Abstract

This study analyzes the legal relationship of engagement to local wisdom in East Manggarai district. The method used in this research is a qualitative approach whose data collection is through observation and interviews. The purpose of this study was to find the relationship between the law of engagement and the local wisdom of providing interest-bearing loans (Célong Séng Bunga) in East Manggarai district. The existence of engagements and guarantees in providing loans to people in need is the basis of the existence of this zinc interest celong system, but in the past the community still did not know that there was a connection between the activities of this zinc flower celong with the engagement and guarantees contained in the Civil Code. With the zinc celong system, this interest on lending and borrowing helps local communities in fulfilling the agreements they make. Interest-Bearing Loan System, Agreement Fulfillment, Local Wisdom

Abstract

Exploring the relationship between contractual law and the local wisdom of "Tura Jaji" is an intriguing subject as it demonstrates how principles of mutual assistance and collective willingness interact with concepts of contractual law governed within a formal legal system. In conducting this research, an empirical method with a sociological approach will be used to observe the relationship between contractual law and the "Tura Jaji" agreement. This study will utilize concrete data or evidence from the real world to understand social phenomena. "Tura Jaji" is one of the cultural practices held by the ethnic Lio community in Ende Regency. The principles embodied in this agreement serve as a moral foundation underlying interactions among individuals, fostering an atmosphere of trust, respect, mutual support, mitigating tribal limitations that often cause divisions, and promoting a sense of unity that solidifies and preserves a cohesive community. "Tura Jaji" is inclusive of an agreement generating obligations between the Lies and Mbengu ethnic groups. It is hoped that both the community and readers actively engage in promoting, supporting, and expanding understanding of the significance of "Tura Jaji" as an inseparable part of daily life. By participating in cultural activities involving "Tura Jaji," collectively, we can ensure that the values embraced within this agreement remain relevant and sustainable within the dynamics of modern society

Abstract

Engaging in warfare that encompasses cultural intricacies is far more deadly due to its repetitive nature and glorified heritage. Similar sentiments also apply to duels in the Adonara-East Flores-East Nusa Tenggara islands which are even more severe and magnificent because they are also considered heritage. Adonara is a small island with a long history of war crimes. Island communities generally consider conflict as a way to resolve problems, especially those related to women's issues and territorial/land disputes.

Abstract

Credit is the provision of money or bills that can be equated with it, based on a loan agreement or agreement between a bank and another party that requires the borrower to pay off his debt after a certain period of time with interest. The problems that arise when there is bad credit or bad credit are the risks contained in every credit provided by the bank. The risk is that the debtor has difficulty fulfilling the obligation to return credit on time. The inability of debtors to pay their debts has a negative impact on creditors as credit distributors. This study aims to determine the causes that result in bad credit from debtors of Bank NTT Kupang Main Branch, and find out how the settlement process is. This study uses empirical juridical research with statutory, conceptual, and sociological approaches. The causes that affect bad credit are intentional elements, namely the debtor consciously does not want to pay his credit and intentional elements, namely the existence of force majeure. The creditor has the right to use the executorial title as stated in the fiduciary guarantee certificate, if the debtor defaults. Creditors also have the right to sell objects that are objects of fiduciary guarantees through public auctions and settlement of receivables from sales or private sales which are carried out based on a mutual agreement between the creditor and the debtor

Abstract

One of the local wisdom in Manggarai that relates to agreement or engagement is the ijon system. Basically, the ijon system is asystem of agreement or trade ia an item that arises in the community that is not clear about the goods or thre results that will be obtained. The method that is appropriate or has relationship with the material that we will discuss, namely the descriptive research method. Descriptive research method is research that aims to describe something is acertain area and at a certain time. Usually in this reseach the research already gets or already has a picture in the form of initial data about the problem to be studied. Buying and selling coffee with a bond system is not made in writing but is only confirmed by the buyer’s deposit receipt. In the practice of the coffee bond system in Colol village, two parties are involved, namely: 1. Coffee Farmers 2. Ijon Buyers/Middlemen to solve any problems related to the bond system in their Village, can use several alternatives and step taken by Colol villagers if a problem occur, namely: 1. Done in a family way 2. Done at the village office 3. Done in court.

Abstract

Development the law of obligations and guarantees is related to local wisdom through the applications of norms related to vocal values and traditions. The development of engagement and guarantee concepts can reflect aspects of local wisdom, such as social values, culture or custom recognized in a particular community. By using normative research methods that focus on research that uses legal sources, statutory regulations and legal documents relating to wisdom in resolving land problems in the Ngadhu-Bhaga Community In Ngada Regency. Local wisdom of the Ngadhu-Bhaga Community In Ngada Regency, East Nusa Tenggara, land isssues are an important matter and are closely related to everyday life. In resolving land issues, the Ngadhu-Bhaga Community has methods in accordance with customs and cultural heritage that have been known for a long time.

Abstract

Reflecting aspects of local wisdom, such as social values, culture or customs recognized by the local Tana Toraja community. Toraja is an area that has many very unique cultural traditions. One of them is the mantunu tedong ritual, which can be said to be one of the rituals that native Toraja people are certainly proud of. By using normative research methods that focus on research that uses legal sources, statutory regulations, local regional regulations, and legal theory and legal documents relating to wisdom in completing the Matunu Tedong agreement which occurred during the Rambu Solo event in Tana Toraja, South Sulawesi regarding the agreement in the Matunu Tedong event which is one of a series of customs in the Rambu Solo event. In completing this agreement, the Tana Toraja people have methods in accordance with customs and cultural heritage that have existed for a long time.

Abstract

This paper discusses the role of local wisdom, especially the **bhedi weti** tradition, in resolving disputes in the Sa'o Nde Tribe community. Through a case study involving Yohanes Ame KAE and Dongga Village, this study explores how bhedi weti functions as an effective and peaceful conflict resolution method. Bhedi weti not only emphasizes reaching an agreement between the disputing parties, but also respects individual rights and strengthens social relationships within the community. Values ??such as justice, communication, and respect for tradition are at the heart of this process, which involves the active participation of all members of the community. The conclusion of this study shows that the application of bhedi weti can provide a sustainable solution to conflict, as well as maintain harmony and cultural identity within the community. Thus, this paper highlights the importance of maintaining and integrating local wisdom in efforts to resolve modern social problems.
