Abstract

Development the law of obligations and guarantees is related to local wisdom through the applications of norms related to vocal values and traditions. The development of engagement and guarantee concepts can reflect aspects of local wisdom, such as social values, culture or custom recognized in a particular community. By using normative research methods that focus on research that uses legal sources, statutory regulations and legal documents relating to wisdom in resolving land problems in the Ngadhu-Bhaga Community In Ngada Regency. Local wisdom of the Ngadhu-Bhaga Community In Ngada Regency, East Nusa Tenggara, land isssues are an important matter and are closely related to everyday life. In resolving land issues, the Ngadhu-Bhaga Community has methods in accordance with customs and cultural heritage that have been known for a long time.

Abstract

Reflecting aspects of local wisdom, such as social values, culture or customs recognized by the local Tana Toraja community. Toraja is an area that has many very unique cultural traditions. One of them is the mantunu tedong ritual, which can be said to be one of the rituals that native Toraja people are certainly proud of. By using normative research methods that focus on research that uses legal sources, statutory regulations, local regional regulations, and legal theory and legal documents relating to wisdom in completing the Matunu Tedong agreement which occurred during the Rambu Solo event in Tana Toraja, South Sulawesi regarding the agreement in the Matunu Tedong event which is one of a series of customs in the Rambu Solo event. In completing this agreement, the Tana Toraja people have methods in accordance with customs and cultural heritage that have existed for a long time.

Abstract

Penelitian ini bertujuan untuk mengetahui Tanah merupakan salah satu sumber daya alam yang penting bagi kelangsungan hidup manusia, hubungan antara manusia dengan bumi tidak hanya kehidupan saja, melainkan bumi juga dapat menyediakan kelangsungan hidup bagi manusia.Peranan tanah bagi kehidupan manusia sangatlah penting, karena setiap orang dalam hidupnya membutuhkan tanah sampai mati dan mengingat susunan kehidupan dan struktur ekonominya yang sebagian besarnya masih bersifat agraris. Tanah dalam karakteristik status Indonesia sebagai negara agraris memegang peranan penting dalam berbagai aspek kehidupan masyarakat, baik dalam kehidupan ekonomi maupun sosial. Undang-Undang Dasar Negara Republik Indonesia Tahun 1945 menetapkan dalam Pasal 33 ayat (3): “Bumi, air dan kekayaan alam yang di kandungnya dikuasai oleh negara dan dipergunakan untuk sebesar-besar kemakmuran rakyat”. Abstract

The increasing population density often leads to differences in views that can eventually trigger disputes, including disputes related to land. Based on the increasing population level, of course the need for land as a place to live and make a business is getting narrower because the land has been controlled by other communities, while other communities also need land to carry out the same activities, this is where the dispute occurs. The method used in this research is empirical juridical research. The results show that the characteristics of dispute cases that occur in Oel'ekam Village include inherited land disputes, customary land disputes and land boundary disputes. The form of local wisdom in the Oel'ekam Village community is oko mama and the advantages of this alternative resolution are that the settlement is quickly realized, low cost, confidential and unemotional while there are also weaknesses, namely the execution mechanism which is difficult because the way to execute the decision, depends on the good faith of the parties to resolve the dispute to completion and the mediator will not bring good results especially if insufficient information and authority is given to him.

Abstract

This paper discusses the existence of Lonto Lèok local wisdom as an alternative in resolving disputes over land rights status in Deno Village, South Lamba Leda District, East Manggarai Regency, East Nusa Tenggara. This research aims to identify the history of land disputes, as well as understand the application of Lonto Lèok in resolving conflicts. The method used is a case study with a qualitative approach, including in-depth interviews, participatory observation, and documentation studies. The results showed that Lonto Lèok is still relevant in Manggarai society, functioning as a forum for deliberation to reach a binding agreement. This process not only strengthens social relations, but also creates a peaceful atmosphere in dispute resolution, prioritizing family values and unity. Therefore, the revitalization of Lonto Lèok is necessary to face modern challenges, ensuring that local wisdom values remain alive and functioning in the evolving social context

Abstract

Disputes or problems that arise in human life often require resolution to maintain peace and social harmony. One of the ways of resolving disputes that is still applied in the people of Belu Regency is through Hakohik customary law, which is a tradition of fighting or struggle between two opposing parties. This customary law is used to resolve disputes, both criminal ones, such as insults or slander, as well as non-criminal disputes, such as land disputes or infidelity. In dispute resolution using Hakohik, both parties involved traditional elders to decide the case customarily, by involving certain rituals and procedures that have a deterrent effect. This process aims to restore the honor and dignity of those who feel aggrieved, as well as to maintain solidarity and peace in indigenous communities. Although this method has existed for hundreds of years, Hakohik is still accepted and used as a dispute resolution system that is considered effective by the Tetun people in Belu Regency. Through this research, it is hoped that it can provide a deeper understanding of the role and mechanism of Hakohik customary law in the indigenous people of Belu Regency, as well as its relevance in dispute resolution in the modern era

