Abstract

Peraturan Presiden Nomor 9 Tahun 2009 tentang Lembaga Pembiayaan menjelaskan pengertian dari anjak piutang yaitu kegiatan pembiayaan dalam bentuk pembelian piutang dagang jangka pendek suatu perusahaan berikut pengurusan atas piutang tersebut. Kegiatan anjak piutang ini dapat dijadikan alternatif bagi pelaku bisnis untuk membantu pembiayaan perusahaan untuk memperlancar aliran pendanaan sehingga perusahaan dapat berjalan dengan baik mampu bersaing untuk meningkatkan kualitas maupun kuantitas produk yang akan diberikan. Pihak-pihak yang terlibat dalam transaksi kegiatan usaha anjak piutang yaitu Klien, customer dan perusahaan factor. Klien merupakan perusahaan yang menjual piutang dagang jangka pendek kepada perusahaan pembiayaan. Customer adalah pihak yang berhutang kepada penjual piutang (klien). Sedangkan Perusahaan Factor, yaitu perusahaan yang melakukan usaha pembiayaan dalam bentuk pembelian dan/atau pengalihan serta pengurusan piutang atau tagihan jangka pendek suatu perusahaan dari transaksi perdagangan dalam atau luar negeri. Dalam kegiatan anjak piutang ketika klien mengalihkan atau menjual piutangnya kepada perusahaan factor harus tetap memperhatikan pertimbangan-pertimbangan yang digunakan. Transaksi penjualan piutang kepada perusahaan factor oleh klien tanpa sepengetahuan customer akan berdampak hukum pada masing-masing pihak. Tanggung jawab dalam perjanjian anjak piutang ini adalah ketika pihak customer yang tidak mampu memenuhi kewajibannya kepada perusahaan factor.

Abstract

The foreign workers are one of the important asset supporting business activities in the globalization era. However, an easy requirement for a foreign worker who works in Indonesia such as dropping language requirement tends to decrease local worker opportunity. The aim of this study to elaborate on the impact of cutting language requirement for foreign workers in new Indonesian regulation. This study uses a comparative approach. The study indicates that Article 36 of the Minister of Manpower Regulation Number 16 of 2015 is contrary to the higher legal norm, namely Article 33 of Law Number 24 of 2009. Based on Stufenbau Theory concerning the Act No. 12 of 2011 concerning the Establishment of Law and Regulation, the lower level will be not applicable. Therefore, revision for the Decree of Manpower Regulation is needed to legal certainty and fairly opportunity for local workers.

Th e creat ionof elect ronic t ransact ions by notaries publ ic is simi lar to de process of creat ingconvent ional notari zed deeds, whereby af ter the draf t i s prepared, the content wi l lbe read out by the notary publ ic to be signed later by the part ies. The signin g part ieswi l l be able to see and read the draf t on the computer screen or the elect ronicmedium in use. And af ter the part ies approve the content , the notary publ ic wi l l askthe f i rst party to sign the deed using the digi tal signature. The notary publ ic t henveri f ies the signature and unt i l al l the part ies af f ix thei r elect ronic signature uponthe deed. Abstract

The purpose of carrying out the elimination of related fiduciary guarantees so that objects that are used as fiduciary collateral objects with the debt fiduciary debt paid off, then the object can be re-registered the same fiduciary guarantee. In the regulations regarding Fiduciary Guarantees namely Law Number 42 of 1999 does not regulate sanctions against parties who are given the mandate by statutory regulations to abolish fiduciary guarantees. The purpose of this paper is to analyze the sanctions against those appointed by the laws and regulations that do not abolish electronic fiduciary guarantees and who can eliminate electronic fiduciary guarantees. This study applies a method which is normative legal research and the approach is the statutory approach. The result of this research is that the sanction given is civil sanction, in the form of a claim for compensation which refers to the provisions of Article 1365 of the Civil Code and the party that can carry out the removal of fiduciary guarantees ie is a fiduciary recipient either through his power of attorney or representative, the attorney referred to is a Notary Public.

