungur Kecamatan Kumpeh Ilir Kabupaten Muaro Jambi dengan metode yang dilakukan adalah ceramah dan tanya jawab. Hasil dari kegiatan penyuluhan hukum ini yaitu masih kurangnya pemahaman masyarakat desa mengenai ruang lingkup tentang Narkotika sebagaimana diatur dalam Undang-Undang Nomor 35 Tahun 2009 Tentang Narkotika serta bagaimana peran serta masyarakat khususnya di desa dalam upaya Pencegahan, Pemberantasan, Penyalahgunaan dan Peredaran Gelap Narkotika (P4GN) sehingga terwujudkan Desa Bersih Narkoba (Desa Bersinar). Oleh karena itu tim memberikan materi yang sesuai dengan permasalahan yang dihadapi oleh peserta. Peserta sangat antusias mengikuti kegiatan tersebut. Rekomendasi yang diberikan yaitu Sangat Perlu dibentuknya Relawan Anti Narkoba di desa sebagai upaya preventif penyalahgunaan narkotika guna Komunikasi, informasi dan Edukasi kepada masyarakat dengan bentuk kegiatan seperti penyuluhan, gerakan masyarakat, siskamling dan lain-lain.
