Abstract

The purpose of this study is to determine the judge's considerations in case decision number 451/Pdt.G/2012/PN.Jkt.Bar is related to the responsibilities of a notary in the process of making an authentic deed using a foreign language format and what are the responsibilities of a notary in the process of making an authentic deed by using a foreign language format associated with case number 451/Pdt.G/2012/PN.Jkt.Bar. The research method used is Normative Juridical, namely an approach that is based on the main legal material by examining the theories, concepts, legal principles, and laws and regulations related to this research. The results of the research study show that regarding the responsibilities of a notary in the process of making an authentic deed using a foreign language format are linked to case number 451/Pdt.G/2012/PN.Jkt.Bar, stating that a deed that is not made by statutory regulations can result in a deed only having the power of proof under the hand or even null and void.

Abstract

A mixed marriage will bring legal consequences to the parties who do it, namely related to property in the marriage. The joint assets formed during the marriage are not only located in the territory of Indonesia, but also located abroad (Singapore). This study examines the position of joint assets in mixed marriages located outside the territory of Indonesia who filed for divorce and property claims in the District Court. The purpose of this article, which is based on the results of this research, aims to determine legal certainty regarding the status of joint property in mixed marriages located abroad (Singapore) based on Decision No. 552 / Pdt.G/2013/PN.Dps) by Judge. The research method used in this study is a normative legal research method with a source of law, namely statutory regulations. The research method used is a normative juridical approach. Research specifications use analytical descriptive and data sources use secondary data consisting of primary legal materials, secondary legal materials, and tertiary legal materials. Materials from the results of this study indicate that joint assets located abroad (Singapore) are subject to the Indonesian Judge's decision. In the eligibility conditions in the Strata Title rules that apply in Singapore, the holder of a Permanent Resident permit has the right to transfer or sell property located in that country.

Abstract

Differences in legal systems between countries give rise to various basic rules regarding international trade contracts. Efforts made to harmonize this were by holding an international convention by The International Institute for the Unification of Private Law (UNIDROIT) which gave birth to The UNIDROIT Principles of International Commercial Contracts (UPICCs). UPICCs are actually used as a legal basis for implementing international trade contracts. The formulation of the research problem is how is the principle of freedom of contract, the principle of good faith and fair dealing regulated in international law and national law?, and what are the challenges of implementing the UNIDROIT principle in international trade contracts in Indonesia? ? This research is normative legal research and is analytical descriptive. The results of the research are that international law regulations regarding the principle of freedom of contract, the principle of good faith and fair dealing are regulated by UPICCs. Meanwhile, regulations in national law can be seen in the Civil Code and the ITE Law. S Because the UPICCs regulate many matters that are not detailed in Book III of the Civil Code, the challenge is the unification and codification of contract law to provide legal certainty, with uniform provisions that can be universally accepted by countries involved in international trade.

Abstract

Permasalahan yang sering terjadi adalah Perjnajian Pengikatan Jual Beli tidak dapat ditingkat menjadi Akta Jual Beli dikarenakan Pihak Penjual meninggal dunia dan sebahagian dari ahli warisnya meminta pembatalan terbahadap PPJB tersebut. Berdasarkan ketentuan ahli waris para pihak dikemudian hari menggantikan hak dan kewajiban yang meninggal dunia. Ketentuan yang diatur dalam Pasal 1318 KUHPerdata tersebut, yakni para ahli waris ab intestato hanya merupakan satu kategori dari golongan yang memperoleh hak karena titel umum. Ketentuan tersebut diatur dalam Pasal 833 ayat (1) KUHPerdata tentang ahli waris ab intestato. Penelitan ini menggunakan metode yuridis empiris. Hasil penelitian yang diperoleh yaitu 1. Kedudukan hukum ahli waris dalam PPJB yang dibatalkan secara sepihak oleh ahli waris, Hak dan kewajiban pewaris secara otomatis menjadi hak dan kewajiban ahli waris, sekalipun ahli waris tersebut tidak mengetahui adanya pewarisan, Ahli waris menempati kedudukan si meninggal dalam hal yang menyangkut atas segala barang, segala hak, dan segala piutang dari pewaris, sekaligus berkewajiban membayar utang dan kewajiban-kewajiban pewaris. 2. Akibat hukum pembatalan PPJB secara sepihak oleh ahli waris pengembalian pada posisi semula sebagaimana halnya sebelum terjadi perjanjian yang diatur dalam Pasal 1451 dan 1452 BW. Pihak yang merasa dirugikan atas pembatalan dapat menuntut penggantian biaya (kosten), ganti rugi (schaden), dan bunga (interesten) karena tidak terpenuhinya suatu perikatan. Sedangkan pihak lainnya yang telah terlanjur menerima prestasi dari pihak lain wajib mengembalikannya. 3. Perlindungan hukum terhadap pembeli dalam hal PPJB yang secara sepihak dibatalkan oleh ahli waris bahwa pihak pembeli memiliki kekuatan pembuktian dari akta PPJB yang dibuat oleh notaris dihadapan pengadilan. Pihak pembeli dapat mengajukan tuntutan untuk para ahli waris melaksanakan akta jual beli.