Abstract

UUPA tidak mengatur tentang jangka waktu pemberian hak sewa untuk bangunan. Jangka waktu pemberian hak sewa untuk bangunan hanya didasari oleh kesepakatan pihak pemberi sewa dengan pihak penyewa. Merujuk pada Pasal 1548 KUHPerdata disebutkannya “waktu tertentu” menimbulkan pertanyaan terkait apa yang dimaksud dengan waktu tertentu karena pada sewa menyewa tidak perlu disebutkan untuk berapa lama barang itu disewanya, asalkan sudah disetujui harga sewanya untuk satu hari, satu bulan atau satu tahun. Karenanya juga terdapat kekaburan terhadap rumusan Pasal 1548 KUHPerdata terkait dengan apa yang dimaksud “waktu tertentu” dan terhadap mutlak atau tidaknya suatu waktu didalam perjanjian sewa menyewa. Dalam praktek terdapat perjanjian sewa menyewa tanah tertanggal 5 Januari 2005 dengan mencantumkan kalausula seumur hidup dan terhadap perjanjian tersebut telah diputus dan dinyatakan sah oleh Mahkamah Agung dalam putusannya Nomor 2785K/Pdt/2011. Sementara itu menurut Pasal 1339 KUHPerdata suatu perjanjian mengikat juga terhadap kepatutan, kebiasaan dan Undang-Undang. Permasalahan yang dapat diangkat dalam penelitian ini adalah apakah pencantuman klausula seumur hidup di dalam perjanjian sewa-menyewa tanah tertanggal 5 januari 2005 tidak bertentangan dengan asas kepatutan dalam ketentuan pasal 1339 KUHPerdata dan apakah dasar pertimbangan hakim di dalam memutus perkara perjanjian sewa-menyewa tanah yang dilangsungkan seumur hidup pada putusan Mahkamah Agung No. 2785 K/Pdt/2011 telah mencerminkan syarat sahnya perjanjian menurut ketentuan pasal 1320 KUHPerdata Penelitian ini menggunakan metode penelitian hukum normatif dengan jenis pendekatan yang digunakan meliputi pendekatan perundang-undangan, pendekatan kasus dan pendekatan analisis konsep hukum. Sumber bahan hukum yang digunakan dalam penelitian terdiri dari bahan hukum primer, bahan hukum sekunder dan bahan hukum tersier. Teknik pengumpulan bahan hukum menggunakan sistem kartu. Hasil penelitian menunjukan bahwa pencantuman klausula seumur hidup pada perjanjian sewa menyewa tertanggal 5 Januari 2005 tidaklah patut atau bertentangan dengan asas kepatutan didalam Pasal 1339 KUHPerdata dan dasar pertimbangan Majelis Hakim dalam memutus perjanjian sewa menyewa tertanggal 5 Januari 2005belum mencerminkan syarat sahnya perjanjian didalam Pasal 1320 KUHPerdata. Oleh karenan itu kedudukan perjanjian sewa menyewa tertanggal 5 Januari 2005 menurut hukum perjanjian yang berlaku adalah batal demi hukum sehingga tidak memiliki kekuatan untuk mengikat para pihak. Kata Kunci : perjanjian, sewa menyewa, seumur hidup, asas kepatutan.

Abstract

The granting of power of attorney to sell the land rights as an instrument for the fulfillment of the obligations of the debtor in a loan agreement of a notarial deed may commonly be found in the everyday practice of the notaries. Power of Attorney to sell is used by the proxy to sell the land of the authorizer in the event that the authorizer (debtor) experienced defaults. The Civil Law Code and the Law No. 4 of 1996 on Mortgage do not stipulate the power attorney to sell as an instrument in the loan agreement. There are two legal contents analyzed from the vacancy of norms regarding the power of attorney to sell, namely: (1) how the arrangement of power of attorney to sell of the land rights as an instrument for the fulfillment of obligations on the loan agreement in the legislation on the guarantee law and (2) the legal effect of power of attorney to sell the land rights as an instrument for the fulfillment of obligations of the debtor in case of default under the loan agreements in connection with the execution of the law of guarantee. The type of research used in this thesis is a normative legal research with the statutory, concept and case approaches. Based on the research results, it was revealed that the power of attorney to sell is based on the agreement of the parties which make the basis of the principle of freedom of contract. The Power of Attorney Deed shall be valid unless otherwise it is canceled by the judge with a court ruling that has the binding legal force. The use the deed of power of attorney to sell is considered weak because the power of attorney to sell can not be used as a basis for executing security object between the grantor and the recipient of the power of attorney. Deed of power of attorney to sell is deemed not obtain legal certainty because at the time of registration of transfer of land rights, the power of attorney to sell can not be accepted by the local Land Registry Office. Responsibility for the grantor and the recipient of power of attorney is related to the obligations and rights of the grantor and the recipient of the power of attorney. As for the responsibility of the notary who made the deed of power of attorney to sell can be studied from three aspects, namely: (1). Civil responsibility; (2). Administrative responsibility; and (3). Criminal responsibility. Legal remedies that can be taken if the debtor is experiencing defaults can be done by way of a summons in advance without selling the rights of the land owned by the grantor of the power of attorney to sell (the debitor).