Abstract

The Poka Indigenous People are part of the Manggarai community, also practicing matters related to Manggarai culture such as resolving land disputes between community members. This research was conducted to find out the role of Tu'a Golo in resolving disputes among the Indigenous People of the Poka Village, Longko Village, Wae Ri'i District, Manggarai Regency. Based on the results of the study, the role of Tu'a Golo in the Poka Indigenous People is to: Regulate and manage the socio-economic and cultural life of the community and resolve land boundary disputes of the Poka indigenous people. The role of Tu'a Golo in resolving land boundary disputes is as follows: 1) The role of Tu’a Golo in the dispute between Benyamin Bago and the Manggarai Regency Government. In this case, Tu'a Golo was presented by the police only as a witness. 2) The role of Tu’a Golo in the dispute between Alosius Sema and Benyamin Bago, namely: receiving and assessing community reports regarding the disputed dispute, leading the lonto leok event in resolving cases, summoning tu'a-tu'a panga and witnesses, leading the event of reviewing the location of cases, deciding cases, being a witness in a case. The decision of the old golo regarding the land boundary dispute between Alosius Sema and Benyamin Bago has binding force and applies to the parties, but is not final. According to the researcher, Tu’a Golo decision in the dispute between Alosius Sema and Benyamin Bago fulfilled the element of justice.

Abstract

Peraturan desa menjadi salah satu peroblema hukum dibidang ketatanegaraan karena dalam pembuatan/penyusunan peraturan desa banyak pihak terkait yang harus berperan dan bekerjasama untuk bersama-sama menyusun peraturan desa terutama pemerintah desa beserta perangkat desa lainnya serta warga masyarakat desa. Peraturan desa yang dibuat/diterbitkan tanpa melibatkan warga desa setempat pada dasarnya tetap memunyai kekuatan hukum yang kuat, namun terkadang sulit diterima oleh masyarakat akibatnya pelaksanaan peraturan desa tidak terlaksana secara efektif dan terkadang mengundang protes dari masyarakat desa setempat. Fenomena terkait peraturan desa yang tidak melibatkan masyarakat desa setempat dalam proses penyusunannya seringkali menjadi suatu persoalan yang dihadapi oleh masyarakat desa khususnya di Desa Bitefa Kabupaten Timor Tengah Utara. Oleh karena itu peran tim pelaksana pengabdian kepada masyarakat diperlukan agar dapat memberikan sosialisasi/pelatihan terkait pembuatan peraturan desa sebagai produk hukum desa yang menjadi landasan dalam penyelenggaraan pemerintahan desa. Tujuan pengabdian kepada masyarakat ini adalah mensosialisasikan tentang pembuatan peraturan desa kepada perangkat desa dan masyarakat desa agar tidak terjadi kekeliruan dalam pembuatannya. Metode pengabdian kepada masyarakat yang digunakan adalah dengan 2 tahapan yakni sosialisasi dan pelatihan pembuatan peraturan desa. Luaran pengabdian kepada masyarakat adalah publikasi pada jurnal nasional.

Abstract

PT Timor Tour & Travel is one of the travel agency business actors that provides services for transportation services that are responsible for service passengers if things happen that are detrimental to passengers due to negligence committed by the company. In Indonesia itself, Law Number 22 of 2009 concerning Highway Traffic and Transportation has been in force which regulates the responsibilities of business actors in carrying out their business activities. Responsibilities need to be considered because it raises questions about who should be burdened with guilt and to what extent this accountability burden it. So because of that the authors conducted research with the title Responsibilities of PT Timor Tour & Travel Kupang agents for passengers of travel user services. This study aims to identify and explain the implementation of the responsibilities of PT. Timor Tour & Travel Kupang Agent for users of travel services and obstacles from PT. Timor Tour & Travel Agent Kupang in carrying out duties. The approach used is a statutory and contextual approach. The population in this study are managers of PT. Timor Tour & Travel, drivers and users of travel services. The analysis technique used is descriptive qualitative. The results of the research show that the implementation of PT. Timor Travel loads passengers at their destination comfortably and is also happy to be responsible for compensating passengers for user services according to applicable regulations, namely Law NO. 22 of 2009 concerning Highway Traffic and Transportation and the principle of responsibility based on presumption, but the implementation in the field has not been in accordance with the facts and looks more at evidence of losses suffered by passengers. Obstacles in accountability can be seen from poor communication in resolving problems between the PT and the passenger, with the rules made by the PT that do not pay much attention to the losses suffered by the passengers. The conclusion of this study is the implementation of responsibilities in general and compensating for players who are harmed by the company, but the company sees more written evidence of losses suffered by passengers. can solve existing problems. The advice given by the author is that in carrying out the responsibilities of the company, it must carry out according to the rules contained in the UULLJR and the principle of responsibility based on presumption with the burden of proof being reversed. and The troubled parties as well as PT or passengers should have good communication to be able to resolve existing problems. So that there are no obstacles in the implementation of responsibilities.