Abstract

Complete Systematic Land Registration (PTSL) is a national strategic project that aims to realize the provision of legal certainty and legal protection of community Land Rights based on the principles of simple, fast, smooth, safe, fair, equitable and open and accountable, so as to improve the welfare and prosperity of the community and the country's economy, as well as reduce and prevent land disputes and conflicts. To accelerate the implementation of registration of all land areas in Indonesia in 2016 a Circular Letter was issued by the Minister of ATR / Head of BPN Number 1756 / 15.I / IV / 2016 concerning Guidelines for the Implementation of Land Registration which is essentially about simplifying the basis of rights for land registration. In this case, for proof of ownership of customary land owned by the Bukittinggi customary law community, some use customary sales and purchase letters. Based on this, the author is interested in conducting research with the formulation of the problem, namely: How is the process of making customary land sales and purchases in Bukittinggi City? How is the process of first land registration through PTSL with customary land sale and purchase rights at the Bukittinggi City Land Office and, How is the process of first land registration through PTSL with customary land sale and purchase rights after the realization of Complete City Mapping in Bukittinggi City. And the purpose of the study is to study and analyze the process of making customary land sales and purchases in Bukittinggi City, to study and analyze the process of first land registration through PTSL with customary land sale and purchase rights at the Bukittinggi City Land Office, and to study and analyze the process of first land registration through PTSL with customary land sale and purchase rights after the realization of Complete City Mapping. The research method is an empirical legal approach method (emphrical legal research), the nature of this research is descriptive. The conclusion is that the PTSL process with the basis of customary land sale and purchase certificates can be used at the Bukittinggi City Land Office and is equipped with a statement of physical control of the land area, and for the land registration process through PTSL after Bukittinggi City is Complete, physical data collection in the form of measuring land areas in the field is no longer carried out, but only legal data collection is carried out.

Abstract

The implementation of the ISO 14001 standard by the World Trade Organization (WTO) has been regulated in the Technical Barriers to Trade (TBT) Agreement (Annex 1A WTO). ISO 14001 is an Environmental Management Standard (EMS) issued by the International Organization for Standardization (ISO). ISO is one of the organizations that determine the international standard. The standard set by ISO has been utilized to equalize the standard of the WTO members in world trade (Preamble TBT Agreement). The WTO is an international organization regulating world trade to ensure it flows smoothly. TBT oversees that the technical regulations and standards, including packaging, marking and labelling requirements, and procedures for assessment of conformity with technical regulations and standards do not create unnecessary obstacles to international trade. One of the standards ISO sets in world trade is ISO 14001, the Environmental Management System (EMS). The WTO has decided that the EMS standard is one of the requirements for goods and services to be traded internationally. Several developing countries of the WTO members consider EMS a breach of the TBT Agreement conducted by developed countries. Export demands using ISO 14001 are considered to be contrary to the non-discrimination principle of the WTO free trade system, as EMS is merely a non-compulsory standard regulated as a mandatory trade requirement by developed countries. Indonesia as a member of both ISO and the WTO has had its own record in implementing the policies of these organizations. This article will discuss the practice of ISO 14001 in the member states of the WTO, including Indonesia as sample of it implementation.

Abstract

Using inorganic fertilizers can increase crop productivity, but excessive and continuous use can degrade soil and cause environmental pollution. To overcome this problem, compost from lamtoro (Leucaena leucocephala) leaves can be an environmentally friendly alternative solution. This activity aims to explain the process of making lamtoro leaf compost and its impact on soil fertility and plant growth. Through this activity, organic fertilizer has been produced in the form of compost from lamtoro leaves and wood dust, which is suitable for use as fertilizer. The manufacturing process includes collection, chopping, mixing with an organic activator, and fermentation until the compost is mature. From this activity, students can gain a direct understanding of compost production and the importance of using local organic materials for sustainable agriculture.