Abstract

There are many business activities in the tourism industries in Indonesia. One of them is the provision of services, specifically in Bali. The tourists, who are traveled to Bali, have a desire to invest. Practically, in the provision of services, there are many variants of the business which are not easy to be categorized as a services trading in tourism. It has been mixed with other business variants beyond the tourism services. One of its variants is the development services and the management of property. It was developed with the business scheme and managed with the management of property scheme. The problem is, the seller or the developer offer a tourism accommodation services. The other problem is that property, which has been developed, financed by the foreign buyer. The property is managed by the developer for the provision of tourism accommodation service purposes. Further, the owner of the property got an income from the property management. The parties of this investment model expect that income as a return of their investment. This business model is usually called the return on investment in the tourist accommodation trading services. The type of this research, which used for this thesis, is normative research. It’s researched from The Investment Constitution, the Tourism Constitution, The Construction Services Constitution and some of regulations related with the arrangement of the return on investment. This research was used material sources of law, which are primary legal materials, secondary legal materials and tertier legal material. The result of this research show that the rules about return on investment in the tourist accommodation trading services are not regulated explicitly. The regulation hasn’t been reached that return on investment activities. It causes lot of losses for the foreign investor. The government and the society also get same troubles.

Abstract

Abstract The purpose of this writing is to find out about legal certainty and comparison of power of attorney to impose mortgage rights stipulated in the Notary Position Law No.2 of 2014 with the form stipulated by the Head of Land Agency Regulation No.8 of 2012. This research uses normative legal research methods. The results of this study show that the comparison of authentic deeds according to the Law of Notary Position No.2 of 2014 and the Regulation of the Head of the Land Agency No.8 of 2012 regarding the creation of a power of attorney to impose mortgage rights made before a notary there are differences in the head and end of the deed. The form of power of attorney imposes a security right issued by the State Land Agency of the Republic of Indonesia which is different and not in accordance with the provisions stipulated in the Law of Notary Position No.2 of 2014. Second, the legal certainty of the power of attorney imposes a security right made by a Notary by following format of the Head of the Land Agency Regulation No.8 of 2012, the deed cannot provide legal certainty. The deed will be degraded into a letter under the hand, so that it cannot be used as a basis in making the deed of mortgage imposition, however, the Notary is given the right to add deficiencies to the blank so that it remains an authentic deed. Abstrak Tujuan penulisan ini untuk mengetahui mengenai kepastian hukum serta perbandingan surat kuasa membebankan hak tanggungan yang diatur dalam Undang-Undang Jabatan Notaris No.2 Tahun 2014 dengan Blanko yang ditentukan Peraturan Kepala Badan Pertanahan No.8 Tahun 2012. Penelitian ini menggunakan metode penelitian hukum normatif. Hasil penelitian ini menunjukan perbandingan akta autentik menurut Undang-Undang Jabatan Notaris No.2 Tahun 2014 dan Peraturan Kepala Badan Pertanahan No.8 Tahun 2012 dalam mengenai pembuatan surat kuasa membebankan hak tanggungan yang dibuat dihadapan Notaris terdapat perbedaan pada kepala dan akhir akta. Blanko surat kuasa membebankan hak tanggungan yang diterbitkan Badan Pertanahan Negara-Republik Indonesia berbeda dan tidak sesuai dengan ketentuan yang telah ditetapkan dalam Undang-Undang Jabatan Notaris No.2 Tahun 2014. Kedua, kepastian hukum surat kuasa membebankan hak tanggungan yang dibuat oleh Notaris dengan mengikuti format Peraturan Kepala Badan Pertanahan No.8 Tahun 2012 maka akta tersebut tidak dapat memberikan kepastian hukum. Akta tersebut akan terdegradasi menjadi surat dibawahtangan, sehingga tidak bisa dijadikan dasar dalam pembuatan akta pembebanan hak tanggungan, akan tetapi Notaris diberikan hak untuk menambahkan kekurangan pada blangko tersebut agar tetap menjadi akta autentik.

