Abstract

The pornography crime through the internet is regulated in Article 27 paragraph (1) of the ITE Law. The difficulty in investigating is collecting evidence to determine suspects from pornography crimes through the internet. This research is legal research with analytical descriptive specifications. The results of the study show that the investigator's technique and tactics in determining suspects in pornography crimes through the internet is by first proving the existence of errors or elements of harmony from the person who became an actor in the pornographic video and the mistake of the perpetrator who recorded and distributed the video. There is a possibility that the two involved can be made suspects. The obstacle in determining suspects in pornography is that there are no witnesses who know directly.

Abstract

The Community in Culture is an agency that is a community within society which has an important role in maintaining and protecting cultural diversity, local wisdom, and forming local arts in the Riau Islands. Apart from that, we also want to know what are the inhibiting factors in maintaining local culture and the factors that support the implementation of local culture preservation by the cultural service. This research is descriptive research with qualitative research methods, namely collecting data from interviews with participants and also documentation. The results used in this research have an important aim for the cultural community in increasing cultural diversity in the Riau Islands by holding cultural festivals, namely increasing the potential of local culture by inviting people to see cultural heritage exhibitions in the Riau Islands, which aims to provide useful experiences and insights. more to the community and increase public awareness of the importance of local culture which must be preserved.

Abstract

Indonesia is an archipelagic country. The possibility of an ideal abundance of fish can bring prosperity to the human life of a fisherman. However, in reality, this natural wealth cannot be obtained immediately by guaranteeing the creation of wealth for the lives of fishermen who live in coastal areas. Fishermen's dependence on tauke not only impacts economic transactions, but also impacts coastal communities. In this research, the author used a qualitative research method by collecting data, namely conducting interviews with fishermen regarding their dependence on tauke and conducting observations in Mantang Lama Village. From the results of the interview above in terms of facilities for worker fishermen to repair their own bots using capital from the tauke. This will also have an impact on the inseparability of working fishermen who are always tied to the tauke because of these things. One of the fishermen's dependence on tauke is borrowing money. Because the majority of fishermen in Mantang Lama Village do not have other jobs. Fishermen's dependence on tauke means they are trapped in complex patterns of cooperation. Starting from capital loans to production sharing agreements, these relationships create dependencies that are difficult for fishermen to break away from.

Abstract

The Independent Curriculum is here as a response to the need for contextual and flexible education with the main goal of developing students' potential holistically. This article aims to evaluate the implementation of the Independent Curriculum in increasing students' creativity and independence through a literature review from various trusted sources. The approach used is qualitative with the library research method and PRISMA analysis. The results of the analysis show that the Independent Curriculum is able to encourage students to think creatively, take initiative, and be more responsible in the learning process. Project-based learning, collaboration, and problem solving are key approaches in fostering these two aspects. This evaluation underlines the importance of support from teachers, schools, and education policies in ensuring the effectiveness of the curriculum.ABSTRAKKurikulum Merdeka hadir sebagai respons terhadap kebutuhan pendidikan yang kontekstual dan fleksibel dengan tujuan utama mengembangkan potensi siswa secara holistik. Artikel ini bertujuan untuk mengevaluasi implementasi Kurikulum Merdeka dalam meningkatkan kreativitas dan kemandirian peserta didik melalui kajian literatur dari berbagai sumber terpercaya. Pendekatan yang digunakan adalah kualitatif dengan metode library research dan analisis PRISMA. Hasil analisis menunjukkan bahwa Kurikulum Merdeka mampu mendorong siswa untuk berpikir kreatif, mengambil inisiatif, serta lebih bertanggung jawab dalam proses belajar. Pembelajaran berbasis proyek, kolaborasi, dan pemecahan masalah menjadi pendekatan kunci dalam menumbuhkan kedua aspek tersebut. Evaluasi ini menggarisbawahi pentingnya dukungan dari guru, sekolah, dan kebijakan pendidikan dalam memastikan efektivitas kurikulum.

Abstract

If we define the provisions of Article 5 and General Elucidation number III (1) of Law Number 5 of 1960 on the Basic Agrarian Principles (UUPA), it can be concluded that the applicable Agrarian law is customary law, as long as it does not conflict with national and state interests. In the context of West Sumatra, according to Minangkabau Customary Law, all land and forests from a single tree, a single stone to a single blade of grass, from the height to the sky and the depth to the bowels of the earth are ulayat. This means that ulayat rights can be in the form of natural resources including land to the underground and space above the territory of indigenous peoples. Article 19 paragraph (1) of Law Number 5 of 1960 concerning Basic Agrarian Principles has actually instructed from the beginning that to ensure legal certainty by the Government, land registration is carried out throughout the territory of the Republic of Indonesia according to the provisions regulated by Government Regulations, including here, namely tanah ulayat. Government Regulation No. 18 of 2021 concerning Management Rights, Land Rights, Flat Housing Units, and Land Registration opens up opportunities for tanah ulayat to be registered and granted management rights over it. To uphold this regulation, in 2021 the Ministry of ATR/BPN in collaboration with the Faculty of Law, Universitas Andalas organized an inventory and identification of tanah ulayat nagari in West Sumatra Province and was then followed up with Pilot Project activities that are currently underway, one of those activities is in Nagari Sungayang, Tanah Datar Regency. This activity aims to provide legal certainty to the tanah ulayat of the indigenous people of Nagari Sungayang, Tanah Datar Regency so that the rights of indigenous people are protected.