Abstract

Tujuan dari penelitian ini adalah untuk mengetahui dan menganalisis kewajiban notaris dalam mengenai prosedural dari pemberian bantuan hukum secara cuma-cuma dalam bidang kenotariatan diatur dalam Pasal 37 Ayat (1) Undang-Undang Nomor 2 Tahun 2014 Tentang Jabatan Notaris, isi dari pasal tersebut menimbulkan penafsiran yang berbeda beda antara orang satu dengan orang lainnya yang nantinya dapat menimbulkan ketidakpastian hukum dengan Peraturan Perundang -Undangan lainnya yang mengatur mengenai kewajiban pemberian bantuan hukum secara pro bo no publico yang khusus dilakukan oleh notaris sebagai kewajibannya berdasarkan UUJN-P. Penelitian ini menggunakan penelitian hukum normatif dengan menggunakan pendekatan perundang-undangan dan pendekatan konsep dengan cara analisis bahan hukum dilakukan secara deskriptif yaitu analisis yang diperoleh dari bahan hukum sekunder dan didukung oleh bahan hukum primer peraturan perundang-undangan dalam ranah profesi jabatan Notaris. Hasil pembahasan dalam penelitian ini bertujuan untuk mengetahui bagaimana penagturan pemberian jasa bantuan hukum secara Pro Bono Publico bagi klien kurang mampu dan hambatan serta tantangan dalam pemberian bantuan hukum secara Pro Bono Publico oleh Notaris The purpose of this study is to find out and analyze the obligations of a notary regarding the procedural provision of free legal assistance in the notary field regulated in Article 37 Paragraph (1) of Law Number 2 of 2014 Concerning the Office of a Notary, the contents of the article give rise to interpretations which differ from one person to another which can later lead to legal uncertainty with other laws and regulations which regulate the obligation to provide legal assistance pro bo no publico which is specifically carried out by a notary as his obligation under UUJN-P. This study uses normative legal research using statutory and conceptual approaches by means of descriptive analysis of legal material, namely analysis obtained from secondary legal material and supported by primary legal material of statutory regulations in the realm of the Notary profession. The results of the discussion in this study aim to find out how the provision of pro bono publico legal aid services for underprivileged clients and the obstacles and challenges in pro bono publico legal aid provision by notaries

Abstract

There are 23 small dams in Ende Regency that have experienced decline in function which affects the purpose of building the reservoir, namely to fulfill the needs of household clean water, crops, and livestock. The research aims to evaluate the performance of small dams in Ende Regency based on four aspects, physical aspects, utilization aspects, operational and maintenance (O&M) aspects and organizational management aspects. The performance of the reservoirs in terms of physical aspects using the Observation and Documentation Method, utilization aspects, O & M aspects and organizational management aspects using the Questionnaire Method. The results obtained the percentage of small reservoir performance in terms of physical aspects with unfavorable reservoir conditions amounted to 62.62%. The percentage of utilization aspects is 53.60%. The percentage value of the O & M aspect of 55.40% is not good. The percentage of organizational management aspects is 51.83% in poor condition. From the four aspects reviewed, it was found that the performance of small dams in Ende Regency had decreased founction by 62,62%. The solution to overcome the decline in the function of the small dams is the rehabilitation of the components of the dam, improvement of road access and subsidies and the establishment of a water user organization to coordinate all activities related to harvesting