Abstract

PBB-P2 is a tax whose delegated authority is transferred to the Regency / City Government. Kerinci Regency Government began applying the Land and Rural Land and Urban Tax collection from January 1, 2014. This research was conducted to find out how the implementation of tax collection of earth and rural and urban buildings in Detailed District and to find out how its contribution to the original revenue area in Kerinci regency. This research uses primary data in the form of interview result as main data, and secondary data as supporter. Based on the result of this research, it is found that the taxation of earth and rural and urban building in Kerinci Regency has not run optimally, because the officer has not consistently run the regulation, so that its contribution to the local revenue is not optimal only about 1.23% in 2014 and 1.19 % By 2015.

Abstract

Pengadilan Internasional (International Court of Justice) mewakili salah satu organ utama Perserikatan Bangsa-Bangsa. Ini bisa menyelesaikan perselisihan yang terjadi antara anggota Perserikatan Bangsa-Bangsa. Pengadilan Internasional karena peradilan internasional memainkan banyak peran dalam membantu menyelesaikan perselisihan Bangsa-Bangsa. Sampai sekarang, Pengadilan tetap eksis dan dipilih oleh Negara karena keputusan dari Mahkamah Internasional yang kuat, mengikat secara hukum dan tidak dapat diajukan banding. Selain itu, hakim terdiri dari hakim yang memiliki reputasi tinggi dan ahli internasional sehingga perselisihan jaminan akan selesai dengan adil dan sesuai dengan prinsip Hukum Internasional.

Abstract

Berdasarkan penelitian awal terhadap Putusan No. 02/PDT.G/2014 /PN.PSB Tentang Kesepakatan Pemasangan Jaringan Indosat Conectivity Solution sebagaiakibat sengketa antara Pemerintahan Daerah Pasaman Barat dengan CV. Citra Sahabat. Bagi pihak Pemerintahan Daerah Pasaman Barat, Nota Kesepakatan yang ditanda tangani belumlah bisa disebut sebagai sebuah perjanjian, hingga membawa akibat hukum yang tidak mengikat. Sementara pihak CV. Citra Sahabat menganggap Nota Kesepahaman tersebut sebagai awal perjanjian.

Abstract

Article 46 of Law Number 32 Year 2009 concerning the Management of Environmental Protection stipulates that a Criminal Account shall be liable to any person of the Legal Entity and / or its Management. Criminal proceedings that have been broken off at the Padang Pariaman District Court where the criminal responsibility is by the corporate management. The problem is the consideration of the judge in the decision of the Mining crime committed by the corporation and the implementation of the corporation accountability system against environmental damage that occurred in the mineral mining area in Padang Pariaman Regency, West Sumatera Province. Research specification is analytical descriptive with Normative juridical approach. The data obtained were analyzed qualitatively. The results of the first study and discussion, Judge's Consideration in Decision Number 190 / Pid.Sus / 2016 / PN.Pmn and Decision No. 90 / PID.SUS / 2017/ PT.PDG the defendant fulfilled the element as the subject of criminal law of the deeds he committed. Defendant as the board (Director) of the corporation. Board is considered as a form of corporation. Second, corporate criminal liability in Decision Number 190 / Pid.Sus / 2016 / PN.Pmn and Decision No. 90 / PID.SUS / 2017 / PT.PDG sentenced to criminal is his company represented by the director of the company. Corporal criminal liability can be demanded through the doctrine of superior responders or vicarious liability.

Abstract

Pasal 6 Peraturan Kepala Kepolisian Negara Republik Indonesia Nomor 2 Tahun 2017 tentang Tata Cara Pemberian Bantuan Hukum Oleh Kepolisian Negara Republik Indonesia. Penelitian ini merupakan penelitian hukum dengan spesifikasi yang bersifat deskriptif analitis. Pelaksanaan pemberian bantuan hukum oleh Bidang Hukum Kepolisian Daerah Sumatera Barat kepada anggota Polri yang melakukan tindak pidana pada saat menjalankan tugas kedinasan adalah dengan cara mengajukan permohonan tertulis dengan menyertakan kronologis kejadian kepada Kapolda Sumbar untuk diberikan bantuan hukum dan didampingi di persidangan. Setelah permohonan tadi disetujui barulah dikeluarkan Surat Perintah kepada Penasehat hukum/Kuasa Hukum/Pendamping yang ditugaskan. Pemohon selanjutnya memberikan Surat Kuasa kepada Penasehat hukum/Kuasa Hukum/Pendamping yang ditugaskan. Kapolda Sumbar memberikan dukungan melalui Personil Bidkum Polda Sumbar untuk memberikan Bantuan hukum. Kendala dalam pelaksanaan pemberian bantuan hukum oleh Bidang Hukum Kepolisian Daerah Sumatera Barat kepada anggota Polri yang melakukan tindak pidana pada saat menjalankan tugas kedinasan adalah kekurangan Tenaga penasehat hukum.Tidak adanya koordinasi yang jelas antara Kepolisian dengan Advokat yang disewa oleh tersangka sendiri. Optimalisasi Dalam Pemberian Bantuan Hukum Oleh Bidang Hukum Kepolisian Daerah Sumatera Barat Kepada Anggota Polri Yang Melakukan Tindak Pidana Saat Menjalankan Tugas Kedinasan adalah dengan mengadakan stimulan untuk Advokat pada bidang hukum Polda dan Melakukan pengawasan dalam Pemberian Bantuan Hukum.
